hello VJs:

I just got my noa2 in the mail box. the weird think is that, unlike most of you guys' noa2, it says my petition has been forwarded to the listed consulate(Montreal). why they didn't send it to NVC first? i am so confused. they don't want to do my background/name check or they will do it later which is what i am worrying about? does anybody here experience this kind of noa2? any help or suggestion will be greatly appreciated! thank you. one more thing, Can I change my consulate to Vancouver?

I still don't know where mines is, consulate doesn't have it, NVC doesn't have it, USCIS is not helpful. NVC says they will search for it if it hasn't got there in 90 days, but don't know if they will search for it if the NOA2 didn't say it was sent to the NVC. I'm going to give it another month and then contact a Senator.

Most of those in this situation, "listed consulate", have actually seen it go to the NVC first.

That's too bad, hope it will go well soon. is it really no way to track the case? I am worrying about mine too. It didn't list a consulate in my noa2 either, just I thought the consulate is in Montreal because I live in Toronto. I think what you got is exactly the same as mine(except for the personal info). please let me know if you get any update and good luck with the rest of your journey.


Hey thanks, it'll work out one way or another, they're probably doing some sort of security checks on mine that is holding things up. Don't worry about yours yet, there was a member, Stinger, who had the same thing a month ago and he is already at embassy interview stage now. The NOA2s from VSC don't seem to list consuates on them so don't read anything into it, they send it closest to where the beneficiary lives. Any which way I am going over there by May, whether its to be with her for the interview, or to marry her and do a DCF, we will see. Its been 4.5 years since I first met her so its about time I get together with her whether Government will make it easy for me or not.

I thought that they have to go through NVC. Ours was only 2 days there so maybe it was quick??


I think they do go through the NVC now, but maybe pre USCIS, back when it was the Immigration and Naturalization Service they went straight to the consulate. I had a 129F approved in 2001 and don't remember NVC in the picture.

Yes thats the NOA2 most of the sentences are exactly the same as on mine, almost like they are cut and pastes. :o
Except for the Consulate box I don't have one of those on mine and the I-797C Rev is 01/31/05.

Yes thats what I think and thats what I'm hoping so that NVC can search my case if they haven't received it in 6 more weeks. Good thing is she's busy riding horses and won a bronze in horse jumping so the delay is not killing her.

Email Gary directly - maybe he put that in his timeline but I remember when there were many, many posts about this. Or maybe search the old posts. There were several people who skipped the NVC entirely and there was all kinds of confusion . . .


KitKat1 I have read all this stuff and spent enough time researching it, see my links to all the topics you are talking about below. Thats why I'm saying that I know of nobodys K-1 petition that went directly to the Consulate. Its also better that way cause NVC can track it with USCIS you are in limbo.

Here's a VJ Discussion that shows one person got the "forwarded to listed consulate" wording but it still went through NVC. Maybe petitions do go through NVC, but not all of USCIS knows it? :huh:

If I remember correctly, their files bypassed the NVC completely and went straight to the consulate. I know it happened to Gary of Luz and Gary. Maybe you could search some of the older posts to find out how they got more information. Unfortunately, I doubt you will get any response from your email.

This happened to several filers in September/October. Wouldn't hurt to contact the consulate directly, but I wouldn't waste your time until 6 weeks have passed since NOA2.

shosurplussales, not nearly enough time has passed yet for you to be at all concerned or to suspect your file has bypassed the NVC. It takes time.

Whats even stranger is that VSC did not list a consulate on the approval notice. Its been 6 weeks now and I just emailed the assistant again at the consulate last week, and she has seen no record on my fiancee.

I sent a complaint to USCIS-COMPLAINT@DHS.GOV telling them that USCIS needs to give us the correct information on the approval notices and should not make us jump through hoops to get information and/or get them to do what their responsibility is in the first place.

So far I have sent a letter and fax to the Vermont Service Center but no response as of yet.

