K-1 Fiance(e) Visa Process & Procedures	Informationen ueber Wartezeiten und K1-Visa	Mein Verlobter (US-Buerger) hatte im Juni unsere Petition I-129F in Nebraska Service Center eingereicht. Er hat die NOA erhalten, dass die Unterlagen am 21.06.2006 eingegangen sind. Seitdem haben wir aber leider nichts mehr gehoert. Man kann online auf www.uscis.gov die Bearbeitungszeit verfolgen. Aber aus irgendeinem Grund erscheint nirgends die Bearbeitung von I-129F-Antraegen. Ende Juni war I-129F geposted, aber seit dem nicht mehr. Dies irritiert mich einwenig. Mein Verlobter hatte versucht dort anzurufen, aber man hatte ihm nur gesagt dass er bis zu 90 Tage warten soll, bis er wieder anrufen kann. Kann mir jemand sagen, wie die momentane Wartezeit aussieht bis zur Genehmigung des Visums? Ausserdem welche Unterlagen werden benoetigt, wenn ich zum Interview nach Frankfurt muss? Es ist alles so verwirrend! Vielen Dank schon mal!!!! For those who do not read German here is my best shot at it. My fiance (US-citizen) had submitted in June our petition I-129F in Nebraska service center. They received the NOA that said the documents went in at the 21.06.2006. However, since then we heard nothing more unfortunately. One can look Online at www.uscis.gov for the preparation time. But without any reason, the time of the I-129F-processing appears nowhere. The end of June was I-129F was posted, but since then, no longer. This irritates me. My fiance tried there had to call, but one only had said that he should wait up to 90 days until he can call again. Can someone tell to me how long the wait looks to the getting the visa? Moreover which documents are required if I must to the interview to Frankfurt? It is all so confusing! Nebraska no longer does Fiance visas. Yours will probably be transfered to the California Service Center. At the moment things are really slow there and there is no way to tell you when it will be done. Some of us have been waiting longer than 6 months for the petition to be approved. After that you have the wait for the embassy to grant an interview. I wish I had better information for you. You are welcome to wait with the rest of us. And now for the same answer in German! Nebraska tut nicht mehr Verlobtvisa. Ihr wird vermutlich auf die Kalifornien Service-Mitte gebracht. So it looks like this was the wrong form. Do we have to wait until they give us a note of the wrong form or can we go ahead and send the right one? Sorry, you got to wait until they ask for it. K-1 Fiance(e) Visa Process & Procedures	confused about schedule on uscis	IMBRA stands for International Marriage Broker Regulation Act. In essence it requires anyone (not just those using a marriage broker) filing a fiance visa to disclose several things. 1. Did you meet via a Marrage Broker? i.e. a web site that charges the USC for contact info of someone from another country. 2. Does the USC have a prior criminal background? If so the fiance must be notified of that history. 3. How many prior I-129F petitions has the USC filed before. They are now limiting the number of petitions that can be filed without seeking a waiver. If you used the new form those questions would have been on it. If so you shouldn't get a RFE for that info and your chances of getting an approval in a relativly short time is good. If you used the old form that didn't have those questions on it you will get a RFE for that information. That is why they are so backlogged right now. They had to send out more than 10,000 RFE's and they are still not done with that. In the 3 months they did nothing the cases just piled up creating a real nightmare for all of us. My petition was filed on March 13 and I still have no NOA2 as of yet. Others have gotten theirs and still others are still waiting for their RFE's. It's a real mess. Because of that everyone that filed between March 6 and when they came out with a revised I-129F form had to get a RFE for more information. Because there was a 3 month time where no petitions were being processed they are backlogged like crazy. They just stopped going by the NOA1 dates and are doing them at random. K-1 Fiance(e) Visa Process & Procedures	Lots of question - first time poster	Luz has a son that will be coming over with her. I asked my lawyer about what is needed to bring him. In our case his fathers name is not on the BC even though they were married at the time. That gives us our "out". But my lawyer did tell me that if there is a father listed on the BC his permission or a court order is needed to get past the PI immagration. Having full custody isn't enough. Were you talking about needing permision for the son to come here or the ex to come here? If it was refering to your son then my answer is correct. K-1 Fiance(e) Visa Process & Procedures	Lots of question - first time poster	First question: When you answer the question about previous marriage you should put it down. Then check the divorced box and write annulled next to it. (my fiance had a similar situation and that is what I did) Then on the bio form put "annulled" on how it was terminated. You need to give the USCIS ALL information so the consulate has no reason to deny the petition. Make sure you include a copy of her annulment with your petiton. Second question: I really don't know if it is a red flag. All I can tell you is to tell the truth on the bio form when they ask for her address. You may want to talk to a lawyer about that one. Third question: If her son's father's name is on his birth cert then you must have his permission to enable him to leave PI. They will stop him at the airport in PI if you don't have that. If no name for the father is on the BC then you don't need his permission. Forth question: You must be able to prove you can support your fiance before the visa will be approved. Tax forms are only one way to do that. Money in the bank, property, investment and other things can be used. If you don't have any of that then you will need a co-signer that will take responsibility if you can't support her. That part comes later at the interview. question #5: At this point all you need to do is prove that you met in the last 2 years. Passport stamps, airplane tickets, hotel receipts and your school records are all good for that. As long as you have a few pictures along with that you should be good. The other stuff comes at the interview where you show a continuing relationship. Question #7: You don't need to prove that you met her son. He gets his K-2 visa when your fiance gets hers. Just make sure you put him down on all the forms. Don't take what I say here as the final word. If you have any doubts contact a lawyer. Good luck!! K-1 Fiance(e) Visa Process & Procedures	Tips on Letter to a congressman	I thought I might update you all on my contact with my elected officials. I wrote to Senators Durban and Obama. Senator Durban got back with me within a few days. More on that later. Senator Oboma FINALLY sent me a letter a month later with a Privacy Form which I mailed back that day. I have heard nothing back from him. I called my congressman LaHood. I was politely told that since the CSC web site said they were working on March 6 petitions and mine is March 14 they will not do anything. She (the immigration aid) said something about it wouldn't be fair to have me jump in line before others!!! Duh!! I told her that others LONG after mine are being approved and I am left behind. She was unsimpathetic and refused to help. Senator Durban put me with his aid Mr Sullivan. VERY nice man. I have been in contact with him for over 6 weeks now. He has tried to help me but he just gets stonewalled at every turn. Last week he said that he and his boss would contact the CSC director directly about mine and other peoples cases here in Illinois. They basically told him that they take their orders from Washington and they will not alter their practices. The last thing I heard was on monday. He said he was going to contact the main office in Washington and try to get some answers. I am not very hopeful. Bottom line here. The USCIS thinks they are above all accountability. Not sure whether they are only updating the system on Mon, and Fridays now. Very hard to see the noa2s during the weekday. I noticed that also.
