K-1 Fiance(e) Visa Process & ProceduresCertificate of Naturalization for proof of citizenship

Nobody is allowed to make photocopies of a Certificate of Naturalization without authorization. That's why is reads DO NOT PHOTOCOPY.
You, however, are authorized to make a photocopy of your own Certificate for USCIS, as they want you to do just that. They also know that the Certificate is marked with DO NOT PHOTOCOPY, as they put it on there. If it would not show up, they'd know it's a fake.

Not true that was ages ago.

K-1 Fiance(e) Visa Process & ProceduresCertificate of Naturalization for proof of citizenship

I don't know how the newer Certificate of Naturalization looks like now but the one that I have has a note on it saying DO NOT PHOTOCOPY. In the guide for K-1 petitions however it says that a photocopy of a Naturalization Certificate could be submitted for proof of citizenship. Is it ok to copy that now?
Also I'd like to find out if you needed to have anything notarized like cover letters, etc as part of the I-129F package. Thanks.

A photocopy of naturalization certificate is fine now, the rules have changed. Don't send originals of such important documents.

No there's nothing that needs to be notarized for the I-129F.

Good luck!

No, your fiance will need it at the embassy, and valid for travel to the US, for at least 6 months.

K-1 Fiance(e) Visa Process & ProceduresWhich embassy processes the K-1 visa application (Czech Republic)

Well the US Embassy in Prague has responded saying they can request the file from their colleagues. This is positive but I'm sure it's not just a case of Prague phoning London and asking for the details. My guess it has to go back through the NVC, how long this will take God only knows.

London should have received my details a couple of weeks ago, but I have heard nothing from them. Would I be naive to think that they noticed the mistake and sent it back or would they just put it on a pile and think "Not our problem"?

Good to hear, it sounds like they have some process to handle situations like this. Ideally they shouldn't need to send your whole package to NVC, I mean they should have your info electronically and just give you a new case number for Prague. But then we all know government does nothing efficiently.

Its a mess, but at least Prague is trying to straighten it out, it could have been worse all of them could have said "not our problem".

K-1 Fiance(e) Visa Process & ProceduresWhich embassy processes the K-1 visa application (Czech Republic)

Not a huge problem no, but I was reading one post, I think today, saying that they went though the visa process at an embassy in a country where they were not resident (Dublin?) and the interview was cancelled at the last moment when the embassy realised they didn't have jurisdiction.

You are right, I just looked up the Embassy Information here. London only does interviews for residents. Sorry, some embassies, like the one my fiance will be going to doesn't require her to be a resident.

In that case you certainly need to get hold of them, in London to send your package back to NVC. NVC would have to give you a case number for Prague so you can interview there.

Thats terrible they screwed up your case!

K-1 Fiance(e) Visa Process & ProceduresWhich embassy processes the K-1 visa application (Czech Republic)

Fiancée lives with me here in Prague.

I tried to call the NVC (AVR) and they said they could not do anything as the paperwork was with the embassy and I should contact them. Have been unable to contact London and have had no reply from Prague.

Yes I was wondering, like you, whether there was a reason NVC sent it to London, like maybe they may do very few K-1s at Prague?

Would it be a problem for you to do the interview at London? From what I hear London seems to be a quite straight forward embassy to do interviews at. I don't know how long London takes to send out the packet to you and how long since you were told that London has your paperwork.

Maybe other people here can tell you about Londons processing time?

Good Luck!

K-1 Fiance(e) Visa Process & ProceduresWhich embassy processes the K-1 visa application (Czech Republic)

Hi,

I am a British Citizen living in the Czech Republic and have recently had my I-129F approved. On the I-129F petition my address is clearly stated as in the Czech Republic and I put Prague for the embassy where I would apply for my visa. This week I received a letter from the NVC saying the case will be processed in London.

Is this correct due to me being a British Citizen or have they messed up? I can't imagine a British Citizen living in Australia for example being asked to travel to London for their interview.

If they've messed up, do I have to take action to get it fixed or will it fix itself? The Embassy in London seems to be impenetrable when it comes to getting information.

Thanks.

I looked at the Czech embassy reviews here on VJ and there were a couple K1s. That does sound strange that they say it will be processed in London! Did your fiance ask the NVC why they said it will be processed in London? You should get the your fiance to call NVC or if all fails contact his congressman to find out what the deal is.

Good luck!

K-1 Fiance(e) Visa Process & ProceduresBenefactor Name Change 6 years ago... relevant?

If the benefactor had a (first) name change change 6 years ago, should that be indicated anywhere? When we met 6 years ago, she still had a passport and J1 visa for the US under her old first name.
Most of the questions on the I-129F are asking for information within the past 2 years so I'm not sure if it should be included (especially on the G-325A "All Other Names" or perhaps in other forms in the application)
Thanks for any advice!

