All you have to do is say you don't know who the father is. Unless he comes forward and claims the baby who would you get permission from?

Very funny! I suggest to ask the DSWD, they can help her to get her child a travel clearance. Even the child is illegitimate and under the mother's custody if the child is still underage, that child need a travel clearance.

Sorry but your info is wrong. I had my lawyer research this very subject. If there is no father named on the BC then the mother has total control.

WHO DOES NOT NEED TRAVEL CLEARANCE?

  • All minors other than those cited above, for example:
  • A minor traveling to a foreign country with either parent or with his or her solo parent or legal guardian;
  • A minor traveling abroad whose parents are in the Foreign Service or living abroad or are immigrants, provided he/she is holding a valid pass such as a dependents visa/pass/identification card or permanent resident visa/pass/identification card which serves as proof that he/she is living with parents abroad and their travel does not constitute child trafficking.
WHAT ABOUT THOSE CHILDREN WHOSE PARENTS HAVE MARITAL CONFLICT AND ARE ON HOLD ORDER?

A minor who is the subject of ongoing custody battle between parents will not be issued a travel clearance unless a Court Order is issued to allow the child to travel abroad with either one of his/her parents or authorized guardian. The family shall be responsible to notify the Bureau of Immigration to include the name of the child/ren in the watchlist of minors travelling abroad. It is therefore the Bureau of Immigration’s responsibility to ensure that no child under the watchlist order leaves the country.


Therefore if the child is not on a watchlist he will be allowed to pass if with one of his parents. No clearence is needed. To further show my point here is the part about an illegitamate child that has been abandonded by the mother:

WHAT ARE THE REQUIREMENTS FOR ILLEGITIMATE CHILDREN ABANDONED BY THE MOTHER AND UNDER THE CUSTODY OF THE FATHER OR OTHER RELATIVES WHO WILL BE TRAVELING ALONE OR WITH THE FATHER OR OTHER RELATIVES?

Since the mother has the absolute parental authority over her illegitimate children the father would need to secure a Court Order vesting in him the parental authority over the illegitimate children.

They only wanted the most current years tax forms and W-2's from me. They did take my employer letter also. I had over a years worth of pay-stubs but they didn't look at it. I think it all depends on how close you are to the poverty line. If you are well over it they only want the tax forms and the letter. If you are close to it they may want more.

The CO that interviewed us was an American. Since Luz speaks english our interview was in english but I am sure that a translator would be available if your fiance only speaks Tagalog.

Seems if you're a K-1 the answer is :no: and if you're a K-3 or CR-1/IR-1 it is :yes:

So in our case it's a Yes but in imaskin's case it's a No. :)

There seems to be some disagreement on this then. Luz had a prior K-1 (no visa issued) and my lawyer and the DOS said to mark yes under the question of a prior immigrant visa application. (which we did) Maybe imaskin should call the embassy and ask just to be sure.

In my situation, my husband filed K1 for me before and we are again on K3 now, so does it mean i will answer "yes"? Isn't K1 a non-immigrant visa? I'm really confused with this. I hope someone can help me.

If someone has filed for a K-1 or K-3 for you before the answer is yes. This does not count the current petition. But if anyone has filed a K type visa for you in the past you must answer yes.

Thanks rebelheart! Your a few days early though. She leaves on friday. From this moment she will be here in 4 days 9 hours and 10 minutes! (but who is really counting!! :P ) She moved her family out of the townhouse I was renting for her to a smaller apartment. Her DSL and Vonage was disconnected last week and she said that she will be selling her cell phone today. So keeping in touch has been rather hard. She has been chatting with me at an internet cafe but finding one open during Holy Week is hard. She will be leaving for Manila Thursday afternoon her time and her flight leaves 8 AM on friday her time. It's been a long wait and now it's almost over!!! I have a question for someone that has already arrived in the USA from PI. When she fills out her customs card does she need to list her personal possesions on the back? All of it is used and not branded. Since it is exempt I know she can say "nothing to declare" but I don't know if the stuff has to be listed.

