OK, correct me if I am wrong.

But I thought that this part (NOA2) was just to check on the Petitioner, not the Beneficiary. The Benificiary gets looked at through the Visa center and then perhaps checked out again in the ben's country via consulate / embassy. I am not sure but this is what I thought.



I would say "not necessarily", if my fiance's name came up on a name check or something, they have to investigate it. I am not sure what is holding up our petition, I don't have a very common last name, neither does my man but who knows???????????????????????????

I was just reading another thread about somebody being held up because something came up on their background check. This is starting to worry me. My fiance was denied at a land crossing border last May. He was coming to see me but was bringing some personal items with him. They viewed it as he was trying to come into the United States and wouldn't be leaving. That was not his intention at all. Now I am wondering if this is going to cause a problem with the approval. He has since been to the US twice to visit me and hasn't had a problem.

What does everybody think? :help:



Maybe I was the person you read about????? I was concerned about my fiance because he was denied entry last year, but was reassured that he should be fine. He will be given a chance to explain at his interview-when we get there. I am under some sort of "administrative review" at the moment. It could have been form him being denied, or it could have been my name-who knows? I will probably never know.

I am sure everything will be fine with you. If he has been back since then, I am sure the interview will be fine. Have you filed for anything yet?

People always write about 'strong ties to the home country', but ties to the home country are only half of the issue. The issue is, 'will the person leave the USA', and the other half that must be balanced against ties to the home country should be obvious - ties to the USA.

Relatively few people seem to recognize explicitly that a family-based visa petition is a very strong tie to the USA, and a clear statement that whatever ties exist to the home country can and will be severed.

The specific aspect of the issue that must be addressed in a B2 visa application, and on entry whether it be with a B2 visa or under the VWP, is 'will the person leave the USA after this particular visit', a subtle but significant difference from the general issue.

Oh I know it is about leaving the USA, my fiance had a letter from a film production company with a signed contract-stating that he had to be back in Ireland by a specific date and they didn't care-they just wanted to see if he had any sort of loans, lease payments and other things that would make his return to Ireland a sure thing. I didn't want to give bad advice-I just wanted the OP to realize that the b-2 is a very hard visa to obtain.

They definetly look at it all-leaving the US after the trip is their biggest concern-for sure!

If I was you I would just hurry up and file for the K1 visa and forget about the tourist visa altogether. You can still be refused entry with a visitor visa if they see that you have a 'K' visa in the works, so it would just be a waste of money. K1s really don't take that long to process in most cases - it may seem like forever apart, but its only about six months and then you'll get to be together again forever...

skip the b-2(which he is unlikely to get) and file the k-1.

If he has a K1 pending, he stands no chance of getting a B2. In order to obtain a B2 one has to have proof of significant ties to the home country, not an intention to immigrate. I think that option is going to be out.

Also, the denial on the VWP would have been due to his entry and exit patterns - like the fact that he stayed for three months and then exited to try and return within a relatively short period of time. Even if he DOES manage to get a B2 (which I consider improbable), that's no guarantee that the POE won't do exactly what they did with the VWP - turn him round and send him home. Particularly once a K1 is in processing.

There is undoubtedly the situation with substantiating non immigrant intent, which is why I asked my question.

I was wondering why he was denied entry in the first place......was it b/c he was back and forth a lot, or did he overstay on the vwp????

As I said earlier-he will have to show SIGNIFICANT ties to his home country or he can forget the b-2, which honestly, with a k-1 in the works-probably won't happen anyway.

just keep it handy you might require it at the interview stage as the I129F does not hv a question asking were you denied entry to the US
this shall be coming under DS156k which is at later stage
so i would not recommend now as it is not asked for..


He was denied for not having enough funds and had just been over for 3 months and then tried coming over again 2 months later..



As the others have said-just hang on to all the paperwork for the k-1 interview. Just so you are aware-they will see the record of his denial when he goes for the b-2. My fiance was denied a b-2, and I do belive the fact that he was denied entry played a part(even though the official denial was 'not having sufficient ties to Ireland"). I am not saying he won't get the b-2..............but just know that the k-1 is for people that want to live here(an immigrant visa) where as the b-2 is non-immigrant and from what I have heard, much harder to obtain.


