It's so unfair, I love my baby more than everybody and more than anything else in the world.
Why me and people who are in love have to wait so long, I don't appreciate it.

There is no logic to any of this..................It is just UNFAIR :(

I wish I had an answer as to why so many people have to be in pain, and be without their soulmate.........there is just no explanation.

Hi guys,

I hope you don't mind a long post.... I read the guides, this thread and the James shortcuts (but not thoroughly.. i will tonight however) I was on this list a few months ago but because of inactivity I was removed. I applied for the K3 visa in May (I-130) and June (I129F). My I-130 was approved very quickly.. I-130 mailed 5/25/07.. NOA2 rec'd 07/20/2007. My I-129F wasn't even accepted into VSC until Sept. even though it was rec'd by the Chicago lockbox in June. I decided at the time of the approval of the I-130 to pursue the K3 visa because the wait time at the embassy in Lagos, Nigeria is approx. 2-3 months for a K3 interview but approx. 10 months for a CR1 interview. My husband and I have an 18 month old son who has only spent one week with his father so far. I also have two other children from a prior marriage (that ended badly). Time is of the essence to us. Adjustment of Status and further fees are things I don't mind as long as he's here sooner. With Lagos, the CR1 is a bad option, or so it seems. Despite the fact that I clearly had K3 written on my I-130, when it was approved, it was sent to the NVC. I rec'd the AOS bill and choice of agent form. I did nothing with them. In september I read something (cant remember what exactly) that made me worry that they could possibly deny my I-129F because I had the I-130 at the NVC. I asked the NVC to return my I-130 to VSC. They told me they can't do that. They said that normal procedure is to hold it there until my husband is in america. When we are ready to adjust his status, they will receive a request from USCIS to return the I-130, and they will return it at that time. Meanwhile, they put it in storage to be held for the adjustment of status.

I was told this week, by VSC (using the RFE Trick.. THREE TIMES) that when my I-129F is finally reviewed (it's still "on the shelf") it will be terminated because I do not have an underlying I-130. They did not put it that way. They said since my I-130 is approved I don't need the K3. I argued, they didn't care. They claimed it is their policy to terminate the I-129F when the I-130 has been approved. I could argue this all day with all the information I have obtained but it does no good. I have already waited 5 months for the I-129F to be approved. Finding this out NOW was heartbreaking to say the least. If you read my posts in the K3 forum, you know how devastated I was/am. I am now wondering if my husband will be here before our son's 3rd birthday.

Either way, I have a few questions for you all, I hope you don't mind my ignorance. I have been trying over the last few days to familiarize myself with the CR1 process so as to avoid asking tedious questions that are obvious to everyone else. I did read this thread and found it to be extremely helpful, I'm very grateful to all of you for your helpful posts. I still have much to learn. I did read a bit frantically hoping to get as much info in as short a time as possible.

I called the NVC two days ago and asked them what I need to do in order to reactivate my case. The nice woman (a refreshing experience to speak to a nice person as opposed to the nasty shews at VSC) told me to simply send a letter or email to the NVC telling them that I would like to continue processing my case. I did that immediately after hanging up with her. I got an automatic reply about an hour later but nothing else since then.

She also told me something else I would like to run by you all. Please let me know if this sounds off track. She said I should NOT send in the AOS bill fee but I should send them the choice of agent form. She said they have to generate another bill for me since I am reinstating the case. Why would they have to do that? Can I still use the James shortcuts somehow to make this faster? If so, how?

Also, my husband would like to start collecting the information he needs as quickly as possible. He wants to go get the police certificate right away. I asked him to wait until I asked you guys if he needs a special form to do this. Does the DS-230 packet have a special form in it that needs to go to the police station with him? Or can he simply provide a "police certificate"?

Is there a place that any of you know of that shows exactly what comes in each of these packets we all receive such as scanned copies? I have not memorized what everything is yet, please bear with me.

please add me to the list, like so many others I applied for a K3 and got the I-130 approval first so now I'm considering abandoning the K3 in favor for the CR-1 or just letting them both ride for a while. It seems that the consulate we'd have to go through schedules the CR-1 interviews WAY later than the K3 interviews so I'm a little nervous about how it's all going to pan out. From what I read however, the consulate is supposed to replace any K3 interview with a CR1 as soon as the petition is in their hot little hands. We'll see....

