K-1 Fiance(e) Visa Process & ProceduresA call to USCIS
When we were waiting for our noa2(which by the way was 30 days outside processing times) I called my congressman. He called for me & he was told that our case was "under review". I rec'd a letter a few days later telling me that it could take 6 months to process our case. We rec'd our noa2 within a month of that letter.

There are many people who recommend calling a local representative & then there are those that feel it could bring a little too much attention to a case. I am glad that I called, it did make me feel better, but in our case, I really don't think it made one bit of difference.

chin up-maybe it won't take 6 months ;)

Hey all-I just wanted to know if this new law is going to affect our already "long overdue" interview? We got our noa1 in Dec & our noa2 in March................will our case have to be looked at again?

I have read many posts but I am getting a bit confused  Gavin is going to the Embassy 6/12 to give his fingerprints, so it would seem we are moving along, but I just wanted some opinions.

Thanks

K-1 Fiance(e) Visa Process & ProceduresNOA2 Expirery

What if my petition expires?

Consular officers have the authority to extend the validity of petitions that have expired. Because many petitions often expire before an applicant can be interviewed, officers at the Consulate routinely extend the validity of K-1 petitions.

Our noa2 expires 7/7 & since Gav may not have his inetrview by then-the embassy told me no problem-they will just extend it. I appreciate that-but I wish they would just get moving already

K-1 Fiance(e) Visa Process & ProceduresI am ready to pull all my hair out!!!!!

This is so, but there is a time to relax and calm down and there is a time to "move yer ###" (so to speak) lol. Also: nagging usually works just fine lol.

Oh, I moved my ####### just fine when it came to filing the paperwork. I did take an extra week to read everything available and triple-check all of the forms, though.

And no, nagging doesn't work on me at all. I detest nagging. Nagging = breaking up, in LarryWorld. I refuse to live with nagging in my life. If something is mentioned more than 3 or 4 times, I intentionally stall on it, just to show that I will not be nagged into doing something. I don't want control of the relationship, but I sure won't let someone else have all of the control, either. 50/50 and all that.

I don't think that most women truly realize the amount of resentment that builds up due to nagging. It may take 5 years or more to manifest itself, but it WILL manifest itself in one form or another. Just like a woman being married to a lazy slob will cause resentment and ultimate manifestation of that resentment.

Just because a guy gives in to the nagging to make it stop doesn't mean the issue is over. Us men can hold onto things for a long, long time, too. Therefore, I wouldn't say that it "usually works just fine."

Again, just my opinion.

Well, I was mostly just kidding with that "nagging usually works" statement; I'm actually not such a big nag (at least in my own estimation). But, on the occasions when I DO nag him, my fiance', not a resident of LarryWorld, usually laughs and mimicks me . But really, he often asks me to remind him to do things if he thinks he may forget/procrastinate on it.

Also, in general, I don't think reminding someone to do something extremely important, like mail an important document for the US gov't, is an attempt to take control of the relationship -- it's an attempt to apply for the visa lol, and that really shouldn't cause someone to feel resentment.

Oh believe me I know

Do you know how many times I have asked(told) Gavin to do things & then he will say.........."you didn't tell me that". I could scream-and sometimes I do  I wouldn't say I am a nag-but I am sure my man would argue that point.
irishgirl73FemaleIreland2006-06-02 11:40:00
K-1 Fiance(e) Visa Process & ProceduresI am ready to pull all my hair out!!!!!
I was frustrated in the begining of our process too(well still am). My man didn't seem to understand the sense of urgency to get all this paperwork submitted. I don't think he realized how much was involved and that the longer we took getting things done-the longer we would be apart. I was prepared for all the K-1 back in October but we didn't get things going until Dec.

My man still has to remind me to say "hello-how are you?" before jumping right in about forms, fingerprints, letters, etc. It may be more of a woman/man thing rather than an Irish/American thing. I know how men feel about "nagging" so I won't do it.

