Hi Everyone,
I received the hard copy of my NOA2 a few days ago. The first line said "The above petition has been approved, and forwarded to the listed consulate." There is no mention anywhere on my NOA2 about my petition being sent to NVC. This is my second approved I-129F for a Filpina. The rest of the wording on my NOA2 just explains that because this is my 2nd approved I-129F it has been added to a multiple visa petition database and says that when my fiancee enters the USA we have 90 days to marry. Has anyone else gotten a NOA2 like this?


Yes, there're many posts on here asking that same question. It does go to NVC but usually doesn't stay there for long. Also yes they do list the number of petitions you've had approved, but this is the first time I've seen them talk about a database, so I guess they finally keep track of approved petitions. Congratulations!

You will not be able to leave the country until you get travel permission called Advance Parole (AP) or the Greencard itself. AP usually takes a few months.

If you need to go home for some reason, then you could apply for the fiance or spousal visa, whichever is appropriate (if you are married by them or not).

Your husband will need to show he makes 125% of the poverty line, which for a household of two is $18,212. If he doesn't have that, he can use a co-sponsor.


Thats true, if you didn't know each other before you came to the U.S. and can prove it, you can marry here and stay here. You'll still need to show evidence in the future of your on going marriage/relationship and all.

Hi everyone,

I was wondering if someone can help me out here.

I attended college and grad school in the States, now back in my country applying for K-1. I'm currently awaiting NOA-2 and I read that I will need to get a police clearance if I lived in a country for more than 12 months. My question is, do I need to get one from the States, or will the USCIS be able to run a background check on me based on my SSN that I had provided. I had applied for and obtained a SSN when I first moved there as a student and had never had any trouble with the law.

If I do need to get police clearance, how do I go about doing it?

As far as I have read on here, you don't need police reports from US, as the background checks are done here. Somebody else can probably verify that.

Just to make correction to your statement, you need police reports from any places you stayed for over 6 months, since age 16.

Which is called the NOA2 by the majority of the users on this website. I know you've complained about it in threads in the past, however, even the guides here on VJ consider the approval notice the NOA2.


Yup sort of makes sense. The form is called Notice Of Action and the second such form that most people recieve, unless we were into RFEs, is the approval notice.

On third thought. You will be fine but they may get the impression ( since you listed her on the I-129F form ) that your ex became your wife through the K-1 process so when you get your NOA2 it may say, this is your second approved I-129F petition.

I think I-130 is one of the forms I filled out. That and something in the 600's or 700's. I know I had to pay a big fee (at the time) because my new wife (in 1996) was illegal. I think it was about $1000 fee. I'm just going to say... Result, approved and give the A# and attach a copy of permaanent resident card and not worry about what form it was she was approved for.


Oh sorry I thought you were the original poster. If you filed for your wife then you probably filed a I-130. But in that case you never filed a I-129F and that question that the OP asked does not apply to you.

So your answer for the question of whether you filed for somebody in the past is NO. Since they are referring to past I-129F petitions. Also your ex wife's green card is irrelevant and don't send it, it will confuse them.

But you don't want to focus attention on her. The whole question, as I see it, is meant to keep track of your prior approved petitons for their IMBRA filing limitations rule.

NOA2 is the approval notice from your petition from USCIS. I think the copy of the card would be good, that has the A# on it.

Hi and thanks to all. I have sponsored a fiancée in 2002. She and i are divorced now but still good friends. She became a naturalized citizen. I am currently putting together a new I-129F packet for my new fiancée. My question is regarding question 11 on the I-129F where it asks if "Have you ever filed for this or any other alien fiancée before?. If yes give name, place, A# and result (attach additional documents if necessary) Can anyone please give me advice?experience on how best to deal with this? Should i attach copies of all the NOA?

You only need to attach NOA2, if you have it, if not maybe NOA1. I don't think they can expect you to keep the one from 2002. You can attach what info you have on an attached sheet. In your case I don't think this question is very useful for them. Good luck!

I went through K1 process about 4 months ago , we did spend time living together for 2 weeks but unfortunately we had fights and thought that we were not ready to get married yet at that time , so I went back to my home country. And a few months later we both decided to get back together again so
if we are thinking to do visa again , and if we do K1 again , it will be my second k1 application as beneficiary with the fiance , how possible is it to pass the interview ? What about doing another spouse visa, like K 3 or CR1 ? I heard that it will take longer than K 1 though.

what will be the best recommendation from you guys in our situation? Please we need your help.