Hello everybody, I hope you can get my advice, if you want. The thing is that for USCIS, everything has to have a support, evidence or probe. what it could be? Let's say, pictures, copy of mutuals emails, or copy of letters, letters together about the relationship, or any kind of other evidence. I think you just need to explain how was the story how you knew each other and that is it. You don't have to put too much mistery or problem to your story. The thing is that if you don't explain nothing or you don't know how to explain the things, maybe the USCIS officer is going to think that you are trying to make up or to invent something, so it is good idea that you and your husband agree on what exactly to tell in the interview, it is very helpful. The preparation and training for the interview, both any visa in Bogota or in any USCIS office in the U.S. is very delicate and sometimes rough. Of course, that always depends on your evidence and your training on the interiview, even a little bit of luck. I tell you that I got a difficult interview in Philadelphia, PA, I got a difficult officer, it was a lady who was a little bit desperate, exaggerated, even rude too. I think she was cocky, thanks to God, about 1 week later, I got my green card. The fact is that you have to train with your husband, bring your evidence to the interview, be tranquil and confident and that is it. Please follow the rules of an USCIS INTERVIEW, Just exactly answer what they are asking to you or to your husband, do not answer less or more that they are asking you. they like that every couple be as much as accurate and every quick, sometimes their patience is almost zero, so, it's better to be as much as practical on everything. The thing is that if you both guys believe that is better to give a good explanation about something that is fundamental, please do it. I think (not sure at all) that the Catholic Marriage is not accepted under State of Florida Law, I think that the only one accepted in Florida is the Civil with the notary, judge or whoever, anyway please figure this item out or else you are going to committ another mistake or waste your time. In our home country Colombia is accepted both Civil and Religious marrage under the law. You have to be aware that in case the Catholic marriage is valid, you cannot get married before you get your divorce done, or else, your new marriage is not valid and worse you get in trouble in case of any further petition or something like that. Hello again

After reading through the forum there seems to be a bit of confusion as to how much money you need to self sponsor. My fiance is currently based in England and has tried contacting the London embassy by email but he received an undeliverable message. Does anybody know the correct email address? Anyone with self sponsorship info would be a big help. If he can not self sponsor,I am confused as to which of the forms would have to be filled out; the I134 or the I864. From what I gather they should both be filled out, but should I submit them from just my co sponsor, or myself and my cosponsor?

Someone correct me if I'm wrong, but I thought that you could get a temporary work visa upon landing in the US on an approved K1 if you come in through JFK. Obviously you would still have to go through AOS but if you are looking to start working right away, and if I'm correct about a temp. work visa at JFK, this may provide a possible solution.

My fiance finally got in touch with Scotland Yard for his police check, but was told he had to fill out a form and then send it in before they would send him his report. Now we have the I-130 sitting at NVC and the I-129F at CSC (transferred from MSC). Reading in the forum we got a bit confused and we decided to try both paths. I read that if you go with the I-129F the I-130 get stuck somewhere because the office assumes that you will pursue the K3 way, is that right?

Our I-130 as been approved pretty fast 89 days, what should we expect at the NVC stage? The timelines are a bit confused but it seems like another 120 days at least.

Any suggestions? Honestly we filed the I-129F but I think that the CR1 will go through first...

I'd stick with the I-130 [CR-1] as it's an immigrant visa and MUCH easier and better than the I-129F [K3] non immigrant visa. Cheaper also as the fees for AOS for the K3 are going up to $1010 7-30-07.
With the CR-1 you will get GC and SSN in the mail shortly after arrival in the US.
K3 requires AOS before you get GC and SSN.
Plus an interview if you aren't lucky to get tranfered to CSC,
The K3 will pass up the CR-1 probably and be a bit faster as you have to submit more papers for the CR to NVC.
I blew it and went with the K3 and ended up costing a LOT more plus having to do AOS which was a pain in the butte.
They can still deny a K3 at the AOS interview so more stress that you won't have with the CR-1!

Correct CR-1 is much less expensive starting July 30, the fee for the visa at the consulate is a bit more, but it results in a green card on entry to the country, no messing arround with AOS or EAD, or flying back to foreigh country for CR-1 visa interview.

thanks for posting this new information on I-130 filing. I sure hope this new rule applies to new I-130 applications only but not to those of us whose I-130 is still in the mailroom. However, I am a little worried because it also says " While the changes are effective December 3, any form I-130 filed with the Service Center will not be rejected; it will be forwarded to the designated Chicago Lockbox". Since a lot of us who sent our I-130's before are still waiting for NOA1 and our checks to be cashed. What if the USCIS forward our I-130 from the mailroom to the designated Chicago Lockbox? Very worried!!!

No wonder these people are so screwed up. They think changing rules every other day is going to make things better? it only succeeds at making a poorly run system even more dysfunctional. What are we paying for?

Yeah, it is mostly the same info (just incase part of the application is missing at the interview). But in other ways its different. For the I-129F you sent in photos, plane tickets, etc. Which prove that you meet at least once within the last 2 years. The evidence at the interview (photos, call logs, etc.) is meant to show that your relationship has continued over time since you submitted the I-129F up until your fiance's interview.

It also depends on the embassy.. I know that Nigeria's embassy for example, has a small space between the counter and window (like at a bank) in which they accept documents. Most people who arranged binders had to take everything apart to shove it in that slot. Sometimes the person receiving the documents would say no it doesn't fit and wouldn't accept them at all. Don't take that chance. Organization is good but not if it costs you the opportunity to present your case.

Your wife needs to sign Part I only. Part II needs to be signed in front of interviewer. I had my wife download the 230 and fill it out on computer then print and sign Part I then send that with the other certified papers they requested to me by FedEx overnight to save some time. You can see by the timeline that things went pretty smoothly after that.

