I hear of this government is gona shut down and stuff. Does anyone know, will it affect K-1 visa and entry to the USA. Immigration is consider federal, so will it slow down the process or mess up anyone about to enter USA of a Visa? I hope not cuz my girl is about to be here first week of may.


If the government shutsdown it will be for a week or less, and certainly not more than 2 weeks.

Once you receive your NOA2, USCIS is out of the picture, until the beneficiary enters the US. The consulate is the one that sends the packet to your beneficiary so you need to worry about correcting the address with them.

The first address is if you send it via express mail while the second address is where you send it if you send it via regular mail. When you send express someone needs to sign for it and that is why it is sent at a different address. It is solely up to you which type of mail you want to send it as. I sent is express and they received it the next day! Still do not have my noa1 yet because they have not processed it through!

Yes, and you shouldn't send your I-129F to VSC, they will choose VSC or CSC. The fee is different also. I suggest you get the I-129F instructions, along with the I-129F and G-325A forms from the uscis.gov site. Also check the K-1 guide here.

K-1 Fiance(e) Visa Process & ProceduresDid I send I-129F package to wrong address?

The instructions list two addresses, one for regular mail, the other for express mail and courier service. I sent mine by regular mail, but registered/certified so it requires signing, to the regular mail address. Did I do it wrong? It is not express mail, but it did not occur to me that maybe only one of the addresses is able to sign for it. (I saw someone hint at that in some other post.)

I checked at usps.gov and there's no record of it getting there after 4 days (should take 2, 3 max). So, I'm wondering if I screwed up. If the literal interpretation of the instructions is correct, I should have been correct in what I did. But, that's one thing I don't like about gov't instructions... when to take it literally and when to figure out what they really mean.

so, my fiance received his packet three today but all of the forms they provided to him to fill out are all expired. What should I do? I was thinking about searching the updated versions of the form but then I might run into an issue with the Kingston Consulate. Any advice would help :(


The latest forms are at the DOS site. You can't tell for sure that a form is expired cause sometimes its normal to go past the expiry date written on the form.

Compare them to whats on this site, they are the latest.

I don't think you can go wrong by having the latest forms. But if it makes you feel better you can fill out both versions and if they have a problem with it give them the version that they want.

I don't know if they are any more organized these days, but they might take too long to process the letter. I would call them also at the service center number: 800-375-5283
Otherwise you'll be left in even deeper limbo not knowing what is happening to that petition, or anti-petition.

I sent my I-129F at the end of last year. I received my NOA1 but my petition is still sitting somewhere at the Vermont Service Center. My fiancee and I had a falling out and in a moment of anger I sent a letter to the VSC this week asking that my petition be withdrawn. We have since patched up our differences. I feel terrible about what I did but we all do stupid things. My question is can I reapply for her given my petition was never processed? I'm guessing no but I have to ask. Thanks.


You should call the service center, it seems it would be better for you if you can still request the cancellation request to be canceled, or who knows maybe you get lucky and they never got that request?

Just my opinion.

In the case of the I-129F package I think all the evidence along with the supporting documentation together form a story and a general picture or your relationship.

I really don't think its normal for the beneficiary to call the petitioner into the interview and have him take his shirt off so they can see his tatoo. :whistle: I think they look at the evidence that was sent in with the petition and paperwork, and interview her to see how sincere she is and whether they have a legitimate relationship.

Of course they do all the background checks and all but I'm skipping that here.

Actually I think if somebody really wanted to get into the U.S. I can see them getting a tatoo to make the relationship look real.

Oh by the way, I'm not sure most people realize this, but nowadays in the EU passport stamps mean very little. Thats because you only get stamped for the first EU country, which may not be your final EU destination. Then when you fly to your final EU destination your passport will not get stamped.

So you probably will not have a stamp for the country where you are meeting your fiance in the EU.

If you got an RFE, something may have made them suspicious, 20 pictures are quite a lot, 4 good ones, also pictures with the fiance and fiances family, would have been enough, but do they prove they were within 2 years? If one of you lives in Ireland and the other has passport stamps in Ireland doesn't prove you two met in Ireland.

If you don't have anything good enough, what I personally would do in this situation is go there to Ireland ASAP, and get the evidence done right so as there's no question about it. But then I don't really know if evidence after sending the package would count?

P.S. Maybe you could both stay at a hotel with both your names on the hotel receipt ( just a thought).

I am preparing my my third I-129 application. It makes three in 6 years. The first 2 were for the same woman. Both of which were approved. I had to write a request of waiver at the time of the second visa, which was fairly easy to compose.

After 2 visas and 3 attempts for her to get settled in, we decided we weren't going to make it living together here in the states, and she returned home.

Now I have met, and fallen in love with someone new. I need to again write a request of waiver, but I am not certain what they are looking for in the letter.

Do I say that I met someone new and need a new visa? Do I add how the other two visas ended in my wife returing home? Or am I missing the point here?

You're right. I think the rules, are vague about whether the filings for the same person should be counted as 2 or not. I think mostly that rule on IMBRA filing limitations was put in place to keep men from abusing overseas women and letting them loose in the US.

