K-1 Fiance(e) Visa Process & ProceduresLetter to a congresswoman
I called my congressman when my case was outside of Vermont processing times. He made a call, and I received a letter from USCIS within days, telling us the background investigation was still being completed.

If you are outside the processing times I would call and they will open a "referral", which is an investigation. If your congressman calls theywill do the same thing. Bottom line-If you feel that you have been waiting too long-call. If you are not 30 days outside of processing times-they won't do anything for you. If it makes you feel any better I filed 12/8 and watched people get approved in days-I waited almost 90 days, which is very unusual for Vermont, but I finally got my Noa2 the other day.

Good Luck to you!!!

Forgot to mention, I called my congressman on a Thurs-he called me back Friday with a response-he was great!!!!!

K-1 Fiance(e) Visa Process & ProceduresK-1 X denied touris visas
On one of the forms for the consulate interview-it asks if you have ever been denied a visa-tell them yes-never ever lie

You will have your chance to explain-just make sure you check the box-YES. There is also another part on the form(maybe the ds156) where it asks you to put the dates you were denied, you will have to fill those in as well.

I am sure you will be fine-many vjer's have been denied visitor's visa and went on to get their k-1.

good luck to ya!

K-1 Fiance(e) Visa Process & ProceduresK-1 X denied touris visas

From what I have been told-the visitor's visas are completely different from the k-1. With the k-1 the person IS intending to immigrate here to the US, where as the other visas are NON-immigrant visas.

My fiance was denied a b-2 and I am hoping that it will not be an issue. Just explain all of this in the interview-don't try to hide any of it

Good luck

If the reason you were denied for a B visa is because you lacked adequate ties to your home country, then getting a K1 will not be an issue. If you were denued for a B visa for another reason, it may or may not be an issue...

exactly zyggy  I should have elaborated a bit-my man did not have strong enough ties to Ireland(or so they thought) that is why he did not get the visa.

I was going by what Ireland requires...........sorry If I gave out bad info

Oh no I'm not railing at you, you at least made a disclaimer that you weren't sure! I've just noticed that pri tends to give information out a lot in similar posts that aren't accurate, they may apply to his/her case but would possibly not to the OP, and this is something we need to be careful about as it would be really bad to mislead users on here and end up harming their process. I'm not saying I know everything of course, that's why I almost always say call the Embassy to be sure!

Oh I know-I just felt bad-God knows I don't want to confuse anyone(this process is confusing enough). I always put a disclaimer-it saves me if I am wrong ;)

I just asked this question today-I believe you send in ds230 pt.1, I don't think you have to worry about pt.2 yet, that is handed in at the interview.

Others will tell you for sure

K-1 Fiance(e) Visa Process & Procedurespassport photo

I'm not sure about the U.K. but I HAD to have a U.S. sized passport photograph for my medical. I would suggest adhere to the instructions as they are written, in order to avoid any unnecessary delays. :)

I am pretty sure they only want the 2x2 size

I wouldn't risk a delay-I am sure some people will be able to tell you how to get the correct size in the UK
irishgirl73FemaleIreland2006-03-09 15:18:00
K-1 Fiance(e) Visa Process & ProceduresThats unbelievable!
I got a letter after they took a referral-it was very similar. It said the the "required background checks were still being completed. If you don't hear from us within 6 months call back.

I think it is a standard response, but I can't be sure.

I rec'd my NOA2 30 days after I got the letter. I guess every case is different. I am sure you will hear something soon.

You may want to contact your local congressman-it certainly can't hurt at this point.

K-1 Fiance(e) Visa Process & ProceduresWhat do you do to keep from losing your mind ?
I called my man the other day to ask about a certain form for his interview................he politely stopped me and said "Hi luv how was your day?"

this process has a way of "taking over" everything. It is the little things that are important-the "I love you", "I miss you", or just plain old "hello" don't be like me-and obsess over all the this. Easier said that done-I know  I never though "WAITING" could be so damn stressfull.

I have been going back to yoga-I highly recommend it if you can go.................very calming.

As for your question-how do we stop from losing our sanity? I have lost mine so I can't help there
irishgirl73FemaleIreland2006-03-10 16:39:00
K-1 Fiance(e) Visa Process & Procedurescase sent to Dublin already!!!!

Told 'ya....Wasn't too long ago you were contacting your congressperson. Patience, patience.........You'll get there sooner than you think.

Congrats.....;)

Look how fast this could go now, irish. See Mand's timeline....interview could be as soon as SIX weeks!!

Dang, I would love to see Ireland in the springtime...

Can you bring me back some potatoes? LOL

sure.................anything you want

K-1 Fiance(e) Visa Process & Procedurescase sent to Dublin already!!!!

Hey Irishgirl... I know how you feel! Last Tuesday I called, and found out it made it from the CSC to the NVC in four days, including a weekend! Then yesterday I called, and was told it was already sent to Bangkok on the 10th!!!

I checked the DHL website and saw two different packages sent to BNK... one for IV and one for NIV... both received on the 13th!

So I have to assume my case is already at the consulate!

I Love the State Department!!! (L)

I am going to check the website too!!!!!!

This is much better than dealing with the USCIS-at least at the NVC you get to speak with someone & they are super nice
irishgirl73FemaleIreland2006-03-14 14:21:00
K-1 Fiance(e) Visa Process & Procedurescase sent to Dublin already!!!!

Your letter should be fine! Rob's letter for our K1 was from July 2005 and our interview wasn't until Sept 2005 and there was no issue with it. I brought updated payslips with me to the interview incase they asked...they didn't!
Good Luck!!! And if you don't hear anything from the Embassy in a week and a half, call them and be super nice, explain you haven't received a letter yet and have they a date scheduled for your interview. And it's better if you call them, they prefer to talk to the USC. ;) This is what we did and we got a date over the phone and an interview letter arrived a week later!

Thanks Amanda-I will wait & see if Gavin gets something in a week or two. I have heard that Dublin is very easy to deal with(well at least I hope so). Providing Gav gets his police cert-we are all set ;)

Now I have to figure out how I can get off for the interview-I work 2 jobs so I have 2 bosses to deal with :o
irishgirl73FemaleIreland2006-03-14 14:01:00
K-1 Fiance(e) Visa Process & Procedurescase sent to Dublin already!!!!

I knew it!!!! Mine was at NVC less than a week too!! Oooh so happy for you! Ask anything you want!!!

I think for now we are all set......................He has all the paperwork(I brought it with me in Jan). I just have to have my affidavit of support notarized, and type up a new letter of intent. I will bring those with me when I go for his interview.

One question...............I had a letter typed up from my employer back in January, If I have current pay stubs, will that letter be ok, or should I get another one? I figured it would be fine as long as I can prove I still work here-what do you guys think?

The new law as it stands only affects meeting through Marriage Brokers....hence the title 'International Marriage Broker Regulation Act'

Below is a link re the new law.

Well I could be wrong but it sounded like you were trying to say I'm reckless or irresponsible or something like that. And of all the relationships you'll find here on VJ, mine is one of the ones you sure can't come down on... so if you like to hear stories about people that don't know each other very well and decide to get married, so that you can criticize them, I'm not what you're looking for.

Not what I meant, nor tried to imply.

*cough*

Thanks for this link Aussie ;)
