I have looked around in reference to what I would like for our wedding, colors, dresses, location, but have def not picked a date because honestly like most have said anything can happen and considering that we want a church wedding it may not be safe to set a date aside and then if he isnt here then I lose that date. I would reccommend looking at wedding decorations, invitations and etc. Things that will help you to know what you want so that the process in planning is easier but dont set a date til he is here!! ;-) Play it safe.

I hope all turns well, sometimes life works in an unexpected way. I know what you are going through. I married back in 2007 to my ex-husband whom is from dominican republic and after 2 yrs of marriage separated. We however didnt divorce right away because of money issues but then I meet my new fiance whom is also from the same place and fell in love I then decided to file for divorce one way or another however it took a few months to finalize and by the time it did I was already flying out to see my fiance and got pregnant during my trip there. I was warned by my attorney that my prior marriage would be a red flag but considering I know whats in my heart and that our relationship is true I decided it was worth the risk especially with the baby and all. My attorney did mention that situations like these have happened in the past and that I should be positive! I wish you and her the best!

It appears to depend on the consulate. The US Embassy and Consulate Info section of this site has a field for each consulate to answer this question. The Panama page doesn't display an answer, but you may have answered it in your post. :)


I know for the Dominican Republic, if you don't go to the interview with your beneficiary (unless there are extenuating circumstances that they know about ahead of time), you're probably going to get denied. You should probably call the consulate in Panama and ask them. Or if you have the money and you want to go, you should go. It might make it easier on your SO. I feel like it's best anyway, whether it's required or not. I don't want my husband to go through the interview alone. I'd rather be there with him so as soon as it's over and we have his visa in our hands we can give each other a big hug and kiss and celebrate together in person after such a long haul.

Hello all,
I am currently engaged to a man from England (I am from the US) and we want to file for the K1 visa but are trying to determine if we should do the process ourselves or via an attorney. We are also wondering how long this process will take and if anyone has any helpful tips.

Here are some of my questions:
1. Has anyone used an attorney? If so, would you recommend it? What do you think is the benefit of an attorney? (We do not have any special circumstances)
2. If you have completed the process on your own - was it difficult? How long from your date of mailing to receiving the visa?
3. While in the K1 process - can my fiance visit me from England and vice versa?
4. When my fiance arrives in the US after receiving his visa - can he work?

If there is anyone in the same situation as me - man/woman from UK and other from US - I would love to hear from you regarding your situation.

Your address should be listed at the top and type your name only as you are the one who is writing the letter and sign.

I received my NOA2 approval notice on October 5th, 2009 and the NVC still has not received my case file after more than 2 weeks already. Does anyone have any idea of what could be happening? helpsmilie.gif

I spoke to someone at NVC today and she said that it could take 2-4 weeks for the NVC to receive my file and to keep checking. I have noticed that all of the June and July 2009 VJ filers (that I looked at anyway) that have approval have made it to the NVC in only a few days.

My girlfriend and I have been together for over a year. She was here on a 6-month student visa, and we were actually roommates. A month and a half before she left we started dating. We've spent a lot of time traveling back and forth to see each other (having an aunt that works for US Airways helps!).

She recently graduated, and we want to be together, whatever it takes.

What are our options for her to move here? I had assumed that a marriage visa would only take 2 months maximum, and when I searched the internet tonight for more information I was shocked to see that it was much longer.

What's the fastest way that she can move here? Should we get married in the Netherlands before filing, or get married here? If we file for a K-1 or K-3, can she visit in the meantime?

Any info would be very appreciated...

Yes his Visa was approved, the crazy thing is we don't know why it's in AP. we did even know until he went back to the US embassy to find out why he has not recieve his passport or visa. this was serveral weeks later. we didn't even know his case was under AP. we didn't get and notice or paper nothing at all. Just that the Visa was approved and pay Domex thats it.

I think they are doing this to everybody.. My father's case just got out of the AP after 6 months... I think they are trying to process my father's case before they print my GF's visa... I hope she didnt get a hit on their DB because that is what makes the process complicated...

Hi, well my finance case in also in AP and we had our interview August 24,2011. They tell me we have to wait. on the State web site it said it should be competed in 60 day but you can't find out any thing. they tells you to wait 90 days from you interview to call and find out. but i have the feeling the wait is much longer. i have read people on AP for a long time. we just have to pray it goes by fast. they have every body lives on HOLD. because you can't do any thing or call any body.

