K-1 Fiance(e) Visa Process & ProceduresG-325A & Letter of Intent questions

Thank for the information. I will put it to good use.

Some additional questions:

I am also wondering about the Date and Place of Marriage and Date and Place of Termination of Marriage fields. Is that just the date and the country, or do they expect more than that? How detailed does it need to be?

There is not enough space to put a full address, and if we need to expand it onto another (properly titled) peice of paper, what do we put on the main G-325A form?

Well, here's the best answer I can give you. You fill the G-325A according to a specific application, which in thisa case is the I-129F. Here are the I-129F instructions: http://www.uscis.gov...i-129finstr.pdf

Step 1. 2. talks about if extra space is needed. Item 6. A. talks about the G-325A and not having to repeat info on it that was already listed on the I-129F.

As far as if there's not enough space you can do something like abbreviate or 'See Attachment' or both. There's no clear reference about that.

On the title of the attachment you can say, G-325A Attachment for <Fiance First> <Fiance Last> A# None

Do you believe that everyone who is in the visa process is on VJ? I would say it is consulate specific answer and the majority (if not super majority) of the consulates do not require it or request it at any time

Look I'm not arguing anything but knowing human nature anything goes. Being prepared for the works is always a good idea.

K-1 Fiance(e) Visa Process & ProceduresG-325A & Letter of Intent questions

Well don't the VJ gudes seem to recommend it? So many people here say that, so they got that info somewhere. You want to show that your relationship is ongoing don't you, so thats just one way among the million others. My initial respone wasn't about the letter of intent but I see no harm in it.

If the consulate has to request later you've already broken your golden moment. Ideally you would like to see the Visa given to your fiance on the same day, so that you can go back to the US together.

P.S. Rarely does your interview letter list all the things that your CO could ask you. I communicated with one lady whose fiance had a 4 hour interview and then got put on AP at the consulate my fiance will be interviewing at. So brace yourself and be prepared is my reccomendation.

K-1 Fiance(e) Visa Process & ProceduresG-325A & Letter of Intent questions

If it is not on the required documents list on your appointment letter, how can an applicant know to come with and updated letter or anything else for that matter? You provide what the consulate wants. If the consulate wants it they will request it. What value does an updated letter of intent do anyway? Nothing.

FYI - London doesn't require an updated letter of intent; they won't even look at it.

But can you generalize that to every case? Your case was probably slam dunk / approved. But what if a case has some red flags somewhere or the CO just had a case where it looked like fraud. I'm just saying that when it comes down to whether your Visa gets approved or in AP or denied. I would rather go way above the 'requirements' rather than risk the possibility of failure.

K-1 Fiance(e) Visa Process & ProceduresG-325A & Letter of Intent questions

You need two letters of intent. Several months will probably have gone by between the first I-129F packet and your interview, and they want to make sure you still love each other. So, you both write new letters for the interview restating your continued desire to marry. :-) Make sure you do this because at our interview they asked questions about them. Good luck!

Also yes you can add info for any question that doesn't have enough space on the attachment. You need to identify the question number you are attaching info for. Also identify the page with A#, Name or something (I forget exactly its on the instructions) so they know which and whose document the attachment is for.

K-1 Fiance(e) Visa Process & ProceduresCASE FILE NOT AT EMBASSY

this feels like a game of 'hunt the wumpus' without any wumpus gun.. (vague reference, sorry)

K-1 Fiance(e) Visa Process & ProceduresCASE FILE NOT AT EMBASSY

So after trying to work with the NVC for a month and getting nowhere I contacted my congressman's office, and 2 weeks later my fiance has received a letter form the embassy saying they are ready for him to send in his forms. FINALLY!

So I'm pretty much assuming it was misplaced, or it took DHL almost 6 months to deliver it. I wonder which it could be?

Good to hear that! This rings a bell, exactly how it happened to me. They misplace it, and then they go and blame it on the other agency. Then you end up in a forever wild goose chase!

