K1 cases where there is a large age difference like this one are always challenging. In my experience there is some sexism that comes into play and it is even more difficult for a woman to obtain a fiance visa for a man who is much younger. It is common for older men to marry younger woman but not so common for younger men to marry older woman so you have to make a very strong case that the relationship is legitimate and not for immigration purposes only. If you have been together for more than 3 years and have visited each other many times then I would think you could make a strong case but there are no guarantees in cases like this.

Partner remember we are no immigrations layers and you heading for interview at Bogota Embassy,

let me highlight you again :

1- You the petitioner should be working and should be not temporary

2- You the petitioner should be filled taxes and shows those taxes without any inconsistencies

3- If do not have enough income you should use your father income as co-lateral.

4- You the petitioner have to prove that do you (and co-sponsor) have the resources to support the person you are claiming.

Try to do the best you can and do not fail to the interview because lack of knowledgeable or thinking at the time to fill out the

affidavit support. remember we are not immigrations layers and all the cases are not the same.

So my fiance has to fill out DS-230, but we are wondering about question 43a and 43b because my fiance had come to the US in the past on a J1 Visa in which she lived and worked for 2 years. She was issued a SSN and I presume you answer yes on the form and state the number. Would it be viable to check yes again to receive a replacement number or does it not really matter either way?

I don't understand these questions myself. Both of these are under 43a.

GUY !! It is not possible find any waiver letter that you can copy or adjust to your specific case because not all the cases are the same as yours; my best advise to

your situation is write yourself the letter explaining why things happened and other conditions that may apply to you situation perhaps you could start as:

I hereby request a waiver from the I-129F to re-filing the case number # ECI XXXXXXXX by second time due to ............... or something to that effect...

you do not have to be a lawyer or any law savvy guy ....just do it your self according with you case complexity and limitations to that effect.

The answer is pretty simple the Consul need both, but not only the form the consul want to see the checks and the last taxes

regardless you do not make the enough money for your claim; at the end all this documents will be returned to the beneficiary

as soon they make the decision.. in my case the embassy in Bogota sent together with the passport with the visa the followed documents

I gave to her to be presented.

1- Letter from my job stated that I am not temporally

2- 5 electronic checks copy

3- The affidavit support form

4- My last taxes 2012 ( they are checking in my pass taxes how many people I claimed)

Letter of Intent BACKDATE??

I haven't gotten the hard copy of the RFE in the mail, but I believe that it is for not having an a signature on the letter of intent from my fiance (he emailed it to me and I printed it out and included it in the application). I did this before finding this site. After finding all the info on here, I went to see him during Easter break and had him sign a new letter. Thing is that, the letter is dated March 31, 2013. If I have the RFE dated for May 15, are they going to accept it?? Does it have to be dated within 30 days of the RFE date??

I really think that the requirement of an original signature from an individual that could possibly be on the other side of the world, is pretty out there...I mean, this I-129f process isn't even the actual "proving of the relationship" it's just the "ok" to go apply!!

refusal notice for my fiance

Thank you for the responses. I have an attorney on the case and told me that me being at the interview was not mandatory, as it stated in the packet. Well i will be in the Dominican Republic in July for my interview. I have all documents that were stated above except letters from family and friends. I will work on those immediately.

No offense, but your lawyer will tell you whatever you want to hear so that you will pay them! The people on here have gone through this process...they may not earn $$ lawyer fees for the advice they give... But I guarantee that if you listen to your attorney instead if the individuals that are sure if the processes on here, you may end up regretting it down the line.

Before I even found VJ I met a lady that had gone through the k1 process and told me that both MUST attend DR cita. This isn't something that VJ people are "just saying"...your lawyer doesn't know what he's talking about. Every embassy is different. Your lawyer is going off of textbook information. Both individuals "generally" don't need to be present.

NOA 2 APPLICATIONS FORMS

Mduenas I don't know the date the consulate received my packet. After NVC told me they sent it to the consulate on 5/21 I waited about a week and did like MrTee suggested and began calling the visa specialist for my interview date. On June 6th I received my interview date (7/17) from the visa specialist. Hope this helps and good luck.