My fiancee went yesterday to Kingston, Jamaica for his interview. They asked him the same questions repeatedly that he provided a sufficient answer to, but they just kept on. They alluded to the fact that our relationship looked orchestrated, which of course is not true. They did not give him a formal denial (no stamp in his passport, no blue form, no reason for denial) the only explanation given was that what was in the paperwork did not match what was said during the interview. They said they would send his papers back to the US and they would contact me directly. Now we are not sure what to do. Has anyone else experienced this? Any suggestions on what to do next. We did not hire a lawyer to do our original paperwork.

We know someone recently who the identical situation happened to and about a month later she was called back to the embassy in Jamaica to do an interview with her fiance there and the visa was granted. Lord we are praying this will happen to us. Thanks for the advice.

You posted this in the wrong forum.

It's sometimes possible to get the visa section chief to hold the petition at the consulate for review, but that depends on the consulate. I have no idea how you'd go about doing that in Kingston, but a lawyer who knows that particular consulate would know how to do it. Anyway, the chances of getting it held are slim in any case.

Your petition is being returned with a recommendation that the approval be revoked. They think your relationship is a sham, and they're accusing your fiancee of fraud. You'll eventually hear from USCIS about it, but that may take a couple of months. Depending on the service center that originally approved it, they'll either just let the petition expire and then tell you to file another one and try again, or they readjudicate it based on the consular officer's findings. If they agree with the consular officer then they'll send you a Notice of Intent to Revoke (NOIR). If you get a NOIR then you should respond vigorously with a truckload of evidence. If they revoke the approval of the petition then the CO's accusation will be assumed to be factual, and your fiancee will be guilty of fraud. You'll need a waiver before he'll be able to get a visa. If they readjudicate it and disagree with the consular officer then they'll reaffirm the approval of the petition, and it will be sent back to the consulate for another interview.

When posting/mailing anything i.e. documents, letters etc it is always prudent to retain a copy for your own records. This is not just in relation to USCIS. It's just common sense!

ITS COMMON SENSE TO KEEP A COPY OF WHATS WOULD BE VITAL TO YOUR CASE.. THAT WOULD BE THE APPROVAL NOTICE NOT A BUNCH OF PAPERS THAT WAS SENT OUT..... THAT IS WHY IN THE INSTRUCTIONS IF YOU READ THEM IN THE PACKET 3 STATES TO HAVE THAT AT YOUR INTERVIEW. IF IT SAID BRING THE COPY OF YOUR ENTIRE PACKET .... IT WOULD SAY THAT... HELLO.......


If you took the time to read the post, you would have read...and understood...that I was referring to keeping copies of documents for your own records. I also stated that this was not just in relation to USCIS.

I made copies just to be on the safe side-whether the are needed again or not. I realize I will need the originals for copies I submitted. I gave my fiance a copy for his records and I have a copy for mine.

Makes sense to keep copies of all this(at least it does to me).

No you will have to send this copy or another copy to your fiance. Your supposed to make two copies in case one is lost, one to submit for your finace or spouse. Good luck and just make a copy of yours or send it to them with all other evidence and NOAs for their interivew. Good luck.

I have a question...............will they have the photos I submitted for the k-1 at the interview? I made copies of all the photos I just didn't want to bring the same ones if they are already going to be looking at them. I had planned on bringing them as well as ones I did not submit anyway. I am just curious

It is a judgement call-some have tried with success, some have failed. I think if you can show that you will be going home after your trip you will be ok(it all depends on the officer). Have copies of leases, utility bills, car loan statement, letter from employer-anything that will prove you will be going home after your visit.


Even with all that evidence they have the right to deny you entry

Guess it depends on what kind of mood they are in. The Noa2 is definetly good proof that you will want to return home just don't forget to bring anything and everyting else you can. lots of luck.

It is CRUCIAL that he show "why" he will be leaving after his visit.

They just want to make sure that he isn't going to stay illegally. Whatever he can bring to prove he will be leaving after his 2 week visit will be what they are looking for. Keep in mind though-it is ultimately up to the officer-so anything could happen.

I would say wait a few days or a week and try the embassy...........at least that is what I did.

Just because they say they haven't got it yet doesn't mean it's not there, some places take a bit to enter it into their systems.

I always thought that the 'number, date and place of issue' part of that form was referring to the naturalization certificate (if citizenship was acquired through naturalization).



:yes: It is referring to the naturalization #..............I asked this same question many months ago.