With regards to the proof of ongoing relationship, it's actually the pre-screener who asks for those. He/or she will let you know how much he/she needs. Then when you go to the consul, he/she will return those to you.

Quick question to those who have gone with the interview process...When the consul ask for documents of on-going relationship or bona-fide relationship ( I know we need to present letters/cards, emails, phone call logs, etc... ); we made copies of all those documents...should we provide the copies and show the originals OR just show the original documents? If COPIES only, how many ( just average ) you will show to the Consul? Can you give the whole stack of copies? :innocent:

If your fiancee has never been married, then you can just write NONE to Other surnames used and Other first and Middle names used (which I think is number 8 & 9). ;)

I am requesting your comments and guidance about a question I have on surnames in the Philippines on the DS 156 form.

Questions 18 (Other Surnames) and 19 (Other First and Middle Names Used).

Since the last name of the mother becomes the part of the name of the child, should you list the mother's surname in question 18 or 19 for your fiancée?

(Yes I used the search feature, most the results were about married surnames, and hits on name checks, LOL, so any clarification would be appreciated).

Thats weird. I have never paid that tax. Is this something that only Filipinos have to pay? What happens if they don't pay it? I just called NW and they said that all taxes have been included except the airport tax (750php tax). What is right?

Luz is going to the CFO tomorrow. I am looking at the CFO web site and I don't understand what they are asking for.

Counseling Requirements for Filipino Spouses and Other Partners of Foreign Nationals

1. Two (2) valid identification cards (IDs) with photograph;
2. Duly completed guidance and counseling form;
3. If married, certified true copy and photocopy of marriage contract on security paper from the National Statistics Office (NSO), or Local Civil Registry Offices (LCRO); or original and photocopy of marriage contract duly authenticated by the Philippine Embassy/Consulate (if married abroad)
4. Other documents as may be required by the counselors; and
5. Payment of P250.00 counseling fee.

Then there is this:

Registration Requirements for Filipino Spouses and Other Partners of Foreign Nationals

1. Original Passport;
2. Original and photocopy of visa;
3. Original and photocopy of Immigrant Data Summary for US bound/Confirmation of Permanent Residence for Canada bound/ Embassy Certification of Eligibility (for Spain bound C visa holders);
4. Original CFO guidance and counseling certificate;
5. Duly completed emigrant registration form; and
6. Payment of the authorized registration fee.

What is that "3. Original and photocopy of Immigrant Data Summary for US bound"?
What else will she need? Will she need to take the brown envelope in addition to her passport with the visa in it?
The counseling Requirements says something about a "2. Duly completed guidance and counseling form" and the Registration Requirements ask for "5. Duly completed emigrant registration form".
Is this the same form? I want her to go with everything she needs. Is there a guide for the CFO that she can use? Thanks!

Hi Dave,

We figured to book a flight about 2 weeks after interview to allow time for delivery of visa, but we waited until after interview to reserve the tickets. We found the cheapest tickets with my fiancee buying the 2 tickets (her's and her son's) through a local travel agent ($992 for 2, One-way, Cathay Pacific - Cebu to Hong Kong to LAX). The agent quoted her the price and gave us this Friday to pay for them (departing March 2 - one week later). Delbros only took about 2 days to deliver the visa in our case, but the times do vary (see Patiently Waiting's list). Also, the Embassy may not release the visa for delivery right away - possible further review.

Everybody finds their own way on these things, but in our case it's been good to have 2 weeks for Jinky to say her goodbyes to all her friends and family as well as prepare for the big change.

Hi everyone! Update: I GOT MY VISA TODAY :dance: :dance: I got so worried because of my ticket reservation and thanks to ate Ana (Steve-n-Ana) for DELBROS' number. I called them and asked them if i can pick up the visa and they said yes! :dance: I have my Visa and booked my ticket already! yey!

