Thanks for the info! Sounds like I need to just "wait my turn"...yuck! Jumping in front of the line sounded like much more fun to me! I guess I should wait to make a call if things start running long.

I feel for the people who filed a long time ago and see NOA2's being given from people who applied this month! I can't imagine how hard it would be.

At least I am together with my fiance... we live in Norway. We don't have to spend this time apart like the vast majority of you. However, I have to be back in the U.S. this summer and it sounds like we won't be done with this process by then. However, I have been in touch with the Embassy in Norway and we've started getting all the paperwork together for his interview. The medical is good for one year so we are going to ahead and get all of that done ASAP so we are ready and don't prolong the process. I encourage others to get in touch with their embassy abroad to see if they can do the same! I don't know about t his process in other countries but THINGS TAKE TIME in Norway... I believe this to be the country moto!! I know once all the paperwork gets here... it's going to take FOREVER!

Thats a nice area there, the Scandinavian region. Its pretty cloudy over there a lot of the time though isn't it? Actually who knows, the U.S. Embassy there might process pretty fast since there are probably less cases being processed there. I know Cyprus, where my Fiancee is living is notoriously slow, like when going to a restaurant you may have to spend hours (seemed like it anyway) looking for a waiter and go tackle him/her before they get away! :lol: But when the Embassy got our petition and she faxed just the DS-230 part 1 they emailed me in 2 days and scheduled the interview for a week later! :yes: I had to email them back and tell them to give us another 2-3 weeks! :lol:

But yes I think its good to get a lot of the stuff together, especially the police reports because they could have to be from different countries and they may take a couple months to get. The medical is good too. Then there's all the other official documents, which may also need translating.

Thanks for your input. I am aware of current case processing times but if there is a way that I can speed up the process by making a phone call or two... it seems worth while!

So... is there anyone out there who has done this before? Can it help? I have connections with different politicans but don't want to call in any favors if it's not going to help.

I realize everyone is waiting patiently and wants to get their loved on into the States. Sharing experiences and tips is what this forum is all about!!

If you have connections to Congressmen or Senators and they are really willing to bat for you, yes they can get you special priviledges but thats the risk they take, in looking corrupt.

In general if its just normal processing time they'll just tell you, you have to wait, but in many cases they can cut through silly B.S.

i was reading the requirements for a fiancee visa. My Fiancee will be moving here from china, upon approval of our K-1 Visa. What are some examples of having. "Evidence of valid relationship with the petitioner."
Also is it necessary for the petitioner to have evidence also?

Its necessary for both parties to have good evidence of the relationship. The petitioner needs to send copies of the evidence when filing the 129F. The fiancee needs the originals during the interview. I made 2 sets of pictures and gave one set to her. You can send all your letters that you received from her, back to her for the interview, along with phone records etc.

Pictures are worth a thousand words. I don't necessarily agree that you need to send copies of passport stamps, in my case most of them aren't perfectly legible anyway. So I didn't use them, and all they say is that you were in her country on a specific date, boarding passes, hotel receipts and travel itinerary can do the same thing.

They take all of it together and see if it tells a story! ;)

I am preparing to send off my I-129F for a K1 Visa. The instructions say to send proof of name change if using a name other than that on relevant documents.

I was married once before and had my name changed at that time but my passport and all my other documents include my previous married name. The only document I have that differs is my birth certificate.

My question is: Do I need to send a copy of my former marriage license to show that my name changed from my birth certificate?
or
Is this requirement only for those using the I-129F form for the K3 visa?


I would send the copy of your former marriage license and your divorce certificate. I would think its independent of what you are applying for cause they want to know what all your names were so that they can check their databases. If necessary attach a sheet explaining how your name changed.

Did you forget the part about getting married after his arrival! :dance: Maybe I am confused, I mean his arrival after the interview.

For his interview he needs to take the DS forms, lots of pics and proof of your relationship, I-134 and financial support docs, completed medical, birth certificate, divorce certificate, police reports etc, etc. The complete list is in about 3 pieces, I 134 list on the instructions, Embassy Interview instructions and checklist, 129F list of official docs on the instructions!

Honestly I think you need to get him to come to Romania and make the relationship look legit without a doubt in USCISs mind. I think the USC needs to be the one in charge here. He needs to come over there and sweep you off your feet, and get all the evidence for the 129F work. Otherwise it may end up looking like just anothe girl wanting to get into the country.

I don't know I guess it depends on how long you were together, in the U.S. I suppose there's a posssibility but remember this evidence has to be very convincing to the consulate, even if it somehow gets approved by USCIS, or you will have ended up getting yourselves some experience in pure frustration dealing with the Government.

You mentioned, in your signature, he has proposed to you 3 times! Did he write you a letter proposing, or maybe he should, and then you could respond to his proposal in a letter to him, through postal mail. Did he send you flowers, and do you have proof of this? If he gives you an engagement ring, the receipt would be very good evidence also. Email letters work also but regular mail seems like better evidence to me.

Do you ever talk on the phone? Phone records are good. For the pictures you have make sure most of these pictures have both of you in them together, dated ones are even better, but you can write the date on the back of them.

We filed I-129F in Feb and now I (filer) changed the address so my fiancee's 'intended address' is also changed.
So, on the letter of confirmation they mentioned that I should call them as soon as address changes, but I also read here on the forum about form AR-11 (which apparently is now possible to file online).

My questions are:
1. Do I just call them? (as official letter from them states).
2. Do I also file AR-11 form?
3. Can I file AR-11 form online?

I think the AR-11 form needs to be filed when your fiancee's address in the U.S. changes. I gather your fiancee is not in the U.S. yet so you don't have to worry about it till later. For the USC there is an online link, but if you are sponsoring a I-134 I think you also have to fill out a form, I-865 I think I read, when your address changes.

Why on earth is somebody who lives on the East Coast of the USA, North Carolina to be exact, required to send their paperwork to Texas, which then forwards application to California, wasting one week of time, and which is known to take an inordinate amount of time to approve applications. Vermont is a heck of a lot closer to NC than even Texas (I think), not to mention much quicker than CA. Why California, and why couldn't I just have bypassed Texas altogether since they don't process the stuff there anyway? That would have made me a February filer if it had been straight next-day aired to CA...now I'm thrown in with March 6th crowd (no offense to other March 6thers). OK, I feel better now.


If I were to hazard a guess. I think VSC has probably got completely old out of date facilities. They only handle the North East cause they probably can't take on more workload. They are faster in many cases, but you take them out of the standard case, like a case with an IMBRA Waiver and they fall flat on their faces.

M fiance received the NOA2 yesterday. it stated there that the petition is approved and forwarded to the listed consulate. But it is not stated there what consulate. Does it mean National Visa center??? it also states there to please contact the consulate with questions about visa issuance or if he would like the petition to be forwarded to another consulate and the participant can also file I-824 with this office to request that we notify another consulate of the petition approval for visa processing purposes. We really dont understand. Do we need to file the I-824 with $200 fee and if we dont do it will they still process the petition??? and to those who have their NOA2 already, are you asked the same thing?
please help. we really need somebody out there to shed some light regarding this.

Hi, first of all congratulations!!! Relax, that statement on your NOA2 is deceiving and its from an outdated canned letter that VSC keeps on using and freaking people out. The reason they did not list a consulate is that it used to be listed in a box at the top, but since the year 2000 or so that box exists no more.

Your petition will go to the NVC first and the to the consulate. The consulate they send it to is the one you requested.

Technically speaking the consulate itself can choose not to process your petition, but I think thats very rare and probably only if the beneficiary does not reside there.

Hi Everyone!!

I'm back in the U.S. with my man!!!! :thumbs:
The interview was a piece of cake - the consular talked to me in English and then interviewed my fiance in Portuguese. He only asked him a few questions and then directed a couple to me. He basically wanted to know our "timeline". When my fiance told him we lived together he seemed satisfied. I made a scrapbook and he asked to see pictures - so I showed him the whole thing. It was nice. There was a window between us but I opened up the book and showed him everything - we explained it in Portuguese.
A friend who was waiting outside said we were in there for 6 minutes.
Two days later we picked up his visa and then 3 days later we were back in the U.S.
He's moving in now - it's sooooo great!!!

