I have always lived on the side of being prepared. Yes it does say if 6 months or longer. But the fact that she does not have her old passport, may raise the question. I would get one anyway, just to be on the side of caution. I know it is not easy for her to get one, but it is better to be prepared, than to have a delay. This is just my opinion!


As the saying goes better safe than sorry so I told her go ahead and get it but it now appears that the Manila Embassy is processing things faster so she probably won't get the police certificate in time, what a bummer. :angry: It takes 2-3 months to get the P.C. and I'm pretty sure her interview date will be before that comes.

Do you know, would I need to call and change her interview date and is there a long delay with that?

That is part of the problem, she isn't sure it was six months or more. She thinks it was just short of six months. She doesn't have her old passport and got a new one. So how would they know? If she puts dates that are just short of six months then how would they know for sure. I only want her to get the P.C. if she really needs it but if not then we can eliminate one big headache. Her local Japanese consulate told her that she needs to get the travel dates from the Philippine Bureau of Immigration. Both of us don't understand why they requested that. The P.C. is basically a criminal background check so both us just don't see why she needs to go to the Bureau of Immigration in Manila. :wacko:

Since she worked in Japan, she will need a Police certificate from Japan. She needs to present that at the interview.



It says with the instructions from the Manila Embassy that she only needs the P.C. if she was there for six months or longer. Is this correct?

No, they will not check in the passport.......but she needs a police certificate from Japan, now depends how long she stayed there......



She isn't positive that she was there for six months which seems to be the cut off date to determine if a police certificate is needed. I think it might be best just to put dates on her DS form that is just short of the six month period then we don't need to bother with the P.C.

So do you think this sounds correct concerning the actual dates? If shorter than six months then no problem?

My fiance had previously lost her passport but got a new one and she had been to Japan before for work with the old passport. On some of her forms it will show that she was in Japan so we wanted to know at the interview will they look at the passport to see if she really went to Japan because her new passport won't show this? Will this lead to another problem? We just don't want any surprises. :help:

SO they received our Petition on May 21st and cashed the check May24th. Online they r telling us that they send us the NAO1 but we havent received anything yet. i know some ppl dont get an NOA1 but i am worried that if the first one didnt show, will the second one????


I never got our NOA2 though approved. I got an approval email from them and I printed off the approval of the NOA2 from their web site. It has been 43 days and still no hard copy of the NOA2. I called USCIS and one guy wanted me to fill out an I-824 to get a replacement for $340. So I called back to today and that person sent a service ticket to some internal department. He gave me a reference number but then says it won't do much because once he sends the service ticket there is no trace of it in their system. Then he says give it 45 days. I said, it has been 43 now how much time do you really need for one piece of paper? I had a few choice words for this system but I kept them to myself.

This system needs to be fine tuned in the worse way.

Someone advised to follow the RFE prompts and we got someone who identified himself as being CSC, but I didn't do anything special aside from that, that I can think of (granted, I didn't jot down the EXACT keys I pressed).

Guess we'll just wait some more!

Well, we succeeded in getting to CSC after all. Howard spoke to a nice lady in Laguna Niguel, and of course she was surprised we never got our NOA2 as we were approved May 7. She said she was sending a duplicate. Yippee! I might not have it for my interview next week (hopefully they won't need to see it there), but we want to file AOS before the fee increase, so the sooner it comes, the better.

These are the prompts we used:
* 1 for English,
* 2 for main menu,
* 2 for reporting an issue,
* 4 for more evidence,
* then 2, 1,
* then entered our case number (with the WAC at the beginning, that is 922+10 digits).
* then it took us to a representative in the service center.



I used your tips today and it worked great. Talked to some guy at the CSC and he said he would request a new NOA2 be mailed to me. I'm sure it will take a while but it was nice to talk to someone that listened and just didn't say, you need to fill out form, blah, blah, blah and send $200 with it.

Congrats!! I hope to get mine soon as it was approved on May 3rd also. I did call today and actually talked to someone at the CSC. He was nice and put in a request to get another copy of my NOA2. He even suggested that they knew of a problem that resulted in many of us not getting our notices.

Great update! I just got through to CSC by following the prompts for an RFE, and before I even started my schpeel about not getting the NOA2, she said "Ok, it seems there is a problem, the notice was sent back to us. There seems to be a problem on all notices that were sent out for approvals on that day. We will send you a duplicate copy and you do not have to pay any fee. You can expect it within 20 days."

I was like Wow!! that is exactly the information I wanted to hear! :thumbs:

So I don't know if you have to call to make sure you get the duplicate...but at least she acknowledged that there was a problem with the May 3rd people. Hopefully they will correct the problem for everyone!

If you have worked at the same job for over 3 years, exceeding the minimum income, 3 years tax returns will satisfy that requirement entirely.

By the way, if you are dealing with the Embassy (Capital City), it is the Consular Section of the Embassy.

On the other hand, if you are in another major city, you are dealing with the Consular Section of the US Consulate.

People always get that wrong here. Everything is called a Consulate = Wrong and not factual.

I am leaving tomorrow for Jordan. I was told it takes two days to get the police clearance for Yemen for my husband. He however was told, it will take weeks.

HAS ANYONE GONE THRU YEMEN?

Don't know about Yemem but my fiance went to get his police report today too expecting it to be done right away and they told him it may take maximum up to ONE month and his interview is in 2 weeks.....!!!


Just curious did you get the police clearance in time for your interview and if not what happened? We are going through the same thing trying to get a Police Certificate from Japan. So far this is the hardest part to do as they say it will take 2-3 months and I know her interview will be before that time. Grrrrrrrrrrrrrr. :angry:

I will still be doing the tax returns but she will definitely be out of the U.S. longer than 2 yrs. I will be working for a U.S. owned company. It appears that she will have to abandon her status on the I-751.

I could possibly be leaving the U.S to take a new job in a foreign country. Once I leave my filipina wife MJ will go back to live with her family as I won't be able to take her with me on this assignment. During this assignment I'm really not allowed to visit the U.S. as I get a special tax break by not visiting the U.S. while employed in this foreign country. By not visiting I don't have to claim taxes on $80,000 of my salary so if I come back to visit I take a huge hit in taxes. The rest will be taxed normally. I plan to retire in the Philippines where we will buy some land and build a new home.

So I have a couple of questions.
  • I assume that I should notify USCIS that we won't be filing the I-751, right? We don't need to file until January 2010 but we won't be here to do so.
  • If for some reason I need to come back to visit in the U.S. can my wife accompany me?
If I missed any thing let me know.

Our 90 day window for filing our I-751 starts ticking on Jan 9th, 2010 but we received what I would call a reminder letter but it was on the rude side. We haven't had to deal with them for almost two years now and that part has been nice. I noticed for whatever reasons that our home address was incorrect and missing the space number. I called them and they tell me I have to write a letter to the local office or request in INFO pass. You got to be kidding me! More than likely it was just an 'oops' on the missing number but just having to go through a dog a pony show for this is truly unbelievable. It reminds me of everything that is wrong with our government. mad.gif

Things could be worse but for something so simple they make it so hard. I can hardly wait to send in our I-751 so the games can begin all over again. wacko.gif

Well its now February 7th and still no sign of our biometrics appointment letter. Our NOA 1 is dated 1-12-10 has them receiving our package. I see almost everyone has either been notified or got their biometrics completed within 30 days. We only have 5 days left till the 30 day mark and not even a notice. I hate going through this process. Is it time to panic?

From what I've seen - 2 - 3 weeks seems normal; A lot of folks have their actual appointment within/near the 30 day mark..

I have been impatiently waiting for my wifes biometrics appointment letter and what do you know, we received a congratulations letter.

Congratulations! Your request for the removal of the conditional basis of your permanent resident status has been approved. You are deemed to be a Lawful Permanent Resident of the United States as of the date of your original Admission or adjustment of status.

You should receive a new Permanent Resident Card, Form I-551 (green card), within 60 days. Your card will include a mailer, Form I-797D, with important services available.

The rest was the usual blah, blah, blah.

Has anyone been approved without having their biometrics done?

(i) who is determined (in accordance with regulations prescribed by the Secretary of Health and Human Services) to have a communicable disease of public health significance, which shall include infection with the etiologic agent for acquired immune deficiency syndrome,

(ii) except as provided in subparagraph © who seeks admission as an immigrant, or who seeks adjustment of status to the status of an alien lawfully admitted for permanent residence, and who has failed to present documentation of having received vaccination against vaccine-preventable diseases, which shall include at least the following diseases: mumps, measles, rubella, polio, tetanus and diphtheria toxoids, pertussis, influenza type B and hepatitis B, and any other vaccinations against vaccine-preventable diseases recommended by the Advisory Committee for Immunization Practices,

(iii) who is determined (in accordance with regulations prescribed by the Secretary of Health and Human Services in consultation with the Attorney General)-

(I) to have a physical or mental disorder and behavior associated with the disorder that may pose, or has posed, a threat to the property, safety, or welfare of the alien or others, or

(II) to have had a physical or mental disorder and a history of behavior associated with the disorder, which behavior has posed a threat to the property, safety, or welfare of the alien or others and which behavior is likely to recur or to lead to other harmful behavior, or

(iv) who is determined (in accordance with regulations prescribed by the Secretary of Health and Human Services) to be a drug abuser or addict, is inadmissible.

Not sure why YuandDan are replying here. I was thinking his wife immigrated from China. Anyway call 632-528-6300 X5184. Call early in the morning 7:30 to 8:00 AM Manila time. Keep trying if you don't get through. Any later in day Manila time you may not have much luck getting through. Good luck.

IIRC the recording says they don't open until 8am. Lina kept trying over and over right after 8am and got through pretty quickly. Machine-gun speed dial works. :thumbs:



Thanks everyone for your input as I called on the way home and someone answered, go figure. :thumbs: Luckily I had the case number memorized. :wacko: Packet was received on May 15th. Now for the next stress period and dealing with trying to get her police certificate from Japan as she worked there a couple of years ago. I doubt she will have it by her interview date. What a waste of time waiting all these months and not knowing about the police certificate requirement. :crying:

Anyone know what the best way to contact the Immigrant Visa unit is? I have been calling the number in Sheriffs post but all I get is a recording saying that person at that extension is on the phone. Any ideas? Just wanted to verify that they received my packet from the NVC.

My fiance is required to get a P.C. because she was in Japan a few years ago for six months. We both called the Japanese Consulate in Davao as everyone says that is the procedure but when we both call we got two different stories on how to get the P.C. First they say just come down and bring her passport. Then she calls and they say she has to go to Manila to the Bureau of Immigration to get the departure and arrival dates?

I don't see why they need this because they are just going to run her name through their records system in Japan to see if anything pops up. So why go to Manila for this other stuff?

Anyone have any insight to this? It seems like every other day some other requirement pops up or is changed or nobody agrees on how it is done.

Mylene (CountryGirl above) had to get a police clearance from Japanese Embassy as well .. here was the procedure we had to use to get the clearance ..

Because the police clearance takes 1.5 to 2 months to get back, we tried to get the clearance very early.

When she went to the Japanese Embassy they told her that they will only entertain a request for a police clearance from the US Embassy;

she then went to the USE and asked for a request to present to the JE but they will not give it out until her case has been forwarded to the USE by the NVC.

We waited for a few months and once the case had been received by the USE in Manila (electronically) Mylene called and requested an appointment time to pick up a request for police clearance.

She was given an appointment the next day early to see the person at window x; she was told to bring her passport, NOA-2, and case number.

The next day Mylene went to the USE and picked up her request for police clearance; she has to insist to the guard that she had an appointment to see the person at window X; this was the most difficult part, getting past the guard.

She then went to the Japanese Embassy and presented her request for police clearance, they made her go to Camp Crame to have her fingerprints taken (they give her a request) and also gave her some forms to complete in triplicate. (go as early as possible so that she can do both of these in 1 day).

When she returned from fingerprinting and presented the request for police clearance, forms in triplicate, and fingerprints .. she received a receipt number. She was told to start calling in 1 month to see if the clearance is back yet, it has been over a month and nothing yet.

Some things in life should not be difficult and this is definitely one them. They act like it is a crime to request a criminal background check on yourself. I have talked to two Japanese consulate locations in Davao, Cebu, and their Embassy and all three told me something different. The Embassy is by far the most strict. I think we will go to one of the consulates. They seem to be a little more cooperative. And to make it more difficult my fiance loss her original passport but has a new one but she has her copy of the Affidavit of Loss for her original passport. The lady at the embassy just didn't want to listen or understand this. I just want to get pass this certificate thing and hopefully after this struggle the rest will be easy.

this is a case to case basis, so my example could always 'may' be differ to yours or as to everyone. there's a lot of factors why someone is being put on AR. for example the fiancee forget her fiance's divorce decree/latest ITR etc so they will ask for her to comply it, so they will put them on AR for the moment until she already has it, and they will give a decision to approve her petition. some consul would even let them pay for delbros (visa delivery) knowing what is lacking is not really a major factor to cause denial, yet just some basic requirements that one has forget or overlooked upon. so im not sure what you mean by the "appoitment". you mean would she have another interview? i think all she need is, just pass the PC if requested then they will release the visa or their decision. or its really up to the consul. my understanding...


Yes I was referring to another interview. Well if everything else goes good and we have to wait for the PC that won't be so bad. I was hoping they wouldn't put her on some long extended waiting list.

Here's an interview experiece written by someone who has a similar situation as your fiancee, she also went to work in Japan and lost her old passport. I got this from the now defunct asawa forum, the link is not working anymore and so i just copy and pasted it here. She was even asked to return for a 2nd interview with the consul. The flow of her interview questions were mostly about her stay and work in Japan. I am not saying your fiancee would also have the same questions. It is a case to case basis and depends on the consul. Just want to send you this so it might help you to know what to expect.


I arrived in Manila embassy around 4am and on window Y the girl gave me number 7074...i was a bit nervous because she never received my passport and just told me to wait for my name to be called.Day before that i went to US embassy to borrow my passport to get the Japan clearance in Japan embassy,they will not give it without the passport.Embassy always tell my fiance that they don't need any documents from me coz i just lack signatures.It was a little weird for us because there's no such thing based on what i read here on asawa.So we decided to do our own thing and be prepared.

Around 10:30am my name was called to window 24 and the Filipina asked me:

F: why you get your passport yesterday?
Me: I need to get my police clearance in Japan embassy Ma'am

F: Did you know why you're having second interview?
Me: I don't know Ma'am,i just want to be ready

F: You lost your passport,why?
Me: My employer in Japan lost it last 2003 and i just traveled back here with travel documents

F: Do you have the affidavit of loss with you?
Me:Yes Ma'am( i'm glad my employer was very helpful about this.Well,that paper was already with me because the japan embassy needed it also).

F:How about your certificate of travel records from Bureau of Immigration?
Me: Yes Ma'am and i gave it to her.( they said they don't need any docs anymore but look what had happen so don't believe them!

F: Okay,go back to your seat and wait for number to be called again. I will refer this to the consul

I'm soo glad i have everything ready considering they never told me what to bring.From 10:30,i'm anticipating for my number to be called.It was lunch break already so they let us go to eat our lunch and let us back around 1:15...I'm back there around 1pm and to make things worst my friend whose having second interview too like me was called to window 35 and she said she was denied.I saw the denial paper and it says the divorce of her fiance was not valid.This add to my nervousness coz i thought i'm the next one to be denied.It was 4 in the afternoon already when my number was flashed on window 27.I suspected that maybe they verify the papers i passed that's why i was called late already.

The consul was soo strict to look at so i'm shaking inside when he started with his questioning.It was fast and he really try to intimidate me

Gosh! I don't know until now how i survived it.There's still a lot of questions he asked that i forgot, it focused mainly on my work in Japan. Maybe because i was an entertainer...Well,i'm glad i'm done and i could see that even he let me feel he did'nt believe me but i'm sure he's satisfied with my answers because i answered him well and full of honesty.I think their approval depend on how you answer it and how you conduct yourself in front of them.It was not easy but if the relationship is true and you know in your heart you've done nothing wrong in the past,you could make it!

I was called in window 35 and saw that approval sticker again.She let me pay the delbros but i told her i paid it already on my first interview so she said,okay just wait for your visa to be deliver and yesterday i received a text message from delbros that my visa is out for delivery..Oh my i can't wait to be with my Baby soon.Thank you soo much guys for all the help with this journey

Thanks ronmay, yes i meant another interview to finish the process because she might not have the PC but if they let her pay and basically approve everything else and we just need to submit the pc to get the visa then that would be great.

Do they still approve the Fiance visa or do they have you come back and deliver it to them once you receive it? Just curious as my Fiance will more than likely have her interview and not her Police Certificate from Japan. I wish we knew this five months ago. Oh well. :angry:
