Asia: East and PacificTravel with Infant
When travel to VN, what do you bring along when you have an infant or 12 months old baby?
Stroller? full-size or compact?
Helmet for baby? If yes, where can you get one? I haven't checked BRU, will do soon.
Anyone travel around Saigon with a baby on a honda? How that went for you?
Taxi is a prefered choice, but if you need to run from place to place without 1-2 miles radius... taxi could be very expensive and unpassible if you live in downtown Saigon as we do.

All suggestions are welcome, ideas will appreciated.

If you read the success stories where CO just laugh and smile at the interviewee and hand out pink slips (Visa approval) like candies... then you may also wonder why is that?

Each Consulate is different, so is each C.O., that is because each case is unique!
But I wouldn't be relaxing just because you're not going through HCMC, C.O. may or may not look at your case as deep as he should. Just prepare for the worse and hope for the best.

Asia: East and PacificGood lawyer in Hcmc?
Hi Tom and Hao,

Retain an attorney's service is a personal choice at this early stage of the journey. With the helps from JV, one could easily complete the filiing by oneself. Many of us have done so all the way through the end. We do have a good support base of knowledgeable members who currently helping and assisting others members who are going through this very same journey.

I would def. get a lawyer if:
1. I was divorced a few times
2. Once married and petitioned for an alien to immigrate to the US
3. Case was denied
4. Refiling new case/petition
5. Criminal background isn't clean as I wish It could be

If nothing out of the ordinary, you should be able to handle HCMC without too much heartache and pains smile.gif

However, don't get me wrong, I do believe in lawyer when I feel and know absolutely sure that I need one.

They can easy up a lot of troubles for the inexperience.

Good luck,
Chuck and Kim

Hi,

Our interview was on 4/20/2009 in HCMC. She fail and only got sheet of paper talking about Section 221.
They didn't give her pink, blue or white slip. Some of her family members live in same city has me,
they told me besides getting white sheet of paper, they also got a blue slip. She didn't get any type
of slip... Just kinda strange...

But they did set up another interview on 5/20/2009.

I have heard that they will not ask her any more questions sense she was already been interview
in first round.

Also, our lawyer said they have failed 99% over in HCMC now....

So, im looking for others that may have failed first round, but passed second round.
I would like to here you comments.

Thanks
Christopher

all CO had 1 year learning experienced Vietnamese before appointing to that job, so basically their vietnamese are limited, not able to hold a conversation.

or they are able but choose not to speak in Vietnamese. Maybe they just want to make sure you are not slipping up some secrets you hold, in vietnamese? Or they choose to test your ability to communicate affectively with your S.O. (USC or VNC) in English.

I haven't seen much of the "English-Vietnamese Conversational Video Tape" request from HCMC for a while now... But back in my days, they asked people to speak in either English/Vietnamese to prove the petitional and beneficiary actually communicate and understand each other, using Video Tape,DVD recordings.

C.O. speak/write/read/hear Vietnamese VERY WELL. Do not by any mean underestimate your C.O.!!!!

Well,

Understand, this Med-Exam will have the fiancee stripped down to her underwears and bras. Check every inch of her body for red spots, rashes. Then drink a cough solution which will make her cough for days afterward.

Cho Ray - some have experience flat out lies to extort for money.
IOM - Professionally done. My wife went in, got everything done. No issue. So what, you need to go to a different location for shots. I like to know that my wife got treated with respect and as a human being and receiving the service that she PAYS for, not asking for a damn FAVOR (as you would when you come Cho Ray).

But it sounds like you want to try Cho Ray because it's all in one package deal? Then go! Do let us know how it turn out OK.

Asia: East and PacificViet translations of documents no longer needed?
True! No more translation! However, my suggestion to you and your wife is to translate and notarized ALL official documents related to you and her. Here is why, once you are here in the US, guess what you have to do? AOS (Adjustment of Status) to get her Green Card. Guess again, how many District Officer in America knows Vietnamese? Zero to None! So, showing up in America with a bunch of documents in brownish looking paper from Vietnam, in Vietnamese is quite useless it seems to me.

I personally have everything translated and notarized by "S? T? Pháp" in HCMC: college degree, highschool diplomat, National ID card, Family Book, Birth Certificate (10 copies). For you will need these documents in America, for various reasons you will find out later. Doesn't cost you much in VN to get it done, but here, it will cost you somewhere from $50-$100 to have them translated, certified and notarized ect. by a professional service.

My thought, just want to share with you
Good luck

Asia: East and Pacificin Vietnam: please help
First thing first, where is your timeline?
In my opinion, you can have income of ZERO dollar the year before you graduate from Medical School and will be a doctor the 1st of January 2008, before the interview date is 100% Better than someone with co-sponsor and make right around poverty guideline income.

Doesn't mean you should show up for the interview empty handed but you need to understand the C.O. does NOT just look at $16,000USD/yr income and some change to determine your case. If you don't meet the Guideline, get a Co-sponsor but do submit evidence about your current and on-going employment with solid income that shows an annual salary. The key here is: C.O. wants to see you can and will be able to support your wife once they issue a Visa for her to come to the US. Can you? Show me! smile.gif

I see you graduated from college (assumed), with professional job, great! Then nothing to worry, at this point, just line up a "co-sponsor" just in case they ask for it, as part of "complete inspection" of your case. But I strongly believe they will not look at your income as a decision factor when you will have a solid income starting from November 2007. Think "BIG PICTURE"! What does C.O. really want to see from you and your wife in the future? Will you and her go on welfare and soupkitchen next month after they issue a Visa for her and after she arrives in the US? If you show them the chance of her goes on welfare with you is ZERO in the foreseeable future, then you're gold! smile.gif

Good luck!

Asia: East and PacificMy story "how I met my fiance".
I'm with Sinh & Lien!!!! good.gif
Dalegg is correct! Go for it!

Congratulations, I love a good love story! People tent to forget the romance in this process and get all wrapped up in the legal and procedural matters while they are going through VJ smile.gif My foremost advice to you and everyone: think BIG PICTURE, what is the ultimate goal here? Everything else is just part of the big picture: getting her here is the final prize smile.gif. So, for starter:
Remember, ask yourself: what would I do if I were the C.O.?
Your case is not complicated as others, both of you've never been married? No children of your own from previous flings? Then it's pretty much going to be: pay the bills, pay attention, build up proof for an on-going relationship, cross all T's and dot all i's, read up on VJ everyday. Post questions, even when you think "this is a stupid question", ask anyway! But do search before you post!

If you think you will be flagged for "questionable relations", well, what are you waiting for? Obtain Police records showing you and her aren't related, including both your parents BC, your grandparents's BC or S? H? Kh?u etc. Preventive strike is the game we play around HCMC smile.gif Get it before they ask for it! If you think it may be a problem, guess what, it will be a problem!

Too little photos and letters? Start with handwritten letters, postcards, anniversary cards, JUST THINKING OF YOU cards, random thought of you cards smile.gif I know I did, or "JUST BECAUSE" cards, make sure hand write them, post mail them, those emails are ok, but POST MARK is better! Remember, it may cost her a lot more to mail letters/postcard to you here in the US, just do it anyway!

Phone calls: you do it everyday, for it is so cheap to call VN and vice versa. Make sure you keep a log of how much you call. Do not use phone cards, they are useless to show proof of you calling her. Use service like www.ipnmedia.net or www.savingcall.com They issue phonebills and you can call from any US phone directly to her mobile/homephone without pin#

Pictures: i love those old pictures, Kim shows the consulate officer a photo of she and I were in the church choir together, not standing next to each other but in a choir together when we were 7-8 yrs old. They love it! That's why I say to you, not to worry about the relation, Bà Con, and stuff! It's all good!
Show it with pride and be proud for you are falling in love with "the girl next door" brother!

Last but not least, talking to a few people who haven't actually gone throu VJ themselves aren't the best resource in my opinion! They will scare you for nothing and offer baseless advice is very dangerous thing. Do not PM anyone for questions, people give bad/wrong advice all the time here on VJ, including me, but posting your questions here will help everyone and everyone can help you to get the correct answer and make the right decision for your case.

Good luck,

love

Chuck and Kim

chuckandkimMaleVietnam2007-08-10 06:16:00
Asia: East and PacificRed Flag concerns...

Red Flag 1: Only 1 trip to VN
Will it matter to the CO if i come a 2nd time in Oct. or if my 2nd time is when the interview process is going on or do they just want me there more than once to ease the red flags?

