I will feel more encouraged to see more noa2 approvals, and it will make me feel mine is coming soon. Not sure whether they are only updating the system on Mon, and Fridays now. Very hard to see the noa2s during the weekday.

I noticed that also. Maybe they only work on K-1's and K-3's on those days and on other days work on other immigration petitions.

she's out there too waiting. i've noticed a pattern about the pages you compiled. seems like there are lots of mar/apr ones waiting.

She is there, #20. I got this info from a timeline search. The results don't give your screen name. It gives you the names you put on your timeline.
If you get the .doc file from me and open it in MSWord the names are clickable. They will take you to the persons info page.
Does anyone know a place I could post this file to and provide a link? It might help if we all send it to our congressmen.

You cleaned up a list that Devilette and myself put together that was fairly complete with information from both the CSC listings and NSC listings... Do you have that in Word or Excel that you can send me? This was from 2-3 weeks ago. This might help fill out with some of those who have not yet updated or changed their service center listing.

I don't have that one. It was just a post. You could go back and look for it.

Thanks so much for posting this. It really gives us some solid data from which we can theorize.

So here are my theories.



My first thought is this. The RFE's de-sorted the applications. And, in order to be fair, applications would have to be resorted. But the powers that be probably rationalized thus: Since there are no doubt a number of early NOA1's who for whatever reason were late getting the RFE back, somebody made a decision that re-sorting would be a logistical nightmare for them. So they decided to let the chips fall where they may (or June, March or April, if you will). (except July and August are put behind in line behind the March through June lump.)

Now, as to why the approvals are slowing. I think I've heard murmerings that the NVC is swamped, so they must have told the Centers to slow down? (Say it ain't so!!) :unsure:

Nice theory but it also does not hold up. My IMBRA RFE was in the first batch. The got it on July 6. I have seen people with IMBRA RFE's much later than mine get approved. I thought about putting in the RFE data but it was just as random as the NOA1 dates. Since they USED to go by NOA1 dates as the standard for processing orders I just left it out. It only confused things.

...and here I thought it was pretty quick for Sian and I.... 94 days. Then I see someone from Iraq was approved in 45 days, Morocco in 50 days, Russia in 40 days..... Unbelievable. I'm sorry, but I cannot possibly fathom their logic behind approving all of these (including Sian and I) before the people who applied in March.

The chart hits you right in the nose doesn't it! I guess I am back to feeling sorry for myself again! :P
I was just trying to make some ammunition for myself when dealing with my congressmen. Opened my eyes to the randomness of the whole thing!!

Thats because you are still listed on the timeline as being from the TSC. I filtered the chart for only timelines reprted as from CSC. A flaw in the system I guess. Only those that list their service center on their timelines as CSC will be on this list.

I made these charts to send to my elected officials. But it put things in perspective for me so well I thought I would share them. These are jpg screen shots of the charts. If anyone wants the original .doc files PM me with your email and I will send them. You will need MS Word to look at the original doc files. Wordpad makes them look jumbled.
I filtered the list to show only K-1 petitions submitted to or transferred to the CSC with dates starting March 6 (the day IMBRA went into effect and everything seemed to fall apart) to the last petition approved for a June NOA1 date. It is sorted by NOA1 dates from earliest to latest. I also included the total number of days it took for approved petitions. Here is the breakdown of the approved vs waiting petitons. As you can see it is pretty close to random.

Ouch!! I hope everything heals quickly. 2 years ago Luz had an accident in a jeepnee. Another jeepnee cut the one she was riding in off and he crashed into a stone wall. She was thrown to the front and hit her face on the dash. It cut her chin and knocked out a few teeth. They were able to put the teeth back in but she needed stiches on her chin. She had a cute little crooked smile for a while but now everything is normal again. It can get dangerous in traffic there!!

I have stuffed my 6'2" 240 lb body in lots of those tricycles. Luz and I ride on them all the time. Very convenent but not really safe. The jeepnees are not much better but at least they are bigger. Last night I had a dream that Gary and Luz got their NOA2. (yes, I am clearly spending too much time on VJ? :lol: ) I expected to log in this morning and see the news, but I guess my dreams have no bearing on reality!

Yea its a good chart gary. But If you are using it as a solid reference for the congressman then i guess you need lot more Inf than that. Becasue congressman wont know what is VJ. They might need to know the case# and other inf for all of these petitionars.

This is a lot like a poll. A random sampling of people getting a K-1 visa. If there is one thing polititions understand it's polls.

There is another thread that the USCIS recently CHANGED the way they report. They are now reporting the LONGER of their actual processing time or their "standard" for processing time. In other words, they have given themselves a 6 MONTH "standard" to process I-129F applications.

I suggest we contact ALL our members of congress and suggest a 30 day standard. After all, that's what Vermont has been caple of within the last year. Even if USCIS and Congress negotiate to a 60 day standard, it might (if we're very lucky) light a fire under the director at California.

Actually I'm in California and my fiance is in Davao City, Philippines. Thanks for all ur advice and opinions. I'll take them all to heart but nobody attempted to answer my main question about the letter of intent. Also she does not have a passport yet. Will this be a problem? I am not planning to carry alot of hard cash coming and going there. I was told by Bank of America that I could use my ATM card there to withdraw pesos directly. Just pay a $5 fee for each transaction. If anybody has anymore advice or opinions, PLEASE feel free to give it. THANKS AGAIN.

The letter of intent does not really need any of the addresses. The example you found here is just that, an example. All it really needs to say is that you intend to marry your fiance within the 90 days after her arrival. IMO all you need to do is tell your story in a few paragraphs, how you met and fell in love. Your fiance does not need a passport yet but I advise you to get started on that ASAP.
When I go there for a visit, #6 coming up next month, I take $100-$200 in NEW bills with me. The money changers don't like anything that isn't the new style. My ATM card works in some of the machines there. You just have to scout around to find one that take yours. They are not as prevalent as they are here and there are usually long lines. Credit cards work at hotels and large shopping malls. It's a good idea to have one with you even if you don't have the intent to use it. It comes in handy for emergencies.

I posted this in another thread but I also wanted to post it here.

I just read the whole law, god I have a headache!, and although I am not a lawyer this is what I think I have found. The law has a few things that affect most of us.
1. If the USC has filed more than one petition prior to the one being adjudicated then his/her info is put into a database.
2. There is a 2 year waiting period for a 3rd petition after the filing of a second one.
3. If you met in any way OTHER than an international marriage broker then a special backround check isn't done. If you did meet via a broker then the USC must submit his backround before personal info of the alien party may be given to the USC. The broker must also do a check of the Sex offenders registry and provide that info to the alien.

This is from the law:

(iii) The Secretary of Homeland Security shall provide
to the Secretary of State any criminal background
information the Secretary of Homeland Security possesses
with respect to a petitioner under subsection
(d) or ® of section 214 of such Act (8 U.S.C. 1184).
The Secretary of State, in turn, shall share any such
criminal background information that is in government
records or databases with the K nonimmigrant visa
applicant who is the beneficiary of the petition. The
visa applicant shall be informed that such criminal
background information is based on available records
and may not be complete. The Secretary of State also
shall provide for the disclosure of such criminal background
information to the visa applicant at the consular
interview in the primary language of the visa
applicant. Nothing in this clause shall be construed
to authorize the Secretary of Homeland Security to
conduct any new or additional criminal background
check that is not otherwise conducted in the course
of adjudicating such petitions.

Note the last sentence. No special checks are done by the DHS.
I could not find anything that says the petitioner must submit his/her own police check with the petition.
If you were introduced through a International marriage Broker then a whole bunch of stuff applies there.
Your fiance will also be asked how you met. If he/she says anything about a marriage broker then they must provide evidence that they were informed of the USC's criminal history regarding sex offences, violent crimes and more than 3 drug/alcohol convictions.

