i filed an I-129f petition for my canadian boyfriend in may. we sent it from canada and uscis told me today that the first notice of action was sent to my mom in indiana on may29. she has not received anything. i'm guessing that one month mail time is way too long....??

I would call and make sure they have the address right. If they do ask them to send a new copy.

Your petition will go to the NVC to be assigned a new number. When it leaves there you will get a notice that it was sent. After that it will go to the embassy in your SO's country. Your SO will get a letter saying that they have the petition. At some point your SO will be assigned a interview date and will get a package with the forms needed. Your SO will also get a date for her physical at St. Lukes. Just follow the instructions included. I would suggest that she gets certified copies of her BC and a NBI report. If she has a prior marriage she will need her annulment papers including the court papers. If she has never married she needs a CENOMAR. Make sure her passport is up to date also. It will need at least 1 year before it expires.

Like someone else said some cases get 'touched' a lot, others not at all! We only had one touch just after CSC received it from TSC, then nothing til we got NOA2. All it (touch) means is someone did 'something' with your file and updated the computer to say they had done so.
Having alawyer won't speed anything up - al cases take the same amount of time (more if you get RFE - which means returned for further evidence - or get stuck in security clearance checks - aka 'AR or AP')
You don't 'need' a lawyer unless your case is complicated, however many people use them for the peace of mind (altho we have some horror stories here!) and hopefully retaining one means they will double check all your paperwork BEFORE its sent off, possibly reducing the possibility for an RFE. It doesn't always work out that way, but if you have the funds and want to go that way then that's fine.
Any lawyer that tell you he/she can get your petition thru the system faster than anyone else's however is not being straight with you.
Everyone has to go thru the same checks and waiting times - the exception being members of the armed forces about to deploy.

How do you know your case has been touched? Will I get an email each time someone does something to it? I did put my email address on the pettion.
I got a lawyer because there were some "issues" with Luz's prior marrage's. I thought it best to seek a good legal counsel. I also wanted someone to double check all the paperwork and talk Luz through the interview. After 2 years of wading through the Philippine legal system to get her annullment we wanted to make this happen as soon as it can be done.

Hello everyone! I just filed a K-1 Visa for my sweetie on March 13 with the Nebraska Service center. I have been watching the posts here and I am wondering about a few of the terms that are used here. When someone says their case has been "touched" what does that mean? I provided an email address on my petition. Do they email updates to you? Is that a "touch"?
We hired a lawyer (***) to help us out just to be sure that everything is done right. Does having a lawyer help to speed things up or make things go smoother at the interview? I am so anxious to get things done right.

no necro posting please, this thread was 5 weeks old since last post, but of course it will always resurrect in one form or another.

When I sent our I-129F in I included pics taken over the last 2 years. I made sure to include pics of Luz's son in there because it is easy to see that he changed a lot from age 13 to age 15. As a kicker I made sure I had at least one pic of Luz and I showing my tattoo with her name on it. That should show at least MY strong intent to get married. :D

-I would think she would have a compelling case in favor of her bringing her son with her ( and the fact he is 15 helps)-the main thing is to do it the right way according to the laws of the country she and her son are a citizens of-the very best course of action would be to seek local professional legal help in determining the correct papers to file there........that's the only point I am making......

Custody of children is nothing to play " fast and loose" with-especially when there are EX's involved and the fact that there are plans of immigrating make it more complex.

Don't worry----Just dot all the i's and cross off all the t's....Protect the custodial rights that are already in place and build the case to obtain the rights you need.....

I just talked to Luz. According to Philippine law she has total control over her son. She also told me her son's birth cert didn't get filed until after they broke up. SHE DIDN'T PUT HER EX'S NAME ON IT!! hehe Sly little babe I have there! One less worry!!! :D

Oh boy! This just started a whole new way for me to worry! Luz was granted full custody of her now 15 year old son but her ex did not cooperate in any way with the annullment. Her ex hasn't seen Robin since he was 9 months old and hasn't tried but I am sure if he was asked to sign a permmitions paper for him to leave the country he would refuse just to spite Luz. Does anyone have experince with this sort of thing? Her son does have a passport.

I think we are talking about 2 different things here. For the I-129F application you only need to prove that you have met in the last 2 years, you are able to marry and you intend to marry. When the fiance goes in for the interview THAT is when the boatload of evidence is needed. The consule is the one that determains if the relationship is bonified. At least that is my understanding of things. For my part I am going to make sure that Luz needs a wheelbarrow to carry all the evidence into her interview.

That is a hard one. Personally I can't stay away from there. In the last 2 years I have gone back 5 times and am planning my 6th trip in June. Good thing I have an understanding boss :) But if you can only go 1 more time it would prolly be best to go with her when the visa is done. International travel along with moving can be a real pain. Any help you give her there would be nice.

