Hi! My name is Christina, I'm German and I'm engaged to Jeremy who is a US citizen and stationed in Baumholder, Germany. Jeremy is working for the US Army and has orders for a permanent change of station to Kansas. We found out in mid-january and his departure date is April 2.

We already know about all different types of visa but were having problems with figuring out if there is a possibility for me to leave Germany with Jeremy and get the visa started there. In order to find out we called the USCIS office (in Texas, since this is where he is from) and they told us to proceed like the following:

1. Fianceé should come to the U.S. as a visitor
2. She will need to have a return flight
3. Couple may get married in the States
4. Fianceé may then file an I-485 (AOS) and receive a visa which needs to be adjusted after two years

My future mother-in-law talked to an immigration attorney who approved this plan as totally okay.

For me, so far, this way has always been known as illegal.

I'd appreciate any kind of comment on this and if there is any chance that I might be leaving Germany with Jeremy in April and be able to stay in the States. Also on advantages and disadvantages of getting married in Germany or the States regarding the visa process.

Something sounds funny to me in that scenerio. I was always under the impression that if you 2 know each other you can get married in the U.S. but you would have to return and wait for the K-1 to get approved. However if you met him by pure coincidence in the U.S. and got married then you could file for AOS, and stay here.

But get more opinions cause maybe I am wrong ;-)


Oops sorry I mean I think he would have to file for K-3 in that case.

the last touch we got was 22 july,the told my fiance we are in the special invastigations!we contacted the senator and the congressman already.
I want to know how long talk the special invastigations?and any advice,suggestion,help to tel me,thank you.


Thats terrible!!! Do you know what the RFE was about, that started this special investigation? If these are FBI Name Checks, I read somewhere that the only ones that the FBI will resond to is the organization that requested the FBI checks. So if USCIS began the checks, you will need to ask USCIS about status, or maybe specifically ask your Senator to query USCIS for the status of this investigation. Your Fiance would also have to give your Senator Authorization to get the informatioon on your behalf. The only guess I have is that one of you names was a hit in the database, which will trigger even deeper name checks. If this is the case they would probably respond to you once they are satisfied with the results. But don't quote me on that I am just taking a guess.

I met my fiancee twice.

1st time - I went to Russia to her place and lived in a hotel and so all hotel receipts only have my name. We together went to a small resort - but since I has reserved that resort, the reservation ticket has my name on it however she had signed for it (so her signature are on that reservation ticket).

2nd time - I was on business travel and we lived in hotel for a day which was reserved only in my name. Then we went to live with my family.

So basically her name does not quite appear in any of the hotel receipts (except for her signature on one of the receipts). Is this a problem?

We have photos together everywhere.


It doesn't really matter, its a plus but I think they take all the evidence together.

K-1 Fiance(e) Visa Process & ProceduresLost Application?

Hi all!
I first sent the I-129F to the NE on May, then received the I-797C, shows the received date was May15, 2006. On June 8th, 2006, I received a notice of transfer, that my application was forward to the CA office. I have not heard anything after that from USCIS. Wondering what is going on with this, I think they lost my application because after I request for a "service request", got a reply from CA, saying that NE is still have my application, but NE is saying CA has it. Any one been through this type of situation before? Any help is greatly appricated.


I hate these nightmare situations! :wacko: I think the best thing for you to do now is find out the website for the Congressman in the district you live in or one of your Senators. Their websites will tell you what they need from you to investigate your situatiion. Generally speaking they will need your authorization to allow them to investigate on your behalf. Make sure you send them a copy of your NOA1 ( I-797C) and letter describing your situation. The problem is they can take 30 - 60 days to find out anything for you. Hopefully you have a copy of everything that you sent in the petition. I suppose in the worst case they will tell you, you have to file again, but since you have the NOA1 you probably can get the fee waived if this worst case turned out.

IMBRA filing limitations also say that if you have previously filed 2 or more approved petitions you would also need to put in a waiver request. There is an IMBRA special topics forum here that you can check out.

I don't know much about when your case would close, but I suppose you could also request that they close the case.