So far I know of nobody's K-1 petition that has not gone through the NVC, they used to once upon a time. I think USCIS still hasn't changed much since old times. Somehow I don't think the new case number is all that important, I had a little chat with a lawyers assistant and asked him about the case number and he was saying I already have the USCIS case number which the consulate can use. The embassy I am going for is so small that they can probably handle it with just a USCIS case number. The good thing for me is that I could just as well go over there and marry her and probably do a dirct consular filing.

my situation is this, i recieved my NOA2 on dec. 21st 2006. i have been calling the NVC all week and they tell me they have not recieved my petition yet. Today i called the USCIS california service center and the late (rude) told me that it is still in there building and i should allow them about 3-5 more weeks before they send it out to the NVC. Its due to the holidays. Is anybody else experienceing this same situation because they recieved a NOA2 right before the holidays.

NVC hasn't received my petition yet either and I was approved 11/29. NVC keeps telling me it has a max 90 days to get there. I asked today what would happen if 90 days passed and the lady said, after that you can send them a copy of your approval notice and they will search for your petition.

USCIS is so frustrating, my approval notice said it was sent to the "listed consulate" and that has got everybody confused. Some people say check with the consulate and others say it goes to the NVC. I've checked with the consulate and they don't have it. I finally got somebody from the customer service center to give me a fax number for the Vermont Service center so I sent them a fax yesterday. Oops I'm ranting a bit aren't I. :blink:

:help: I't like an addiction... I honestly check both VJ and my email atleast every half hour. The worst part is that I have just began my journey. I hope this is just the initial excitement that goes with filing a petition. I do hope that some of my eagerness, frantic-ness subsides a little. I can't imagine being held prisoner by a computer and two websites.

If NVC hasn't received it after 6 weeks or so, for the K-1, you can send them a copy of your NOA2 and they will search for your petition. After I called NVC Thursday night thats what the lady told me to do, and my approval notice didn't even say it was sent to the NVC.

I have more faith in the NVC as they are a private company contracted by the DOS.

Well i was browsing through the topics and i saw one of these questions in one of the forms

Have you ever been arrested or convicted for any offense or crime, even though subject of a pardon, amnesty or other similar legal action?

So can an offense be a non-criminal activity such as traffic offenses or tresspassing offenses because in Ontario their considered non criminal but it's still an offense, Do people with speeding tickets answer yes to this question?


I think the key words are, 'arrested or convicted' for an offense. Since you weren't arrested or convicted you are ok. I think USCIS is worried about letting a real criminal into the country. Besides, since its not on your police report how would they even know about it?

back in my university days, i got a d.u.i. in 1991, another one and a resisting arrest (simulataneously)in 1993...last day of finals...DO I NEED TO PROVIDE THIS INFORMATION WITH MY I-129F PETITION??????

Well I would say put it down and attach a sheet and provide the dates and explanation, like it says on the question. The background check will probably find it on your record so you might as well explain it now so that it doesn't give them a reason to deny you.

16 photos of mostly us together with a couple with his family and his friend
Copies of bank statements that show each time I sent him a letter as well as my airline ticket purchase
Copies of 5 letters and envelopes from him
1 passport photo of each of us with our name on the back
My itenerary
Copy of 2 baggage tags, reciept from a duty free shop, and a copy of 1 of my boarding passes
Telephone bills from June-January of this year with all of the calls/texts highlighted
Copy of Marlon's divorce decree
Copy of my passport photo page and the stamped pages for my visit
Copy of my birth certificate both sides (the one with footprints)
A couple of emails he sent me
Some chat logs from June/July of last year
Text messages from Marlon

I don't know exactly why people here say save phone bills for the interview, cause for the ongoing relationship you would want new phone bills and letters dated after your NOA2. 16 photos is a bit overwhelming, half of that is fine, and too many letters might slow them down cause they might have to read them, just a sampling would be fine.

I mailed the petition to Vermont June 7th, and the recieve date is June 9th, and notice date is June 19th. Later recieved and sent the request for evidence which they recieved Aug 3rd.

The process time for Vermont is now July 17th.

I subscribed to the website, and to get udpate thru email. The website currently shows they recieved request for evidence on August 3rd.

So I tried to call 1 800 375 5383 and went thru the automated menu system, which eventually asked for the Receipt Number that started with 3 letters followed by 10 digits, and required me to put in the 10 digits. So I put in the 10 digits, and it said not enough digits were entered. So I tried again, and again, carefully. Kept getting same error message. Maybe cause it starts with a 0? Or Im calling after hours? (7:30pm eastern). Or is the case just lost and not in the system anymore? Which wouldn't make sense cause on the website I still see the August 3rd for last update when they got request for evidence back.