All other names used is not restricted to a time period. They also want name change document and translation. At the embassy stage, and possibly at USCIS, they would certainly want to know when they are doing name checks on her. For instance you mentioned the J1 visa which she got under her previous name which if they find out was hers but under a different name that you didn't tell them about seems could raise suscpicions.

But I decided that I will do all to be with her and in any case I will be able to say I DID\MADE ALL!

Exactly, distance and/or time can kill. But for me, I was saved from a crazy woman, so I still believe that in the long run whatever happens, happens for the best. Just keep up your good attitude and it'll all turn out best for you!

I asked her to marry me about 3 years ago, she said we can do that only when she is done with her education and that is right!
I hope we can start the process in 2 years, one year to be done with her education and 6 months for work and then about 6 months for the K1 process.

Wish you best of luck there. Actually I've been in a similar frustration such as yours (not quite the same situation) so I feel your pain. I had my first K-1 approved in 2000 but that woman freaked out from the long distance and waiting, and married some local guy.

K-1 Fiance(e) Visa Process & ProceduresIs it an impasse?

Not really the point, but this is what you wrote.

If she is willing to stay in Russia for a couple years, you could make her a business partner which would be her source of income.
This would not help because the income would not continue once they arrived in the USA. Only continuing income is considered.

If you two were to marry there you could file the 1-130 directly with the embassy, that is if they have the DCF option and you could meet the criteria to file for it.
Filing DCF doesn't change the financial qualifications or income issues.

If your business could be done in another country such as in an EU country, like Cyprus, marriage and possibly DCF there have less requirements such as no residency requirement to get married.

Same as above. Doesn't address the primary issue which is financial qualification.

There are people here who clearly understand the process and requirements and actually CAN be helpful. I suggest you read and learn. Eventually, you'll be one of those people who can help. Until then, I encourage you to be sure you understand the actual issue and have confidence you're giving accurate, on point and helpful advice when you participate in the upper visa forums or just wait until those who do have a chance to respond. People's lives and happiness depend on it.

I didn't have to address finances as they were already addressed the petitioner has no money and can't get a co-sponsor. He mentioned how the petitioner does not want to live in Russia.

Oh so I put a bunch of IFs in, what do you expect he's the one who knows his situation not me. You can do all those things, I'm not about to go do all the research about his embassy and all.

What I wanted to do was make him aware of some things he may not have known about so if anything interested him he could look into it.

Since you clearly know the process what useful info did you give him??? Other than you have to depend on your fiance getting in a good job in a year?

Give it a break dude.

Thoughts yes. Helpful? Absolutely not.

Well since his question seemed to be about whether the 2 of them could be together and get married, and NOT necessarily in the US. I told him what I know. Many Russians have made their homes in the EU and/or former S.U. countries. Also since I believe if two people really want to be together they will find a way, so in that context I believe my statements were relevant.

If you didn't find them helpful, thats not my problem.

K-1 Fiance(e) Visa Process & ProceduresIs it an impasse?

Any source of income must continue after the alien immigrates to the US or it won't be considered. Unless the OP will continue to derive income from his business after moving to the US then he won't be able to self-sponsor or contribute to his fiancee's sponsorship as a household member. If his fiancee moves to Russia to work in the OP's business then it's a given she won't be able to continue that job after returning to the US (she must be domiciled in the US in order qualify as a sponsor). Both of those plans sound like non-starters.

Well as he said the parents don't want to Sponsor him at this point, but that may be different after they are married. He also said she will be graduating college so she can get a job in the U.S. after that. Depends on the business, who knows maybe it is possible that some businesses can be done from the US also.

I just gave him some thoughts. They are the ones that have the relationship and business. He also said she does not want to live in Russia, but what if they both could live in a intermediate country, like in the EU. Then in the future they can plan their US strategy.

K-1 Fiance(e) Visa Process & ProceduresIs it an impasse?

Thank you guys, now I see that we still have a chance.
Also I sent an email to US embassy with my problem, soon we will know what they will say.

She is 26 and of course she is going to get a job after college, in a year.
And her family is not poor, her father is a lawyer.
Of course her family is able to be my co-sponsor, but they don't want to :( I guess they don't believe in me because I don't have appropriate education for America.
That is why we try to find a way to be together.

Some other possibilities:

If she is willing to stay in Russia for a couple years, you could make her a business partner which would be her source of income. If you two were to marry there you could file the 1-130 directly with the embassy, that is if they have the DCF option and you could meet the criteria to file for it.

