K-1 Fiance(e) Visa Process & ProceduresI-129F Evidence
I always see posts about "what people should send with their petition". If they do not require evidence of an on-going relationship, then it should be removed from the guides.

Just my opinion, but I do think it would save everyone a lot of time. The same question gets asked a lot on here. I am wondering if that is why my petition is taking sooooooo long to get approved, when others are approved in days.

What do you guys think?

K-1 Fiance(e) Visa Process & ProceduresI-129F Evidence
Documentary Proof of Having Met in Person in the Past Two Years and an Ongoing Relationship:
Use as many of these items are possible. There is no minimum,
but the more you can provide the less likely you are that you will receive an RFE. 1. Copies of all airline 1.boarding passes, train passes, itineraries, hotel receipts, passport stamps (make sure you can read the dates on the stamps), and other documentary evidence that you have met within the last two years. You may want to highlight or place post-it notes indicating the dates and locations on the copies (to make the adjudication easier) for the person reviewing your file.
2. Color Photo's of you and your fiance(e). Make sure you write your names, date, and location on the back of every photo. Provide two to five photo's. If you only have a single copy of the photo, then make a color copy and send that. If it is a digital photo, have it printed at a company such as ofoto.com. You can also make duplicates of photo's at your local photo store (Walgreeens, CVS, etc). Place photo's in a plastic bag or photo sheet and label the sheet. Note that you may not receive originals of photo's back.
3. Copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)
4. Copies of phone bills, cell phone bills, emails (you can edit personal info with a marker), letters (edit personal info also), stamps on the letters (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present.

This is what's causing confusion, I followed the guides here on vj. I probably sent too much, but I thought it is what was required to file. Maybe it should be updated-if it is incorrect?

K-1 Fiance(e) Visa Process & Proceduresquestions on -129f
You have to put n/a or none in ALL places where it applies. Don't leave anything blank.

A# would refer to your "alien fiance" if they have never been here before or had a visa, they won't have one so put n/a. That is what I did.

As for how you met-it seems most people put a brief response-I put that "we met a wedding in Dublin, Ireland Aug 2003" then I attatched a supplemental page.

I just called vermont & they are looking into my case b/c they are processing cases rec'd 30 days after mine. The woman seemed nice & at least I know that someone will have to explain why it is taking so long(well a girl can dream).

I will keep ya posted.

I agree with Pax-don't lie-but that doesn't mean you necessarily have to say you are visiting your boyfriend. Just be prepared either way. If you do have proof that you will be going home-bring it!!!!!!

best of luck :D

K-1 Fiance(e) Visa Process & ProceduresScared about flight!!
Yyou always run the risk of being denied, that is why it is SO important to have proof that you will be returning home. If you do not have a job & live at home.............do you have any bills in your name? a car? they may give you a hard time if you don't show enough reason to return home. I am not trying to discourage you, but you will need something to show them.

K-1 Fiance(e) Visa Process & Procedurescase being investigated
It has actually been 62 days-vsc is processing cases in 30-45 days. As of yesterday I was allowed to inquire b/c they are processing cases dated 1/8 & mine was rec'd 12/8.

Mostly everyone going through vsc has been approved in record time-EXCEPT us. People that applied in late Jan have been approved. Either way-I am upset b/c it is taking this long. I may wait another week, it may be another 3 months-I am pissed & hurt & rightfully so.

Thanks evryone for your kind responses. I am really upset & hope that I calm down soon :(

K-1 Fiance(e) Visa Process & Procedurescase being investigated
I am a wreck-I just can't believe this happened to us. We have had a really hard year(he got denied last march). I just thought that we would be together in a few months & now this. I honestly don't know how much more heartache I can stand. Maybe now that my congressman got involved the will do the security check quickly? I can stop checking my e-mail now b/c there won't be an approval there :(

K-1 Fiance(e) Visa Process & Procedurescase being investigated
I just got a call from my congresswoman's office-vermont told her that my case is under some kind of administrative review..............can't stop crying. I just don't understand why this happened to us?

he said it may take another 90 days :crying:

I don't know how much more of this ####### I can deal with-how do they decide who gets investigated? my man was denied entry last year but it wasn't a big deal. I have no criminal record-so #######?????????

K-1 Fiance(e) Visa Process & ProceduresDS-156 Question 31.
There is a specific question on the form that asks if you have ever been refused a visa(date & place) for that question you would answer "yes".

That is different from the question you are refering to about being refused entry-there are two seperate things. Hope this helps.
irishgirl73FemaleIreland2006-02-15 10:24:00
K-1 Fiance(e) Visa Process & ProceduresDS-156 Question 31.
Always answer honestly. I filled out the forms for my fiance.............he was denied entry here in Philly a year a go for overstaying on the vwp 2 days. He was also denied a b-2 visitor's visa for not having strong enough ties to Ireland. when the time comes for his interview interview, he will be able to explain the denials & hopefully will not have a problem.

K-1 Fiance(e) Visa Process & ProceduresTouched?

touches mean nothing, so i don't understand why people even bother to post them. 100 touches does nto equal 1 approval. so what is the point?

People should be hapy if their petition is being looked at-it gives a little comfort while you are waiting. It is horrible sitting around NOT knowing what is going on with your petition-is it lost? is it in the freaking trash? When mine gets "touched" you can bet I will post it!!!!!!!!!!!!!

