Do you know your receipt number? That is one important piece of information on the I-797C Receipt of Petition (NOA1). You may need to use that number to get information from USCIS, until your approved petition is forwarded to the NVC.

It is advisable to take better care of your I-797 Petition Acceptance Notice (NOA2). A copy of the NOA2 is necessary later on in the immigration process. Some folks have been able to do a work-around. However, USCIS can charge you around $400 to get a duplicate I-797 NOA2.

What to send to your fiance(e) once the I-129F is approved (Receive NOA2):
1. A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one). 2. Send all originals of the documentary proof that you submitted for the I-129F to your fiance(e) for their interview at the embassy. 3. Send an original letter affirming your desire to marry your fiance(e) and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F). 4. I-134 Affidavit of Support form. Ensure it is signed, with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all. 5. You will likely need at a minimum (for the above form) two to three of your most recent pay stubs and a signed letter from your employer listing you job title, start date, your salary, and the status (full-time) of your position. Begin collecting these ASAP after your NOA2 arrives. You will also probably want to include other evidence such as your banking information and other assets as required by the I-134. Specifically you will need at least 2 of the 4 options mentioned in Section II-Supporting Evidence of the I-134. See this FAQ for more tips and ueful information on the Affidavit of Support Form. 6. A copy of the NOA2 that you received in the mail. 7. Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, etc from between the time you filed and present (NOA1 date-now).

Examples: Copies of land line and cell phone bills, appropriate emails and letters you have sent including the stamps on envelopes (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)
You can enter any time after your visa is approved.

Ron. The consulate is not obliugated to give Senators any precise or even correct information. They give a vague answer which means nothing. NO I have never heard of that problem BUT if it were the case then NO ONE would be getting a visa, are you kidding me?

They blew smoke up your Senators tailpipe. He is not going to get a more precise answer because they di not have to give one.

Your case is in AP. The visa will be printed when the AP is finished satisfactorily and Sveta will be notified.

You answered your own question. The paperwork is filed with the understanding you are "free to marry" at the time of filing. If you aren't free to marry at the time of filing the petition (which you state above) then you can't file.

So you need to wait until Feb 6th, 2013. Take this time to get your evidence together. Have your fiancee send you the documents she needs, download the forms and fill them in (but don't date them) and have the packet ready to go. Once it hits Feb 6, 2013, date the forms and send the packet.

**note - make sure before you mail it off to check the dates of the forms :)

Yes, they will want to see employment letters. It may be advisable to write a letter, as you describe, explaining your employment situation. USCIS/DoS have seen all manner of employment situations. The financial information is somewhat time sensitive. You will want to give them as up-to-date information as possible. Submission of "stale" documents may result in an RFE or denial, that would delay your plans.

Not long ago this sort of request was unheard of at the petition stage. USCIS left it up to the consulates to determine the bona fides of the relationship. This seems to be yet another new tactic from USCIS.

Well, obviously, give them what they're asking for. Since it's a reasonable assumption that the adjudicator won't understand the conversations if they're not in English then you should probably translate them. I don't know if a translator's certification would be required since you're not translating official documents. If you can translate them yourself then it wouldn't hurt to add a certification statement. One certification statement should suffice for all of the conversations.

If I were personally responding to this RFE, I'd provide as many copies of correspondence as I could, but I'd only translate a handful of them. I'd also include an explanation that there wasn't time to translate everything and still respond within the window of time they provide. Don't knock yourself out trying to translate a big stack of conversations and then miss the response window. If you don't respond by the date on the RFE then they'll deny the petition.

I'm not sure what USCIS is up to with these new tactics. Perhaps they're trying to screen petitions in advance for factors that the consulate might use to deny the visa, and hopefully stop some petitions from being returned by the consulate. I can't think of any other reason they'd be doing this.

This is simple.

In order to get an I-129f petition approved you must BOTH be eligible to marry. You are not, you are married already to each other! The I-129f is dead, you killed it the moment you got married. You do not have to like it, want it, or agree with it. It just is. Nothing bad, nothing new and you are not the first or the last to change their mind (you think I am guessing about this, right? :lol:)

You now have an I-130 in there also. The I-130 REQUIRES that you be married to the person you are petitioning. When they see you also have an I-129f for the same person,(they WILL see that) they are not going to approve the I-130 because you have another document on file which says you are NOT married to this woman.

You have one official document saying you are NOT married to Jane Doe, and another official document saying you ARE married to Jane Doe. You cannot be both single AND married to Jane Doe at the same time. USCIS is not going to try to decide which is correct. Why would they waste their time and make someone else wait while they sort out the nonsense? They just deny both and let you re-apply. "Kill them all and let you sort them out"

Withdraw the I-129f with a registered letter to the Service Center referencing the case number on the NOA1, explain what has happened and also reference the NOA1 case number of the I-130. There is nothing bad here, nothing wrong. You changed your mind, just tell them and get on with it. You are out the cost of the I-129f petition and the brief headstart. So what? It is nothing in the scheme of things overall.

OR...don't. My wife is already a citizen, makes no difference to me.

Hi all!

Our petition was received on the 25th of July 2012 and has been stuck on initial review ever since... We have a lawyer representing us and she has only just noticed this... I have been keeping an eye on the USCIS website and have noticed that it has always been on initial review. But due to the fact I'm not a lawyer and am not completely understanding of the whole process I just assumed the initial review was considered to be part of the NVC stage as well. This is why I hired a lawyer because I do not know everything. So I guess I'm just wondering has anyone had any experience with excessive wait times whilst waiting for NOA1 or has any idea why this could be taking so long? Is it lost, did we get an RFE?! No one (us or our lawyer) has heard anything back from them. So confused and frustrated at this point, I really do not understand.

If anyone has any ideas I'd love to hear them.

What did you apply for? Welcome to VJ. As most of us found out most attorneys are not on top of stuff and we did all the work. If you applied for K1 you should get a notice soon. It usually is about 7 months for a K1, see similar time lines to give you an idea.

What do I have to do to make sure that everything is up to par and there are no problems.

Obviously her address will be changing. Does she just have to take that information with her to the USEM or do I have to send something in changing it here?

The rest of your photos put 4 on a printed page list the people present and date, also the occasion, don't send loose photos, other than the passport photos.

I apologize if the questions are similar, but no one answered the specific question about paperwork and when I asked my previous question she did not have an interview date yet. Unforunately there are no addendum instructions on the GNI-2 form. I hoped someone had some specific experience similar to my case.

As of now I am going with addendums to the GNI-2 form and the DS-230 part II form, which are the two forms asking specifically about the two year restrictions. Hope it works out for us! Just want to make sure everything is right, on our end!

A word of caution on the wedding/reception thing/married not married issue. There have been tons of threads on this. USCIS can refuse a K1 for acting and looking married, what ever that is, then you have to repay and refile. How about an engagement party period, keep it clean and get married after the arrival in the USA. Other option is get married, come home wait till its approved and arrive in US. I have heard both sides on the K-1 visitor visa issue, yes and no. I would not do it personally. Good Luck what ever you choose.

No one who enters on a K-1 get a work card. That is obtained when you file for AOS and your EAD. You can get a social security card about two weeks after entering on the K-1, which is stamped no employment without DHS approval.