Anyone else aprox mail their case out in June, and mailed out request for evidence in August, still waiting for a decision?

I spent 40 hours preparing all the papers, typing them (not hand written), all requirements are met, and evidence sent in including photos and IMBA REF. I tried to make it easy as possible for whoever would be reviewing the case.

So we're waiting now over 7 months for decision and getting worried. This is my first attempt to get a status update other than using the website which I've been checking more frequently lately for processing dates, and case status update on our receipt number.

Any advise? Please help.



You would need to input the 3 lettters along with the digits on the menu system. To get to a operator you have to either go through the option that says you are beyond the regular processing times, or after the recording tells you about the case you get the option to talk to an operator, I think. IMBRA slows things down, and can take your processing times beyond what they post. You could seek the help of the congressman in your district.

Well the photos are proof of having met over 2 years ago. But I wonder is that enough. We've got tons of photos of us away together and everything plenty. I hope 2-3 that are over the 2 year mark are enough. I can prove we travelled away together at the same time but that was only a year and half ago.

Just on the subject of photos, I've been going out with my fiancee now for 3 years in march. The only proof I have of us meeting in the over the 2 years is photos during the summer and her 21st. Our first trip away together wasn't until the following summer which would only be a year a half ago. We've been abroad numerous times but all under the 2 year mark. I take it won't be worth submitting our passports with stamps? Are the photos going to be enough. I've e-mails but thats it. Kinda frustrating as I'm unsure and worried. I know we've met over 2 years ago and I've plenty of people who could swear to it but I've to convince the people reading my application!!

Can both of your passport stamps show that you were at the same places at the same time? Pictures can be pretty good evidence, but if you have boarding passes or hotel reservations or receipts, or letters, phone records, text messages, or something it can help. You can put in a good story of how you met and your relationship and all and explain what you just wrote above.


Hmmm I am under the impression that you need to have photos together under two years. Maybe someone else can verify that. If you could possibly do it, I would go to see her 1 more time, and if you do take the forms for her to sign and help you fill out.

Sure I do have the passport stamps with dates on them and all tickets except one. (however I do have the return which proves I did go there to come back. ) I guess I'll attach about 6 photos and another 6 phone bills from each of us is what I'll attach.

Now for the interview (assuming my petition gets approved), do we use the same submitted evidence or we still need to provide the more current emails and phone records.





As far as extra relationship evidence was concerned, I think we put in about 6 pictures, and a small selection of phone records. That's it.

We saved everything else for the interview.


What other documents do we need to keep gathering from now onwards for the interview process ? Any ideas would be helpful.

To prove ongoing relationship, engagement ring receipts are quite good, new letter of intent to marry from both of you, letters, emails, phone records etc.

The stuff which may take the longest times are police reports, birth certificates, name change documents, divorce certificates etc, and all of these translated.

I'm in the process of filing my I-129F for my fiance in India, and am gathering the emails and phone records and photos.

We've all the phone records for the last 2 years.
We've a few photos of the engagement ceremony and a few casual photos as well.

Q. Based upon your experience I want to know how many emails and how many pictures should I attach ?

Q. Also we don't have all the email exactly since the beginning of our relationship(Q4 2004). Since we have chatted mostly over the phone. Is this going to be a problem ?

You just need enough to prove that you have a relationship, I don't think you want to provide all the emails and stuff as they will probably have to read what you send them, unless you blacken parts out, and it'll take them longer to process. I read somewhere that maybe 6 dated photos together are good. I would put in some phone records scattered through the 2 years but think its really up to you. I don't think it matters as long as you've given enough to show them you are not trying to fake a relationship.

The NOA2 says "The above petition has been approved, and forwarded to the listed consulate."

Now I was under the impression that after USCIS sends the stuff to NVC... Notice date is Jan 23rd, and I called the NVC to check if they got anything just now (28th), but they didn't get anything.

Also, no consulate is listed anywhere on the notice... at least I didn't find one listed, so what is that supposed to mean?


