About the repetitiveness of the G-Form, if I remember it correctly, "back in the days" where we didn't have the internet, didn't have Visa Journey, and didn't have PDF fillable-form, the INS (yup, no the USCIS) will give you a G-form with all four pages carbon-copy style. So where you fill out the form on the first page, it will carbon-copy the information down to the 2nd, 3rd and 4th page, include your Signature. That's why it was never an issue for those older folks to forget signing all 4 pages :)

If I remember correctly... someone confirm... :D

About the photos: Echoing everyone - write the date when it was taken, approximation is ok, make sure your beneficiary can explain to them later when/where/who/what/why/how that picture to come about. They want to see your love story and that is one of the evidence where they try to piece your story together. No worry OK! :) You will get aproved. Can you feel the POWER of VJ Love? :thumbs:

Hi Slings,

You've been here long enough, I guess you have spent sometime and read the FAQ's plus the GUIDES. Please and I mean, please, read up my friend. People feel a little bit insult if you come on this board and ask for "QUICK and FAST" way to bring your love here with you. Because, in reality is, once you start this process with a lawyer or yourself, you will see how long and slow it can gets, it's a test of your patient. Everyone was or is or will be going through the SAME lengthy process through various sections of the USCIS and Consulate before they get the approval and Visa. So this is just a quick "hint hint" :) People are on edges here :) just like you will be soon :)

To answer your question and echo many: There is no QUICK and EASY way, left alone having a "WEBSITE" to do your work for you. Lawyer is great resource for consultation if your case is complicate and involve criminal records or countries which declared by the President as terrorist states. Otherwise, VJ is a good start and consider by many as "one of the most responsive and informative" immigrant forum (IMHO)

It depends!

You can check with your fiance's specific Cons. office. I know Vietnam wants 3 years Tax! something they don't!

The big picture you need to see here is: To get approved, you need to show them you two have solid relationship, genuine love, finanically stable RIGHT NOW and in the foreseen future (a year from now) etc. How are you going to prove that? What is your game plan to prove it?

ITR (Income Tax Return) is only a part of this whole picture! Don't be discourage! An example I often use is: There is a Medical student who has not made any money for the past 5 years, just study and does his residency. However this med student will graduate next year and will be making 6 figures income in the coming years. Would the Cons. Office will fail him because he didn't make any money for the past 5 years, or file tax return or what not! I doubt it, but it could happen.

The bottom line is each case will be examined and invaluated to the specific case/situation. Relax and collect your evidences first OK!

You should count your blessing and make the trip. It only helps strengthening your relationship with him than not. The speed of approval in VT is known, they are pretty good! However, the big time waster is the Consulate's interview. I don't know how bad it is with marriage frauds in the Philipines, but in Vietnam it's pretty bad and that causes so much delay and denies for the vietnamese petitioners.

Keep in mind, any lawyer who advertises their 100% SUCCESSFUL RATE, is only telling you their successful rate of approval NOA2 which I would say: everyone on this board who didn't use a lawyer get an NOA2 pretty soon after they file, especially if they file through VSC. hehehehehe... so do not mistaken with the ADS from these lawyers.... Your ultimate goal is getting the Visa in the fiance's passport!

To answer your question: It depends! I notice people who have criminal background or prior immigration issues will and I mean they WILL need a lawyer to sort things out and file the neccessary waivers and what not. Speeding things up? YEAH, speeding it up to where 90% of the folks who have no questionable backgrounds or immigration troubles, meaning it will speed you up to where the "normal" joe may be! AND then you can wait like the rest of jones :)

Lawyer will give you a peace of mind, knowing they suppose to know everything is pretty comforting feeling then you start reading more and more information on Visa Journey which is the most up to date (90%) hahaha and it scares the ####### out of you... thinking... OH MY, i don't think my lawyer is aware of this new changes at the consulate/embassy where my case is sitting.

Bottom line is, ask yourself: Do have the money and time to do this for my fiance/love/wife/husband? If you say YES and NO then hire a lawyer! If you say No and Yes, then you can start downloading the PDF forms from this site and come back with questions... I am 100% someone on this board will be more than happy to get you started... FYI: read the FAQ's and Guides first before post your questions!

Good luck and I did have a lawyer, nothing to complain and was happy with the level of service was provided.

The police clearance requirement is the huge issue and USCIS requires that piece of paper for a very good reason: to track any criminal and ban them from entering our country. Not saying your fiance is a criminal, but I do nothing he can get around that "illegal immigrant" issue. Do you know if he can obtain a PC from St. Maarten police dept? Does he register to pay tax or have a driver license or some type of ID? It would be hard for the PD to clear someone who is not shown in the system as resident or what not. I really hope they let it go and give him the PC. Only then you might have a chance!

However, if someone can tell me how the OP's beneficiary will come clean with the US Embassy and get Visa approval given that he "will" tell them he was living in St. Maarten "illegally" for 10 years? That's the part I say we have no control of it. The officer at the embassy may or may not ignore that fact and issue him a visa. As meauxna mentions earlier, I think these countries are pretty lax with their citizenship and therefore the US would be easy on their citizens as well? I could be wrong! So, as people already said, get a good lawyer, who knows how to deal with cases have specific characters as yours.

My fiance is not Chinese. He is a refugee who carries citizenship papers from the Tibetan governtment in exile. He lives in India in one of the two areas Nehru gave to the Tibetans in 1959 when the Dalai Lama fled Tibet. And, incidentally, the USCIS and the Embassy both accepted "Tibet" as his country on all forms.

But I appreciate your two cents and your concern for my visa process.