I think mostly they are just looking for a signed and dated letter requesting a waiver on IMBRA filing limitations. You can explain why they should let you file again, and its a chance for you to explain why the past ones didn't work and why this one will. I think its not too big of a deal. Good luck!

1) when can the us fiance send the packet to the foreign fiancee after noa2 since the intent letter i know he is suppose to send should be close to the interview date. and now since we don't know the interview date yet what is he suppose to do?

2) what kind of things presently is he suppose to send since i know the embassy in Ghana have made some changes in their processes.

In addition to what was mentioned, if you haven't already, you should get police resports from places you lived for more than 6 months, since you were 16. Birth certificate, Divorce certificate, passport. You will also need to get a medical exam with the doctors your embassy tells you to see.

Tax transcripts or copies of the signed 1040s are fine. For the interview I think the beneficiary should have originals of the DS forms, receipts, boarding passes and other evidence. Good luck!

ok, so i got my noa2. now my question is, what next? i know it's been askked many times before but my situation is a little different. unlike the smarter ones, i forgot to make a copy of my i-129f. with that said, it is to my understanding that i didn't completely goof up. as far as what to do next, i believe i'm supposed to send these items to my fiancee:

1) copies of NOA1 and NOA2
2) copies the reciepts, paystubs, pictures, plane tickets, etc. proving our relationship if she doesn't have it already <-- should these be originals? or copies will do?
3) I-134 Affidavit of Support


Is there anything else i forgot? I want to know so I can jump the gun and send these things to my fiancee asap. Pls help. Thanks in advance.


In addition to the above, you should print and sign a new marriage intent letter and send it to your fiance.

Your fiance should get, if he/she hasn't already:

Police reports from the places she lived for more than 6 months while over age 16.
Birth certificate, divorce certificate and translations of these, if needed.

Fill out the forms for the consulate interview. The forms necessary are probably on the embassy website, they would include the DS 156, DS-156K etc available here: http://travel.state....forms_1342.html

I was checking out the embassy information for Bogota and it said that once you know the embassy has your case, immediately send them via email or fax forms DS-2100 and DS-230 before we even recieve packet 3 in the mail (since you can just download it anyway).

After that, can we immediately start working on the medical exam stuff by just downloading and printing packet 4?? Or is there a specific paper called "the appointment letter" that we have to wait for to proceed? I'm just a little confused on that. It would be great to be able to go ahead and get all of that done if we can.

I don't know specifics about your embassy but I don't think there's an appointment letter. If you can find out the list of doctors from the embassy website you can call one of the doctors and ask for an appointment. I don't know how they handle the fees there, some embassies have you pay the fee at a bank and get the receipt, but that may be for the interview. But you should be able to find out, or even call or email the embassy your question. Good luck!

No not at all, touches are not necessarily good. People get approved without ever being touched. Touches can also lead to an RFE. No news is good news, thats how I see it, especially in the middle stages of the wait.

Yeah thats what I read on some of these posts. Apparently there're different levels of people at the service center, the tier 2s have more knowledge or maybe put in a service request, hopefully to do something for you.

Maybe somebody else here can tell you more, or maybe do a search on here on, 'calling USCIS' or something.

P.S. Or maybe after you talk to the first person and can't tell you anything ask if you can speak to a tier 2.

Hi Everyone,
Well, I received my NOA2 today via email. That's the sweet. The bitter is: on the week of April 4th I sent a letter asking that my petition be withdrawn. My fiancee and I had a big fight and in a moment of stupidity I sent that letter. The following Monday,the 11th, I sent a letter to VSC via fedex overnight asking that my previous letter be canceled and explained why. My fiancee and I have resolved our misunderstanding. So at this point I have no idea if I will be receiving a letter in the near future saying my petition was withdrawn. I guess I'm writing this post to anyone who is having problems with their loved one who is far away and is thinking of sending that withdrawal letter. Take some time to think about it and really make sure you want to send that letter. I'm going to call USCIS tomorrow and ask if my withdrawal letter had been canceled but I really don't think they will be of much help. I guess I'm in limbo now...


Hey, if you already got your NOA2 you might be in luck! Yeah talking to USCIS is like talking to a recording but maybe you can make them understand its urgent that they don't cancel it, and you need to talk to a tier 2 person.

Relationships are hard as it is but the long distance multiplies the misunderstandings and arguments. Hope you get a break on this one, good luck!

So I just received my passport with the k1 visa on it. But I saw that they put my middle name together with my last name. Like given name X.Surname XX

On my previous Visa was like given name XX and Surname X. Why is different now. Do they put it wrong? Or is because of my kind of visa now K1.

Can this cause any problem on the immigration?

I think it could possibly cause a problem, you never know. I would contact your Embassy ASAP, they should correct that.

Hey everyone.

I'm flying out in 8 days (may 1st) and just had a couple questions about the POE experience.

