Hi! Case is not yet in manila but hopefully nxt week it'll arrive and i havent call the us embasy in manila yet. But we will call them nxt week... Do i need to call them frst before attempting to set the interview online? Again thank for the useful info.. God bless!

 

Actually we have the same question. lol! Our case left on feb 7 and hopefully it will be at the USEM Manila early this week. Your case will come before ours. As per kryspekreme our docs should be "physically" received by the USEM. So I guess you need to call them first to make sure that you can have your interview on the date you will resched it. Tho I have mine resched on Feb 19. The last time I resched, Feb 12 and 13 are available and Feb 18 and 19 same with Feb 25 and 26 if I am not mistaken. Other option is get it resched and call the USEM and ask if you can go through the interview on the day you resched it. That is what we will do. Call the USEM next week once we get our case ready to ask if we can go through the interview on the 19th. ",) keep us updated :)

And was confirmed by nvc operator that my case left the building feb 4... Please help.. Thank you!

Hi Fellow VJers!

 

I need your help for specific Manila US Embassy rule if it is. We got our case completed on Jan 27. 2014 and got the appointment letter on Jan 29 with Mrach 13, 2014 interview. We rescheduled my interview on February 12, 2014 but our case didn't leave until Friday, Feb 7, 2014 so the expected delivery would be before Feb 11, 2014. My questions are, is it safe to take the interview on Feb 12, 2014 if the case shows ready at CEAC on Feb 11, 2014 or do we need to reschedule it? What number can we call to confirm that we can have the interview the earliest possible?

We included a bank certificate of our joint account in the Philippines. We also asked a friend and relative to sign an affidavit of bonafide marriage. I had it notarized by a lawyer.

Lol! My Husband hates paperworks too so I was the one who researched and filled out some and just had him print and signed it, I also asked him to double check and read me the documents he was sending and to which address. Sometimes I annoyed him but he was ok and said after this, I will be the one to take care of the following papers. He was referring to the ROC. lol. Probably run another check before he put everything in the envelope.

Now I am worried about my case? My BC has Middle Initial on it but my passport doesn?t have. When I applied for my passport , I gave them my BC and told me that since I am Illegitimate, then theres no need for middle name. So they  just put my given name and family name on my passport and no more middle name or middle initial.

Planning to send both my BC and biopage of my passport with our I-130.  Do you think I will have the same problem later?

 

 

 

 

 

Hey! My sister had a similar case with the bc . It showed on her bc that she is illegitimate and they wanted her to use my mom's last name (maiden name) instead of her dad's. She uses her dad's last name on all her school records so her bc is not matching the records. What she did, she went to the local municipal office and had some amendments, She asked her dad to sign something for her to use his last name and whenever she gets bc from NSO, she gets the one with the note on the side that her dad acknowledge her as his daughter and let her use his last name.

They won't cooperate. They said they onle deal issues regarding jobs of foreign workers her and told me to settle the issue in the LCR, they said it is not in their jurisdiction.

 

Scare them with the republic act 

Republic Act No. 10172 Implementing Rules and Regulations.

 

I guess that is your only option at the moment. Remind them the law if they don't know it.

Another thing, if I will do this option, I cannot come back here in HK again bearing a different passport. I will definitely go to jail. Even Phil consulate here warned me of the possibilities and the risk. Some Filipinas did corrections like what I am doing now and got in trouble. 

So, more or less, I need to file my K1 visa in Phils and and US consulate in Phils. will surely dig my documents from US consulate here in HK.

If at least... I can hear a guarantee that I have a big chance I might pursue this route.

 

You said you can no longer file a petition for correction in the PH but I found something that said you can file it in the PH Consulate in the country you are now. http://www.census.go...and-regulations  . I'm not sure if you already read this or even tried. Let us know.

that stupid lawyer I hired didn't do his job. I was in Australia when he could have filed for an appeal when the decision came out. He screwed up the chance. Now I believe... with the 2 lawyers I hired for all these visa issue... lawyers can't be trusted sometimes. they just after money.

 

Yeah! It's really hard to trust people. I'll try to ask someone and update.

I tried all of that. I was trying to late register when that BC came out. The NSO insisted it is mine, and get it corrected. I know PAO, but this time even the lawyer nor the court can do anything because the first petition to correct it got a final decision and that means I cannot file the same petition again anywhere in Phils. 

 

That really sucks. But there should be a way. I will ask a friend regarding it. It got finalized in the regional or supreme court? Did your lawyer just missed the time frame for filing an appeal?