One thing I know if you plan to have a wedding in Vietnam by a church official (priest, pastor, rev.) you MUST have a Marriage Certificate. Vietnam Government will not allow, will withdraw the Priest's license, and shut-down your wedding ceremony/reception (local POLICE) IF you did have a wedding ceremony/reception performs by a PRIEST or PASTOR. The priest and pastor himself will be put in prison for ILLEGALLY perform an UNREGISTERED wedding ceremony. The local police and city police will invite everyone back to the local station for some VC style of questioning method. That's the reason why the Priest/Pastor you mentioned would not do the Wedding for you.

I personally experienced this issue when Kim's pastor kindly refuse to perform even the "religious" wedding ceremony for us back in 2004 at her Church for this very reason: No marriage certificate, no wedding.

I'm echoing many members here: go back in Feb first and talk it over with your honey and the family (hers and yours). Maybe they can change their schedule which something they have control over, but not you and the USCIS' process. You do not have control over the USCIS' time table. I hope this helps, since I've gotten a bit confused to where you stand on the issue by now...

Used Lawyer: It depends! How complicated your case/situation? Yes people use lawyer various reason, majority of VJ people don't until their case get stucked somewhere in the process.

Better to use an attorney: It depends! Money, level of comfort, too lazy to fill out a few forms and post 1000's questions on VJ, then YES, it's better to have a lawyer. I personally had an immigration attorney who filled our forms for us, because I didn't find VJ after I sent in my I-129F. So, it WAS better for me at the time. For you: I don't see how it is better when you already found VJ :)

Faster to use a lawyer: compare to what? I would say 99% of the people with simple cases will say: NO WAY. People with "issue" would say: using a lawyer to guide them through the legal trail was the best idea.

My vote: no lawyer, when you already got Visa Journey. Unless your fiance is in trouble with the Laws.

You mentioned, your last K-1 never got married? Did she return to Thailand? USCIS and State Department may ask you where your EX-Beneficiary is now. Just to make sure you have an answer and backup evidence.

we want to get married, before having met. we want to meet each other before asking K1 coz it is a condition.

But they say it is a visa fraud, coz i will go to usa, as tourist ( so no visa) knowing i will get married with a US citizen later


1st of all, you have never been together.

2nd of all, you want to meet her, find out if you are really meant to be together, then marry her.

3rd of all, you want to marry her, before having met. (?)

4th of all, you will come as a tourist, but have all intentions to marry beforehand.

Have you ever considered having her move to France instead?


The issue doesn't seem be as complicated as you listed here... no 1st or 2nd or but... OP wants to make sure he does it LEGALLY. Moving to France is not even an option to consider at this point. There is no problem in my view. There are tons of folks on this forum knowingly and intentionally abuse the VWP to enter the US then get married then file for AOS. So what! OP only wants to MEET his girlfriend.

OP, come to the US and meet your honey. Visit our great country. Then go back to France, start your K-1 process with your honey (the USC). never look back or "what-if-fing" :D Good luck!

Similar case I saw on Vietnam side of this forum. USC and Beneficiary are about to have a baby. Beneficiary came for the interview, was denied of K-1 Visa. HCM Consulate sent beneficiary away, telling her to go and have the baby, file for US Citizenship or Birth Certificate as US Citizen for her child first. Then return for more instruction. Possibly have to switch her Visa application to K-3, spousal Visa.

You may email the consulate/embassy for more detail/requirement.

The letter of intent is A-OK!

Your fiance is smart! He makes sure this letter covers all involved parties (US Consulate in France and US government)

Don't get stucked with the little thing... need to see the big picture of why you're applying for the I-129F and what is the requirement? One of the major factor in decision making and satisfy USCIS requirement for approval is: YOU MUST MEET YOUR FIANCE AT LEAST ONCE IN THE LAST 2 YEARS. With that in mind, you and your USC will put your "Story" together in the form of a I-129F application :) packed with proof and evidence that may show USCIS you and him WERE somewhere in France. One picture of you two together would be enough, more is better. BUT the point being, you two met and now you can file for I-129F. All other evidences are supporting your claim: WE MET!

did you expidite your case yet? why not try first and let us know how that works out for you. General rule of thumb as most have responded here: must have a very convincing and undeniable proof to back up your story and answer the 1 million dollars question by the US Embassy in Casa: "WHY SHOULD WE EXPIDITE YOUR VISA APPLICATION WHEN THE 1000'S OF OTHERS ARE WAITING THEIR TURN"

With this in mind, let's put together a good story and try it out...everything is possible, just because the chance is slim, doesn't mean it can't happen.

Age for marriage: check with your state law. I know in PA it's 18 yrs old to apply for Marriage License.

I know I did... here is what you should do, post all your K-1 related issues in K-1 Forum, then Consulate forum after you get your NOA2. Some of the forum is very specific to the people in each region, like some of them here are from southeast asia and AU. I'm a little bit confused, are you the poster is a beneficiary? Your husband/wife is USC?

If you're here already, why would you want to file for K-1? Why don't you go for the AOS after marriage? Sorry for the confusion if there is any...

The question is: Who is this Check for? USCIS? Is this the check you are paying for your I-129F? If YES, then sure, you will have a HUGE problem for it is VOIDED as you mentioned. USCIS can not cash a VOIDED check... nor anyone!

BUT

If the "check" you describe in this post is a "photocopy" of the actual check, or a digital scan copy of the REAL check, which you have for your record, then the answer is "who cares". If this is part of your "supportive evidence" package for the up and coming Visa Interview, then also no problem!