I do not believe it matters. Remember, they want you to help them to make the right decision in granting your fiancé a Visa approval. How will you do that? This is one of the many steps you can help them to help you ? Go for it! I would rather go there if I could before and during the week of the interview.

Red Flag 2: Introduced by her uncle at my work and other family in the states
Currently Tram has 1 uncle in FL, an Uncle and Aunt in VA, and an uncle and aunt in Cali. There are also some cousins, from what i understand, in Texas.
How we were introduced:
Her uncle is a coworker on the opposite shift as me. While talking to him one day i found out he was going to vietnam for a month to see his family there. There is a running joke at work to ask the people going back to their country if they have any pretty nieces that are single. (there are more people from SE Asia at my work than "white" people). So jokingly i asked him and he said, yes, actually i do have one. Bring me a picture with your email address and i will show it to her. A month passes and no emails. So he comes back and i ask him if the picture went over well. he said no, she was not interested but he passed it off to another niece that he never really talked to before. (he still to this day doesn't know much about her and thinks its funny i know everything). A week or two later i get a random email and we start emailing back and forth. and the rest is history.
How will the CO feel about her having some family here already and they way we met??

Normal, CO sees cases like more often than they wish. Also, match making is still the most trusted way among Vietnamese traditional family, so if her uncle trusted you enough to introduce his niece to you, and she trusted her uncle enough to make the initial connection, I don’t thing there is anything WRONG with it. However, you and your honey must remove all doubt ( I don’t know how specifically) that her uncle PAYS you to bring his niece here to America. Or you marry this woman in returning a favor to your co-worker.

Red Flag 3: Vietnamese at interview
Trams spoken English is broken and slow but she is able to communicate. I would like her to do the interview in English, however, I'm afraid the CO will ask something she does not understand and there will not be a translator there to help her. I also don't trust the translators after reading the posts. I plan to talk to her frequently in English and quiz her with random interview questions. She is also attending a school to learn English. She can read and write very good when she takes her time. I want her to at least try English before using the translator because i think she will surprise herself how much English she knows.
Advice?

Ask yourself this: If you were a CO, interviewing my wife and you only have no more than 5 mins to make the decision to approve or deny my wife’s visa application. How would you do that and still maintaining the state of fairness and professionalism? I would rather trust my wife speaking ENGLISH directly to you than trusting a translator who has NO incentive to help my wife to get an approval. Back to your case, it is to your benefit and TRAM to be able to communicate affectively and be able to show that to the CO. You can’t tell the CO “Let me write down my answer on a piece of paper for you”, forget that route and be frank with Tram: Learn English and learn it fast, my Vietnamese sux but you know more English than my Vietnamese. Stop sugar-coating the situation and recognize her English is NOT up to the task, have her study English grammar, speaking to her in English for she will need that language skill once she’s here in the US regardless of what she’ll be doing for job (nail salon worker needs English too!). Here is my suggestion: learn English, interview in English, ignore the interpretor, they do more harm than good, plus since you can’t speak anything else fluently but English, it only helps your case if she can speak English well! Can’t have a relationship when you can’t communicate affectively, that’s how I see it and I believe the CO believes more so than that. Don’t you?

Red Flag 4: Length of relationship
Nov 06
The first email i received from Tram was on 11/13/06. We immediately hit it off and started talking on Yahoo (logged every conversation) Messenger after a few weeks of exchanging emails. From there we started using webcam and phone and talking on headsets over the net and writing letters, we also started doing a lot of texting on the phones this past month.
Dec 06
Within a month of talking 11 to 2 times a day we were already finding out each others views of marraige and family and all the good stuff. By the end of Dec. we were already talking about getting married, and were "boyfriend and girlfriend"
Jan 07
Early Jan we start talking about me coming there and getting engaged and doing a traditional wedding/party. I never said "Will you marry me" it just came up as a known thing that we were a perfect couple and were going to go through with it.
Feb 07
More of the same
March 07
I go to vietnam (for 3 weeks) knowing i was about to get married to a girl that i never met in person before. We planned the wedding to be in the middle of my time there. i knew i could get out of it if it was a mistake. From the first time i layed eyes on her i knew it was all perfect. It was like we knew each other our whole lives. I went for it hook, line and sinker!
April - August 07
I-129F stuff

Now here we are today, Aug 07. I still stand by our decision to wed and will forever. I am in absolute love with her, as she is with me. HOWEVER! will the CO think this is just TOO fast a relationship? Even with all the proof provided will they fail me just because i haven't seen her 5 times over 2 years or something?