I agree! I will be very happy if my case get's touched as well, and will include it in my signature! Like Peter said, not all of us get our petitions approved in 2 weeks!
So ryecatcher, don't rain on other peoples parades!
Sometimes just a glimmer of hope is what gets us through this whole long drawn out bureaucratic procedure!
:D

that's right! we need some sort of hope to get us through this ridiculous waiting game

K-1 Fiance(e) Visa Process & ProceduresAILA Processing Times Updated

Just so it's clear I'm not criticizing anyone for wanting to know stuff and being unhappy about the unfairness (because I'm unhappy about it too!), I just want people to be able to cope better by realizing the dates really aren't that helpful and that patience and waiting is their best option for getting through this process with their sanity intact!

I agree..............the dates don't help much, I was just adressing some unfair, negative comments
irishgirl73FemaleIreland2006-02-16 15:52:00
K-1 Fiance(e) Visa Process & ProceduresAILA Processing Times Updated

well said, but you just cannot get that message through people's minds. we live in an instant gratification culture where people think that a fiancee should only have to fill out a couple of forms out at the airport before leaving for united states.

Look, it's not about instant gratification, or getting into the
country with only a minmum of paperwork, it's about fair
and equal treatment of visa applicants.

I don't mind jumping through whatever hoops the USCIS
want us to. They can't just open the doors to the country
and wave us all through, so if there's a process that must
be followed, then that's fine.

What's not fine is that those who follow the rules, do the
paperwork, and pay the fees are not treated in the same
way.
ryecatcher25, you got approved in two weeks from NSC.
Someone else on these boards recently got approved in
less time than that again. Other people submitted their
applications a few months ago, and are still waiting for
their NOA2. Why this inexplicable variation in processing
times?

For my case, it took NSC almost two months to open our
package and send us an NOA1. Why?

My fiancee and I have a very simple and straightforward
case with no complications, and our K1 package was
beautifully organised. We've already waited over a month
since our NOA1, and still no sign of an approval when other
people who submitted ahead of us are already approved.

Why?

There is absolutely no explanation for this widely varying
standard of service. So, don't sit there and patronise those
of us who have been waiting unnecessarily for months by
telling us we're part of an instant gratification culture. The
system is broken, and that's a fact. Visa applicants are not
treated equally and fairly, and that's a fact too.

Yes, not much can be done to beat the flawed system except
to have patience. However, stop trying to make people feel
bad just because they're complaining about something that
should be complained about. The inconsistencies
displayed by the various service centres are NOT ok,
and we shouldn't be trying to pretend like they are.

ryecatcher-You posted something similar when I was complaining about being under AR. I was not expecting "instant gratification" & I am sure most others arent't either. You were very fortunate, your petition was approved in 2 weeks, so please have a little compassion for the people who are still waiting, whether they are waiting patiently or not. I too have a very straightforward case & I prepared my application very well. This is a place for people to come & vent! If you only have negative things to say, maybe you should just keep them to yourself for a while

And don't get me started on what's fair!!! Seriously I won't even go there.

well the sooner the USCIS approves me i can get touched by my fiance  but for now the USCIS touches are accepted. :D

I have to admit, now that my petition is being held up I wonder if it isn't b/c I sumitted too much #######. I mean I followed the guides here, but I may have been a little overzealous. I don't think the people looking at my paperwork care if I have changed my hairstyle over the course of our relationship :hehe:

I think this is just one of those things where people send in what they are comfortable with. For one person it may be no pics, another 15.

To each his own I guess.

I also submitted hotel receipts, car rental receipts, boarding passes, copy of passport to show travel dates. I don't think pics are that important...........why did I send in 5????? I don't know  but believe me I wish I had kept it much more simple.

Whatever you can show that will prove you have in fact met-that is what they want!!!!

I sent in 5 photos of us together(here in the states & in Ireland). I sent in photos taken over the past two years. I haven't heard anything from them yet so I think someone must have a crush on me or my man :P and has our pics on a desk somewhere(we are such a cute couple).

I would try your best to get some photos, if it is impossible.......I am sure there are other ways you can prove you have met.

K-1 Fiance(e) Visa Process & ProceduresTimelines

Hi Everyone,
I recently applied for a 129F for my fiance at the Vermont Service Center. I checked my bank account a couple of days ago and the check had been cashed. I looked at the check and printed on the back in the signature area was my case number. So i went online to the USCIS website and clicked on the online case status. When i put in my number i was really surprised to see that it said Case Status: Approved. My question is, what stage of the process does this put me at? (1st NOA, 2nd NOA, etc...)

How do I know when the next step is going to be processed?

Also the mail is really slow where I live (It's University owned housing with a central post office, which means after its delivered it has to go through a whole other sort and delivery process which can take up to 2 weeks) What will I get in the mail that I will need to continue the process?

Thanks for any help!

Ben

Approved is NOA2

Your application will be forwarded to the NVC where it will be assigned a case number and then sent to the consulate where the visa interview will take place. You will get a letter from NVC once they have assigned the case number.

Ditto.

Peter Miami

2 weeks??? I am SO jealous now. I sent my application in 12/8 & haven't heard a thing.

I am so happy for you but man I am angry at the same time

what did you send in with your petition? hope you don't mind me asking.

This process is so unfair, it is unreal!

That is so true Peter Miami-I mean I am delighted when I hear people are approved but OH MY GOD 2 weeks??? I am on day 70 with no end in sight. No wonder I am miserable
I sent in all the required info & some extras to ensure we didn't get a RFE I honestly figured I would be approved straight away. I could scream!!!!!!!!!!!!!!!!!!
