The go home every three months is a sign of temporary status and not residency....


Like the OP said its required by Italy, I'm guessing that Romania is not a EU country, and so she does not have an EU passport.

But its the US embassy that decides whether she is legal enough to interview there, not Italian rules on whether she has to return once in a while.

Only thing not all embassies require legal residency, such as Cyprus. The thing is the EU countries these days allow residents of other European countries to work and reside there. So they are there legally.

That makes it a little confusing. She could definitely interview in Bucharest Romania, but I can't tell you for certain about the Italian embassy.

Maybe you should try to call them and see if they will let her interview there. I mean I would say they should let her but ...

Were you planning to put in her address in Romania, I didn't think there was even a place for that on the I-129F? Are you talking about her address abroad as her parents address in Romania? Sort of confused me there, or maybe you are taking about the G-325A. You don't have to list her address in Romania, except maybe on the G-325A where it asks her last 5 years of residence. For the interview she'll probably need policice reports from Italy and Romania. I think on the G325A they talk about the last address abroad but on that form they talk about abroad as outside the US.

1. I am an active duty soldier stationed in Italy. My fiance is a Romanian citizen residing in Italy. We live in the same city, and see each other every day. I am petitioning for her K1 visa. Can we go to Napoli to get the medical exams and do her interview, since it is closest to where she resides, or does we need to go to Bucarest?

2. On which form, and to which address will USCIS be sending me my receipt? I put my APO address in PART C, Question #1, of form I-129F, and my home address in the states in Part A, Question #2. At which address will USCIS be corresponding with me? To which address will they be corresponding with her? She doesn't have a mailing address in Italy, but receives packages through my APO address.

3. Does anyone have any experience with this?


Yes she can interview there as long as she is a resident there and has an address there where she can get her mail. I had been approved for my fiance in the past and am reapplying for her now and she resides in Cyprus but is from Latvia.

My fiance was in canada for 13month during her college year. Is criminal record check a mandatory document? Does anyone know how long the process takes to apply for a criminal record check from canada?


Congratulations on your NOA2! Yes police reports from all places that your fiance lived since age 16, over 6 months, outside of the US, are required for the interview.

I have no idea of the process for getting it though from wherever she was in Canada. Somebody else should be able to tell you.

Anyone on this site who's been holding a classified position and going through the K-1? Do those things get along together, considering foreign influence..? About a year ago, prior to being introduced to my fiancé, I applied for some job. I hadn't heard from them until yesterday. Almost forgot to think about it. They called me and asked about my availability for a whole-day interview (a pre-step) They also emailed me a GB of instructions & procedures (aren't quite that simple: ts/q clearance, ssbi as part of it, and may include a ci poly)


Don't know about a Top Secret clearance but I had to get a public trust clearance for my job and I had to list the countries I went to and I forget exactly but I think I had to mention my fiance but it didn't cause a problem at all.

But for sure holding a clearance doesn't seem to speed up the K1 process at all. Good luck,

I have been living in Mexico on a tourist visa with my Mexican Fiance and going back to the U.S. to renew it. When starting the I-129F package I asked my attorney if I need to prove income or if I can't do I need to have someone to sign off and say the will support me and my Mexican Fiance.. she told us no. I see things here and there that say I do need to show. I don't work, nor have I ever had a job. My fiance who I am filing for supports me.
Do I need to show income? If so when do I show it, when the package is sent it or at interview? How do I show it..

Yes the USC petitioner has to show income, 1.25% of poverty level in the US, or have a co-sponsor who will guarantee to support you both. Good luck!

P.S. You show it using the I-134 affidavit of support and supporting documentation. In your case you will also need the co-sponsor to fill out a I-134

So my friend is heading back to Japan after entering the country on a K1 Visa. Her and her fiance broke up and will not be getting married. She wanted me to find out something for her though.

After she returns to Japan obviously she can't return on her K1 Visa. I know this, but wanted to ask about her returning to the US for tourism or school.

Do people ever have problems coming back into the US after having a K1 visa? She doesn't intend to use the K1 visa again but will she be have any problems when she comes back to the US to visit or go to school?

