Thought I would put it all together.  TBone and others have each laid the process out:

Start making plans for your marriage now, you can shop for ideas, places, just don't make a  hard and fast money down option you cannot change if their is a delay in the arrival date.

Two weeks after you arrive go and apply for your social security card, why wait two weeks, their will be no information in their system for them to reference.  You can get the form on line and pre fill it in.

Once the social is in hand, get your drivers license or state id,  depending on your state regulations and square away the banking and financial stuff.

Their are lots of nice simple quick options to make sure you are inside the 90 day window; Las Vegas everyone likes to go there, the local court house, or your local and or frequented church.

For example we invited or people showed up in Las Vegas about 20+, had a beautiful ceremony at Las Vegas Weddings in their chapel (holds about 150), spent a few days and had some fun.

Got her on my medical plan at work when we returned, completed her medical for AOS at a Civil Surgeon..

Filed for the AOS in the 90 day window, and had a very nice reception at our ranch about a month after we got married i.e., wedding cake, BBQ everyone attended even the guests who went to the wedding. 

Just because the government has a time line does not mean you can adapt and overcome.  Take lots of photos, save everything for your AOS filing and interview.

Order your wedding certificate(s)  etc. on a rush and get an Apostille if needed from the secretary of state.  Oh yea have fun and congratulations.

Since you are a USC, you can go and visit your fince at UK, however; your fiance needs to get a visitor visa in order to come to US.


This isn't correct - UK citizens can use the visa waiver program (VWP) to visit the US for up to 90 days, so long as they are eligible to use the VWP (majority of people are, but people with certain criminal records/visa denials can have problems using it)

I want to run this by everyone whos ran into customs ALOT

I am currently going to Canada in 2 days to see my fiance. We haven't submitted our I-129F packet yet due to a real bad mix-up with the USPS. When I went through last time, All they asked me was how long I was staying, who I was seeing, and purpose of the visit. This time around, I have quit my job cause I am in the middle of a move back to Arizona. How difficult is it going to be when I hit Canadian Customs?

Heres what I have to show proof of ties back to the US:

- If needed, Copy of the entire I-129F packet, minus my fiancé's G-325A and Letter of Intent
- Proof of loans that I'm paying on ( car loan, personal loan, and school loans )
- Copy of my cars registration showing that I own it
- Proof of my address change for everything in my name ( Credit cards, cell phone )
- Roundtrip ticket/itinerary ( probably the best proof I got since it shows I am coming back )
- Copy of the U-Haul reservation that I have for when I get back to Utah to move the next day to Arizona

( For anyone asking why didnt I fly out to Canada once I was in Arizona, tickets are ALOT more expensive compared to flying from Salt Lake City )

I also have my aunt/uncle's phone numbers on hand as well to confirm my move down there. I'll have my fiance's numbers as well to confirm anything too.

If anyone has anything that may help or confirm anything here, please let me know.

Alright, I know what to do.

 

Look I'm in the same situation as you were, my income fluctuates (restaurant) and on my taxes it didn't nearly show enough (that's my fault I should've claimed more).  I can't fix my taxes as I tried to look into it and they said not possible so here is what I did because literally we have the same issue.

 

1.  On the employment letter I had my boss state why my last years income was the amount (because I took 3 months off to visit my husband) had I worked I would've met the income.  I also had him fill out my projected income.

2.  I write my own letter explaining why my income looks much less than it should (having time off for my husband)

3.  On the form I claimed every dollar to my name including what's in my bank account.

4.  I attached past years taxes.

 

This got me through NVC.  I was ecstatic because I had no chance of a co-sponsor.

 

Then my husband had the interview.  One consulate officer said it was fine, the other said no.  The one who said no has my authority.  Everything in our interview was approved except they want a cosponsor (sigh).  So now we are sitting here scrambling to find a co-sponsor weeks after the interview.  Don't do our mistake.

 

Here's what I recommend.

 

Get all the evidence you can to support your income, send it through to NVC.  NVC will most likely approve it, find a co-sponsor.  You can always submit that document later before the interview to the embassy or NVC.  Then you are clear, golden and everything is fine.  Don't take the risk that they will reject you when it's at interview stage, now we are in AP because of it and we don't know how long we will be in AP now.  You don't have to wait on your co-sponsor to submit documents, since things are so darn slow now I really wouldn't waste time waiting for them to finish the paperwork.  The embassies can make their own rules (I have the worst one at casablanca) and if they decide they just don't like your income they can issue you a co-sponsor.