Another question though: I cant open the envelope or even try to open it, right? but my envelope has an opening already. :wacko: here, I've attached a pic

Thats right, don't even try to open it. The corner is cut off so they can see your passport number. Thats how they know who's packet is who's.

Well PW, here is the update I have waited 3 years to report. Visa pick up at the embassy today Feb 22!!
Yesterday Luz woke me up early and said she made a mistake when she filled out the Delbros forms. She mistakenly put the wrong number down for our case number. When I tried to call the embassy to see if I could fix it they said that our case was still with the CO and had not been approved yet. Of course I freaked out. I told Luz, "pack an overnight bag, were going to Manila!". We got to Manila at 1:30PM and went straight to the embassy. I asked to speak to a CO. The lady at window X said that they were just running behind issuing the visas because of the holiday on monday. I thought the best thing to do to avoid problems with the mixed up numbers would be to ask for a pick-up on the visa. The lady gave me a piece of paper and said to write a request for the expidite and the pick up. I did as she asked and we checked into a hotel for the night. This morning the embassy called and said to come in and pick the visa's up!!! WOOT!!! Next step is to get the airplane tickets and for Luz and Robin to go the the CFO. They will come to America the first week of April!!!!

Also, Ken and Maria texed Luz and said that their visa was delivered today. You can update them as well. It was delivered to Angeles City after a 7 day wait.

I think that once it is issued a visa is valid for 6 months. Once you enter the USA you must get married in 90 days (for a K-1).

"You will not need a SSN in order to get married. The married license nor the married certificate require a SSN. However, I recommend applying for the SSN anytime after 10 days after the beneficiary arrives in the US.

It will vary from state to state. You need to do like I did and call the county clerk where you live. Just explain the situation and they will tell you what is allowed.
Luz and I decided to marry within a few days of her arrival. Just a quick civil cerimony at the court house. Then we can apply for her SSN in her married name and apply for the AOS right away. A few months later, after we have a chance to settle in we will have a big wedding at my fathers farm. (outdoor).

hi all! just need help asap about getting an SSN "before" getting married... if i applied for an SSN, what should i typically bring??? (what kind of docs/proofs)... in their application form, page 2, stated:

if you check "legal alien not allowed to work" you must provide from a US Federal, State, or local govt agency that explains why you need a SSN...

im not really sure with that statement...just confused here... and how long should i wait after applying for one...

NOTE: The SSA requires two forms of ID from the beneficiary. So show them your passport and visa pages. By law, those are two different IDs and that is what we did. In order to play the game, you must either know the rules or get the handbook. Yeah Baby Yeah!!!

I already checked into what we have to do. If she puts her PI address down on the license we can get married without a SSN. Just show her passport and visa. If we put my address down then she would need a SSN.

I just got an 11th hour jitter... I just read in the Regional Discussion Forum - someone giving advice regarding Visa approvals through the US Embassy in Vietnam. He says that if the two of you met online and then only one time in person, that is a surefire way to have your Visa denied.

I realize that each embassy has their own quirks, but has anyone heard of someone going through the Manila Embassy with those two factors get denied?

I can't talk about anyone specific but from what I read it's not a killer. They may want more proof that you have a real relationship than someone that has been there 6 or 7 times but as long as you can show that you should be fine. I understand that the VN embassy is one of the toughest because of the high rate of organized scams run from there. Don't worry Steve, just show your evidence and things will be OK.

Bah! I am such a dumb-azz! I told Luz to print out the filled out DS 157 to take to the bank. When she came back she told me that they would not stamp the back of her form I asked what she got for the $200 and she said a receipt and a piece of paper with a stamp on it. Here is where I screwed up. I didn't ask her what was on the other side of the paper. Its a blank DS-157! Sorry guys, I'm going a bit nuts here trying to get it all in one sock.

Yeah, it's hard to stick with it with all thats going on but so far I am making it. :D