My wife says she read some blogs that had experiences of those in similar situations being rejected because they had an ex-fiance/e in the country (possibly because they were worried about her getting married illegally?). So I wanted to check and make sure because I had just assumed that there would be no problem whatsoever.

Only thing I can imagine is that when applying for a Visa into the US you are asked about prior entries into the US. If she can show ties to her country enough to need to go back and not a flight risk into America then she would have much better chances of getting a visa. Otherwise I guess she would need an immigrant Visa and have to go through those requirements.

If somebody were to file a K-1 petition for her again, I don't think that would be a problem.

Yes 6 months+, and so if you figure Visa by end of September, then you have exactly 6 months before expiration. So if they'll renew for you pretty quickly then it might be worth renewing, but make sure you get it back before your interview. You're asked for your passport expiration date and info on one of the, I believe, DS-156 form for the interview, the decisions up to you cause you'll need to fill the form out and whether you can live with putting this expiration date on it. My fiance' had his interview in Copenhagen on June 23. They refused his visa because they want more documentation relating to a diagnosis of schizophrenia made several years ago. The diagnosis was apparently incorrect -- I knew him through that whole period, and reviewing the situation a few years ago we believe it was more likely a depression brought about by some extremely stressful circumstances that was then improperly medicated -- we have evidence between his medical records and our chat logs that he did not start hallucinating until after they gave him medication, and the diagnosis was clearly made on the basis of his hallucinations. The medications he was on affected his mind such that it prevented him from putting that together until much later.

Unfortunately, he's effectively considered crazy until proven sane. Fortunately while he was visiting for six months last year he decided to see a psychiatrist here, who supervised his coming off of medication and agrees that, even if he may have possibly needed medication several years ago (he can't say because he didn't see him then), he certainly doesn't need it now and shows no signs of schizophrenia or any other potentially dangerous mental health condition.

The consulate said if he provided a letter from the psychiatrist he saw last summer, they would reconsider. We obtained the letter and submitted it to them almost 2 weeks ago. They acknowledge they got it, and we know they have contacted his other physicians. I am trying to be positive, but it's hard. His psychiatrist in Denmark doesn't speak Danish well (she's Ukrainian) and many of her notes in his record (what few there are -- six years in the system and his whole file is less than a cm thick) are nonsensical, largely due to her poor Danish. It's hard to say what she would say if contacted, and it worries me because she logically would be more interested in defending her diagnosis and treatment than admitting she may have made translation mistakes.

Anyway, I just needed to vent a bit. I'm anxious and frustrated, but I'm sure it will all be okay in the end.

We have been dating for about 5 years and engaged on 10/10/10. We are getting closer to our interview date in Costa Rica. I plan to fly down there and be there - I hear that helps the process go smoothly. But I have read a few threads in the forums where people have mentioned that they were the only ones to get approved that day, or they saw a lot of people getting denied, or that K1 (fiancee) visas are not as reliable as K3 (spouse) visas.

So now I am worried about getting denied - as it will be a crushing blow to both of us. Not only because we love each other and have been anticipating being together for so long, But also because of certain realities. She has already put in her notice at a job she loves (they want a long notice to enable you to get your severance package). And I am a single dad working full time trying to make ends meet, keep the house, etc. and having a 'normal' family again would bring balance back to all three of our lives.

So I am getting a case of 'the worries'. And the only cure I know is knowledge and facts.

Please tell me any reasons you have been denied or saw someone denied (if you really know the info) at the interview stage. We will be in Costa Rica, but I think this info would be helpful for anyone facing an interview so we can learn what NOT to do.

On a related note - if we are denied, do we have to start over from scratch? I-129F and all the waiting again? Or are there instances where they will let us come back with some missing info/document/correction and pick up where we left off?

So far everything has gone smoothly. We have not gotten any RFE's or anything like that. She came to visit in December and I was there in October of last year. I don't want to fumble on the 5 yard line. Are there any statistics for how many are rejected?

Thanks for any info to calm my fears and teach me what not to do and pitfalls to avoid. I am getting anxious for us to get married and make a family all under one roof.