Sorry I messed up, the previous poster is correct. For the G325A itself each person is the applicant. In other words each person needs to put in their biographic information.

You, the USC are the Applicant, or Petitioner

Your foreign fiancee is the Beneficiary

If you were always a U.S. Citizen then you never had an A# so I guess, 'N/A' would be your answer.

and yes they are asking you the USC, if you have lived outside the US for more than a year. If its not applicable put, N/A

So... here is my story.

I live with my fiance in Norway. Orginally, we were going to get married here and file for a I-130 at the American Embassy in Norway. With the passing on the Adam Walsh Act, embassies abroad were no longer able to accept these applications. Well... now they are.

My question is... can we cancle the fiance visa we filed in February?

If so, how do we do this? We would much rather go through the process here since it is supposed to move much faster.

Any advice?


Hi, my thoughts here would be that this ( DCF ) will not be as fast as it used to be. There willl be a delay added for that Adam Walsh check. But since you want to get married in Norway this may work for you. But then it may only speed the process for you by a couple months, and of course this rule is so new that it probably has kinks in it that need to be ironed out.

I don't know the process for cancelling the I-129F petition. I guess you need to talk to Customenr Service, and probably fax or send USCIS a letter for cancellation. Its probably better you do this before they approve your case.

But for thiose jumping out of their seats, note the major restrictions:

Must be resident abroad for 6 months.

Must not have a permanent address in the U.S.

Well, I know nobody is that interested but finally a POSITIVE result (in a way!). The senators office called us back to tell us the USCIS has 'lost' our petition. Completely lost all paper trail, only retaining a computer record. She took some details from my fiancee and they are going to 'reissue the NOA2', which sounds a lot like what happened to lookywhatifound. She then said it'll be 'expedited'. Anyone else had this happen and did it make much difference to when you got the interview date?


Hey Ashp, sorry to hear they complety lost your petition. In my case they didn't ask any details of me, just reapproved and sent the the new NOA2. Well at least you now have hope that it will get to NVC. It did proceed quite fast after I got it though, it probably only stayed at NVC for 2 days. The consulate she is going to interview at is quite small and ours was the first case they received on that day, and they were faster than we were even ready for! So I don't know whether the consulate process was expedited or just normal for them.

In any case I hope your headache is finally over and you will soon get your interview. :yes:

Its funny that people say VSC is so fast. They can be fast but, also so fast that they might put your petition in the dump truck instead of the truck going to the NVC. :devil:

Well, here we are 19 days later and once again nothing has happened. We called Senator Collins this morning and she said if she hasn't heard from them by Thursday (I didn't make the call, but my understanding is she had it flagged for them to respond to her as well) she's going to .. well, do something.

How disappointing, even a senator can't get the USCIS to get their butts into gear and fix problems. She's been really helpful and I'm sure glad to have her on my side, because if she can't get them to act, what hope do the rest of us have?!


Hi ashp, it took them 30 days on my case for them to retrieve it from the storage facility, reapprove it and get it to me. Hopefully yours is just around the corner. I know you had the same exact problem as me, they had me wondering for a while also.

Well,

Just to cheer everyone up we got in touch with Senator Collins office in Maine, and within 15 minutes she located my petition, they promised to take it out of the 'storage facility' its in (that they already wrote me a letter to promise me its not in), and as a bonus she requested they expedite it to make up some of the delay!

So, as I was told and others have said - if you get any grief from the NVC your senator is the person to go to. I know someone getting my vote in the future :)

They did that based on my faulty NOA2 that said it was 'forwarded to the listed consulate', so none of them really know the overall process cause the top department, DHS obviously didn't do a good job informing anybody.

So don't wait 3 weeks for the NVC to send you a stupid notice that says check with somebody else! :devil:

Well, we left our details as the person who deals with this type of thing was out of the office, but they promised to pass over our details for them tomorrow. Being up in Maine they can't be _that_ busy, *grin*, so hopefully we'll hear back.


