2) MAKE SURE YOU READ Nick's instruction/suggestion for London Embassy.
3) If you want to fast forward things, you should schedule your med appt now since you already have your LND number. They will get your packet 3 within a couple days of you sending it but NO INTERVIEW DATE WILL BE GIVEN until they have received your medical results!!! The Knighsbridge drs required additional exams from my fiance GP, it took a month for those test results to come out and even though our packet 3 had been received, we didn't get an interview date until the day after the embassy received the complete medical results :(

I did the same thing your fiance did. The way I understood the question is "What is the date I submitted the application" and to me that date is when I mailed my 129F. Reguardless of when it was entered into their system, the day I mailed it is the day I submitted it too.
I don't think it's a big issue though, they'll know you are refering to the petition you are now interviewing for and your fiance it not going to have to sponsor someone else. I think it's just a way to double check if financially you guys will be fine.

I took the last tax return anyway, even though it is not required,just so I had it. Only the employer letter was asked for.

If you are self employed it doesn't say anything about W2's.

Hello all,
My fiance has his interview in London next week and I mailed him my I-134 along with its supporting documents: letter of employment, last 3 years tax transcripts, most recent pay stubs (3), bank and savings account letters. I didn't think of sending my W2 since the same informations are present in the tax transcripts. My question is will they ask for the W2??? As anyone gone without them and was approved with no problem?

My fiance is from Cameroon but will be interviewing on London. Make sure as you fill out the I-129F you put US embassy in Cameroon as your consulate because your info will be sent there after NOA2. You can also change your mind later but remember you'll need police certificates from all countries you've resided in and you'll have to do medical exams and such in the country where you'll interview so you should plan in being in Camer for a couple months...

Green card received in the mail today!!! THANK YOU MY LORD for having taken us through this journey. All is well than ends well. When we started 1 year and 3 months ago, we didn't know it will take this long. The wait and uncertainties made us want to give up at times but I'm glad we kept at it.
For all those waiting whether you are pre or post marriage it will all come in due time. Focus on what you can such as looking for a job and strenghtening you relationship. My husband (who has a master in aerospace engineering) is still looking for a job but in the meantime he started a part time job (at the mall, believe it or not) to help pay the bills...

Hello friends. The scenario is this one, the evidence is important; however, the interview is too. You are confirming in the interview what you have on your evidence; if you perform a bad interview, that does not mean that you are doing a fraud or whatever, but I think the credibility or your case is going to be on doubt. I always advice to everybody that goes to an interview on Inmmigration or any consulate or embassy, to use this keys. First of all, just answer exactly what they are questioning, do not respond more or less from what they are answering. It is useful to carry good evidence and many evidences; however, to carry too much evidence sometimes might be used as a knife against you! so, the officer or the person in the consulate has too much information that he has to question and discuss from. I like to tell this advice to all the people that I prepare for immigration interviews; so, the result of everything is clear: it is not only good evidence, neither little neither too much. This is important too: a good preparation for the interview. I would say everything is important! thanks and take care, I hope you the best of the luck for your process!

Dear All,

Thankyou very much for your help so far everything has gone well my fiance has his visa and will be arriving in a few months. We are now just wondering whether it is worth him coming into JFK to obtain a temporary work visa. As far as we can work out this is the only worthwile way to start working before obtaining adjustment of status. This work authorization will run out when his I94 runs out. There will be a period of time when he cannot work because he is waiting for AOS. Has anyone ever been denied work authorization at JFK and is there anyway to continuously work if you are waiting for AOS to clear.

Second post today, thanks again for your patience.

My fiance has informed his work that he wants to leave and this has then inspired them to offer him significant incentives to stay. We have already obtained a K1 visa and plan to get married in late October. Has anyone ever obtained a K1 visa then gone to live in the non US country for a couple of years. If this was the case. How long would it take for the US citizen to be allowed in the UK after the wedding. What other steps would we have to take to make the move possible. It looks like things would get complicated with the Adjustment of status and I'm sure there are issues we haven't even considered. I realise this is a rather open question, so thanks very much for your time, you have all been a great help so far.

I'm a newbie to the site but I've had our application in since 4/4/07 for the K-1. We unfortunately just received an email from USCIS that they have sent a RFE out yesterday. Should I be worried? I checked, triple checked the packet before I sent it..........even went over my copies last night to make sure I dotted every 'i' and crossed every 't' but couldn't find anything that would cause them to send an RFE. It is really bothering me and I'm so glad that my fiance is so optimistic. I'm also wondering if those who have fiances in Nigeria get RFE's more than other countries? I just hope this doesn't further delay the process. Whatever they want I will immediately send out to them express/certified mail.

Hi Amber, I am in almost your exact same position, American living in Cadiz came as an auxiliary -I assume that's what you're doing- well we're married now, here in Spain and trying to get him into the states. The affidavit of support is our big problem because I have job history and a personal property in the US, but because I have nothing on my 2011 tax returns nor is my main residence in the US, since I showed proof we live together, I am not eligble to sponsor him.

The legal responsibility of a sponsor is quite large actually.... they have to show proof that they could and will support your fianceé if he cannot support himself while in the states. Your sponsor will be legally tied to him for a minimum of 10 years, and that's 10 years of him working in the US for that sponsor to be removed. If at any time he files for any kind of government aid, your sponsor can be sued by the federal government to pay the money he was given in aid.

I don't know about your situation, my husband and I both have degrees and good jobs, but since we're not paying US taxes it counts for nothing and now we are faced with the dilema of having to ask someone in my family to do us this huge favor!

I know how stressful it can be, but you are doing the right thing- in my opinion- and planning ahead. Let me know if you have any questions.

1) So I have several questions... is it a bad idea to put that we are living together in Spain? I was planning on sending in a copy of our ¨empadronamiento¨ and our NIE´s with the same address, showing that we live together as proof of an ongoing relationship. I briefly included in the ¨how you met each other¨ question that I have been temporarily residing in Spain for the scholarship and that I will return to my permanent residence in June when the scholarship ends. And I put my address in USA on all papers. Is that ok do you think?

2) How did you show auxiliares or working in Spain on the tax return, if you did have to show it? All I have is the letter that says how much the scholarship pays me. As I said last year I was here with Fulbright and since it was partly American money I had to report it for taxes, so I have all of that info. But if we have a co-sponsor do we have to submit our own info?

3) After I establish myself in USA and have a full time job, would I be able to switch the co-sponsor off and have me be the sponsor?

4) Do you think it´s ¨easier¨ to marry in Spain and do the K-3 visa rather than the K-1 ?

Hi everyone!! I'm new on here but have been following the posts for a while and you all are so extremely helpful...thank you!
I have so many questions because my situation is quite unlike others that I have seen on here...

Some background info:

I'm American but I've been living in Spain for the past 2 years. I originally came on a Fulbright Grant and now I'm here on a similar scholarship from the Spanish Education Department, teaching English (but it doesn't technically count as a "job", as it is a scholarship). I met my fiance when I arrived in 2010, and we are living together this year. We've recently started the 129-F and hope to mail everything in this week.

Since I moved to Spain straight out of college, I don't have a job in the US, nor a car or permanent residence. My scholarship ends in June however (as well as my Spanish student residency card, booo), and so I'll have to return to the US to my Mom's house for the time being while I look for a full-time job, place to live, and basically start my "American Life" while I wait for Eddy's visa to hopefully be accepted!

So my questions are the following:
- I know you have to have a US address, so I put my Mom's address on all the papers because that's where I'll return to in June. Is this ok? Also, I said that Eddy and I are currently residing together in Spain and am showing proof of that as proof of an ongoing relationship. Will this cause any confusion or problems with the 2 different addresses?

-I know I don't have to deal with this yet, but I'm worried about when it comes time to do the whole Affidavit of Support thing. Since I'm technically a student with a scholarship/internship and no real income I will need a co-sponsor, right? Does the co-sponsor have to be someone who lives with me (my Mom) or could it be a cousin or friend? My Mom is also under the poverty line so wouldn't be able to be a co-sponsor either.

Any advice or similar experiences? Thank you in advance!

Hi everyone!
I'm a newbie and in the process of putting together the I-129F package.

I'm sure there have been many posts on here about what to use for proof of meeting and proof of an ongoing relationship, but my situation is a little different and I'm not quite sure what to do...

I have been living with my fiance in Spain for the past year and a half (I'm an American here on a scholarship) and so we don't really have letters/emails/call logs/ etc. since we live here together. We do have a boarding pass from a trip we took but it's just the online boarding pass from Ryanair (low cost European airline) that anyone can print out, it doesn't show that we actually went on the flight. All hotels we stayed in only have one name and they're also only online confirmations.

however, we DO have the following that I was thinking of sending:
- proof that we live together (either a contract for the apartment or the "empadronamiento" - I think the English translation would be Municipal Census Registry??)
- proof of our joined bank accounts
- a copy of both of our residency cards (which proves that I've been living in Spain, and it also has our address on both of them)
- and of course we have a ton of photos together

What do you think???

On another note, I'm also concerned about sending the proof of living together in Spain because I put my American address on everything (briefly explained in the question #18 that my Spain address is only temporary until my scholarship ends in June). On the Biographical form for current address do I put my American or Spanish address?!

Your friend won't be able to meet the requirement as a joint sponsor. And combining incomes it not possible with the form I-134.

Your income ought to be enough. The affidavit of support is not needed until the interview so you will have more time in the new job and corresponding paystubs to support your current income claim.

Hi everyone! I have some questions about the Affidavit of Support..

1) I'm trying to decide on a co-sponsor. I just got a teaching job in a public elementary school, and so I am making more than 125% of the poverty line, but I have only been working here for the past month. Before that, I was living/working in Spain for a few years, and making almost nothing! Do they look more at my current income or my past income?