How the USCIS is interpreting IMBRA may in fact be exactly what LookyWhatIFound said, but it is not what the law says.

The law says that if you have filed two or more petitions at any time (in you life) regardless of when (ie.. your third petition), you will need to request a waiver, However if you have filed a petition within the last two years and it was APPROVED, then you must also request a waiver.

None of these situations need result in a VISA approval or issuance but only requires either a filed petition or the approval of a petition (ie...I-129F)

The only thing we said different was within the two year rule it is suppose to have resulted in an approved petition not simply a filed petition. Anecdotal evidence would indicate that the USCIS is adjudicating based on filed within two years regardless of approved status.

I , the us citizen, sponcered my fiance for a k-1 visa and it was revoked in october. Nothing has worked out for us and have decided maybe it just wasn't meant to be. Anyway my question is if i ever decide to do this again for another how long do i have to wait before i can send in another petition for somebody else? Dont have anybody in mind just curious. Our case is not close yet it just made it back to california service center. When would the date begin? When i sent out the petition in January of 2006? Or when the case gets close? Thanks

Just in general, I would sugggest, if you haven't already, you should call him up and see if he can handle the complications in your case. Depending on how complicated some problems are he may end up twiddling his thumbs waiting for the Government also.

well just like i mentioned in the tittle above my case is the strangest ,,,it s one of a kind .anyway,i am a moroccan young man and i went to the united states ,MI on a K1 fiance visa to marry the love of my life .however,things didn t work out the way we planned due to alot of misunderstandings that happened between us . thus we didn t get married and i decided to come to my country for i had to reason to stay in the USA.
when i came back to morocco we kept in touch and we realize that we blong together and that being apart for awhile is what we needed to work things out.

My fiancee's manila interview was Feb. 13th, and today, (Monday, Feb., 19th), I was here at here house in Tanza and signed for her visa and brown envelope. Time for her to resign from her job and go to CFO and then it is onward to the US on April 22nd. I hope everyone who is still waiting for their visa can just be patient and everything will work out. Thank you visajourney and all of the members for your help through all of this. I was just lucky enough to be here in the Phils since November, 2006, to help her through her part of the process.

I can't help you much on any ideas about re-newing your visa. I have never heard of anything but starting over. I can give you one bit of news which is good. You definately will not need an IMBRA waver. If you read the law closely you will see that it is needed only if it is a different fiancee. That is assuming you have not had one before that you have not talked about. Good Luck


But UCSIS enforces the law the way it feel likes, I applied for the same fiancee and they count it, they will then note on your NOA2 "It has been noted that this is your 2nd approved I-129F petition."

My fiance returned home 2 weeks after arriving in the States because she was told that her mother was ill. She arrived to find out that it was a ploy from her (very controlling) family to get her to come back.

Reasons aside . . . We never had a chance to get married, but still want to. I read somewhere that the consulate could still revalidate her visa, allowing her to reenter the States, but the validity would still be 90 days from when she first entered the US. I am doubtful on this, but contacted the embassy to request that information and am still waiting on word.

I guess I am hoping that someone here might be able to tell me about the process for applying for a K1 for the same person within 1-2 months of her having already recieved a visa? Is it the same process? Would we have to wait for her original visa to expire? Could it be expidited.

This whole situation really sucks, because we were victims of the whole IMBRA debacle and waited almost one year to see each other again. Her family is the pits, and she is the first one to say that, but . . . they are family.

Any help would be much appreciated.


The little I can tell you is that if you went through the K-1 process again within the time period specified in IMBRA, I forgot what it was, you will have to request an IMBRA Waiver with your petition. Ideally you shouldn't have to but I don't think USCIS cares whether you're applying for the same person or a different person.

I know nothing about Visa expirations or whether you can get reentry. You might possibly get more response in the IMBRA Special Topics discussion.

Hi, folks! I'm so glad that I came across this message board. With some helpful advice, I applied it to our situation. If you have the patience and knowledge, I would appreciate your input. Here is our story (Note: I'm not married as the title suggests - We are engaged):

1. My fiance, a Swedish citizen, and I, US citizen, are planning to get married next January. We been dating for more than a year. I met her while I was an exchange student in Sweden. We moved in together for two months before I had to go back to the States to finish up school. Since then, she has visited me here in LA and lived with me for a month before going back to Sweden for school.