Sometimes he drives me crazy b/c he seems a little too laid back, and I could kill him-but I have learned one thing-If I don't mention anything in a few days-he will ask me what's going on-Ladies NEVER NAG

men :bonk: :bonk: :P

K-1 Fiance(e) Visa Process & ProceduresSenator's response to my inquiry

My Senator's office called today to say that they made an inquiry into my case. The only thing they could tell me is that it is in California and that I should expect another 30-60 days processing. When I pressed further on the whole form/questionnaire issue she said they told her nothing about this. When I explained that this is probably the most important question to get answered, she said she will inquire again in 2 weeks and at that time, if they mention the form, she will ask for more information.

I don't think the woman from the Senator's office was trying to give me the runaround - she just seems to be very calm and laidback and thinks that this stuff is normal for USCIS and that there is no way she is going to get a straight answer from them until they are ready to give it - which is probably 100% correct.

Not sure what to believe at this point - I guess if I got a form in the mail asking for my criminal background information, then I would be fine with the 30 day quote.

When I contacted my congressman I got the same response-I must say though-it made me feel better to know that they told him the SAME thing they told me. I did receive a letter from VSC telling me the case was still being processed & it could take another 6 months-it didn't. We gout our noa2 about a month after the letter. I don't think you are getting the run-around. I am sure you will hear something soon

When else in your life will you ever be able to say you wished and hoped and prayed and wished and hoped and prayed some more for anything SO HARD as you are doing DAY IN AND DAY OUT right now?

Probably never. I think I will just have an ulcer when this is over. Thanks for listening to me biznitch!!

I know EXACTLY how you feel-most people do. I would drive myself mad because I was seeing everyone get approved in days & I felt like we were waiting forever. People give great advice here on vj but the best advice I was given "don't compare your timeline to others". I didn't take it of course but it is still great advice ;)

I swore I waited an eternity for the noa2-when we got it I was over the moon. Now my man hasn't even had his interview yet-could be a month, could be 6-who knows? with this process-we are always waiting for something. Really unfair-but it is our reality  For the record-I DO have an ulcer  I had one before but this one is soley because of USCIS. We are all here for eachother-rant on!!!!!!

K-1 Fiance(e) Visa Process & ProceduresFinally got a response from Congresswoman

Ok, I contacted my Congresswoman regarding my case, today marks day 135....she called me today and stated she got a response from CSC, they stated basically the same thing to her as they did to me that my case is undergoing "security checks" the only difference is they told her that it could take another 6 MONTHS to complete my case!!!! We have already waiting almost 5 months. Does this make any sense to anybody????

Has anyone had to wait this long to be approved, over a year??? Do you think I will really have to wait 6 more months???? :crying:

If it makes you feel any better-my congressman was told the same thing & I rec'd a letter telling me the same thing.....................we rec'd the noa2 about a month after that phone call & letter.

hope it goes quickly for you-just jeep in mind that they say it will take 6 months-but that doesn't mean that it will. my letter from USCIS said 6 months & it certainly wasn't!

chin up (F)

That actually does make me feel much better, thanks Irish Girl, hopefully it will go the same way for me

I was told it is a standard response-a few vjers thought that maybe b/c I contacted my congressman I made things worse but I am glad I did it. I bet you hear something in a week or so ;) I wish I could show you the letter but my man has everything in Dublin-sounds exactly like what happened to us. Don't worry-you will get your approval soon. Believe me-that was one of the best days of my life. I never thought an e-mail would make me so happy-but it sure did.

K-1 Fiance(e) Visa Process & ProceduresNeed to help a friend...

Matt x,

There's an issue with using the VWP to effectively live in the USA interrupted by brief visits back to the home country, the issue being that that's not what the VWP is for.

Your friend may get away with the 2nd VWP visit, but she is very unlikely to get a 3rd visit following the same pattern.

Yodral

Hi everyone

Hope someone can help me (and my friend) out!

Basically my friend (British) has met the man of her dreams (American). Now that she has graduated from University she wishes to go to the USA under the visa waiver program and stay with him for the maximum 90 days, before returning home. Then approximately 6 weeks later she intends to go back in again on the visa waiver program and stay for the maximum 90 days before returning home once again.

Is there any issue with repeatedly entering under the visa waiver program for the maximum period? I've tried researching this myself but to no avail!