Major reasons could include, among others:

They don't believe you have a real relationship, i.e. attempt to get in the US by faking it and that could be by one person or collaboration between both.

Major infectious disease or psychotic behavior that could pose a danger.

Some sort of criminal or violent activity, sexual abuse etc, or matching in the background check databases.

Not enough income to support the beneficiary in the US.

Your engagement or religious ceremony looks too much like you are already married.

If you are denied and you find out why and/or they ask for evidence you can get the decision reversed, but not in all cases. But you might have to get senators/congreesmen involved.

One other question. She got the police certificates from all of the provinces she's lived in. Does she need some sort of national certificate?


As long as she is a legal resident there she can interview there, so I don't know whatever is required there to show she is legal maybe a passport. She should have a passport that is good for at least 6 months for travel to the US. About the medical, make sure you do it eary enough before the interview to have the results ready at the interview.

Our petition was approved April 4th, and the NVC notified us they sent out our petition to Argentina in a letter dated April 22nd. We still havent received the packet to send back to the embassy. I called the embassy through the 800 number and the international number, they refused to forward our calls to persons who could help. I called the NVC they refused to look into it. This was all before the second week in June. I emailed the embassy again June 30th to see if we could download the forms they require from their website, also ignored. I emailed my house representative, no one contacted me.

Fastforward to today. I found out that some overpaid immigration or State department official didnt correctly input her address. They left off her unit number and the postal code. Now the Visa office at the State department says, well if they dont contact you (embassy) then contact your congressperson. Well I did that before today and they didnt contact me back.

So my question of help is, does anyone here have any suggestions or been in this situation. I have no idea of what else to do. All else I can think to do is to just send the downloaded forms from the embassy website even though they havent been requested yet. Any suggestions, or contacts in the State department that could help.

I'm probably just spazzing out :) But I was going through our evidence, getting all the emails and phone logs together. I'm a little worried because for the last 4 months my fiance hasn't had regular email access. In Cuba access to email and the internet can be difficult. We are exchanging about 4 emails a week right now (2 from him and 2 from me), I call 2 or 3 times a week (again this is expensive so I can't call more) and text messages. I have some old chat logs and extensive emails from when he had internet in his home.

We are trying really hard to get him an email or internet connection at home.

I would assume that the embassy will understand that few people in Cuba have the internet and therefore can't use skype and chat as much as people in other countries. I just get worried when other people on here talk about their 2,000 emails and 25 pounds of chat logs :blink:

What are people's experiences with this. I have about 500 emails right now plus some old facebook chat logs. I'm freaking out over nothing right :unsure:


I think you are fine, as long as you converse with each other. We don't communicate much at all using the internet, mostly by phone through a calling card that has a list of our calls. Even snail mail letters are good and also the envelope stamps.

A friend of mine called and was in tears because her fiance was denied visa at Laos embassy interview. The decision papers arrived last week. Apparently, she (petitioner) did not make money enough above the poverty guild line (<$15,000). She consulted immigration lawyer today and was told "only married beneficiary alien can have a co-sponsor as of May 2011".

I looked on instructions for both i-129f and i-134 (5/25/11 revisions) and there is no mention of such claim.

Can anyone rebuke this claim with a link? or is this indeed true??

Yes you are right, you have 6 months to go to the US and then 3 months to marry once you enter the US.

You have to wonder though, there really should be some sort of extension allowed in the case that he couldn't return home a couple months later than March, because of military deployment. But government doesn't always do what makes sense.

You're talking about passport photos not your relationship photos right?

Passport photos no, you are done with them for now. Your fiance will need to make some of hers for the medical and interview.

Does your fiance have duplicates of relationship photos cause the interview is the time to show off your relationship.

I'll tell you my experience with this, my current fiance didn't do the interview in 2007 and 4 years later we are going through this process again. Morale of the story think about it before you make a decision based on how you feel at the moment.

In my case I went over there when I found out she didn't do the interview contacted the embassy again and had them reschedule the interview. I begged her to do the interview but found out she'd already done things to avoid coming to America and contacted the embassy and told them she wasn't going to do the interview at this point in time but maybe in the future.