This is all governed by international treatry, which the US is a signatory. You will find a link somewhere on the Dept of State pages. Basically any child brought here without the permission of both parents will be sent back as an international kidnapping. The other parent can file thru a US Consulate to have his/her kid returned, and it will happen.


Since the fathers name isn't on his birth cert I am wondering if his father even has a basis to object. One would think he would first have to establish his parenthood. Since that would involve DNA testing and a huge expense and given the fact he is a drunken gutter bum without a job I doubt if he could do anything. My only question is will her son be allowed to leave the Philippines or enter the US under these circumstanses?

My situation is somewhat like this that I wanted comments about it. My fiance has a 15 year old son. She left his father when he was 9 months old. His father hasn't seen or tried to see him since. He has also offered no support. Luz got an annullment from him and the court order says "full custody is granted to Luzviminda". However it also says something about reasonable visitation and support. So my question, his father has not offered support. He has not tried to see his son. Her son has a passport. The last kicker is, Luz had not filed her son's birth cert until AFTER she broke up with her ex. She did NOT put her ex down as the father! In the box for fathers name there is N/A.
So, based on all this does anyone think there is any reason to worry here? I know for certain that if her ex's permition is required he will not give it just for spite!

Things get rather uhhh... spicy. :devil: Do you all think if I just documentend my 5 (soon to be 6) trips there and showed them the thousands of pictures of us together it would be enough? Luz's son has his passport now and that isn't a problem. I just have this nightmare that he will be turned away at the POE. He already calls me "Pop" and I really want to adopt him after his mother and I get married. I have been trying to get an answer from my lawyer about this but so far I haven't gotten an answer from him. I guess I will have to camp on the phone and wait my turn to talk to him. :angry:

Maybe his bc is an abbreviated one? I know my childrens bc's were like that and I had to apply for their full bcs showing both parents? Unless you fiancee has full custody of her son the consulate will require consent from his father for him to leave and some consulates have been known to ask for a parent's consent even with full custody.

It is a full BC. The spot for Fathers name has N/A in it. It was a delayed submittion and by that time her and her ex were broken up. She didn't want the bum's name on it. Her son carries her madien name. At the annullment Luz was granted full custody although it has the customary "reasonable visitation" remark on it.

I want to double check my understanding of the K1/K2 process, especially regarding the child.

I am in the final stages of getting the initial I-129F submitted. There is nothing in there about my fiance's child other than a line item on the G-325. I believe that there is nothing additional needed at this time. My understanding is that during the interview at the consulate, the discussion of the K2 visa will come into play.

Is there paperwork that will be filled out on site? I ask, because in the docuemtation I have read, it does not seem to mention that Birth Certificates for the finance or child need to be included in the packet at the consulate.


Should have the child listed on the I-129F, not the G-325. Until the petition is approved and forwarded on the the embassy nothing else must be done for the child or your fiancé. However, they can start on getting their passports, birth certificates and visa photos together, if they don't already have them. The child will need a medical exam and submit a visa application along with the filing fee, same as your fiancé. If the child is under 16 no police clearance will be needed and the medical exam fee is reduced. I don't know the procedure of every embassy in the world, but I'm pretty sure that a birth certificate is going to be required for both of them

Is that something that will work for us or against us? I am worried about needing something from his biological father for him to leave. (that isn't gonna happen)

At this point all you need to do is prove you met in the last 2 years, you are both free to marry, the pettitioner is a USC and you have the intent to marry. The rest is all saved for the interview. Just send in the stuff that slam dunks the stuff they want. I sent: copies of my passport showing my entry/exit stamps. Airplane ticket stubs. 10 pics of us together. my divorce decrcee. her annullment papers. my BC. a notarized affidavid stating I want to marry Luz.

I have been putting together all the stuff she will need at the interview. Since I am going to see her again in June I thought I might as well get all that together now and take it with me. Already I have over 200 pages of stuff. Phone records, pay stubs, letters, pictures, original BC, original divorce papers. She will also have a boatload of stuff. TONS of pictures. monthly westernunion recepts for her budget I send. letters. ect.ect.ect...
The interview is where the more the merrier!

I think it will be OK. My lawyer says that when my NOA2 comes in he will send the packet 3 via fax before they ask for it. It is the one way a lawyer can speed things up.

Don't know about the papers you need to send to Manila. What Department of state forms are you referring to? If I understand the proccess she will get a packet with some forms in it and an appointment letter for her interview. She will also get some forms for her medical. As far as anything you need to send I think all you need is the evidence of your relationship, income and ability to marry. Someone that has been through this should be able to give you more on that.
BTW I see you went to Bagio! I was there in January. Loved it there. I also have the boat rowing pics. :D I am going back in June for Luz's birthday. I love it there!