K-1 Fiance(e) Visa Process & ProceduresCASE FILE NOT AT EMBASSY

We are getting really frustrated and anxious.

The NVC sent our case to the embassy in London on December 17, 2010, and three months later the Embassy still does not have our case on file. My fiance finally got through on the phone after 5 days of trying and they told him not to panic and gave him the email code. They replied to our email stating they do not have our case on file. Well thanks, the woman on the phone told him that!

Would we be correct in assuming our case is lost? And if it is does anyone have any advice on what we should do next?

UPDATE
----------------------------------------------------
Oops sorry I reread your case and its different that NVC never got it but hopefully you can get NVC to resend it but maybe getting a congressman involved might help if NVC can't find it. Good luck!

Wrote this first.
____________________________________________________
I had this happen to me in 2007. The way I got it resolved was I wrote my congressman. In my case it worked and he found out that instead of being sent to NVC it was in an "off site storage facility", whatever that means, but USCIS resent it to the NVC.

That might not be the same issue with yours but I would say find out the congressman in your district and send him a letter with all pertinent info and a copy of your NOA2 and they might be able to find out for you.

Good Luck, its very frustrating!

Oops your talking about beneficiary, thats a bit tougher. Have the US citizen call USCIS and ask where they need to send the change of address.

Oops again. Since you already got your NOA2. The petitioner while calling the NVC can see if the NVC will process the address change. If not contact the Embassy once they recieve your case and notify them of the change, otherwise they'll send your packet to your old address.

K-1 Fiance(e) Visa Process & ProceduresBeneficiary changed jobs while application under review

Hi All,

My Fiancee was approached with an offer to work for a different company not too long ago, and the pay and benefits were simply too good to pass up. I called the hotline, and they said "If you choose to notify the service center, please submit an application with evidence of the change."

Pretty ambiguous. I am certain that I want to, but my Fiancee is not so certain it is relevant. Any advice?

After having read some posts over reasons for denial, I also want to submit a letter with further evidence and pictures of our relationship, since we submitted the application some months before I was able to offer the ring in person. Is this also advisable, or would it slow the process down any?

Appreciate any assistance!

Its not a problem. When she fills out the forms for the embassy she can list her new job. Her job is pretty much irrelevant for the Visa, except they could possibly use it to check up if she actually worked there. But, like I said, you have a chance to update her info when you fill out the DS forms for the embassy.

K-1 Fiance(e) Visa Process & ProceduresExpired I-134 Form

The current form I-134 on the USCIS website expires on May 31, 2011. Has anyone had experience with the form being denied if it was filled out and notarized and submitted to VFS or the consulate prior to the expiration date but the interview did not occur until after the expiration date?

Does anyone know how close to the expiration date the USCIS will deliver the updated form.

FYI: Additionally, DS-230 Part 1 & 2 was set to expire on May 31, 2011 but has now been updated on the USCIS site.

What is on the USCIS site are the latest forms. They can go past the expiry date on the form, if there is no later one available. Same deal with the travel.state.gov (DOS site, DS forms).

K-1 Fiance(e) Visa Process & Proceduresmake sure I am correct about NVC and question about Bene address change

Ok so I got my NOA2 last week. Based on what I have been reading here, the NVC will send me a letter (including the I-34) saying they received my packet next correct?

Then (hopefully) soon afterwards they will send the packet to China?

Then the embassy mails packet 3 to my fiance correct?

My fiance has changed her address since we mailed in the NOA1. I heard some bad stories about trying to change fiances address with the NVC and for some reason it doesnt get changed. I heard its better to change her address with the consulars office in China. But how will I know I can call the embassy to change her address? I dont want them to get the application and turn around and mail out packet 3 to her without me having a chance to change her address.

So what I assume I should do then is get the DHL tracking number and when I see its delivered to China, call them up and have my fiances address changed?

Thanks alot guys!

I wouldn't wait for letter from NVC, you should call them. Soon after that you should check with the consulate. Yes you or your fiance should call and/or email the embassy when your case is over there and inform them of the address change. Good luck!

K-1 Fiance(e) Visa Process & ProceduresK1 Visa Expiring In 3 Weeks and No Marriage

Hello All,

My fiance has been here on a K1 visa since March 8, 2011. After living together since then, it looks like we are agreeing to not get married and she will be going home at the end of this month. Is there a waiting period before she can go the K1 route with someone else in the future and is there a waiting period before I can go the K1 route with someone else in the future?

Thanks for your time.

Sorry to hear that.

For her I don't believe so and never heard of such a thing. Somebody can correct me if I'm mistaken.

For you the petitioner if you are going to make another I-129F petition within 2 years you have to write, sign and date a letter about why you should be allowed to file within the 'IMBRA Filing limitation' of 2 years and attach any supporting documentation, like past NOA2, etc.

K-1 Fiance(e) Visa Process & Proceduresi-134 question

I have a question here... do u really need to bring the pay stubs?????

I am bringing a letter from my FI's boss stating that he has been working there for N years, that is a permanent position and his annual income (which is a lot more than the minimun required)

Also all of his bank statements to show the money he has saved.

he owns a house as well, I am trying to get that paper as evidence too.

I dont think they care but I am also bringing my bank statements to show all my savings.

Is not that enough?? not sure though but I dont think he has any pay stubs

A lot of companies these days directly deposit into the employees account. In those cases they usually have their check online and people can go and print it. So chances are he can still print his pay stubs. You should check with him.

[quote name='Augustajim' date='Feb 25 2007, 10:43 AM' post='744390']
This is primarily true but people that fall under VWP I don't beieve have to show that proof. Here are the VWP countries. I might be wrong.
Which countries participate in the Visa Waiver Program (VWP)?

Currently, 27 countries participate in the Visa Waiver Program, as shown below:

Visa Waiver Program - Participating Countries.

Germany

I believe Augustajim is right, Germans can travel to U.S. without a Visa for 90 days.

I have no idea what the border guards would ask, maybe a good question for the U.S. Embassy in Germany?

When you find out your Visa petition is at the NVC she could travel back to Munich.

Lets see if anybody else here has input on this.

K-1 Fiance(e) Visa Process & ProceduresDanger Will Robinson!

Well, maybe more frustration than danger.

My petition was approved 30 Aug 2006 but didn't get to Kiev (or rather, was not acknowledged by Kiev) until 18 Oct 2006. Nadya had gotten busy on her details, but still almost missed the 1 Dec 2006 interview, going to the police in Nikolaev to get her criminal report. She has a bit of a problem since she was married to a career military man and thus lived several different places in the FSU. However, there is no SU now, only seperate counries. The Ukrainian police said they could handle this, so she paid the fee early in October and waited a couple weeks. The reports were not ready yet, so she kept checking every other day or so. As the end of November approached and her interview date loomed, she asked her son-in-law, who is a businessman in Nikolaev and thus has some connections, to look into it. Her reports showed up the next day. With a date of 27 Oct 2006!!! They had been sitting on them for a month! So she went to the interview. The Russian police report, gathered for her by the Nikolaev police (and, BTW, paid for by Nadya), did not pass muster. So she went to the Russian embassy in Keiv. They said they could get a report in 6 months, or she could go to a firm in Moscow to get the report. It would be free if you didn't mind waiting, oh maybe 3 months. Or if you were in a hurry, $100 would get in in a week. Or if you were really in a hurry, $200 would get it in 2 days. Sooooo, she boarded a train for Moscow. It seems the firm wanted $400, and it would take 2 weeks. I said we had no choice, so she paid and hopped back on the train. The trip was 60 hour, 4 of which were in Moscow, and 56 on the train. When she went back in to weeks, she was told it was not ready. That was three weeks ago. The report is still not ready - 2 weeks has turned into 5. Meanwhile, I read today that "your fiancee has 4 months from the time your petition is approved to get her visa". I read that on this site, but naturally can't find it now. If you will recall, my petition was approved on 30 Aug 2006, or 4 months and 2 weeks ago .... Nadya is going absolutely crazy over this. We foolishly thought we would spend Christmas together. Then we thought maybe New Years. Then mayb the Orthodox Christmas. Maybe Easter???