So I guess there's always a chance that if he really loves you, he will find a way to make it work later. But if you really don't love each other then the long distance Visa process and relationship hassles is not worth it.

By the way, the beneficiary has no obligation and it won't affect you one way or another if you don't bother to go to the interview.

The petitioner only needs to prove he/she is a US Citizen. That may of may not require a birth certifificate. A naturalization certificate and/or passport page would work just as well.

There's no way I would send my Original naturalization certificate to USCIS, consulate or my fiance for her interview so a copy better be just fine!

Amigos,

Has anyone ever had their documents not show up at NVC after having been approved (NOA2) at USCIS? The folks at NVC have asked for my NOA2 evidence because were in the fourth week now since approval at USCIS and we're not in the system.

I am wondering if a) this has happened to you; and b) how long it took to solve the problem? Did they contact you and say, "hey, we found it" or did they just forward it on?

This is all the more disappointing because we had made good progress with USCIS, getting our NOA 1&2 in just 80 days.

In 2007 my NOA2 was stored in an 'offsite storage facility' instead of being sent to NVC. I found out after contacting my congressman. USCIS finally sent me a new NOA2, and I got a letter from the VSC director explaining where it was stored and case number letter from NVC. I imagine getting the letter from the VSC director was because of my congressman. That was probably 2 months after the inital NOA2.

That being said I think you should wait at least another 3 weeks or so cause you may still get the case number from NVC. Good luck.

Hi VJ members please help me with this issue. if you petition for K1 for your fiance and in the course of the processing the beneficiary wins DV Lottery can she/he abandon the K1 and follow the Lottery?


Make sure its the real thing and not a fraud, cause the DOS site has fraud warnings on that. Also I think they should make sure they meet all the requirements for the immigrant Visa before abandoning the K1.

K-1 Fiance(e) Visa Process & ProceduresRFE Finished, but a little concern

Well I got my RFE finished. Passport copied, airline ticket reciepts and iternerary, boarding passes, and more pics. My concern is about the pictures. The instructions say that film-dated photos are needed as secondary evidence, but my camera did/does not do that!!! I had to write the date, people and place on the back of each photo. The pictures were saved by date in my camera, but the camera doesn't print it.

I have all the primary evidence sumbitted, but the secondard (due to the date on the pics) may not be 100%

Should I be worried?

I think you will be fine, not everybodys cameras date the pictures and they tend to believe you with the dates that you put on the back. The real key is that all the evidence fit together with your story and dates.

For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

congratulations to both of you:-) we received ours on july 26 from Vermont Service Center as well.
However, ours read this" "the above petition has been approved.and forwarded to the listed consulate. HUH?

There was NO listed consulate! When i finally reached a Human being at the Vermont Center, she said that the K 1's
do not need to go the the National Visa Center and that they go directly to the Conulate? I posted about it here and was told NO, all petitions go to the NVC.

So, where is my petition? At the NVC or on its way To China, GUZ? I would feel so much better if they actually had listed a Consulate, like the document stated.

I am a nurse and if I would run my unit the way they run this process, I would have lost my licencse years ago!"=_

It can easily take two weeks to a month to get to NVC. The operators just tell you that whatevers on your NOA2 is correct. But thats not true they are just canned outdated letters. It'll make it to NVC, good luck.

Yeah, I got the letter in the mail that it was approved approx June 8th, adn he was scheduled to come here June 22nd, so I got everything I needed together for the I134 etc and had that all ready for him.. no point in mailing it since he was going to be here in the US anyway, but he's been back since July 14th and yes, got hte fingerprints done and his passport updated already, but he travels for work..he is away from Sydney most week days and never has any idea where they are going to be and what days until a day or two to a week in advance, so it's been tough getting all of that done. I'm not sure why he waited so long to call to make an appt for the medical, but he did.. can't change that now.. but that is the only thing pending before mailing in packet 3. but either way, it looks like its going to be cutting it close by the time they schedule the interview, because since it will be so close, we KNOW it will be scheduled for 5 weeks out.. haha! I think we should def get an extension. better than starting from square one all over again. Any idea on how to get the extension?? Thanks!! Jenn


As long as you are in touch with the embassy you are fine. They will automatically extend it for you if the know you are woking on it and still planning to interview. Good luck.