Very good, if you haven't already also get the authorization document off of their website and fax or mail it to them cause the may need your authorization to get your information. Hope you find out something soon.

For me its going great now, the assistant from the embassy emailed me and told me our petition was received and sent me instructions and documents etc that she needs to fill out for the interview. So essentially an electronic Package 3! :yes:

I had the same problem, when i filed for my wife around a 1yr and 1/2 ago they sent my paperwork to the wrong location, i remember calling VSC and NVC and got all the run arounds what i did to solve my problem was call my local senators office and explained my problem that I was haveing, in 15min they called me back and explained that my paperwork was sent to the wrong place and that they would locate the paperwork and expedite my case. so call your local congressmen and senator and make sure you tell them you voted for them.......


Well, I sailed over the 90 day processing limit, I guess this means my case is 'offically lost' for the time being. I'm going to ask my fiancee to call her congressman as that's one thing I don't think I can do on her behalf, and I've emailed the NVC to state it's over 90 days, along with a scan of my NOA2. Not sure what else I can do. Waiting on their phonelines to open right now.

Very very disappointed, the VSC/NVC have really let me down.

Hey just letting you all know, I checked my case status online and to my surprise, I was touched today, and they said they sent me an approval notice! So the VSC director pulled through on his word, its been 30 days on the dot!

Now I'll be waiting for that NOA2.5 in the mail! ;)

So I hope that gives all you stuck in limbo a bit of hope.


Glad to hear it's worked out as you mentioned in PM. My experience was different, they just insist they sent it to the NVC and the NVC insist they don't have it. If I talk to the NVC they just tell me 'well... we don't have it'. I'm pretty upset at this point because I don't know how to resolve this.

I know there's a 90 day processing time, that's the 1st of March. What do I do at this point, just send more letters? Is there a special form we can fill in? Is it worth calling my local embassy like some people suggested above?

I just don't know what to do next. If VSC insist they mailed it and NVC insist they haven't, I don't see how to resolve it short of them making us file again.


ashp, that is terrible!!! :angry: Did you ever try contacting Your congressman or your Senators? Uggh what else can one do :blink: This is a nightmare!!! :( I think at this point you need your Senator or Congressman to investigate, either that or the dreaded last option that you mentioned. :wacko:

I decided to call CIS back yesterday (Feb 12) to complain again and see if I could get any additional information on the original application, but this time I got a different story (I didn't tell them about the I824 application). This time the lady told me, "Well, NVC shouldn't have your petition; it should have been sent directly to the US Embassy". I couldn't believe this could be the case, and it did not seem consistent with with I have read online or with what the NOA2 said (before I lost it). The CIS lady told me to contact the US Embassy in Nairobi and see if they have the case on file and to update my fiancee's address through them. So I've asked my fiancee to contact the US Embassy and DHS in Nairobi to find out ####### is going on. So I guess I could get some good news tomorrow, or I will find out I was mislead (the latter being what I think has happened).


Just curious. They are saying the file was sent directly to the Embassy. I know the procedure was always to send it to the NVC, they assign it a file number and send it to the embassy. I have also noticed that many of the NOA-2's now say the file has been sent to the appropriate embassy (Including mine) I am at 3 weeks since my NOA-2 without hearing anything. It is not to the point that I am concerned yet but I am wondering about the wording and what they told you that it had been sent to the Embassy rather than the NVC.

Is there any chance they have changed the process and are now sending them from Vermont directly to the Embassy????????


This has become a pet peeve of mine. The confusing wording, 'Forwarded to the listed consulate' is outdated. I think lately everybody has seen NVC get a record of their petition. When USCIS was INS, 2001 or so, they would send it right to the consulate. It can take up to 6 weeks to get to NVC. It seems the customer service people did not get the update.

If it takes more than 8 weeks to get to NVC, go through the Customer Center option till you get to the one that says there was an error on your notice, complain like this wording has completely confused you and eventually they will give you a fax number for your processing center. You need to send a copy of the NOA2 with all correspondences, so your NOA2 is all important, especially when you have these kind of problems. I've already made and used so many copies, its ridiculous!

I can't believe this has happened.....I would be furious!!! Have any of you tried contacting your local government to make a call on your behalf? Or fax/email an inquiry at least? Maybe that would help. Sorry I don't have anything else comforting to say except good luck and I'll keep you in my prayers.


Thanks lion_lioness, yes I think 3 of us, which includes me, are getting quite furious. One is already working on drafting a letter to their Congressman, the other is waiting to see if they get a response from VSC, and I already got a response from the VSC director, mostly a canned letter, telling me to allow them 30 to 60 days, to request my files, from an 'Offsite storage facility', for another NOA. For me I know it won't help to contact a Congressman or Senator until the 60 days are over, cause they'll just tell me I have to wait that 60 days.

I hear the Government inquiries can take from 30 to 60 days too. I had a little conversation with one lawyer and she told me they have just as much power as we do on something like this.

Still waiting on my NVC number, CIS- haven't replied to my letter, fax and emailed complaint about us having to wait almost 2.5 months now. Looks like I have to go to the full 90 days then find and submit that form. Has anyone ever done this before? How long did it take, what options do I have now? :(

We're both really upset, so unfair to have another 3 month delay.


Ashp, M & N, and whoever else maybe frustrated with VSC right now, don't really know what to say here, this is pure frustration! It hasn't even been 30 days since I got that infamous letter from VSC and its already felt like years.
Has VSC lost our petitions, I really am starting to wonder? But the fact is that our NOA2s were approved, so since this is USCIS's error, would they allow us the Embassy interview anyway, or do we have a chance of getting expedited processing, if we were to go the K-3 route now?

I'm going to give it the full 60 days and take it from there. If they find my petition, I hope some of yours are found with it so they can resolve your cases also. Who knows maybe all the snow and winter havoc is just slowing things down iat VSC and NVC.

Argh, so frustrated!

My NOA2 was granted Nov 29th, and I'm STILL waiting for the NVC to receive the application. They won't even look into it until 90 days have gone by, so once again I'm sat frustrated by the total inability to proceed. Nobody will let me talk to VSC to check they mailed it, they claim they don't keep records of what was mailed. How can they be so useless!

Just needed to vent, so frustrated. :(


Ashp, you may be in the same situation I'm in, my NOA2 was approved on the same date, 11/29 and I found out they stuffed my file in a storage facility. They are retrieving my file, so who knows yours may be being retrieved along with it. Here's the things I did. VSC has a fax: 802-527-4816, send a copy of your NOA2, and write a letter, with your Receipt Notice, and explain that you have no idea where your petition. I also wrote a letter to the VSC address on the NOA2, along with the NOA2 copy, also complained at USCIS-COMPLAINT@DHS.GOV

I am in Philippines at this time and would like to file for K1 visa for my girl that lives here. I should wait till I return to us on March 8th. to file? :help:


You should download a G325A and let her help you get all the info and get her to sign it. Make passport photos of her, get pictures of you two together, receipts and all that stuff so you have it all together. Buy her an engagement ring maybe, and keep the receipt etc etc. :)

Anyways, my financee lives in the UK and he sends me money sometimes to help out with the bills here ,,,, will whoever checks us out see that, and therefore deny us because of it..... its not like its a huge sum of money

The only thing I can add here is that you probably want to gather strong relationship evidence, because you want to make sure it does not look like he is paying you to get himself into the U.S.

Hello Everyone
Can my fiance enter US while still I am vactioning in my country?. My fiance is also from the country. My fiance's interview in on May 2nd. I am planning to travel to my country on May11th and returning on July 21st. But my fiance has to be in US on or before end of June. I can change my ticket to travel with my fiance but if possible I want to stay till July 21st. Did anyone had this problem or have suggestions please. Thank you all in advance for your replies.

Your Fiance is allowed 6 months since she receives her Visa to enter the U.S. so its not a problem. You too can travel together, but you two have 90 days once your fiance sets foot in the U.S. to get married.