1: is it: Get off plane -> go to customs -> go to interview -> get luggage/meet fiancee

2: if so, how long does it take

I will be landing at San Francisco so anyone who landed there your timescale will be a huge help, but i would also like to hear times from other airports to, just for my own curiosity.

also, if i do have the process right in number 1, how long does your luggage hang around on the conveyor belt thing? does my fiancee need to pick them up?

I don't have experience with it. But I don't believe there is an interview at the POE except for the questions the customs/border guard will ask you on entry.

I think you should have your I-94 form filled out, the card that they gave you on the airplane, also your sealed envelope that you got after your consulate interview, and of course your passport with Visa stamp inside.

As far as your baggage if your baggage is cleared off of the belts, they will store it on the side somewhere. Keep your baggage claim numbers.

Congratulations and yes it throws a slight monkey wrench into things. Since you already got NOA2, you didn't request K2 child visa but the baby does not care about the interview timelines! :lol: Of course the embassy does not expect to have to give you a K2 visa for your baby, but there is no baby as of yet. Yes contact somebody at the embassy and mention its an emrgency and you may be having baby antime now! Good Luck!

I'm confused and I don't know what to answer to this question. Way back 2006 my mom used my checks to her transactions and she never told me that she has a problem and some of the checks bounced because there's no fund on it. One of her clients filed a case against me for issuing my checks without fund. But my mom settled the said problem out of court with her client without the court or lawyer present in 2007. In June 2010 court sent me a warrant of arrest but they didn't arrest me. I went to the court for trial and request to dismiss my case because its already settled. Same year October 2010 the court dismissed my case and now I'm free. Do i have to answer (yes or No) to this question? What should I answer to this question. I really need a professional advice for this. Thank you and more power to this site for helping people like me.


My advice isn't professional advice but the Key Phrases are Were you "arrested or convicted" and I gather none of thos happened. If thats correct the true answer would be NO.

P.S. You have to get police reports for the places you stayed for over 6 months, over age 16. If the police report does not show anything then that settles it.

Wow this is a unusual happy situation! I would contact the embassy ASAP, maybe they can expedite your processing. They must be able to grant Visa for new born baby in case of situations like this. If that doesn't work have your fiance contact his congressman or senator. Good Luck!

No I don't believe so. I never did. I think USCIS just assumes your fiance will be able to go there to do the embassy interview. It is possible that she might want to take proof of her residence to her interview.

That said, I would think it really shouldn't be US embassy concern.

Just a couple examples, scattered through various dates, of each type of evidence is enough. You can black out anything personal. I'm not sure they won't read everything and that would end up taking them more time to process your case. They might have to read it all, to catch red flags.

I haven't dated the check yet.

Is it okay to backdate the check to 04/08/2011 and not date it with 04/25/2011.
I don't want to get an RFE for something as silly as the date on the check.

No problem with dating it with the current date. Just make sure its this year. Somebody on here had the whole packet sent back cause they wrote 2010 on the check.

You're talking about the embassy interview results in AP? It could mean a lot of things like they are skeptical about the relationship etc. There are several posts here or people in AP. Hopefully you're not in that situation, but if you are you may need to get a congressman or senator involved, to find out why they put you on AP. Good Luck!

It still applys, the only difference is that you are not sending it to thos places anymore. Everyone sends it to the new sorting facility in Dallas instead. Its to help save the inbox from backing up in VSC and CSC.


Actually it may not apply they could be using the lockbox to keep the number of petitions that each service center gets balanced. There have been several NOA1s here that didn't go to the service center you would have thought.

As far as I know, yes beneficiaries need an exact copy of the I-129F package. i may be wrong, but it never hurts to be sure. I suppose having a copy will help in reviewing small details that may be asked during the interview. good luck!

For beneficiary:

You want an exact or reasonable copy of the I-129F cause you want to make a good presentation on them, if asked. Original receipts and proof of evidence too.

Don't forget the things you have to do like:

Get police reports for places you lived over 6 months, since age 16.

Birth certificate.

Divorce certificate

translations.

You'll also have to get the medical exam done several days or a week or so before your interview so they will have the results.

I don't know about beneficiary's daughters birth certificate, but probably good to have to prove she is under 18, to be eligible for K-2 visa. I wouldn't take chances on this.

No you may not get a letter but you can call them. There a little hard to get a hold of, I haven't looked up the number recently. Some recent posts on here mention there number.

Sometimes it takes a week or more to get to NVC.

I'm sure somebody here has got the number. Hopefully they'll respond, if not I'll dig it up.

Hi Everyone,
I received the hard copy of my NOA2 a few days ago. The first line said "The above petition has been approved, and forwarded to the listed consulate." There is no mention anywhere on my NOA2 about my petition being sent to NVC. This is my second approved I-129F for a Filpina. The rest of the wording on my NOA2 just explains that because this is my 2nd approved I-129F it has been added to a multiple visa petition database and says that when my fiancee enters the USA we have 90 days to marry. Has anyone else gotten a NOA2 like this?


Yes, there're many posts on here asking that same question. It does go to NVC but usually doesn't stay there for long. Also yes they do list the number of petitions you've had approved, but this is the first time I've seen them talk about a database, so I guess they finally keep track of approved petitions. Congratulations!