So remind me, why am I doing this??? It sure seemed like a good idea at the time ....

I'm just whining. I know others here have had more grief than Nadya and I.

Uggh! :o Hmm thats the FSU for you  They say the emabassies can extend that 4 month deadline on your petition. I think there's a form on here somewhere that you can send the embassy, or hopefully they automatically extended it for you.

Best of luck with it!

K-1 Fiance(e) Visa Process & ProceduresPlease Help!!!!

Thank you for taking your time to think about my situation.
At first my thought was that with the college it would be impossible, since we have already tried before to get me into college, but one of them that I needed to go to( there is along story about it too, I have to go to college to take some basic courses, and then to the uiversity) requires a green card. But the university that I was going to continue my education at might offer a student visa, and I don't mind working, so that is a good advise.
There is one thing about my mother, you can't talk with her, because she just doesn't listen. And she knows about all my goals and plans. You have no idea how this person acts with her rules. And I am a live human being, so now I just got the point where I can't take it no more. I've tried this a thousand of times, and I am tired of being a rug for wiping her feet at...I prayed to God that maybe we will make up, but it seems that it's gotten so far, there is no way for that.
But I appreciate your help. And you have really encouraged me.

I'm sorry to hear this is such a tough situation! :help: Do you know for sure your mother is planning to send you to Russia? Its still kind of hard for me to believe she would do that. Somehow maybe you can at least find a way to delay this till you get a green card. I mean you are here, what a shame it would be if you had to go off without one. I mean they would have to go through more Government beauracracy just to bring you back for a visit!

Like others have suggested maybe some counselers at school or some college or public government offices where you live may be able to give you some advice or point you to someone that can be of help.

Well good luck to you and do let us know how things work out.

K-1 Fiance(e) Visa Process & ProceduresPlease Help!!!!

I have a very unusual and awful situation and I would be really thankfull if anybody would help me out with this problem. I came with my mother on a k2 visa. She has married her husband and we are staying here 7,5 months and have not yet gotten the green card. The real problem is that my mother want's to send me back to our country, because to be honest with you, she is a real dictator and I can hardly tolerate her tourtures. So she decided to get rid of me. But I am 20 and I strongly want to finish my education here and build a strong career. I have all the documents exept for the green card, so I am not sure if there is any way to stay here, though I obviously want to. And unfortunately there is no way to make up with her, because our relationships have been like that for 8 years. I don't want to share all the grief about this, but I just kindly ask your advise if there is any legal way to stay in the U.S.? Please help.........................

Hi Opel, hmm there's probably a lot to your story we don't know yet. I bet your mother loves you because she brought you here 7.5 months ago, and seeing as you are above 18, she probably didn't have to.

Here are your options as I see them, on initial thought:

If you are in college, or looking to get into one, check with the counselors of Community colleges or Universities near you, who knows maybe you are eligible for a scholarship, or they may help you get a Student Visa. You might have to work part time but maybe better than going home to Russia right?

Maybe your mother is just upset with your antics, at the moment? Maybe its about time that you finally talk to your mother, about what you really want and these goals like finishing up your education to get a strong career. Also maybe that you will go by her rules for a while until you finish your education.

Well I gotta go but I hope but wish you a lot of luck getting this all settled with your mother and all! :-)

K-1 Fiance(e) Visa Process & Proceduresfiance got new address

everyone! im newbie here inVJ. i just want to be to the point about my dilemma right now.. u see my fiance moved to another apartment last march Ist . i want to know whom to call up to cos our petition is already in manila embassy and i have recieved a packet from them just last january but off course it has his old address in it.. we called uscis 3 times but they have 3 different answers, first the lady said that my fiance should write NVC for the change of address, we did. the second call they said that fiance should file for AR11. the third call they said that fiance should write a letter to manila embassy to inform about change of address..its so confusing and when fiance called up manila embassy they said that its not a big issue at all cos when i have my interview i can just tell the interviewee that my fiance just move out and have a new address. they make it sound so simple but how come they have 3 totally diffrent answer.. pls pls pls help.. nobody can help me out but concern and who got knowledge about my situation .. thanks and god bless!! joy

Well actually they are all telling you the truth. They are seperate depatrments. For Embassy changes you need to contact the Embassy, if your Fiance did not get the packet, you need to tell them to resend to his new address.

When notifying USCIS if he and you move to new address you need to send AR11 for his address change, in the U.S. , and the USCIS web link for your address change.

Good luck.

K-1 Fiance(e) Visa Process & ProceduresK1 interview tomorrow - fingers crossed!

My fiance just got out of his medical, other than needing 1 more vaccine all went smoothly and quickly. (The physical part of it was only about 10 minutes!) His interview is at 1pm his time tomorrow, 7am EST. I can't believe it came so fast! It feels like just yesterday that we realized we'd have to wait two whole gigantic months til his interview... and now... it's here! :o People here told me it'd fly after NOA2 and I didn't believe them... well... wow, it flew! Guess who still hasn't secured an apartment? ME! Oops. I have to put together the chat logs/e-mails that my fiance will print tonight (hah, last-minute-Angilla, I'll never learn) and then I'll have to get to work on the apartment hunting. I just can't believe it! 14 months since we've seen each other - and since we first started planning to file the K1. Finally over. Finally! My poor fiance really started to panic about the interview last night, I calmed him down... now I'm the one nervous, and I can't show it cuz it'll make him nervous! So instead I figured I'd ramble here! And make myself late for work like I always do on VJ!

So anyway, please everyone, fingers crossed and prayers said tomorrow. Let's bring my baby home!

Good luck Angilla! No problem Visa is just as good as yours! Fingers Crossed! ;)

K-1 Fiance(e) Visa Process & Proceduresmedical question?

For the medical you need to produce your vaccination record? Does it have to list everything that you've had or just what is required by the US? I contacted my GP and they said that I had to request it in writing but I couldnt just ask for my vaccination history, I had to specify which ones I wanted to confirm that I'd had. Is this right?

I've read that the doctors can assist with that, if you don't have your vaccination records. They can determine what vaccinations you have had by sampling your blood.

My check was posted as "cashed" March 8. All the worry for nothing. I can't believe I'm so happy to turn over 170 to the government, but I am.

My worst fear was that the package would get sent back as incomplete or something ... I can't imagine they cash your check anyway.

K-1 Fiance(e) Visa Process & ProceduresQuestion 11 on I-129F

Its ok just to put the approximate date, month/year of the filing, her name and place where the service center is, and just wether the previous petition was approved. You didn't specify wether he filed a K-3 or K-1 before, but if his
ex-wife is still in the U.S. she should know her A#. But in any case they have the info on record so if you don't have the A# don't worry about it, or you can state the circumstance and that you don't have this info on an attached sheet
( signed and dated ).

His ex is not in the US. She is in Italy now.

What exactly is that A#?

The A# is called Alien Registration Number, the U.S. assigns it and it is used to get the Green Card and up to Citizenship.

Since she is in Italy she probably didn't care to keep this information. Don't worry I think mainly what USCIS wants to know is how many times he has filed before.

Good Luck!

K-1 Fiance(e) Visa Process & ProceduresQuestion 11 on I-129F

We were starting to fill out the form yesterday when we noticed that in Q11 they ask if "you have ever filed for this or any other fiance or husband/wife before?" you need to give the name, place, date and A# and result.
Now is our problem that My fiance DID file for his ex-wife in 2000, but he doesn't have the paperwork cauese she has it.

What can we do? Is there a way to find that info?

K-1 Fiance(e) Visa Process & ProceduresSurprise! Surprise! Surprise!!!!!

Talked to my fiancee tonite after trying to get a hold of her for three days. I called her at work and was able to talk. She said go to YM and I will tell you what is bothering me.
We meet in Ym and she tells me. " I have had a change of heart and do not want to move to USA." She says, " I am scared and do not want to follow through with it." Now bear in mind I have made plans, purchased tickets, got hotel room suite and am going to the Philippines in 25
days to see "my fiancee."
Needless to say as you can see by our timeline the ####### was totally knocked out of me. Have you ever tried to cancel internet flite and hotel tickets bought thru a broker of said things?
I am just floored. I simply wrote her an email and said I hope you can look your 5 y/o daughter in the eyes when she is 12-15 and tell her you did what you thought was best. Nerissa and I have been talking about this for 4 years and now she does this.
I have no idea how she could do this to me.

I am still going to PI in March. I saw for myself that there are millions of beautiful ladies there and who knows. End of chapter, start a new one. My life is definetly a chapter book.
Kevin

Sorry to hear that Azcactus,

This had happened to me a while ago, for me it came down to the long distance relationship thing. Some people just can't take being alone for so long, living in a virtual relationship, and/or the reality of living in a completely different world frightens them to no end. I went over there only to find out she married some local guy. In my case it worked out perfectly cause I was saved from getting messed up with a crazy woman and I found the woman of my dreams.

Best of luck to you, eventually it works out for the best.

K-1 Fiance(e) Visa Process & ProceduresPetition I-129F , letter of intent

On the letter of intent from the petitioner and beneficiary, right were it says "[name of country where Embassy is located] is this the one in Mexico where my fiancee is from or the one in TX where the embassy of Mexico in the United States is located?

Im not sure which one they are asking for.

http://www.visajourn...r_of_Intent.doc

Anybody that filed for fiance(e) in Mexico know this question?

There's no set format to this letter, that is just VJs sample. Put in whatever makes sense to you.

K-1 Fiance(e) Visa Process & ProceduresCan gov. officials speed up the waiting time?

Thanks for the info! Sounds like I need to just "wait my turn"...yuck! Jumping in front of the line sounded like much more fun to me! I guess I should wait to make a call if things start running long.

I feel for the people who filed a long time ago and see NOA2's being given from people who applied this month! I can't imagine how hard it would be.

At least I am together with my fiance... we live in Norway. We don't have to spend this time apart like the vast majority of you. However, I have to be back in the U.S. this summer and it sounds like we won't be done with this process by then. However, I have been in touch with the Embassy in Norway and we've started getting all the paperwork together for his interview. The medical is good for one year so we are going to ahead and get all of that done ASAP so we are ready and don't prolong the process. I encourage others to get in touch with their embassy abroad to see if they can do the same! I don't know about t his process in other countries but THINGS TAKE TIME in Norway... I believe this to be the country moto!! I know once all the paperwork gets here... it's going to take FOREVER!

Oh well... good luck and thanks!

Further experience or imput is also nice!

Thats a nice area there, the Scandinavian region. Its pretty cloudy over there a lot of the time though isn't it? Actually who knows, the U.S. Embassy there might process pretty fast since there are probably less cases being processed there. I know Cyprus, where my Fiancee is living is notoriously slow, like when going to a restaurant you may have to spend hours (seemed like it anyway) looking for a waiter and go tackle him/her before they get away! But when the Embassy got our petition and she faxed just the DS-230 part 1 they emailed me in 2 days and scheduled the interview for a week later! I had to email them back and tell them to give us another 2-3 weeks!

But yes I think its good to get a lot of the stuff together, especially the police reports because they could have to be from different countries and they may take a couple months to get. The medical is good too. Then there's all the other official documents, which may also need translating.

Well good luck to you!