Thanks in advance

Matt x

irishgirl,

Returning home at the end of one's visit is an important issue, but it is not the only important issue as your post seems to imply.

A zyggy points out, one doesn't just have to leave the USA, they have to stay out for a while. One cannot use the VWP, or a B2 visa, to live in the USA without immigrating.

Yodrak

If she trys what you suggest, she's in for a long ride home on her second try without the opportunity to use the VWP ever again... If the CBP believes that she's spending more time in the US than in her home country, they won't think twice to send her packing. The rule of thumb is to spend at least as much time in your home country as in the US. If she stays in the US for 90 days, she should plan to stay in the UK for at least that if not more...

this is good advice-you never know if they will send you home or not-just make sure there is LOADS and LOADS of evidence to show that you will be returning to the UK. I think that is the most important thing they look for at the POE.

yodrak-

I know that you can not abuse the vwp-I just wanted to stress to anyone coming back(after being here) on the vwp-that you will need to be prepared to show evidence of your departure. I would certainly never recommend using the vwp too often-you are asking for trouble

K-1 Fiance(e) Visa Process & ProceduresIMBRA-could it be?

Hi Iris

I think the consulate confused on your NOA1 and NOA2. They thought your NOA1 was on 3/7/2006

there won't be any confusion when I call back tomorrow ;) I am sick of waiting & dealing with screw-ups!!!!!!

worst of all-our petition expires 7/7/06-they better extend it!

K-1 Fiance(e) Visa Process & ProceduresIMBRA-could it be?

This is really in sane. The priority date for IMBRA is on March 6 or after. Now it is Jan 1st? what is the correct answer?

Bill

That is what I want to know-#######?? no one seems to have a straight answer. I just called the Visa office(whatever that is) in Washington(the guy at the NVC gave it to me) he said that from what he can tell our petition shouldn't have anything to do with IMBRA-well then what is going on with Dublin????? I am going to call the embassy again tomorrow to see what they are doing & why they are sending petitions back.

I must say I am a little suprised with Dublin-I have heard great things about the embassy, but considering they didn't even know he was coming in for fingerprints that they told him he had to give  I don't know what the deal is but I am certainly going to find out.

I thought IMBRA only applied to petitions filed after 3/6 too

Just called the NVC-they said that it could be the IMBRA law because it went into effect Jan 1st & we were approved AFTER that date.

I am confused-that doesn't seem to make sense compared to a lot of other posts on here. I am going to make some phone calls

You´re not supposed to be affected by IMBRA.

I know(well at least that is what I thought) but my man & another member got calls today telling them that the cases were being sent back here for further processing-doesn't make sense. Now my man DID have to get fingerprint clearance, but the fact that another person got a call is really making me nervous.

I have no idea what this is about

Hi Irishgirl73

I don't know what is happening now. Your post got me very nervous. My NOA1 is Feb 7. I hope everything going to be ok.

Bill

sorry-I don't want to freak anyone out but #######????? why would they call someone 3 days before their interview & tell them the case is being sent back? when I called them-they said "oh it is just for the fingerprint check" but something seems really strange.

I don't know what to do now :(

Some things are unfortunately beyond our control sometimes (no matter how much of a control freak we may be). So, in this time of us relenquishing control (with us kicking and screaming every step of the way), I just want to give a shout out to everyone here because DAMMIT I think we all rock! In fact, I think everyone of us should email or call the one we love and say "Thanks for being patient, I love you, and DAMMIT, we rock!"

En serio...think about it...this sh*t will make a great book someday..."Two star-crossed lovers kept apart by the government"...I think it has Pulitzer all over it...and if not award-winning novel...just think about the stories we can all tell our grandkids...we will be the COOLEST grandparents ever!

Just try to stay positive. Stay strong. And, I cannot believe I am about to quote George Michael...but "You gotta have faith, baby"

My man & I ARE writing a book-then it will be a cheesy dramatic sappy lifetime movie

As long as we get a happy ending I will be happy & yes we do rock! Everyone here does, people give advice unselfishly & with compassion. If we didn't have this site what would we do?