I would like to say NO, he won’t fail you. But nobody knows. Remember, there isn’t one thing that will determine the approval of her Visa. THINK “Big Picture”. So what, if you only met her once and decide to marry her on the fist trip. People get married for various reason, yours is “LOVE” remember? ? Nobody can fault you for falling in love with a Vietnamese girl just after 5 months talking to her online, Vietnamese women will do that to you! You stated the “doubt” and “what the CO might have thought of your case”, that’s good, now tell us how overcome and remove their doubt? Remember, Yahoo/Chat/Voice seem to be a secondary supportive evidence, they love to see “hand-written” postcard, snail-mail, actual phone bills is better than random used calling cards. Pictures of engagement ceremony/reception seem to be expected for most K-1, after all, traditional Vietnamese wants to have an engagement for their daughter before she gets married.

I saw a LOT of denials posted do to lack of evidence and lack of support.
For evidence i have:
IMs, IM log, emails, letters, pictures (including hundreds from the 100+ person wedding with all guests and all family, random pics of us together and professional studio wedding pics), receipts for everything purchased in Saigon and Da Lat (honeymoon spot), cash advances from HCMC banks, credit card statements, the earings, rings and necklace she will be wearing (pictures of me putting them on her at wedding and the receipts) , phone bills showing text messages to and from her with phone number and country listed, receipts from money i send her every month, boarding passes, itinerary, and so much more plus whatever i will add to it over the next few months including the 2nd trip i will take.

For support:
WAY above the guidelines for 1 or 2 people household (for about 5 years running). Stable job (2.5 years) in a massive company in a management position (company has a plant in HCMC too).

This looks really good! Again, how will you organize them to “TELL” your “love story” is the tricky part ? Rule of thumb: When in doubt, throw it in anyway! Rather have MORE than enough evidence than MISSING that one piece of paper ?

Okay so that sums up ALL of my current concerns. I know its early into the process for me but i know how picky HCMC CO's can be after reading all the posts. I want my ducks in the straightest line possible. Please reply with all the advice you care to. I am incredibly flexible and take well to criticism. Luckly i read a lot about the 129F before going so i knew what items and information to collect and such.

Never too early to prepare for HCMC. You will have a much better journey than some of us, who jump right into the process without knowing what is up ahead waiting for them. My only suggestion after all the posts I did, get Tram to learn English fast. Speaking to her, forcing her to speak and communicate in English. And last but not least, the CO’s in HCMC do know Vietnamese but sometimes they choose to have the Vietnamese staff speaking on their behalf. But don’t worry yet, you’re along way there. Think “BIG PICTURE” = Getting her Visa is your ultimate goal and objective from now until the PINK SLIP day ?

Asia: East and Pacificpreparing for the interview ahead of time.....
Cuong,

Congratulations and hope you will have a successful interview.
As for the preparation, I always recommend people to ask themselves these questions:
1. How do I best tell the C.O. my love story?
2. How do I support it?
3. What evidence I can gather to bulk-up my support?
4. If I were the C.O., what would I want to know from the individual who claims they are in love and want to live in America together forever?
5. What are the issues I'm not feeling comfortable with to tell the C.O.?
6. How do I prevent and better prepare to answer them if they ask (because they will)?
7. Is my story straight? if not, why not? Can I make it right? How? then go do it!
8. Do I have everything they ask for this interview?
9. If I don't have everything, what ELSE can I show them to explain why I don't have everything?
10. WHAT else did I miss or don't remember to include in my package?
11. Do I have too much evidence in supporting my case?
12. Do I have ENOUGH?
13. What is my ultimate goal and objective in doing this journey? (The answer is GETTING her a VISA - everything else is just part of getting the visa process) smile.gif Don't get distracted.

Last but not least, Not one single item or request in your Visa Case will determine the decision of the C.O. upon your wife's Visa outcome. Think the Big Picture!

Good luck and prepare for the interview well, once you think you have done everything, do it again, check it again. Practice the questions with her!