Hey this is just an idea. Have you asked your local municipality if you can have a late register for your birth cert and have all the correct info there? Instead of getting the birth cert that you have that you consider not yours due to the discrepancies. Or if you can get help from PAO, public attorneys' Office. Do you know anyone in the municipal office? I know you know that some "public servant" still consider the "kumpadre system"

I am holding a PH passport. I was 19 when I applied a job oversea and the agent did all for me. I was just asked to give necessary infos then they did the processing in the DFA.

Thanks POA. My petition for correction got a final decision from court after three months. My lawyer could have filed for an appeal. He didn't. After the decision was made final by the court I cannot file the same petition again, anywhere in the Philippines. That is why I said there is no point hiring a lawyer this time. What can a lawyer do if Court won't accept a petition for trial?

 

Also we are planning to get married in HK not in Philippines. 

 

Yeah that really sucks that you spent money for nothing. But just to share experience, when they made a mistake on my name on my social security card here in the US, they asked for my marriage contract and my birth certificate. So I am not sure how will you have it corrected. They usually make a mistake for people with two first names like myself. They tend to put my second name as my middle name. Just out of curiosity, are you holding a PH passport or other country?

I'm afraid no lawyer, no court this time. The first petition was final. My lawyer's fault, he didn't filed for an appeal. 



What I was trying to say is, hire a lawyer to get vour birth cert corrected before you start another petition. Just to make sure you have it all correct because if you are planning to get married in th Philippines they wiLl ask for your birth cert and mirror it to your marriage contract. You also need your birth cert in renewing your passport. So it is very important you have all the info correct in your birth certificate.

I have some questions: 

 

Do you have a PH passport? If so, how did you get a PH passport without presenting your birth certificate?

 

Are you planning to get married in the PH? 

 

Because if you are, you would need to present your birth certificate to get a marriage license in the PH and they will mirror your info on your marriage contract.

 

So i guess, the best thing to do is get your birth certificate errors corrected first to make sure all your following documents will be correct.

 

I'm afraid you really need to get a reliable lawyer to get your bc corrected.

At the USCIS website, Elis, we paid for it the moment i received my visa in the mail. Sign up here http://www.uscis.gov/uscis-elis, then you will get a new case number that you could check the status from the check status link of USCIS.

I was on CR-1. You need to pay the fee or they won't mail her green card. We paid mine right after I got my visa and received it after a month of getting here. There would be no fee then until the ROC.

I have a question for all those who have already been approved their CR-1 Spouse Visa:

 

My entire case has been approved on July 17, I payed the fees for my Green Card on July 26, I entered the US on July 27, I moved within the US on August 14 and I changed my address August 28.

I still have not received my Green Card or Social Security Card and as a result can not do anything there (get my Driver's License, open a Bank Account, get a Credit Card, or start a company).

 

What do I do?

Did I miss something?

Who do I call?

 I was on CR-1, received my SSN after 10 calendar days and received my green card 5 weeks after my arrival. Paid the $165 before I left for the states.

 

Yes you can go the SSA to get your SSN just bring your passport. You might want to bring your marriage contract and birth certificate just to be sure. (they asked for those when I corrected my name at the SSA since they misspelled it) 

 

I guess the rest for the green card was answered.

Hello Vj members, got a question that I read from the internet their passport was in the same package which u suppose to not open the seal. Now my question is...how will u get ur passport out of the package when its sealed, to show at airport for traveling? thanks for your time

 

The passport and the packet are both inside the plastic. So you can open the plastic where you can get your passport without opening the packet.

Call them around 7PM or 11:50am MNL TIME. 7pm because it is their opening time and 11:50am is 10 mins before they close. That's what I did when I was in the PH. I am the beneficiary. When I tried calling them in the mid of the day US time, i usually get busy tone. 

 

They don't usually reply timely in email. If I could remember it was a few weeks. I used NVCinquiry@State.gov but never used the other email so I am not sure which is better.

I am an American living in the US. I was introduced to a Filipina from Cebu that was married but unhappy and looking to divorce her Filipino husband. Some half assed research has led me to believe that there's no way I could ever petition for her to come to the US on a K1 visa because Philippines does not allow divorces. Am I correct in my assumption? I read something about paying almost $3000 and waiting 2 years to get a divorce recognized in Philippines. Long story short, what can I do, if anything, to petition for her to come to US and marry me if she's already married in Philippines?

 

She needs to be annulled. Being unhappy with her husband isn't even grounds for annulment. Philippines is strict with that. Not even adultery will be ground for annulment plus the fact that it cost a lot and takes so long.

 

If she still lives with him, I kinda suggest think well. I am not trying to generalize Filipinos but asses her well,

My wife already changed her last name to my family name, including on her passport. In this box, do I enter her last name at birth correct?

 

My wife has changed her name to my family name. She had entered last name as my family name. If your wife has changed her name officially including passport she must enter her last name which is in her passport. It is understood that after marriage if spouse change their name.