He must show tons of proof that he will return home after his visit(a mortgage/lease, car payments, loan payments,)
I am only speaking from my experience with Dublin and my fiance-others may have completely different advice for you

On Steves last visit 10-05 to the US he was on the VWP and denied entry to the US...In order for him to get back in the states again he has to file for a holiday visa...he has an appoitment set up for March 20, 2006 for this and with this i am also gathering all our info for the K1..so my question is would it be helpful or harmful to add the transcripts of his denial on 10-05 to the K1 packet? Any help would be appreciated :)



I am sure others will respond................my opinion, his denial won't come up until the interview stage. On one of the forms it asks if your fiance was ever denied entry, or denied a visa. Be honest and you should be fine(providing he was just denied entry for an overstay or something simple like that).

As for the b-2................if he does not have strong ties to his home country he MAY get denied(the same thing happend to my man). The b-2 should have no impact on the k-1.

Oey, I'm going to get roasted over a spit fire for this one! I met Felicity through a friend in 2004. My friend and I were planning to go out to dinner, and my friend brought Felicity with her. We all hung out for a few hours after dinner that night, and exchanged MSN names, and never really thought any thing of it for a while. Then Felicity started messaging me in late November/early December. I was going through a rough spot in my relationship with my then-girlfriend at the time, and she was always there to listen, and offer suggestions. After talking most nights for a few months online, then moving to phone calls, she was talking about coming to visit for a week or so on her way to New York for the summer. A few weeks later, she admitted that she'd started developing an emotional attachment, and was falling for me. So, she came in on the evening flight from New York, and there I was pacing nervously by the baggage claim at the Lexington airport, when I saw her coming down the escalator, and I FREAKED. I was too nervous to go over and talk to her (I was shaking, and just stammering.. I mean, damn, she was the most beautiful woman I'd ever seen, even for spending 12 hours in an airport and on a flight :luv:), so I just waited outside the bathroom after she went in. But after she came out, the way she looked at me, smiled, and hugged me is something I'll cherish and remember forever. Everything in the world just felt so right at that moment. She stayed for a week or so in June, then came back for almost 2 months right before Labor Day.

There ya go.. You asked me what time it was, and I told you how to build an atomic clock. :jest:

I caught the bouquet that night as well :P Funny thing was I had a mad crush on Colin Farrell at the time, only to find out my "soon to be boyfriend" was an actor as well. After a few days with him I didn't even rememeber who Colin Farrell was :lol:

Yes, that is what everyone refers to when they say "touched" it could be when your case was updated, or it was given to another person. It doesn't always mean anything significant. Some people(like myself) never had anything then I got my approval e-mail. Others got a "touch" and were approved a day or two later.

I already gave Gavin all the "original" copies of everything, I just have to send the I-134, a new letter of intent, and my new lovely noa2.(he already has everything else).

I was concerned when I read about "originals" for the g-325a and the I-129f petition, I sent those in b/c they needed to see the signatures-that were in blue ink of course!!!!! I made 2 copies of everything I submitted.


I am going to save this post-cause I was about to double-check and see what he will need. You literally read my mind(sorry you had to see what's in there) :lol:

Silly question(sorry) but I made copies of the entire packet when I submitted it. I was assuming they wanted that, along with the originals of-boarding passes, hotel receipts and things like that. They would have the original I-129f and G325 right?

Believe me I know exactly how you feel. Our case was outside the processing times, I called them and the took a "referral", I then got a letter telling me that our case was still being investigated. It is incredibly frustrating to have your life on hold-waiting for an answer. I finally got my Noa2 the other day(day 88). It was out of the blue-I checked my e-mail and there it was. I am sure you will hear something very soon.


In the words of many of my fellow vjer's .........................."be patient, your time will come" They must have told me that a thousand times-I realize that they were right. (sssshhhh don't tell them I don't want them to say "I told you so" :lol: )

I was never very good with the patience thing but in this process-we don't have a choice.

I called when my case was 30 days outside the processing dates-they took what they call a "referral" asked for my receipt#, my name, fiance's name and so on. I rec'd a letter from them telling me the case was still being investigated. I was about to call again b/c another 30 days had passed but I got my noa2.

If it is 30 days past-I would call them now-definetly!!!

well there's that whole group of us who are MIA all mostly Jan/Feb of this year. If you get thru to someone PLEASE post and let me know, I will be taking the 30 mins or so time on my lunch break today to try and do the same thing. It is a very unpleasant feeling to check that damn thing every day and see YOU DON'T EXIST!! you also don't exist on the info line, no such case is what they say. It sucks!!



So when you call they have no record of your petition?? sounds strange. If you have your noa1, you have a case# so you do exist in the system. Have you called 1-800-375-5283? You should call & speak to someone right away :yes:

That's really weird the diference in the processing dates... Most people that applied for the visa in the same time as you did, got their 2nd NOA's a long time before! It pisses us off, because we get even more anxious! :unsure: :protest:
