Aside from that particular case we actually do have many people who filed two petitions and got approved. You have a much better chance if you file a CR-1 and are married but it doesn't necessarily mean you won't get approved on a K1 either. Like Aztec said, you can't change the facts, you just have to roll with it.

I don't agree. I don't think the recent divorce will make much difference if it is indeed final. I also don't know who told him he had to be married for two years to get the divorce because I think that's bull. You need to check that out, as far as I know both parties do not have to be present in the DR for the divorce and there is no time limit on this. It's possible he is just telling you this for an excuse as to why they didn't get divorced right away. If that's the case you might want to rethink your petition.

Take Aztec's advice. Pictures of the two of you together and at family events are going to be the best evidence you have for the DR consulate. They put a lot of weight on photos and they will grill you about details of your relationship as Aztec stated. Take the other evidence you have but don't volunteer it unless you are asked.

Like Aztec said, AP can take months to complete. All you can do is wait at this point. You can try to contact your congressman and see if they can get a status but they may only be able to get info that it is in process. The petition will not expire as the Embassy will extend it for you until the visa is issued.

IMBRA Special TopicsMy last approved K-1 was in 2001. Why do I need an IMBRA waiver?

The filling limitation law states that:

"IMBRA imposes limitations on the number of petitions a petitioner for a K nonimmigrant visa for an alien fiancé(e) (K-1) may file or have approved without seeking a waiver of the application of those limitations. If the petitioner has filed two or more K-1 visa petitions at any time in the past, or previously had a K-1 visa petition approved within two years prior to the filing of the current petition, the petitioner must request a waiver. These limitations do not apply to petitioners for a K nonimmigrant visa for an alien spouse (K-3)."

I have filed only one K-1 in the past that was approved in 2001. Why are they requesting that I must apply for a waiver?

Can we have a link to the source for this? I need to verify that this does not apply to the K3.

OK he really didn't give you all the details.

He already applied for his spousal visa via I-130 (for the CR1), and he is wondering if he should go ahead with the K3 because on the I-129F they ask all the IMBRA questions and one of them is about the DWI convictions.

What I would like to know is if they deny the K3, can he still proceed with the I-130?

He also recently filed another petition which he withdrew because the girl was only trying to get a visa.

IMBRA Special TopicsDo I need IMBRA waiver??

Just to let you know, I just sent my Certified Docket Request today! I called the court house, they gave me my case number and told me to send a self-addressed stamped envelope with a written request for a certified docket (showing my conviction and satisfactory completion of all sentence requirements and probation), a blank check "not to exceed $25.00), and they would mail it to me immediately.

I also sent a request for an exungement form that will show my case dismissed once approved!!! That will cost me $60.00

So my question is: with a certified docket and a letter from my fiancee stating my full disclosure to her of my criminal history, do I need to get an IMBRA waiver, or should these things I m gathering be sufficient?



Waivers are NOT required for IMBRA specific criminal convictions. Waivers are required for filing of multiple K-1's/K-3's only.

Dean, can you post your source for this? I want to believe you very much but I am kinda a stickler for official sources.

I did NOT use a marriage agency to meet my fiancee. I had 2 driving while inpaired convictions in my late teens (1980`s). Since then I did recieve another DWAI in 2003. I know stupid!!

Using an IMB (International Marriage Broker or marriage agency) does NOT require a waiver as it has no apparent bearing on the application other than to indicate it as such. What requires a waiver is if you have had multiple "K" filings previously (if petitioning for a K-1) or if your record of criminal convictions meet the criteria. The crimes that require a waiver request are listed in the instructions.

Well not quite. It lists a few things you need to say yes or no to. There is no "list" of things that need a waiver in the instructions. They are ambiguous at best.

It can take over 6 months in some cases to get a waiver through. We have a case on our web site that is almost a year now. You have to have patience in these cases because you know they are making an exception. Not all waivers are approved.

I believe she has her greencard which would open the US Virgin Islands for her. I have little experience there other than a few days in St Thomas a few years ago. Sitting here in Grenada which is one of the options they would have I would be hard pressed to recommend it as a choice. I think it depends a little on what is important to them. I think if they are looking primarily for a nice beach D.R. is excellent.

Cozmel Mexico would be a good choice. Also one of the coolest places I have been, Roatan, Honduras is just wonderful.

I lived in the US Virgin Islands( St. Croix) half of my life. A great place to vacation. St. Croix is the largest, and the most laid back. St. Thomas is a tourist zoo but it is right next to the beautiful island of St. John, plus the BVI's (British Virgin Isands) are very close by. Check out Virgin Gorda. If your there for New Years go to Yost Van #######. From what my friends have told me DR is not much fun, more or less a dump and it is not wise to leave the resort properties.

He said he was looking for a place where they both could go. I am not sure, but I don't think she can enter the US Virgin islands without a US visa.