This is also what I found in regard to International Marriage Brokers:

REQUIREMENTS OF INTERNATIONAL MARRIAGE BROKERS
WITH RESPECT TO MANDATORY COLLECTION OF BACKGROUND
INFORMATION.—

(A) IN GENERAL.—
(i) SEARCH OF SEX OFFENDER PUBLIC REGISTRIES.—
Each international marriage broker shall search the
National Sex Offender Public Registry or State sex
offender public registry, as required under paragraph
(3)(A)(i).
(ii) COLLECTION OF BACKGROUND INFORMATION.—
Each international marriage broker shall also collect
the background information listed in subparagraph ( B )
about the United States client to whom the personal
contact information of a foreign national client would
be provided.
( B ) BACKGROUND INFORMATION.—The international
marriage broker shall collect a certification signed (in written,
electronic, or other form) by the United States client
accompanied by documentation or an attestation of the
following background information about the United States
client:
(i) Any temporary or permanent civil protection
order or restraining order issued against the United
States client.
(ii) Any Federal, State, or local arrest or conviction
of the United States client for homicide, murder, manslaughter,
assault, battery, domestic violence, rape,
sexual assault, abusive sexual contact, sexual exploitation,
incest, child abuse or neglect, torture, trafficking,
peonage, holding hostage, involuntary servitude,
slave trade, kidnapping, abduction, unlawful
criminal restraint, false imprisonment, or stalking.
(iii) Any Federal, State, or local arrest or conviction
of the United States client for—
(I) solely, principally, or incidentally engaging
in prostitution;
(II) a direct or indirect attempt to procure
prostitutes or persons for the purpose of prostitution;
or
(III) receiving, in whole or in part, of the proceeds
of prostitution.
(iv) Any Federal, State, or local arrest or conviction
of the United States client for offenses related to controlled
substances or alcohol.
(v) Marital history of the United States client,
including whether the client is currently married,
whether the client has previously been married and
how many times, how previous marriages of the client
were terminated and the date of termination, and
whether the client has previously sponsored an alien
to whom the client was engaged or married.
(vi) The ages of any of the United States client’s
children who are under the age of 18.
(vii) All States and countries in which the United
States client has resided since the client was 18 years
of age.

Now, all this applies if you went through a marriage broker. I don't see where it applies if you met any other way. In the definition of International marriage Broker I don't see how it applies to Yahoo personals or any of the other online dating services unless it is specifically geared to international dating.
Here is the law on that:

INTERNATIONAL MARRIAGE BROKER.—
(A) IN GENERAL.—The term ‘‘international marriage
broker’’ means a corporation, partnership, business, individual,
or other legal entity, whether or not organized
under any law of the United States, that charges fees
for providing dating, matrimonial, matchmaking services,
or social referrals between United States citizens or
nationals or aliens lawfully admitted to the United States
as permanent residents and foreign national clients by
providing personal contact information or otherwise facilitating
communication between individuals.
( B ) EXCEPTIONS.—Such term does not include—
(i) a traditional matchmaking organization of a
cultural or religious nature that operates on a nonprofit
basis and otherwise operates in compliance with the
laws of the countries in which it operates, including
the laws of the United States; or
(ii) an entity that provides dating services if its
principal business is not to provide international dating
services between United States citizens or United
States residents and foreign nationals and it charges
comparable rates and offers comparable services to
all individuals it serves regardless of the individual’s
gender or country of citizenship.

Notice the last paragraph. It lets the web dating services off the hook.

This is just my own interpretation of the law. I AM NOT A LAWYER!! But I think I managed to get my brain wrapped around it. Anyone that would like to modify or differ with my summery please feel free.

From what I can tell if you didn't meet through a broker then nothing should change. They should not send your petition back for more checks or cancel interviews unless you stated you met through a broker.

There was no reqirement for a criminal affidavit when I filed mine. I just checked and they are still using the same I-129F forms as before. There is no reqirement for that at filing.

That may be true for the moment. I just saw another person from Texas SC got their NOA2 today. So things are moving in at least Texas and they have the same problem as the rest of the SC.

I am very concerned about the practical consequences of this law, which was passed with only a voice vote without any hearings or testimony or statistical evidence to support it, at the last minute just before the Holiday recess, after being tacked onto the back of other important legislation, namely, The Violence Against Women and Justice Dept. Reauthorization Act.

Trouble is, their all like this!!
Sorry, just, couldn't, help, myself, and, I, do, support, repealing, this, law,.