2. Like most EU citizens, Swedish citizens do not need to obtain a visa to visit the US, but cannot overstay their visits (no more than 90 days at a time I think).

3. We do not want to break any immigration laws, so we will pursue a K1 fiance visa

4. In January 2008, we are planning to have a big wedding in Los Angeles with her friends and family (all 50+ of them) flying here, and of course my big family will be there.

Here is where the facts get complicated:

5. Two months after the wedding, my fiance needs to go back to Sweden to finish up and defend her master's thesis. She'll be done by May 2008, at which time she'll come back to live with me in the States for good.

The main issue is how to time K1 process, her going back, and filing for an Adjustment of Status (AOS) with the INS.

Here is our plan:

1. July 2007 - Apply for a K1 fiance visa. From what I could gather, it takes about nine months the whole process (me turning in forms, the US embassy in Sweden getting her forms, her conducting an interview, etc.)

1. January 2008 - Have a family wedding in January 2008 in Los Angeles without signing a marriage license. It'll be just like a normal wedding, but without the minister signing anything. We won't even apply for a marriage license. From what we could gather, one needs to apply for a marriage license and marry within 30 days for the license to be valid. If there is no marriage license, then there is no legal marriage. We think that this is a good compromise between having a grand wedding for the families and friends and not jeopardizing her going back and reentering.

2. Late February 2008 - She goes back to finish school.

3. She waits in Sweden to get her interview within the US embassy in Stockholm, Sweden. After the K1 issues, she comes here hopefully within a month after the interview.

5. When she comes here on a K1 visa, we get married officially in Minnesota at a court house. I plan to go back to Minnesota anyways for job reasons, and from what I've heard MN is immigration-friendly. For example, she wouldn't need a special visa or a green card to get a driver's license in MN. All she needs is her passport and her foreign-born birth certificate. In contrast, CA requires a special visa (e.g., H1 visa) or a green card to get a driver's license! That's crazy, because presumably someone could be without a driver's license for more than a year in Los Angeles! You can't get anywhere in and around LA without driving. It would be unfair to her for having to depend on me to drive her to places all the time. If I put myself in her shoes, I would go insane!

6. With the marriage certificate in hand, she files for an AOS in hopes that she'll be granted a status of permanent resident within a year. This is important to us, because we intend to live in the US nine months out of the year and the rest in Sweden.

Any advice or suggestions on our plan on the timing issue? What is the likely wait between filing an AOS and getting a permanent residency for MN residents? Thank you for your help.


I agree with the previous poster. One thing you have to remember USCIS is no help in letting you accomplish your goals. :whistle: I am not knowledgeable on how long it would take to get AOS. She may either have to wait till the following semester to finish school, or your wedding date may need to be moved, and/or think about a way that K-3 might work in your situation? You get married in 1/08 in the U.S., she goes back to finish schoo and meanwhile you file for a K-3? Just some thoughts...good luck with it!

We are working on the I-134 form right now, just wondering if Sam needs to go to the USCIS or embessy in the states to swear in front of a officer for sumitting the form? Please help!

Is it necessary to do that as long as he needs to fill in the form? What if his daddy is our main spousor, does Sam still need to be sworn before an officer to make it work?

No he just has to go to any Notary, his Bank may even have a Notary and they can probably notarize it for free. I even got them to notarize my tax form, but don't think thats necessary.

We mailed our I-129F to Nebraska on Feb. 1, and according to the post office, it was delivered on Feb. 6. But we haven't received an NOA1, and the cheque hasn't been cashed either. Other people who filed on the same day or after us received their NOA1 well before now.

How long do we wait before trying to find out what happened? And how do we look into this? Without the NOA1, we don't have a file number to ask about. Also, the contact information at the USCIS site says that they can't provide information about the status of cases.

In my opinion its way too soon to worry. If the Post office says it was delivered on the 6th, it has only been 2 weeks now. USCIS does not work that quickly. You may see the lucky ones on VJ post that they go it so soon but the rest of us have to wait.