If your business could be done in another country such as in an EU country, like Cyprus, marriage and possibly DCF there have less requirements such as no residency requirement to get married.

Just a thought.

K-1 Fiance(e) Visa Process & ProceduresBeneficiary on Changing Address, pls Help..

Hi Good day!

We are currently waiting for our NOA2, i am currently residing in Cagayan de Oro city, my question is, i wrote in my G-325A the Cagayan de oro address as my current address. Now, i planned to go back and stay in my hometown in Siargao while waiting for NOA2. After the NOA2, my petitioner will receive a letter from NVC, right? Me as a beneficiary, i will only receive an appointment letter or USEM letter, right guys? Since i am using the cagayan address and will move to Siargao, for sure the basis of the embassy in sending the letter is the address that i wrote in my G-325A. What would be the steps or move that me or my fiancee will do? Is there a form in changing a beneficiary address? or he can call the NVC after receiving the NOA2 stating that i am changing my address and that i moved to another place. Any idea guys and infos on what we gonna do? Your kind reply will be appreciated. Thank you and God Bless.

The AR11 form is for changing the aliens address once in the US, and the online form is for changing the petitioners address in the US.

I'm not sure whether the NVC can change it or not. There have been conflicting threads here, one said yes and one said no. What you should do is contact the embassy as soon as they have your case and inform them of your address change cause then the packet will get sent to your old address. Generally the packet tells you the documents you need and forms to fill out and the doctors you have to make appointment with for your medical, several days before the interview, etc. Most of that info is available on the embassy info links at the top of the VJ page.

On the DS Forms for the embassy you will be able to list your new address, and where you intend to live when in the US. Good luck!

K-1 Fiance(e) Visa Process & ProceduresNOA2 confusion

Hi everyone,

So we got our NOA2 hardcopy today (approval was on June 3rd). I decided to call NVC to find out the case number. The first thing that operator did ask was our EAC number, then she asked what exactly does our approval says...... and it says the following: The above petition has been approved, and forwarded to the listed consulate. Basically the operator told me that it is not the final notice of approval (got me really confused there) and told me to call USCIS. I called VSC where I was told that our approval most likely went straight to embassy that was listed on 129f (Moscow). I emailed U.S. Embassy today asking if they received our case (no answer yet). I guess my question is..... how do we get an interview now? Is it something that I need to arrange with embassy or just for me to wait until they pick a date? Thank you for your help VJ community!!!

I would call NVC again, you'll get a different operator, it doesn't sound like she knew what she as talking about. You got the notice with the EAC number and it told you you were approved right. The notice most always say they forwarded it to the consulate but it stops at NVC first.

It doesn't get to NVC right away so you should give it a week or so. Good luck!

K-1 Fiance(e) Visa Process & ProceduresCheck List from Embassy & getting Police check before getting it (Pakistan)

Good Evening Everyone-

I am always trying to think ahead and try to save some time. I was wondering if anyone who is going throught the K-1 Visa process, in Pakistan, or anywere else could share the thngs that were on the check list from the Embassy?

Also, specific to Islamabad, Pakistan, is there a way to request the Police certificate before getting this cheklist requiring it? If so how and where.

Thanks in advance for any infromation. Like everyone else, the wait is killing me and since it is inevitable that we will go through some time on AP I was thinking of how to save time elsewhere.

Best,
Kinda Sad Today Kim

Don't know about Pakistan, but in general you should be able to get your police reports anytime, but you should get it close to your NOA2 so that its not too old. You will also need birth certificate, divorce certificate, translations, medical done early enough before the interview for them to get the results by the time of the interview. You will also need the I-134 affidavit of support and supporting documents from the US fiance. Also evidence of ongoing relationship.

Good luck!

K-1 Fiance(e) Visa Process & ProceduresI-29f Naturalization question help!!

Hi,
I am stuck at question 10. My citizenship was acquired through (check one)
I am naturalized so I put a check on Naturalization and put my certificate info

But after that it asks (after Parents) Have you obtained a certificate under your name?

Well am I suppose to click on "Yes" and again put certificate number under "If 'Yes', give certificate number, date and place it was issued"?
Or Don't do anything (Don't click on yes or no and leave the "If 'Yes', give certificate number, date and place it was issued" blank

Thats the only place I am stuck at :( Thanks

The NATURALIZATION checkbox refers to you having applied and gone through the naturalization process on your own.

The other checkbox is if you were eligible for naturalization certificate cause of your parents.

If you don't get any response from any of them, ask your fiance to contact his congressman, in his district. It seems to be happening more and more that USCIS sends the package to a storage facility instead of NVC. They never own up to the fact that they could have made a mistake until a congressman or senator asks them about it.

