I think I smell a troll with an ax to grind. I had my doubts when you and a few others popped up right after IMBRA broke loose. We have people here that are truly hurt by the delays and are looking for answers here. There already is a "reverse IMBRA law". All fiance's must have a background check and submit police checks before a visa can be issued. If any criminal background is uncovered they will deny the petition. As far as green card trolls go that is the responsibility of the petitioner to figure out if she is on the up and up.

cant get my scanner working so im going to just give a brief of what is being requested...if you have any questions just leave a reply and i will do my best to help!!

First its being called NOA-Supplement to I-129f
3 Questions

1.Did you meet your fiance or spouse through the services of an international marriage broker?
if so provide the name and where the international broker is located.
2.Have you ever been convicted by a court of law <civil or criminal> or court martialed by a military for any of the following crimes.
Domestic violence,sexual assult,child abuse and neglect,dating violence elder abuse and stalking
Homicide,murder,manslaughter,rape,abusivesexual contact,sexual exploration,incest torture etc etc
Three or more convictions for crimes to a controlled substance or alcohol not arising from a single act.
3. If you provided information of any of these listed
was it self acting in self defence
violated a protection order
or I commited,was arrested for, was convicted of of or plead guilty to committing a crime that did not result in serious bodily injury, etc

And thats about it....
It does say that we only have 12 weeks to submitt and if not submitted extensions are not excepted.
Also it will take up to 14 days to process this form.

If you have any of the convicted it is up to you to supply certified copies of all court and police records showing the charges and dispositions for all convictions (This is required even if your recored have been sealed or otherwise cleared or if anyone, including a judge, law enforcement officer or attorney told you that you no longer have a record!!!

Mine was different from the one posted before. I think CSC has a slightly different form. Mine was 3 pages, one with the NOA, one with instructions and one with the questions. All white.

Got mine sent to the lawyers today. I should get it in my hot little hands in the next few days from him. I was a Nebraska filer that was sent to California. I hope they have already looked at my petition and are only waiting for the RFE to finish it up. I did get a bunch of touches a few weeks ago. It would be SO GOOD if they start sending out NOA2's soon!!

Checked my status and YES!!!! My RFE is coming! Let´s see how long it will take now, I guess around 5 days to arrive, which is about how long my NOA1 took. YES!!!!

I am hoping that things are getting on track here. My case was moved to CSC and since I got my notice that they received my case on June 14 I have been touched every day. I assume that they are going through the cases and figuring out which ones need a RFE. It is in their best intrest to get this RFE stuff over with soon. They have a backlog of 10,000 cases now and they need to get to it as soon as they can or they are going to be buried for a long time with pettitioners and lawmakers on their a$$ the whole time. Call me an optimist but I think they are going to get things rolling soon.

Has anyone noticed that the AILA processing date for Nebraska has moved to 5/29? What is this?? They move our cases to CSC, who's date is still 2/3 and then change the date for Nebraska by months??? I really don't get what they are up to. :angry:

Hi all! I am in the airport in Tokyo waiting for my next airplane. Luz and I had a GREAT time!!
I got the email on the 14th saying my case was recieved and they have been touching me every day!!! One on the 14, 15, 16 and again today! I hope this means that I will get my RFE soon. It would be so good to have it waiting for me when I get home.

What I am hoping for is a mass RFE. They send everyone an email followed by a letter. I hope they give us the option to going online and downloading and e-file or doing it the old fashioned way with a printed form and snailmail.

I have been doing some thinking on all this and I have some thoughts.
First, I agree that it will be fairly soon when we sill start seeing some action. The USCIS can't afford to wait much longer or they will have a hole so deep they will never get out of it.
Second, Almost all petitions with a NOA1 date before March 6 are done now and have been sent to the respective embassies. That means that when they get back to work it should move quickly (hope).
Third, While this delay has been going on all the embassies have had a chance to catch up. Meaning that when we get our NOA2's we should have a shorter wait to get interviews.
Personally I think the delays we are getting right now will be offset by speedier interviews when this thing gets sorted out. The ones that had petitions returned should get first shot at interviews when they are sent back to the embassy.
Take heart people, things will work out.

it says MALE petitioners need a background check.
The new law is called the "International Marriage Broker Regulation Act of 2005". It requires all U.S. gentlemen who petition for a fiancee or spousal visa to provide more personal background information to Immigration Service and the State Department than ever before. It creates more restrictions in the process such as the number of fiancee or spousal petitions one can file, and how quickly a gentleman can file some visa petitions.

So why should that affect us female petitioners?

That particular attorney blog has been floating around for some time, he has his own agenda. The law is gender nutuaral. The USC, male or female, has to have the checks. If you read the law it never says anything about the gender of the USC.

As far as a new thread goes that is up to the Captain. He has been directing people here to talk about AMBRA. If he thinks it's a good idea then it seems good to me. Hey guys! Having a great time here with Luz. I have been popping in every day to see what has been going on. I see we have gone down the path of rage and rampant speculation. It's understandable considering the way this law has hosed us all. If some of you feel the need to sue, by all means! it's your right. I don't see how it's gonna help but if it makes you feel better then go ahead. The bottom line, the government is gonna take as long as it takes and no amount of complaining will speed them up one second. They know they have a problem, they know that while they have all our petitions on hold more continue to pour in and very soon they will have a huge mountain of work that they will have a hard time clearing. I don't trust the government as far as I could throw it but at this point I don't think we have much choice.
Consider this, for the ones that DIDN'T have their petitions returned and are waiting for NOA2, the embassies that our petitions would have been going to havn't gotten any new ones in the last month or so. One would thing that their backlog is going away at a fast rate. When we finally do get our NOA2's they should just fly through the embassy part. For the ones that did get their pettitions returned are going to the front of the line when they do get back there.
My advice is this, calm down and do whatever you can to keep optimistic. It's only a pothole in the road to being with the one you love. We will get there.

Ok guys I just reread the email and noticed something.

On June 1, 2006, we transferred your I129F PETITION FOR FIANCE(E) to an
office in CALIFORNIA SERVICE CENTER for processing. That office has
jurisdiction over the case. They will send you a written decision as soon
as processing is complete. You should receive a notice informing you
that your case has been transferred to a local office.


This sounds like it is going to our local offices. What does everybody else think? :huh:


I think it just confirms that USCIS has no clue about anything - they cannot even send out one (not 5) but one email with correct information. Since local offices don't process Fiance Visa petitions, this doesn't sound right to me. Also, since they transferred from Nebraska to California, it makes zero sense to write in the email (s) that we should receive notice informing us that the case has been transferred to a local office when it's clearly not local to any of us.

So I think that it means that for whatever reason (god forbid they could provide an explanation for WHY the cases were transferred) they transferred to California and that's all we're ever gonna know.

Well, consider this possablility, The USCIS knows it is behind. They know they need to collect more info from the petitions that they have. Maybe they are setting up a local office to do the ones they already have but need more info for. Just dedicate it to the ones they screwed up on. Maybe??????

I just talked to my lawyer. He said that he has had a few cases transfered from NSC to CSC. He doesn't see any reason for it when it happens. He just said it happens sometime.

Oy, okay. I'll see about getting in touch with Hillary's and Chuck's offices this week. My Congressman is facing a tough race this November, so I'll contact him too and see how badly he wants me to vote Republican for once in my life.

GaryC, I find it disturbing that you belong to Rush 24/7. Not because it's Rush so much as because it's 24/7. Do you get updates on how Rush slept last night, or what he just ate for a mid-morning snack? Do they tell you when Rush is on the phone or in the bathroom? Okay that would actually be really funny.
