No not for K-1 because K-1 does not stay at NVC, they log it and then send it to the embassy. Some cases are only there for 2-3 days.

Call DOS if you are looking to find out if your case left NVC.

Could you tell me please what is DOS?
Thanks

IR-1 / CR-1 Spouse Visa Process & ProceduresJoint Sponsor's Liability
I'd like to explain to my aunt exactly what her total liability would be in agreeing to be our joint sponsor for the CR-1 spousal visa.

If my spouse gets sued in the US or incurs a $100,000 medial bill that we can't pay, how exposed is our sponsor?
Is the scope of their financial obligations limited only to government benefits?

Yes, correct. Visiting...

Though the form says "Information about your relative"..."2. Address"

Her perm address is Peru, though she's here by my side in the USA.

My spouse is currently residing with me in the US, but will be departing for her home country soon. We're filing the I-130 before our departure, and was wondering if the addresses (in part B and C) at the time of filing should match if we're both in the same location?

IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 Submission Timing Question
Howdy -- Quick question for you all.

My lovely Peruvian wife and I were wed last Friday. I'm a natural born USC. She's here on a tourist visa.

I'd like very much to submit the I-130 package to the USCIS, but am unsure if this is permissible while she's still visiting the country. We've already purchased airfare to leave (together) for Perú on May 20 to wait out the process and use the embassy in Lima to do the final interview after NVC processing.

Can I do this now, in April, or do I need to wait to mail it off just before she departs? I'd read that initiating the process while she's here is a problem:

My fiance/fiancee came to the U.S on a tourist visa and we intended to get married and for him/her to return home afterwards and then immigrate from outside the US. Does this mean our petition will be denied, and is what we did illegal??
No. It is perfectly ok to marry in the US on a tourist visa as long as the intending immigrant returns to his/her home country to file the I-130, and does not try to adjust his/her status and remain in the US during the I-130 process, as that is illegal.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864A - Living with my Aunt
Howdy,

Just wanted to make sure I'm filing out the I-864(a) properly for myself and our sponsor.

The joint-sponsor is my father's sister (my aunt), and we have the same address. It's my understanding that we're all considered under the same household by this standard, and as such she would be filling out the I-864A.

Just wanted to make sure this is getting filled out properly... (the "other dependent" verbiage is a bit confusing)

8. Relationship to Sponsor (Check either a, b or c)

c. I am not the intending immigrant. I am the sponsor's household member. I am related to the sponsor as his/her:

? Other dependent (specify) AUNT (SISTER OF SPONSOR'S FATHER)

IR-1 / CR-1 Spouse Visa Process & ProceduresCR-1 Concerns

Also can you travel in and out of the US while it is being processed?

Typically if your spouse has a tourist visa the game is up for coming and going from the US -- it's hard to prove that you want to be a tourist and have no intentions on sticking around after you've expressed a desire to immigrate to the country.

All that matters is your residence the time of filing. Speculation on when or where you might leave that home can be kept to yourself.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864a or I-864?

You aunt is not your parent, sibling, spouse or child so she would do the I-864 as a joint sponsor. Simple as that.

Based on that criteria, yes, I'm inclined to agree -- although initially I really thought it would be an I-864a b/c of our close family relation and shared residence.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864a or I-864?
My aunt (father's sister) has agreed to be our joint-sponsor. We share the same address/household.

But I'm a bit confused as to what AOS paperwork to file regarding her joint-sponsorship. According to the instructions, it doesn't seem like she qualifies as a traditional "household member":

Who May Be Considered a "Household Member" for Purposes of This Form?
A relative who has the same principal residence as the sponsor and is related to the sponsor as a spouse, adult child, parent, or sibling;

Initially I was going to proceed with an I-864a -- is this incorrect?

perpetual nomadMalePeru2010-11-11 22:26:00
IR-1 / CR-1 Spouse Visa Process & ProceduresI-864 Gotcha?
I pulled this from a list of "Potential 'gotchas' on form I-864":
On the top right hand corner of each page the petitioner must write (not type) their full name, social security number, and the words "Form I-864".

On the James' Shortcut guide, there's this little note:
"Make sure to write your case number in the upper right-hand corner of EVERY page including I-864."

The NVC says only this:

Before mailing the I-864 to the NVC:
1. Ensure that:
- All pages are in the correct order and stapled together
- Each page is filled-out completely
- The form is signed

Thoughts?

This provision does not apply to joint and substitute sponsors.

On the Joint Sponsor's I-864, do both boxes need to be left unchecked?

Just attempting to keep things as easy as possible for our generous joint sponsor, who has already done a lot.

Thanks for your thoughts -- I've told her that if she's issued physical pay stubs that I'd like to include the latest one (even though the employment letter is current).

My joint sponsor makes in excess of $100,000. She obtained a letter from her employer. She will be submitting IRS tax transcripts from the past three years. I'd think it was pretty obvious that she's making money w/o the extra evidence.

Thoughts?

IR-1 / CR-1 Spouse Visa Process & ProceduresDS-230 Packet Checklist (Peru)

That is what I thought also, but you are not applying for immigration in Peru, you are applying to NVC, which is in the USA.

The sentence isn't directed towards DCF filers and non-DCF filers, but (according to the person I spoke with over the phone) folks who are submitting documents which are not in the official language where the interviewing embassy is located. A Russian birth cert for a beneficiary that will be interviewed in Russia is just fine w/o translation.

When in doubt contact your local embassy or wait on the phone w/ NVC for clarification. ;)

IR-1 / CR-1 Spouse Visa Process & ProceduresDS-230 Packet Checklist (Peru)

I read conflicted posts on the need for translation. According to some, a translation is required for each document when it is sent to NVC.

Translation Requirements

All documents not written in English, or in the official language of the country in which application for a visa is being made, must be accompanied by certified translations. The translation must include a statement signed by the translator stating that the:

* Translation is accurate, and
* Translator is competent to translate.

http://travel.state..../info_3195.html

In this case, the documents are written in Spanish and the application/interview will happen at the US Embassy in Peru -- no translations needed. If she was born in Brazil (Portuguese speaking) and dealing with the US embassy in Peru, then yes, they'd need a translation.

Looks good.

Hope the beneficiary signed DS-230 Part1, but NOT signed Part2.

Write NVC Case#, Beneficiary name and DOB at the backside of the photos.

Also, I hope you and your spouse had no prior divorce(s). If I am wrong, include the divorce decree of each marriage termination too.

Loto

Thanks for looking that over. No prior anything (divorce, etc) and I'm sitting w/ her here in Peru... so she certainly won't be signing Part II!

There's not much to my I-864 packet, so just wanted to make sure things look kosher to you fine folks.

This is it, aside from the generated coversheet (w/ barcode) and my cover letter, which lists the following...

1. Form I-864 - Petitioner

1.1. 2009 IRS tax return transcript
1.2. 2008 IRS tax return transcript
1.3. 2007 IRS tax return transcript

2. Form I-864 - Joint Sponsor (the petitioner's aunt)

2.1. U.S. passport biographic data page
2.2. Original letter of employment
2.3. 2009 IRS tax return transcript
2.4. 2008 IRS tax return transcript
2.5. 2007 IRS tax return transcript

I'm not even going to bother w/ my income, as I'm self employed and far below the poverty line. The joint sponsor makes plenty.