I almost forgot there is one viscious rumor that USCIS spreads with occasional Misleading information on its NOA2s, and I want to put a final nail in that rumors coffin! If they ever tell you on your NOA2 that your approved petition was 'forward to the listed consulate' add this to that line, 'through the NVC'

I don't know if USCIS is truly misinformed or that they have gotten such a big head that they don't want to acknowledge NVC. But those words cause people a lot of headache cause you end up getting a massive runaround with USCIS and NVC and the Embassy.

Then add the confusion to the fact that they don't list a consulate on NOA2s anymore. But on the forms they say they do not guarantee your choice of Embassy.

Actually hope you both breeze through Chennai, I'm actually Indian myself but my woman is living in Cyprus. For me the delay didn't take anything out of our plans cause she is jumping horses over there and won Bronze in a jumping contest. Then she will be in a TV commercial there in the end of March, on horseback. She likes warm weather so that'll be the perfect time to start our lives here! :dance: :dance:

Fifty-seven days after the petition was approved by the California Service Center, I just got a message from my congressman's office with some outstanding news:

"[Your petition] just arrived at the National Visa Center and my contact said it will be entered into the system for the processing there by the end of the day. That should take 3-4 weeks. Fortunately, the embassy in Kenya is one of the smaller, more efficient agencies and so once the documents are sent there and there are no questions about eligibility, an interview should be forthcoming fairly soon. All in all, you are still looking at 2-3 months before any real action will be taken. When you have an overseas case number let me know and I can continue to monitor it."

I had been getting the run-around by CIS before finally asking them to run a trace on my petition. At the same time, I got my congressmen involved. Persistence pays off! Now at least I can say I'm back on track. Keeping my fingers crossed for no further delays!

Then to my surprise my Congressman called me up 2 hours later and gave me my NVC case number! :yes: A while ago I had contacted a Congressman in the wrong district, before I found out about the 'offsite storage facility' mess, but they forwarded it to my Congressman, but I didn't follow up with him.

On that form, which diseases are considered communicable disease of public health significance? I know AIDS and TB are, any others or do you know where I can find this? Are they just ones reportable to CDC? Thanks!


I don't really know, but it sounds like it isn't a box anybody should be checking if they want to get past the interview. :blink: They're asking the applicant if they think they would be of public health concern. :help:
Guess if someone is quarantined they needn't apply until they are well enough to get out of quarantine.

Thank you! Though, on question 21 of that form it asks for a current occupation. While my fiancee HAS been looking for a job since she graduated last spring, she hasn't been successful in finding a job. Should she put 'none'? Will being unemployed be a problem when they look over her information?

Hi, I had to have an enhanced criminal check for my current job and it took 10 weeks. It came through in September 2006. Will I be able to use this for my fiance visa or will I need to apply for another one?


I'm assuming you are the foreign beneficiary of the K-1 and you want to use your criminal check from your job for the interview? In that case you would probably want to check with the Embassy if thats acceptable.

Was this security check done by the police? Normally they want a report from the police.

My current residence is Zürich, Switzerland but I spend most weekends in Munich, Germany with my fiance. However, I'm currently looking for work in the United States and it's likely that I'll have a new address within the next few months. I was planning to use my parents' address in Pennsylvania so they could then forward anything they receive to my new address, where ever that might be, but I realize this might not be the best option.

Has anyone been in this situation before? What address should I use as my current address?



I have a similar question. Our petition is on it's way from the NVC to the consulate where they supposedly mail out the packet. My fiance' just moved and has a new address.
What do I need to do to inform the embassy of his new address?


The Embassy has a web site, so find an email or phone number. You need to contact the Embassy and inform them of the new address. I believe they can also resend to another address if your fiancee didn't get the package. Does filing the new address change with the Post Office there in Nigeria not work?

Using your parents address is fine. I think you can always change the address later.

Your fiance in the US needs to call the NVC. There are rumorrs that NVC sends a letter but thats just a rumor and don't count on it. Its hard to get hold of a live person but keep trying cause even the automated system is not as up to date as it should be.