Be well,

Asia: East and Pacificlegal rights for VN abroad who visit
Andrew,

Thuy is not giving UP all her rights when she immigrates to the US under K-1 Visa.
She needed to transfer/sale her moped because that's what you do if you want the moped to be legally driven around Saigon by someone else other than her.
Her money in the bank, this is somewhat a question of trust, can she trust this individual who holds the account with her? If not, take it out.
The bottom line is, she is still a VIETNAMESE regardless of where she is living Andrew! If in doubt, check her greenish passport smile.gif If you travel to VN, she will get to be processed in a shorter line for Vietnameses, and you have to stand in the longest line where they process all the foreigners smile.gif

Asia: East and Pacificwith a little patience and persistence
AustinJohn and Neverseen,

Nothing personal, but your case is only special to you and you alone. In the eyes of the C.O., you are some random people from the States come into this third world underdeveloped country to marry some Vietnamese woman for a wife and they (C.O.'s) have to review your case, make their decision to grant a visa or more evidence is needed. NEXT! Nothing personal and nothing means, just business as usual. Don't take it personal if the C.O.'s yell or mistreated your S.O., so what, don't blame them, blame the ones who lie and fraud their way to HCMC for years. I would keep this reality in mind and prepare, overload your case with evidence and don't hope or count on your girlfriend will get an easy/nice C.O., prepare for the worst and anything else is just icing on the cake brothers!

mytrang_chinhgoc gives us a lesson that readers on VJ should learn, I myself did too, be patience and persistence are the two main drives you want to possess during this Visa journey, especially through HCMC. Remember, HCMC don't owe you anything, they got something that you want (K-1, K-3 Visa), so convince them and hope they yield to favor your case!

My opinion: long courtships for the consulate = real deal.

Anything less than two year courtship; they'll be skeptical.

I would too, wouldn't you?
To mytrang_chinhgoc, time and time, I see people get blue and green consistantly when it comes to case that has a short timeline, nothing personal or special treatment which HCMC gives your case. I'm glad you take the process with a clear mind and high concentration and extremely focus. Congratulations and let's this be an example and encouragement for all who are going through and struggle with HCMC.

The couple have now been released and they did not hold the visa waiver. If you are a visa waiver holder and you get into this type of situation, even George W. Bush can't bail you out!!!!!!! Good Luck!!!!!

My advise to you: stay away the hell from Vietnam. wacko.gif

Asia: East and PacificVisa Waiver for Vietnamese Americans
This is not where we start an anti-communist war. Anyone who wants one, should have stayed in Vietnam and faught it out.
However, I believe you all just like the rest of those big mouth in Bolsa and Northern Virginia who fear the wrath of VC so much that fled the country and held parades each year on 4/30 to bash VC and re-live the golden days of VNCH.

Here is the news flash, USA has normalized its relationship with VC awhile back. It will take times and no matter what they do, you won't like it, but you won't have a choice. As David Hien said: Jungle Law is what runs the country. Well, you can choose to apply for the visa waiver, or continue your old way to apply for the $30 Visa. I am informing others who actually read and hold the government of VC accountable for what they claim about the new Visa Waiver. SURE, there will be errors and mistakes for this is a new program they implementing, the goal is to benefit both VC and VK. If you think you can just walk in VN and claim: let me in, I am vietnamese, then you're pretty out of your right mind. Even an American born and raised here wouldn't get the luxury if he shows up at JFK International POE and ask to let him in, they won't let him in just because he claims "I am an american". So, when VC asking for your proof of origin, and if you want to obtain the waiver, get in line and who the proper documentation.

I've read a few articles on nguoi viet dot com, quite interesting how these anti-communist-paper-tigers are NOT reporting and giving the vietnamese in the US the whole picture. They themselves also have an agenda. Question from Reader
Moreover, I understand there are fears of losing your US Citizenship if you apply for the Visa Waiver, please someone, find where you have good intelligent official proof that if you apply for the Visa Waiver, you will lose it! You understand in this great country US of A, there is a thing call due-process, even if you have the Visa Waiver, I do not believe Michael Chertoff will stop by and ask for your Citizenship Certificate back.

Bottom line is, from reading what they have on the Ministry of Foreign Affair website (in vietnamese) here is what I understand, and we may discuss to help each other to better understanding new policy. It may or may not work for EVERYONE. Let's read (edits are welcome for my English is not 100% agreed with my Vietnamese) good.gif