I have a family member who has agreed to be a co-sponsor if needed, but I just realized she only makes 13,000 (below poverty line). However, she files joint taxes with her husband who earns A LOT more, and I'm guessing if they have a joint bank account it would show that. Is it ok to use her as the co-sponsor, looking at their family income, although it's her husband bringing in most of the money that they have? I don't know the husband that well so I would feel awkward asking him to be the co-sponsor.


2) Do I need to have all of this paperwork finished, and mailed back first, in order to receive the interview date? Or I must bring it TO the interview? I know this is a long, step-by-step process with NVC, consulate, etc.. I received my NOA2 already but haven't yet received the packet of paperwork for the Affidavit of Support, so I just want to have everything prepared to send back so we get the interview date as soon as possible. However, if I don't have to have all of this done until my fiance goes to his interview, I would feel so much better! What exactly is in that next packet that I'll be sending back?

The beneficiary (Spain) receives the P3, not the petitioner; the case is already at the US Embassy in Madrid. He'll need to fill out a biographical data form, not too complicated, and send it back together with a checklist of papers he needs to gather for the interview. He shouldn't send these back to them until he's got everything, just in case, but he better starts gathering everything asap (no need to wait until P3, start already):

- His complete birth certificate and "Certificado de Fe y Estado" (certifies he's single/divorced/widowed and thus, able to marry). He can get these two forms at a Registro Local office, they give them at the moment and free of charge.
- His "Certificado de antecedente penales" (police records). There's a small fee to pay (less than 4€) and I needed to send a letter to the Ministro de Justicia in Madrid to order it; it took 2 weeks to get it. Also, the police records from all the other countries he's lived in for more than 6 months. (I had to order one from Finland and it also took a while)
- Affidavit of support I-134. This one goes on you and you need to provide him with all the attachments too. Gather everything already and mail it to him; it'll also take some time!

He should make copies of all these forms and bring both, originals and copies, to the interview.
There will also be 3 forms to fill out for the interview; one is included in P3 online and the other two are available online through a link in the Instructions sheet attached in P3. However, he can do those before going to Madrid, so don't worry about these just yet.

Any question don't hesitate and ask me; I had my interview last week and I'll be glad to help you out! :thumbs: Also, consider emailing the Embassy about any other inquiries; they're very nice and always reply fast.

Hi everyone!

I just got my NOA2 last week and am trying to see what I can prepare in the meantime. I have read all of the K-1 guides and the Madrid consulate page, but I am still not exactly clear on some things.

What should I be expecting to receive in the mail next? I received my NOA2 hard copy. Will I receive a packet of papers to fill out and send back? Or does my fiance in Spain receive something first? What is it exactly that we receive, in what order, and what do we need to send back?

He is traveling around Spain visiting family at the moment, and we just want to make sure he can plan to be back home in time to receive whatever papers will be coming to him.

Well I have a problem with them too if I may say so!! I filed my I129f for my fiance through my Attorney on 08/19/2011 and recieved my reciept letter on 11/02/11 dated for 10/31/11!! I was like what?? I called the USCIS customer service center and indicated that the application reciept date was wrong and they informed me that I would have to provide proof that they recieved my application by the date I was stating so after waiting for my attorney to forward me the copies of the certified mail sent through the US postal service with confirmation stating that they recieved the application at their site in vermont dated 08/19/11 2;50pm; I forwarded this to them and even wrote a letter to the direct department and asking them to take a look into my case as I feared that the wrong date would push my wait time even further back!

I spoke with a nice lady up in their office twice over the phone and explained that i had forwarded all proof required by them she told me she would make sure all was in deed forwarded and for me to wait for my response. My response from them was according to the information provided we do not have a repsonse for you as the information recieved was not sufficent!!! What else could i possible send?? I have placed several calls and emails but nothing as of yet.

I was told that VSC has up to at least 6 months before giving back a response in accordance to their decision which means if they dont change my reciept date to the correct date I could be waiting a total of 10 months before hearing anything back! I wish you LUCK!!

I agree with everyone else. If possible do it yourself. Had I known what I know now I would have done it myself too. I hired an attorney thinking it was playing safe when it came to my application because I wanted everything to be perfect turns out he held my apllication and all proof I turned the same day I filed for 7 weeks before mailing it in and at that he mailed it to the WRONG LOCATION/ADDRESS!! He then would not return my calls or messages I felt like a complete paparazzi stalking him down for answers. At that he had to resubmitt my application correctly to USCIS on October.....I came to his office in early July. He wouldnt give me any answers I found out about the application wrongfully being submitted after calling, emailing and even writing a personal letter to USCIS!! It was crazy all this and I paid for a complete back up. I was extremely upset. I think you should take everyone's advice and do it yourself. That was you can assure things get done correctly! ;-)

I have looked around in reference to what I would like for our wedding, colors, dresses, location, but have def not picked a date because honestly like most have said anything can happen and considering that we want a church wedding it may not be safe to set a date aside and then if he isnt here then I lose that date. I would reccommend looking at wedding decorations, invitations and etc. Things that will help you to know what you want so that the process in planning is easier but dont set a date til he is here!! ;-) Play it safe.