Don't let them waste your time, in confusion, like they did mine, they are using outdated wording. The petitions all seem to get recorded by the NVC now. I've been keeping track of people that recieved those words and all of them saw it go through NVC. Except for me, Vermont stuck mine in a warehouse somewhere and hopefully it'll go through the NVC soon.

Give it 6 weeks sine your NOA2, chances are NVC will get it.

I tried searching around the forum and the USCIS website for an answer, but had no luck. I was wondering if it is mandatory that my fiancee' has to have her interview conducted at a US Consulate inside her own country? Or is it possible to write on I-129F another US Consulate outside her country? I only ask this question because Ukraine has only 1 US Consulate inside her country. It is in Kiev. I've heard very many undesirable things about this particular US Consulate. People that had gone through the US Consulate in Kiev said they would recommend going through a US Consulate in another nearby country. For example, Warsaw, Poland. Do I need good reason or must file something to ask state another US consulate outside of my fiance's country? Or will this throw up a red flag for wanting to have interview outside my fiancee's own country? I was under the impression that one US Consulate is the same as the next US Consulate as in any other country around the world. I would love to hear your thoughts on this one. I know I must not be the only person who must have this question in mind. ;)


I've thought about this before but found no clear answer. USCIS seems to say you can request any consulate you wish, but its the consulate which can choose not to take your case. I would suggest checking with the consulate that you wish to do your interview with. The NOA2 approval notice from USCIS says that once your petition is sent to a consulate you can then request the consulate to forward your files to a different consulate. The other option is to file a form with USCIS I-824 I think it was, pay the $200 fee and they will notify a different consulate.

K-1 Fiance(e) Visa Process & ProceduresPetition expired - reapplying

It expired several months ago, however, we haven't received any final notice from them saying so. I know that the Embassy returned our petition to the National Service Center at least last October. One would think they would have just sent us a letter telling us that it has officially expired, but the online status information just says it's waiting a decision. :huh: I'm not sure what there is to decide.

It's our own fault that it expired. We had many chances to apply for the visa and requested extensions, but eventually, the Embassy said enough extensions already.

So, here we are.. still in love, our problems have been resolved, and we would need to begin at square one again, I am assuming. But, I really don't know. I'm just mainly interested in finding others in our situation because I'm concerned that once he finally does apply for the visa, all the extensions would appear as a red flag to them.


I've reapplied for the same woman before, it can be done. Depending on the timing of the next petition or if he has previously filed, he may have to file with an IMBRA Waiver.

I don't know how it works with the expiration thing. I would suggest him scheduling an INFOPASS appointment with his local USCIS field office, and maybe talking to NVC.

Oh My God!!!! She arrived at 8 PM and was done by 10:30! The interviewer was very nice to her. There is so much to tell, but I am fried and want to sleep a deep and sound sleep. I will explain everything tomorrow. Now I go to bed. :thumbs:

I'm in the same boat as you. My file should have been at NVC by now. I received NOA2 on 1/17 and NVC still has no record, according to the automated system. I never imagined it could go straight to the Embassy in Bangkok.

Its best to talk to a person at NVC, I have heard here the Automated System does not record K-1 cases. It can take up to 4 weeks for NVC to record your case.

So I called USCIS today to inquire about my petition not being at NVC yet after NOA2 and to ask about "and was forwarded to the consular office listed" on NOA2 and they told me that for I-129F they send not to the NVC but directly to the embassy. She didn't really give a normal answer as to whether this was previously the case.

Any thoughts? Was this true for anyone here recently? Do their support folks just not know what's going on?

Though, the NVC still doesn't have my petition and the Moscow embassy hasn't responded yet.


The Customer Service center told me this many times, but I don't believe it is the case. I spoke to my USCIS field office about this, and he said it would go to the Embassy through the NVC. Things have changed since USCIS became part of the Department of Homeland Security, and I believe people at USCIS, especially the cusomer service center, have not been informed. I would be very surprised if it didn't go through NVC first.

There have been many cases on VJ with that wording, but if you look at those peoples timelines now, they all have a date listed for when NVC received it.

:dance: I still feel slightly stunned but I had my interview in London yesterday and couldn't believe how easy it was. There was no need to show proof (photos, emails etc ) of relationship, a few simple questions about how we met and then was told "I am approving you for a visa pending on your medical" which I had the day before. Enjoying this time before the next round but at least I will be with my loved one.

For those that have already sent off your I-129F and all related forms etc....Did you all put the paper work in folders?...or in plastic sleeves? Because I have a folder with plastic sleeves in it...and was thinking it would be a good idea to keep it all together in that?

I know its a stupid question but i havent got a clue :unsure:


Thats what I did, with clear plastic sleeves. I heard they don't really want bulky folders cause they have to take it all apart and arrange it the way they want to arrange it. You can put passport photos and little things in a plastic sandwich bag and staple it to a sheet of paper.

You will present the I-134 during your interview at the UK Embassy, so you fiance will have to fill out and gather supporting documentation, Bank Letter, Employer Letter, recent pay stubs, and assets, and get the I-134 Notarized, some, I would put in copys of the 1040 type IRS Tax Forms for the last 2 years and some have them notarized also.

I need some help in Section 16 of I-129F form and Other name uses on the Bio form and fund and photos.

1. In Section 16 ask to write down fiance's name and address abroad in native Alphabet. I am a foreign fiance. I came from China but I live in the UK for 11 years. Does my fiance in the US need to write my name and address in Chinese in Section 16?


2.On the top of the Bio form ask All Other Names used, I used a different name before but I am now using maiden name. Please let me know if I need to provde proof of name change.

3. Does my fiance need to provide prove of his Income/saving and do I need to provide that for the petition?


4. The photo requirements in theI-129F form stated it need to be 3/4 frontal view. However, the USCIS website stated it require 2x2". Please confirm which one do we need to submit?

This is my interpretation:

1. By your fiance putting your name and address in your native language shows that you two colabarated with each other in filling out the forms and shows that you are interested enough in each other to do this.

2. I believe your divorce and previous marriage certificates would be enough to prove why your name changed, that is if they do show your name changing.

3. For the I-134 Affidavit of support only the USC needs to provide financial informatiion to show that they are 25% above the poverty line and will be able to support you.

4. The new format is the 2 x 2 frontal view, the other one is outdated.

Hello everyone.. Thank so much for the quick replies.. yes i agree with you that we cant really have the fiancee visa if we will not meet.
Canada will be the only place that we will meet.. nearer to him.. but we have a problem because i dont have any friend or relatives that lives in canada..
How will i do it? can i possibly be in canada with just visiting visa and no invitation at all?

Excuse me for being skeptical, but why is he not helping you with this? Fear of flying is not enough to convince USCIS or NVC or the Department of Homeland Security, that you are not just doing this to get into the US.

If you want to meet in Canada, why is he not helping you, does he know any friends there that could invite you, or maybe he could go there, make friends there and have them invite you.

Again sorry for the skepticism but it is in your interest to find out what he really wants.

I didn't send in copy of passport pages but I had overwhelming evidence of our meetings, airline bording passes, hotel reservations with her name included on the reservation etc.

Hi! My name is Christina, I'm German and I'm engaged to Jeremy who is a US citizen and stationed in Baumholder, Germany. Jeremy is working for the US Army and has orders for a permanent change of station to Kansas. We found out in mid-january and his departure date is April 2.

We already know about all different types of visa but were having problems with figuring out if there is a possibility for me to leave Germany with Jeremy and get the visa started there. In order to find out we called the USCIS office (in Texas, since this is where he is from) and they told us to proceed like the following:

1. Fianceé should come to the U.S. as a visitor
2. She will need to have a return flight
3. Couple may get married in the States
4. Fianceé may then file an I-485 (AOS) and receive a visa which needs to be adjusted after two years

My future mother-in-law talked to an immigration attorney who approved this plan as totally okay.

For me, so far, this way has always been known as illegal.

I'd appreciate any kind of comment on this and if there is any chance that I might be leaving Germany with Jeremy in April and be able to stay in the States. Also on advantages and disadvantages of getting married in Germany or the States regarding the visa process.

Something sounds funny to me in that scenerio. I was always under the impression that if you 2 know each other you can get married in the U.S. but you would have to return and wait for the K-1 to get approved. However if you met him by pure coincidence in the U.S. and got married then you could file for AOS, and stay here.

But get more opinions cause maybe I am wrong ;-)


Oops sorry I mean I think he would have to file for K-3 in that case.