So they dont send you the DS230 with some kind of barcode on it? your foreign spouse can just download and print it?


The packet will only contain a letter telling you what they want and a cover sheet with barcode that must be on the front of what your send in. Yes, the DS-230 must be downloaded. The easies way for us was for wife to download and print, then write in the infor as she collected it, then downloaded it again and filled it in on the computer so everything was typewritten. This let her have everything done abaout the same time I got the packet. Then she can sign only Part I then send everything to you and you attach barcode sheet and send it on to NVC.

I think that it's a good idea to take advantage of this opportunity on December 14th and share our collective VJ wisdom. I propose starting a new thread that only has constructive ideas for USCIS to improve their services. As my mom said "you can attract more bees with honey than vinegar".

For example, it would be very helpful if they had some links to free services to help with immigration law in their "Education and Resources" section. It'd also be nice to have more communication from USCIS-it seems like folks get more frustrated when we don't hear anything from them (i.e. no NOA1). Perhaps if they could attach an email address to the barcode on our file so we'd get automated email notices when they 'touch' our file.

...and any other ideas/suggestions that are constructive and would help future filers makes alot of sense to present to the USCIS on the 14th.

One thing that USCIS needs to change is the lack of consistency across the board. Some service centers or small groups within service centers enforce some policies, others believe there are other policies. They need to be trained and updated when things change. They also need to inform the public of the new changes more effectively. If they do not hold to current policy, they should be penalized (in some way).

Also, training the operators who answer that 800 number to actually KNOW what they are talking about and giving them some tips on effectively dealing with sad/frustrated/angry/anxious etc. callers might prove helpful. It is extremely upsetting when you are already distressed and get treated like ####### when you call there. Giving them a little access to our cases, i.e. latest updates in detail, would probably be more helpful than reading back to us the same website page we already have.

To my dismay The NVC has yet to receive it.

I am so heart broker for my husband. We put our trust
in your staff. We paid you to put our trust in in
you.

Where is our check? I need to know if they need
another check. Do we need to cancel the one we
overnighted to your office?

How dare you be so careless with my husband's lively
hood. This is about two more months we have to
maintane two households. I thought you
were compassionate and understood the process.

Can you please send me our files and turn this over to
me. I cant wait 20 days - 2 months for someone to
take action on our case.

You are no longer a K3 applicant but that doesn't mean your I-129F has been terminated as mine has. You may be in the running for both the K3 and the CR1. Just do yourself a favor and keep the CR1 going until that K3 is at the embassy. If you need any help with what's going on now, feel free to ask any of us. I'm just getting my claws into the CR1 process so it's all fresh in my mind.
This situation will have fruits also. Someone may read this and decide against getting a lawyer.. or benefit in some other way. It seems we all get some glitch in our process, lets hope this is yours and everything else is smooth sailing!

I care more about your visa journey than the lawyer does. They are busy and there are no deadlines on when to apply for these things. I work for lawyers (God help me) and the ONLY thing that gets them to act is a court order enforcing a deadline. Your case is not on his mind. Get your papers back, fire his ### and move on. But first find out what the heck is going on. If you paid NVC fees then you should have an NVC case number or is your lawyer taking your money anticipating a future bill. Also, if you do fire the lawyer, contact the NVC and let them know your husband will be changing his choice of agent to YOU. Find out what you need to and let us know what's going on. We'll help you through this step by step.

Yes go. I'm assuming you made an InfoPass appointment. Just go, explain everything to them. They'll try to help you. Just because their website doesn't have the update it doesnt mean they don't have internal access to your information. You have your I-130 Receipt number right ( you said you used it to get your NVC case number). Just go.. find out everything you can and let us know what happens. I'll be praying for you all afternoon!

No. In September I asked the NVC to send my I-130 back to VSC so I could process the K3. I was nervous then that they would force me to take the CR1. They told me that it is "common procedure" for the NVC to hold the I-130 in their storage until my husband comes to the US on his K3 visa and applies for AOS the UCCIS will request the I-130 to be sent back to them. Until then, the NVC will hold it.

I don't know if any of you will be able to help me but here goes...

July 2007 My I-130 was approved and sent to the NVC.
September 2007 I asked NVC to put it on hold for AOS (Adjustment of Status) when my husband entered the country on a K3 visa.

... K3 was murdered by USCIS because I-130 was approved already... that's another story

Last Tuesday - I asked the USCIS to pull my case out of storage and start processing for the CR1 again. They said DO NOT send in the AOS (Aff. of Supp) fee bill or the Choice of Agent form. They said they had to generate a new bill and choice of agent form.

This led me to question if they are going to change my case number. They said no.
Then I wondered, can I just send it in anyway using James' shortcuts? I thought I better wait until I get confirmation that they have pulled my file out of storage and are generating the new bill.

I got an email today saying they have pulled my case, they are generating a new bill and I should expect it to arrive in 2-4 weeks.

Here's the question (finally) would it be ok to use James' shortcuts now? Not by generating a barcode or anything like that, I already have a bill.

What would you do?