I don't have the answer for you, but I suggest you prepare 2 I-134 sets - one just on you, then another set with you and her stuff.

If any possibility of you getting a co-sponser - a USCitizen or a permanent resident, I suggest making a 3rd set.

Then, on interview day, spread out all 3 sets with the Interviewing Officer, ask him to choose.


Maybe a new USCIS card game in the making? :thumbs:

Notice Of Intent To Deny, or NOID. It's bad news.

The consulate officer didn't believe your relationship was real. They believed it was an attempt to circumvent immigration law. The consular officer sent the petition back to the USCIS with the recommendation that the approval of the petition be revoked. In the consular officer's mind, it should never have been approved.

The reason this letter is bad news is because USCIS apparently agrees with the consular officer, and now they're intending to revoke the approval of your petition. What's worse is that it was the California Service Center. They usually don't readjudicate returned petitions. They just let them expire and let the petitioner file another one. The fact that they're sending a NOID without you having first tried to submit another petition means the consular officer's evidence must have been very convincing.

Here's the rough part...

By returning the petition, the consular officer has made an accusation against your fiancee. The accusation is that she made a material misrepresentation by applying for a visa based on an invalid relationship. That resulted in your petition being flagged. Marc Ellis, an attorney who sometimes posts on this board, calls this a "P6C marker", where "P6C" refers to section 212(a), paragraph 6C, of the Immigration and Nationality Act. That particular paragraph deals with immigration fraud.

In a nutshell, the consular officer has accused your fiancee of fraud. If USCIS concurs by revoking the approval of the petition then that accusation becomes a finding of fact. In the eyes of the US government your fiancee will be guilty of immigration fraud. No future visa application will ever be approved for her unless she can get an I-601 waiver for the fraud charge. Those waivers are difficult to get, and usually require an experienced (and expensive) attorney.

What I suggest you do is contact a good immigration attorney now. When you get the NOID letter you will have a limited amount of time to respond to it, usually about 30 days. If you don't respond forcefully and with tons of evidence then they'll revoke the approval of the petition, your fiancee will be guilty of fraud, and it will be much more difficult to get a visa in the future. Your main objective now is to stop USCIS from revoking the approval of that petition.

Hi,

I met my GF Nov 2011 during my vacation in the Philippines. We never went out just exchanged contact info. Could never connect during that trip. We just remained friends and chatted on rare occasions. As I got closer to my annual dive trip this Nov, communication increased dramatically. She met me on my arrival day and ended up asking for a leave from work so she could stay with me for my entire 18 day trip. Now I want to marry her and apply for a K1 visa. Other than my decision being too soon, is it too soon to apply for a K1 visa? How long do they like to see the relationship evolve before applying for a K1 visa. How many visits is appropriate. I only have so much vacation time.

The only obligation on K-1 for visitation is for an in-person visit in a 2 year period and you met that, the rest is up to you. Take some time and chat, make some plans and get to know each other like you would normally, then make a final decision to apply. It's not my decision although I would check out the Philippine forum for the issues with K-1 from their embassy. Congratulations on meeting a nice gal.

Then, should not present a problem as long as you are able to present copies of ALL your divorce dissolution certificate(s) obtained from the respective state(s)/county(s) department of health/vital statistics/records/clerk (and are able to provide, for inspection, the original(s) upon request of an Immigration Official). Be sure to fill out the requisite information about ALL of the divorces on the forms as completely as possible. Consider composing a short narrative for you and your fiancé(e) disclosing the details of your previous marriages, discuss fully with your fiancé(e) as that they may be asked about it at an immigration interview.

Do you know your receipt number? That is one important piece of information on the I-797C Receipt of Petition (NOA1). You may need to use that number to get information from USCIS, until your approved petition is forwarded to the NVC.

It is advisable to take better care of your I-797 Petition Acceptance Notice (NOA2). A copy of the NOA2 is necessary later on in the immigration process. Some folks have been able to do a work-around. However, USCIS can charge you around $400 to get a duplicate I-797 NOA2.