Hi guys, I wanted to ask a question that I just can't find the answer to through google, idk maybe I'm just bad at looking or haven't looked thoroughly. And yes, this is my first post, but I've long been a "stalker" on the forums.


Question:

I plan to file for the K1, to bring my fiance. But I'm currently unemployed, I have no resume of past work, because until now I've been a student. I cannot find an hourly job, I've applied everywhere. I'm worried about putting 'None' on the G-325A "Applicant's employment last five years", and not providing MY (the main) affidavit of support on the I-134.


I could put my close friend as a co-sponsor, she earns around $180,000 a year, which is way more than the federal poverty line of $15k or so. I DO intend to work, and I AM actively seeking a job, I'm not disabled, but worried if I don't provide the main I-134 they will deny the case at the consulate on the interview date, specially when they see no work history (I was a student).


Please, I beg, if someone could help me, or someone that has gone through similar events of unemployment, but provided a co-sponsor. I can provide 2 con-sponsors, each earning more than $150k+ a year, but I don't know if that will do if I don't provide the main one, which is my earnings. I'm not disabled, I'm young, and plan to work, I just can't find a job and I don't know how long this will last.

Thank you all, if you take the time to read this and respond. Sometimes I get depress and lose all hope and even start crying when I start worrying about this.... :(


Hi first every embassy is different, so you need to find out if Cuba accepts co-sponsors. I imagine it does but can't say for sure. your co sponsor and you will both have to fill out the I-134 with supporting documents like employer letter, tax transcripts and 3 pay stubs.

If they accept co-sponsors they will not reject your case, for not being employed. Other than that I've never had a co-sponsor so I can't tell you anything more. Good luck.

this is probably a dumb and obvious question ( I just want to be completly sure if I am right or not) but me and my fiance just filed for our k-1 visa recently to VSC. we got our hardcopy of our noa1 and the service centre notified us that they got our I-129F July 15/2011. I looked on the USCIS site and made an account to check our case status and it says our case was last updated July 20/2011 and nothing since. I just want to know, was this a "touch"?


Yes thats a touch, most people only get them when its first entered into the system, and when it gets approved. If the touch is in the middle its probably an RFE and that happened in my case.

K-1 Fiance(e) Visa Process & ProceduresPrevious petitions - how much of a red flag?

Some of the responses to Sannybel's thread about the rejection in the Dominican Republic got me wondering, how much of a red flag is a previous K-1 petition?

In my case, I petition for my then Canadian fiance in 1998; the K-1 was accepted and we went through the AOS process with no issues (and it was much quicker). The marriage ended in divorce in 2007. There were no children. She did not become a citizen, but as far as I know, still resides in the US as an LPR.

How much of a liability will this be for the petition I just filed? This was 13 years ago after all.


Its not a problem at all.

As far as only being able file 2 K-1 petitions, absolutely not true. If you go beyond two you just have to file for a waiver request on IMBRA filing limitations.

I just received the NOA2 approval letter and I am happy about that, but I am now more confused than ever.
It says,"The above petition has been approved, and forwarded to the listed consulate". The consulate is the
Bangkok US Embassy. Why did it not go to the NVC? How do we get a case number? I thought all fiance visa
approvals go to the NVC and then a case number is assigned. Then NVC sends it to the embassy. Has anyone else
had this happen? I have no idea what to do next. I called uscis and they just said, "your petition has been
approved and it is no longer in our system". USCIS could not give me any answers. I called the NVC to ask them
if this was normal and they said, "no, normally we get the case from uscis". They had no answer for me either.
Can anyone give me some information on what we should do? Thank you!!!


Its a canned letter so many of us get that. It stops at NVC and then goes to the embassy. It can take 2 to 4 weeks to get to NVC. USCIS never ever mentions NVC.