You can file again, but if you file within 2 years of the first petition you would have to file a IMBRA waiver request telling them why they should let you file withing the 2 years.

Since you ask for recommendation, something for you to think about, if you had that many fights that you only spent 2 weeks together, do you think a couple months apart have solved this problem. I'm not asking, just giving you something to think about.

I don't believe K3 is available.

By recent accounts, the petitioner had sure as hell also be there for a beneficiary's interview in the Dominican Republic, or it's nearly a guaranteed 221g or refusal.

Ecuador has been another such. A couple of fairly recent interviewees have attended alone and been granted the visa, but it's not clear whether the consulate's policies have changed, and certainly no pattern is yet obvious. Accordingly, it's still safest that Ecu petitioners be there with their beneficiaries.

Anecdotally (meaning from what I've gleaned without reading the actual embassy reviews), Haiti is yet another country where it's prudent for the petitioner to be on the premises.

In general, it never hurts and may help (and may save the day) if the petitioner is present or at least available on or near the consular grounds when the beneficiary is interviewed. If nothing else, it's great moral support for the beneficiary. :)


I agree, and I am planning to go when my fiance interviews also, but what I was referring to was that the OP sounded like the petitioner was the one that had to do the primary interview. So my statement was making sure the OP understood whose role is what.

What about just your Current year Income tax return only for income verification?


That becomes so subjective, I don't really know what the best answer is, it depends on your situation.

Well if you feel comfortable with your situation and want to show your financial stability 3 years of Tax transcripts from the IRS would be good, to show a trend.

Do you have assets like 401K and/or bank savings. Maybe house.

A letter from you employer stating how long you have been working there, your job, your salary, and whether the job is 'permanent' is always recommended.

Average account level in your bank account over a year.

Thats what I do. Its much better to overdo it than be sorry later. I guess its also really dependent on the embassy.

The bolded is not needed. The consulate has the I-129F packet and they don't need to see the original NOA1 or NOA2.

On that note, it is good to bring an extra copy just in case something is lost at the consulate level, however, it is not required.

Technically the only thing a petitoner would need should they go to the interview is their passport.

Hello to all,

As some of you know we have our interview date set to June 16,2011. He (my fiancé) has already received his packet with the list of things he needs to do and documents he needs to take with him to he interview. I however am very lost as far as what I need to take with me. I have heard that I need a letter from my employee, letter from bank, 3 years worth of income taxes and affidavit of support. I just can't find this proper list of things I need. Where do I find it? I'm afraid i will forget something and m very OCD when it comes to things like this. Can someone help me by telling me where to locate this list and/or copy and paste the link and/or copy and paste the actual list?


Your statement is confusing, the petitioner ( the US Citizen that filed the I-129F ) does not have to interview and so does not take any documents to the interview. The petitioner sends the original receipts and evidence and copy of the I-129F package to the foreign beneficiary, along with the I-134 affidavit of support and supporting evidence.

The beneficiary ( the foreign fiance that interviews at the embassy ) will have to get birth certificate, divorce certificate, police reports, whatever translations are required, medical exam and fill out the DS forms listed in the packet from the embassy.

hi also something to add you should see if you can marry in a country next to Italy you just have to be married dcf will be a lot easier you wont have to deal with California or Vermont and less expensive than the k1 also you my need a cosponsor because you wont have tax returns for the u.s. also you could have a ceremony here for your dad and family and just do the paper wedding over there. good luck and read all the guides to see the best way for you :thumbs:

We've explored that option, although for our situation it won't necessarily be quicker. Italian laws and red tape are one bazillion times more lengthy and complicated than those in the US and for me (USC) just to get MARRIED here requires a ridiculous amount of paperwork and sometimes months of waiting for appointments, wedding dates, etc.

To add salt to the wound - and even more stress to get this thing out of the way - we're immigrating to be closer to my dad who is seriously ill. I'll be heading to the US in a couple of months. My fiancé will join me as soon as he can and then we'll marry there. I think that between getting married and doing a DCF or going the fiancé visa route, we're looking at potentially the same time frame. The only difference is that I can feel free to return to the states to be with my dad while waiting for the paperwork to be handled, instead of being "stuck" here until I can finally get an appointment to be married at city hall in Italy and starting the DCF paperwork in a couple of months!! :)

Anyone who can prove me wrong and thinks DCF will be faster (even if we still need to get married) your comments/advice are welcome!!!!!!!! Seriously, anything to get this process done as quickly as possible.