I think we just need to make sure her church understands it would be a non-legal wedding ceremony. Nothing would be signed or turned into the government/authorities.
So we would not "be married". It would just be a demonstration of our commitment in front of her family at her church. Then when we get to the US we have a legal wedding.

I don't want to do anything deceptive or that could get us in trouble, but I don't see why this would.

I don't know a whole lot about it, and the whole thought of it makes me nervous.

No I don't mean deceptive, just I've probably read to many freaky interview posts. I would post this question by itself to see what people say and you'll get more thoughts.

Oh man...okay.

Well what about this....

Once the K-1 is approved, I fly to Colombia and we have a non-legal/non-official wedding ceremony in her church. Then together we fly to the USA and have a legal wedding (or say our vows in front of a Justice of the Peace). Is there any problem with that?

Ooh you need to make double sure that in no way does the US interpret this as a legal wedding. If at the interview there's any hint or interpretation that you might possibly be married they could deny you the K1.

Okay, so we could have a "non legal" wedding in her country first, then have a legal wedding when she arrives. That's pretty much what we were wanting to do. Once the K-1 is approved, we wanted to fly to her country for the ceremony in her church, then return to the USA and have a legal/official wedding.

Somebody correct me on this, but I thought you weren't allowed to leave the US until after you get Advanced Parole and working on Adjustment Of Status.

When you first login, you'll see a bunch of blue links, they call it your portfolio. The links are things like your case number, mobile alert, email alert etc. One of them says, last updated date and under that is the date.

But its not very useful cause even if you ever get touched you won't know why. Personally I don't want touches cause they are more likely to be RFEs if its in the later stages of your filing.

Here's an updated form but its not on the official link so I don't really know what it is but if you need to fill it out right away you can fill this one, and the other one. This one doesn't print the barcode but the one on the official link does.

K-1 Fiance(e) Visa Process & ProceduresFiancee Out of Status

I am in no way really knowledgable on this but here's my 2 pennies.

I just took a look at the guide for F-1s at UCLA. http://www.internati.../F1Handbook.pdf

Just as an example:

They do mention that in case of illness or request for leave of absence if you get prior approval from your academic counselor you may not be required to attend.

So it seems it could be possible this is ok. To me it does not sound like a violation and like you said she didn't get flagged for anything. She had a valid visa to be in the country and her school did not report it as a violation of her F-1.

Does any of this apply to you? If you weren't there beyond the dates that you were authorized to leave you're ok.

"Staying Beyond Your Authorized Stay in the USA and Being Out of Visa Status
It is important that you depart the U.S. on or before the last day you are authorized to be in the U.S. on any given trip, based on the specified end date on your Arrival-Departure Record, Form I-94. Information on successfully maintaining your immigration status while a student or exchange visitor can be found on the Immigration and Customs Enforcement (ICE) website. Staying beyond the period of time authorized by the DHS causes you to be out-of-status in the United States, which is a violation of U.S. immigration laws. This may cause you to be ineligible for a visa in the future for return travel to the U.S. Select Classes of Aliens Ineligible to Receive Visas to learn more. Staying unlawfully in the United States beyond the date Customs and Border Protection (CBP) officials have authorized, even by one day, results in your visa being automatically voided, in accordance with immigration law, INA 222(g)."

K-1 Fiance(e) Visa Process & ProceduresFiancee Out of Status

Hello Everyone,

So my situation is a little complicated (bear with me).

I applied for a K1 visa on behalf of my fiancee, and we just received our NOA2 (thank goodness).

While filling out the next set of forms, we realized we could have a serious issue.

The DS 156 form asks "Have you ever violated the terms of a U.S. visa, or been unlawfully present in, or deported from, the United States?"

The issue is this: my fiancee (who used to be a Tanzanian citizen, but is now a Canadian national) used to live in the US, attending university in Albany. She attended university there on an F1 visa, completing two semesters (Summer 1999 and Fall 1999). However, she didn't attend any classes during her third (Spring 2000) semester (health and financial issues prevented her from returning to school). She lived in Albany from January - July 2000 without attending school, and departed voluntarily to Canada (she was granted the Canadian equivalent of a green card, so she left the US).

So the question is this - how do we address the fact that she lived in the US on the strength of an F1 visa, but didn't attend classes? Can this pose a significant issue as we move forward in her application process?

Interestingly, she didn't return to the US until November 2000 (so 3+ years after she voluntarily left the US), and was issued a tourist visa without issue. In fact, she has continued to travel between Canada and the US without any issues, which makes me think they haven't "flagged" her for anything.

Has anyone else encountered something similar? Any advice would be greatly appreciated.

Thanks.