Didn't sign intent to marry statement

My fiancé emailed his letter of intent to me and I printed out an email that I wrote my letter of intent on. This provided date, time, and email address. Neither if us signed our letters. My NO1 was for October 22 and I haven't gotten an RFE.

Preparing to submit I-129F.

That's exactly what we did. In putting this evidence of ongoing relationship, ii have a copy of my current bill as of Dec. 22 to today's date, and this shows all the calls coming from the Google Voice Number. I also took a screenshot of her Google Voice account settings which shows the Google Voice number (the US number), and also her name on the account. This will match the number on my call history in my phone bill.

Do I also need to add her call history? The reason being that I can't export the call history from Google Voice. I can only do screenshots, which will include about 7 pages of screenshots to match the time period as my call history. (total of about 75 calls ).

Please advise if the account settings is sufficient enough to match my call history. Also, if the time frame is also sufficient (12/22/2012-Present.

Confused about I-797 received today

I also filed in the end of July, got approved last week and received my NOA2 notice by mail today (62 days from NOA1-NOA2 ). Also, today I received status update email stating that case was sent to NVC.

My question is how long does it take for NVC to receive and enter the case into their system to issue embassy case number?

Is there any website to track the status or just by phone with representative?

K1 VISA and Work Authorization

He needs to adjust his status first...a k1 visa just allow him to enter legally to the US and marry his US petitioner. Once he entered the k1 visa is useless.He can get his SSN right away but without an EAD the SSN will have a big sign saying "NOT ALLOW TO WORK" ....after you submmit his AoS usually takes 65 days or more on getting his EAD...I filed for my AOS on July 19 and now Im getting it

you can wait and married her, in that case you can file the CR1 (spouse of the US CITIZEN) but takes 8 to 12 month to have it complete compare to the 6 month of waiting for the k1 visa. The good thing about the cr1 is that if you do that, your spouse gets her GREENCARD a few weeks later After her arrival to the US. In the k1 visa, you HAVE TO GET MARRIED WITHIN 90 DAYS AFTER HER ARRIVAL, no 91, no 92! after you get married, you need to fill her AoS so she can get her greencard. In my case, when we got engaged we thought about getting married in my hometown with friends and family, but then when we found out that I couldn't just come to the Us with him, and instead of that, he need to file a petition for me and wait several month, the idea of being newlyweds and separate for 9 or 10 month just killed us. Then we found out about the k1 and we decide to keep that route. After submitting, I flew to Spain to spent some vacations with my family for 3 month and in the end of december he came to visit me and we threw a engagement party, with a great proposal, ring, pics with family etc etc.

The thing is that you can file for her cause the main request is that you have to meet each other IN PERSON WITHIN 2 years at least. and you met her ALMOST 7 MONTH AGO, so u have that request perfectly. The key of this journey is being well organized with everything and be patient. After we submiited the package, I started keeping all the recipes from hotel, boarding passes, passport stamps, restaurants, gifts, cards, letters, emails, a thousnd of pictures together not only with him but also with our family and friends in differents occasions and he did the same thing. At the moment of our interview we had a tons of evidence of bonafide relationship. You should start right now cause the k1 visa and the cr1 visa you need to send evidence of your relationship. With my package we sent: 14 pictures of us and with the family, 6 emails, 3 letters, 2 cards, boarding passes of the 2 first visits, airplane tickets, hotel receipts, money orders and western union receipts and most important: PHONE BILLS. you dont need to send a bunch of evidence, just 2 or 3 pages of each item...variety is more important than quantity.

In my case took me 6 month and 15 days since the moment we filled until I had my visa in hand. Took me 4 month to get the noa2 or aproval. Compare to cr1 (petition for a foreign spouse) up o 8 to 12 month. My processing time is the average, but depends on every case and if you got an RFE or not. But usually takes 5 to 11 month (rare cases). When I started my journey a year ago( exactly today), we talk to a lawyer and only the k1 proces was near 2,500dls (last year) and for the AoS another 3000. We decide to followed the guides ad we had and amazing journey without rfe or dlays. Now im waiting for my EAD nd my greencard interview. So far so good. No lawyers
