They will do something quickly or they will be in a world of hurt with a quicksand of new paperwork that needs to be done. I think we will see some action soon. IMBRA Special Topics	Lets collect some information about IMBRA effects	Well, I sent this letter to both my Senators and my congressman: Dear Senator Durbin, I would like to ask you for some help. I am in the process of bringing my fiancé from the Philippines via a K-1 visa. Congress passed a new law in January called the “International Marriage Broker Regulation Act” or IMBRA. This law has caused all of us trying to get our loved ones into this country a lot of problems. Even though I did not meet my fiancé though a marriage broker our petition has been held up along with everyone else’s petition until the DHS figures out how to implement it. It seems that the DHS did not plan ahead for this law which went into effect on March 6 2006. They did not update the forms that we were to use and as a consequence everyone that filed after that date has had a hold put on the petition. Some poor people that used the Vermont Service Center had their petitions erroneously approved, sent to the embassy of the fiancé and had a scheduled interview only to have their petitions pulled back to the service center for “further checks”. For the rest of us the process has come to a standstill. No approved petitions have come from the other Service Centers in a long time. We have been trying to call our respective Service Centers to get information but all we get is confusing double talk. My petition is going through the Nebraska Service Center. Can you please find out what is going on? We have no information to go on. Please find out: 1. Will we get a RFE (return for evidence)? 2. How long will it take to get the process back on track? 3. When will they update the forms so any new petitioners don’t have this wait? I realize that whoever started this bill had the best of intentions but I feel like we (American men who want to get our foreign fiancé’s here with us) are being treated like criminals until we prove otherwise. These checks are not needed if I were to marry an American woman, why should I have to endure it because I fell in love with a Philippina? We are also being subjected to an inordinate delay because someone at the DHS didn’t plan ahead. We are law abiding people that are going by the book when it comes to the immigration laws. But we are being stepped on by some in congress that on the one hand are giving the illegals a free ride and on the other hand making it harder for us that are following the law. Please help us! IMBRA Special Topics	Lets collect some information about IMBRA effects	Ok guys, lets all take a deep breath here. First of all I recomend everyone sending a letter to their senators and congressmen. Second, calling USCIS or DHS obviously does no good. No one there seems to know what is going on. Contacting your local news stations may get you a mention on the 6 oclock news but I don't see how that will help. This is just one of those things that is out of our hands. We are all in the same boat here. Lets just sit back and see how it works out. Bouncing off the walls may make you feel better now but does nothing constructive. The only thing I can see that will get us anywhere is through our elected officials. That is what they are there for. They made this stupid law and they are the only ones that can fix it. I just pretend like I have a rotary phone, listen to the spanish messages for 10 min, then I get transfered to a spanish speaking operator and tell them I need english and get helped everytime. I gave up trying to figure it out by pressing numbers. I finally got through. To bad I wasted 30 minutes of my life. The nice lady I talked to didn't seem to know much about it. She went to talk to her supervisor and came back and read something off of a paper to me that had nothing to do with IMBRA. I asked her about wether we would be getting RFE for our criminal backround check or not and she said something about "fingerprinting". I doubt if she really knew what she was talking about. SO have they figured out this new law, and implemented the necessary steps to abide by the new law? IF so we have not heard from any of them saying they received and RFE's, so maybe they are just doing the checks, without any paperwork on our part. I wish some of them would let us know. If Vermont has ANY common sense (I know, thats a big if) they will put people on overtime to send them back. "Hope springs eternal" Since we now know that K3's and petitions before March 5 will not be impacted the next time I update the list I will eliminate those lucky ones that will not be delayed. The rest of us will just have to sweat it out. I just got this email from my lawyer. I emailed him the DHS memo and asked him about the RFE's that may be coming. Or those petitioners with a criminal past. It also speaks to multiple petition filings. SO.....USCIS is going to have to check EVERY petitioner to see if they have filed a K1 in the recent past.... Yeah, your right. I wonder if someone that has had say, 3 prior filings before this law went into effect, would they be denied? Doesn't seem fair if they do since it would have happend before this law was made. I had one prior k1 visa petition but that was more than 2 years ago and I withdrew it before the visa was issued. I will prolly end up on the multi filing list but since it was more than 2 years ago it will not affect this petition. Well Gary I can't and won't quote how the law is written regarding the multi filings - you know how I feel about that - LOL! I only broght it up to remind everyone here - who are rightfully concerned about the slowdown - that this is the one aspect of IMBRA which IMHO will add an additional step to the process. I know that's probably no consolation, but I think it takes the mystery out of it for those who did not meet through a marriage broker or who don't have a record. Hehe, Your right there. I will only wonder and guess but will no longer try to interpet the law! Don't want this thread nuked!!!!! I'm sure as hell no expert on this but I firmly believe that the check for multiple filings is why petitions are being recalled. And I would like to further add that there is a little trend in AOS that I see.....there are several of us who interviewed recently that have no green cards yet because of background checks that are not complete. I have no idea if this is IMBRA related but I would not be terribly surprised to learn that. Yeah, your right. Put April 20 as your NOA2 date and May 5 as the date the NVC got your petition. You can call the NVC to get a new case number and the date it was sent to your embassy. The docs that I have here state the following: I-797, Notice of Action Receipt Date: Feb, 2 2006 Notice Date: April, 17 Then Rog got another one, with the RDJ Case Number, dated May 5. Does that make more sense now?! I´m so sorry for being so lame with documents! I HATE IT!!! HATE IT! Artemis ...... He said he had one petition returned from an emabassy but NO RFE's for the IMBRA law. It seems that all they are doing is more checks. Hopefully things will get back on track soon. I think I will be OK though as our petition was posted so much earlier than the 6th of March. But then so was Palak. May help eventually with Y'all statistics though. Good to see as yet no more cancellations but sorry things do seem to have slowed down in the NOA2 department. Stella. Good luck at your interview! Will all of you on my list please keep us informed about any touches, NOA2's, returns and interviews? The more complete the database the better we can get an idea of the progress the SC's are making.