That is a tough situation. I just thought with the DCF you are eliminating the USCIS approval and proof of meeting part and in both cases you are doing the embassy interview. Well, it was just a thought, good luck whatever you do!

Hi all,

My fiancé and I have lived together in Italy for nearly three years. I'm planning on including a copy of our apartment lease (translated into English), both of our drivers' licenses that show our same address, the receipt for the engagement ring, and some photos of us together as proof of us having "met" in the last two years. It kind of makes me laugh because living in a tiny apartment together means that I couldn't get away from the man if I tried!! :)

What else can I show??????? Unfortunately (stupidly) hotel receipts, etc. from our vacations together have all been thrown away because it never occured to us that we might need them one day. I'm racking my brain for any documentation that might have both our names on it. But all utility bills are addressed solely to him, as is the insurance for the car and scooter. Our relationship doesn't really have many "tracks" since we see each other all the time!!

If anyone has any ideas, or is living with their fiancé that they are filing the 129f for... all suggestions are welcome!!!

Since you both live there I think the quicker way is to go and get married there and then do a DCF (Direct Counselor Filing) straight with the embassy. You have to verify that you are eligible for DCF and your embassy processes DCFs.

By the way passport stamps in the EU does not mean much because you only get a stamp for your POE into the EU and then nobody stamps your passport in any EU country.

As mentioned above does Pakistani consulate allow co-sponsoring for affidavit support on K1-visas? I`m almost done with the entire paperwork and would like to send it off this week. My parents are very supportive on our relationship and are willing to co-sponsor for us as well as let us live together at their homes until the entire K1 process finishes and she gets her green card. I`m a full time student with a 15 hr per week job. While I do have a guaranteed full time placement as soon as I finish school on December, I would like to start petitioning to start living our lives together when she gets here. If a co-sponsor is allowed would I need to fill 1 as well as my parents?


If you don't get an answer you might want to post in the Embassy and Consulate section, or if all else fails maybe send the U.S. Embassy in Pakistan an email or call them and see if they can answer you.

Cause somebody did just this at the USCIS stage and his petion still got approved. Cause like I said another person had their packet sent to the embassy after cancelling it and the Embassy said they could still do it if they want.

I am sure USCIS has this happen many times.

P.S. By the way he didn't say it was cancelled.

If it has already been cancelled it is too late. You have to start over. IF you can catch the cancellation notice before they process it you might get them to cancel cancelling it. However beware that no matter how snail slow they are at everything else they jump at the chance to cancel a petition and work as fast as we wished they worked every day.

There was somebody on here that posted recently about cancelling at the USCIS stage. But I don't know of any at the NVC or Embassy stage.

Can't she call them back? Actually now I remember one person said that the Embassy responded and asked if they still wanted to cancel the case or something like that.

If the new I-129F petition is within 2 years of the previous I-129F petiton you have to file a IMBRA waiver request along with your petition. Its basically a signed and dated letter requesting them to allow you to file within the 2 years. You should attach your previous NOA2 approval notice and any supporting documentation.

Whose address and without letting who know? Yes I think you can change the beneficiary's address on the DS forms you are filling out for the consulate. But if you move you may not get the packet from the Embassy unless you tell them the change of the beneficiary's address ahead of time, unless they also notify you by email. Then make sure they know your address has changed at the time of the interview.

As far as USCIS, they are really only concerned with people living in the US.

Actually no you don't need to, they ask for Police reports from places you lived for 6 months or more since age 16.

I'm an American living and working in the US. My fiancee is Algerian, living and working (legally) in France. Our end goal is to get married, live and work together in the US.

Should we A) Go the K1 / Fiancee Visa route and petition to get married in the US? or B) Go the K3 route, get married in France, then petition for her Visa to the US?

Initially we were thinking a French marriage would speed things along, but I'm not sure...

Any insight would be appreciated!


You might want to consider DCF ( Direct Consular Filing ), you get married there and file the I-130 at the consulate, bypassing USCIS. There is a whole section here on that and VJ info and a DCF forum.

Hi,
I am a US citizen living and working in Canada. My employer might be sending me to its US office in a few months.
I do not yet have any formal job offer or documents about the transfer but I will be paid more than in my current job and the income level is not a concern.

For the I-134 affidavit of support, is it sufficient to put my current Canadian employment details, perhaps with a note that I will be employed in the US with the same company? I could include a copy of my 2010 Canadian and US tax returns if that helps.

Would including info about the assets in my Canadian bank accounts help? (I can transfer them to a US bank account but would prefer not to do that until I move).

Its purely about your financial situation and whether you will be able to support the beneficiary in the US, not the country where you are getting your money from.

Is this I-134 for a I-129F K-1 petition? If thats the case then you would only have to send the I-134 to your foreign fiance closer to the time of their interview. So at the time you fill out the I-134 and supporting documents your situation could be different if by that time you are in the US.

Pictures can speak a thousand words. No matter what USCIS defines them as they can't override human nature. But in general your evidence all together should all fit together to give them a picture of your story.

For the interview, if you were planning to go over there, you could possibly take some pictures together a few days before the interview, just a thought.

I don't believe so. I think mainly they do name checks of the beneficiary, at the consulate stage, and check the police reports that she has to get from the places she lived for over 6 months since age 16. Different embassies have different policies, you can check the VJ reviews for you embassy, there's a link in the second row at the top of the VJ page.

While you are waiting for NOA2 here in the US they will do the name checks on the petitioner.

I don't think it'll be much of a problem for Sweden, but I really don't know. Good Luck!

I don't beleive there's a form for changing the beneficiaries address. I think there's a way to change your address online at the USCIS.gov site.

YOu could call the service center and they'll probably tell you you have to write a letter and send it to them, but you can find out to what address and what info they need with it to identify you like case number and all.

They aren't always reliable though.

In any case, when the time comes, it is the embassy that you will need to make sure you notify of the new address when your case gets there. It depends on your embassy, some you can call or email when they have your case. Also on the DS forms that you fill out for the embassy you can list the new address.

Yes, it would save you some time to get all the info needed on the G-325A, fill it out and take with you to get her signature and whatever else. You can also get her passport photo done while you are over there so you can take it back with you. If you plan to stay in a hotel you could get both your names put on the itinerary so you have it as evidence that you were together. Good luck!

thanks for the reply. yes, my son was listed on the I-129F. My problem now is that i don't know where to start or what to do. do i need to call the embassy and set an appointment interview for my son or are they the one who will set the interview date? because as what i can remember when i was still processing my k1 visa, i called the embassy to set an appointment for interview, after that i paid $350 for the non-immigrant visa fee, then undergone medical tests, then had the interview, then one week after the interview i received my visa. my question is how do i process my son's k2 visa? do i need to send forms to the embassy? do i still need to pay the $350 non immigrant visa again? i really am confused on what to do... :(


Is your son not on the Visa you received? I don't think there is a seperate interview for your son. I don't really know so if I am wrong somebody correct me. But if your Visa doesn't list your son you should contact the embassy and find out why not.

What is the "A# None", is that the alien registration #?

In this case I don't think there would be "Part Y" as there is no header for that question, so it would simply be...

I think what you are thinking is make an attachment for each question. Thats not necessary one page will be enough for all your responses to the questions.


So the title of the page should list who it is for and their A# if applicable ( you are just identifying whose G-325A this attachment is for.

Yes list whatever question # you are responding to or whatever you think is appropriate. There's no set format, they just need to be able to figure out what you are referring to. I would make sure you list the # as they may be used to dealing with the number not the question itself.

About termination of marriages, it seems like city and/or state, country might be good, if they fit. I think most important is they want to know you are both divorced. Remember you are also going to provide divorce certificates, either here or at the embassy so they will get all that info one way or another.

I can't tell you for sure. But I think your best is probably good enough.

There is not enough space to put a full address, and if we need to expand it onto another (properly titled) peice of paper, what do we put on the main G-325A form?


Well, here's the best answer I can give you. You fill the G-325A according to a specific application, which in thisa case is the I-129F. Here are the I-129F instructions: http://www.uscis.gov...i-129finstr.pdf

Step 1. 2. talks about if extra space is needed. Item 6. A. talks about the G-325A and not having to repeat info on it that was already listed on the I-129F.

As far as if there's not enough space you can do something like abbreviate or 'See Attachment' or both. There's no clear reference about that.

On the title of the attachment you can say, G-325A Attachment for <Fiance First> <Fiance Last> A# None