Contrary to what some people here are saying I think you will find the DR to be a nice place and VERY easy on your pocketbook. If you stop by the site, we can suggest alternatives to Punta Cana also. There are some great resorts on the North Coast. You may also want to check out Las Terrenas, which has a very large contingent of European tourists.

Very good information.

I don't agree on one point though. If you wait until the last minute to buy your plane tickets it could end up costing you thousands of dollars, certainly more than the fee to change the flight. Also, some airlines, like Continental, only charge a minimal fee of $30.

The fee for the visa application that you must pay at Banco Popular is $110 if you are doing a K1 and just $10 if you are CR1/IR1.

As I posted on one of your other threads, if you think it is taking long to get through the USCIS, you have a rude awakening coming when you get to the interview stage. The wait for an interview is about 2 years now because of the backlog.

If you stop by our forum, we now have Chief Consul William Bent from the Dominican Republic answering questions every Wednesday. I know it's hard to believe and you don't want to believe it but unfortunately it's true. I myself waited 20 months for my wife to get here.

This is simply a change in the processing of paperwork and where the appointment scheduling is handled. It is not just for DR - it has changed everywhere. Now the NVC handles the paperwork and scheduling that the consulate used to handle. The backlog and waitlists still exist.

Exactly. Kitkat, I believe there is also a backlog in Mexico also right? How long is it and how do you know where you are on the list down there? Just curious.

I lived in Peru all my life and nobody used checks, everybody uses credit cards or cash, and we too pay the rent with cash. Our landlord wants just bills, no checks. I prefer not to use my credit card always cash, why ? I don't know.

Yes but your not in Peru anymore, you are in the US where it is common to use not only a check but more likely a debit card to pay things. It is dangerous to carry loads of cash everywhere not to mention it can be lost or stolen or damaged in a fire, etc.

FTR, I NEVER said that anyone should be discriminated against for using a money order or not having a checking account. I merely stated I could not understand why you wouldn't have one if you were in the states, that's all.


And the fact we don't have checks isn't a good reason to get treated like #######.

....And no one EVER said it was.

I will like to know if you had some bad experience with discrimination in this country, I'm a latina living and working in NYC, specifically in the Upper East Side and if you are not familiar with NYC this is one of the richest areas of Manhattan.. The population is mostly white and jewish and honestly there are just a few latinos living there so if they see a latina they assume that we are cleaning people or nannies. I'm not against those jobs and the people that perform those activities is just that upsets me the fact that they get surprised when I tell them that I went to school (Peru) and had a very decent life. They think that 'cause we are latinos we are all here ilegally, NO!!!! I COULD BE LIVING IN MY COUNTRY BUT I FELT IN LOVE WITH A WONDERFUL MAN AND HE'S THE REASON WHY I'M HERE.

Not usually, we live in Florida, but I had a terrible experience with my husband (he's from Peru too) at Amscot trying to get a money order the other day. I won't get into the details it makes me so mad, but let's just say the stupid woman had the nerve to ask us WHAT IT WAS FOR. For our rent, wasn't even a lot of money. I know it's hard for you people petitioning for first world countries to believe, but indeed it is taking 20-24 months just to get your interview scheduled in Santo Domingo. I guess I should post my timeline sometime. Mine was relatively *short* at 20 months from start to finish. 13 month wait for the appointment alone. :unsure:

Dear VisaJourney members,

does anybody know whether the sponsored immigrant is also supposed to sign the Authorization for Release of Taxes form if joint taxes were filed for several years, but the immigrant's income is not used in the Affidavit? My husband believes unless I sign as well, the form would be invalid because our taxes are joint, and IRS won't release information because both need to sign.

And a probably silly question about DS-230 - should there be a picture attached to the form? There is a space there that looks exactly like a picture space, yet nowhere did we read that the picture is needed...

Yes, you should sign it. If there is any doubt why would you NOT want to?

No, there is no picture required on the DS-230. Don't read things into the directions that aren't there. Just follow the instructions to the letter and you will be fine.

Please take a few minutes to read the form instructions. Everything you want to know is actually in there! I took the paragraph below directly from the form's instructions. The bold part answer's your question about the joint return.

A copy of your complete Federal income tax return, as
filed with the Internal Revenue Service, for each of the
most recent 3 tax years. If you were not required to file a
tax return in any of the most recent 3 tax years, you must
provide an explanation. If you filed a joint income tax
return and are using only your own income to qualify,
you must also submit copies of your W-2s for each of
the most recent 3 tax years, and if necessary to meet the
income requirement, evidence of other income reported
on your tax returns, such as Forms 1099.


Your child support income will go where all the other income goes, they don't ask for you to list it separately.

That is the fee at the NVC. You will get an official "fee bill" for the form and then you have to wait until they receive the money to send the form.
