I'm almost certain that the AP and the EAD are just temp until you receive your GC. The GC itself gives you the right to travel outside the country and work... the other documents just allow you to do those things before your legal permanent residency is established. I've been reading yes.gif

But AP and NVC... I think that's what they call getting stuck at the NVC stage of the k-1 process for additional security checks and stuff. Glad that never happened to me!

laughing.gif So when you apply for AOS, apply for EAD/AP at the same time (cost is inclusive $1010). AP is just to have until your 2 year GC arrives, AP and EAD are valid for 1 year. You should have your 2 year GC after 1 year and therefore the EAD/AP are void. Your fiancee can use the AP as many times as he likes until the GC comes.

I just found this in another area, it seems to be a widely discussed issue!

My fiancee arrived from Cambodia in March. We will be married soon and within the 90 day requirement. My situation is this: I lost my job just before she got here and money is tight now. I won't be able to file for AOS and AP until a later date due to financial reasons.
Will this cause a problem that I will be filing after her I-94 has expired?
"No."

Will there be any other problems by not filing soon after we are married?
"Yes, she will be out of status, even though you are married, this can cause issues with ICE/CBP checkpoints."

Is there a time limit before filing for AOS and AP?
"Your suppose to do it before you go out of status. As pointed out above, if your out of status more than 180+ days from the end date of your I-94, you should not use the AP, even if issued, since you will be hit with a ban on return. Your status isn't "pending" till you have the NOA for the AOS."

It may differ by state.... here in PA, as soon as we got married the officiant gave us our marriage cert. But, then it was filed with the courthouse (officiant mailed off his part) and we had to call and request a certified copy. Then went to pick it up, $40 or so. Definitely let the person marrying you know that you need a certified copy, that's really important and I'm sure they'll guide you.

Correct, until EAD arrives you are not legal to work. And don't think about taking a job paying cash only, because that isn't legal and if you were found out you could be deported (I'm not saying you'd do that, I just didn't know myself I couldn't take a cash job until I read it on here!)

You could volunteer, but taking cash paid jobs is not legal because it's not being taxed. "under the table" jobs, if found out could get you in heaps of trouble. You could say, what are my chances of being found out, but still after all of this work, you don't want to risk it!

You do need to be married within the 90 days, now filing for AOS I'm not sure. I did, just because I was really wanting my AP ASAP. However there are different discussions on when you need to file the AOS, some say it has to be within 90 days and others say it doesn't matter as long as you marry within 90 days. The thing is, once your I-94 expires and if you don't file AOS within 90 days, you don't really have legal status anymore I don't think. But I'm sure others know more than I do on this subject.

There's a good chance they will. Yesterday there was hour long line ups just to get in the store, bars and restaurants are spending thousands as they are worried of a long lasting strike. The LCBO has already run dry at some locations

There are times when we joke about how he can go teach the kiddies and I'll stay at home instead. I totally understand what you're saying! It's so nice to do chores/errands during the week, and have the weekends open. When I worked full time, I did all my cleaning/shopping on a Sat or Sun and that sucked. Seriously, I can honestly say that since I moved here, I haven't had many bored/restless feelings, even though it was over winter. I keep myself busy and productive, I wasn't one of those people that got bored to tears not working. I could definitely be a stay at home Mom! I do need to start looking for a job, but I've really enjoyed this break!

Anyway, I didn't have to pay vehicle tax. I registered my car free of charge, pretty much. And I got my DL no problem, in PA. Not sure about DE. Are you trying to get a DL in PA or DE?

They'll send you an assessment and tell you where that extra money is coming from. They gave me an extra $1000 for 2008 and at first it didn't make sense and then once I got the assessment, it made sense.

What's the website to check, and what do you need? Your SIN #?



the website is http://www.cra-arc.g...t/menu-eng.html. You can log in if you have an EPass or just log into the "quick access" (that is what I did). You need your SIN, date of birth, amount on line 150 and the year of tax return. If it has not been processed yet, it comes up with a screen saying something like you have entered incorrect information etc. If you try more than 5 times I think it is they lock you out and then you can call and have them reset your account.

You need to send your complete tax return to International Tax Services in Ottawa ON.

No no.. whomever did my 2007 tax refund messed up and forgot to include a few credits.. so I had to ask for a reassessment (for them to make corrections).. which I filed in July.. the reassessment took until now to process..

There are trains but Mike and I drive there if you want to catch a ride with us thats no problem at all. All the museums in DC are free so afterwards we usually walk around in those. Last year we got home at about 9:00 or so. But if you want to take a train there are those as well.


That would be awesome... the only reason I wouldn't be able to go is if I have a job by then, but at the rate things are going right now, I most likely will not whistling.gif
