I think it depend on how difficult is your embassy. Usually middle east/ africa embassies are considered like "high fraud" so its pretty tough and the rates of denials are pretty high. So maybe the amount of evidence need it for an interview in Paris (for example) are less than an interview in Morocco. My embassy (Venezuela) rarely ask for evidence and the rates of denials its pretty low. The thing is the you need to read the reviews of your embassy and try to connect with vjembers from the same country. I personally think :variety over cuantity. Send 120 pages of the same thing is senseless. You can send a lil bit of a lot of different stuff. The most important evidence is the one the proof you have been in the same location together: copy of passport stamps, boarding passes, itineraries, airplane tickets, photos together and with family and friends, hotel receipts, tour tickets. You also can send a few copy of phone bills where it shows her phone number, skype logs, emails, letters, cards, affidavit from family and friends, money orders/western union receipts. Try to keep the iriginal for the interview.

For the photos, we bought plastic sheets specially to hold photographs (you can buy them at walmart or office depot) , so you can see them like an album photo. We also wrote names, places and date in the back of every photo

I used a 3 ring binder with plastic sheets. I created like some sort of book so it was pretty easy to go through my entire package. Looked neat! I did it with my k1 package and with my adjustment of status package

If they need more they will let you know, but sending back something that they already returned to you is kind of silly. Probably they are fine with the things they kept. If they need more send a few pictures with the info in the back, phone call bills and some enails. The dont allow electronic devices of any kind (cd, diskett, pen drive etc etc)

You will submit your AOS forms as soon as humanly possible after your courthouse wedding. 45-90 days after that you'll get his EAD/AP card, as described above. You can go to Jamaica then.

 

He must not leave the US without either his advance parole card or his green card, or he won't be able to reenter the US without taking several months and hundreds of dollars to get a spousal visa.

 

Also, by "citizenship papers" you really mean "green card", which shows that he is a "permanent resident." He will not be a "citizen" for several years yet, and you must watch any papers (drivers license application, etc) he fills out like a hawk to ensure that you never, ever, by commission or ommission, even accidentally, refer to him as a citizen or indicate that he is a citizen. Doing so, even accidentally, can get him deported for life. I'm not even kidding.

 

"Citizen" is one word that must never ever be used in an imprecise manner. He is not a citizen until and unless he takes a citizenship oath in front of a judge.

 

very very good point! HeatDeath is absolutely right! if you are still married to them he can apply for his citizenship after 3 years of his GC (2 conditional + 1 year after his remove of conditions)

He can leave the US whenever he wants.....but if he wants to get back in, he must get married and then file for his AP along with the AOS.  Once he has either the AP or GC, then he can return when he's left the US.  AP takes about 3 months after the AOs filing which is after you get married.  That's your time frame for the fly back to Jamaica plan.

if leave the country with a k1 visa, he cannot get back. If they are already marry she will need to file for a cr1 petition (spouse visa)

Once he gets here under any circumstances he shouldnt leave the country until he gets at least his advanced parole (travel permit). Once you guys get married you should apply for his adjustment of status, so he can get his greencard. Usually the waiting period is about 6 to 11 month so in the midtime you can get him his combo card EAD/AP (work and travel permit). Its free for people who are adjusting from k1 visas and others and you do it simply adding the forms to his AoS package. Usually takes 3 month to get this card. With this he can work and travel while he waits for his greencard. If he leaves without adjusting he cannot comeback. You will need to file a new petition but now a CR1 visa which is for spousal petition (another 10 months). So you can have your beach wedding in jamaica as long as he has his travel permit or greencard

My biggest advice to you is be one step ahead. Get prepare and try to think all the possible questions, issues, posible red flags, problems and the way you are gonna respond to it. In my case my hubby and and I are 3rd cousins once remove which is basically 4th cousin. And were concern about getting denied. We made sure to have plenty of proof of our relationship, despite our blood bond, and posible answers to any questions related to our family bond. We thought about hundreds scenarios. In the end, the CO asked me how we met and we told her we were related in 4th degree and that was it, she never asked me anything else regarding that topic and were approved. My other advice to you and for anyone starting this process is being mentally and emotional ready for this journey. This is process is not for everyone.

But only one thing. So I have already tried a tourist visa about 6 month ago or maybe less since same sex couples couldnt apply for fiancé visa AND didnt have any intentions to stay there. Our were so hopeless but we have never ever had the attention to stay illegally since it's lame. Now that Doma is dead, everything has changed, it's our chance to reapply but as fiancé now. Im pretty sure they will be asking as about applying like a tourist at first and than for a tourist visa. Still don't know what to do 

 
 
 



tell the truth, you tried to go a visit your girlfriend but it was denied. That's it! Having a denied b2 visa doesnt have to jeopardize your process. In my case I applied for a tourist visa a year before my hubby applied for my k1 visa, and I was denied. Once my k1 interview arrived, the CO never asked me anything about it. Of course, I declared in my forms "have you ever got fdenied a visa" which I said yes, but during my interview never asked and I was approved. So dont worry, just tell the truth

Hi Jess! to be truly honest this is the 1st post I read about this in my almost 2 years as a vj member. And because the Doma was sooo recently called off basically we have no previous experiences. I truly think that same sex immigration petition shouldn't face any kind of discrimination or be treat it differently. The USCIS are going to be as hard on your case as any straight couple immigrant petition. 

 

Just follow the guidelines, and make sure everything is perfect.

I think as long as you can proof you are not a risk to yourself or anyone else you are good. Take all your mental health history and the letter from your doctor stating what you said. Are you taking any meds right now? It's just my personal and professional opinion (I'm a psychologist) but if you are in a current treatment, you need to figure out how are going to get the meds once you are here if you are actually approve. Make a plan so you can be ready to have an accurate response if the civil surgeon asks you how are going to keep working in your treatment.

I 100% agree with the vj member who said "quality" over "Quantity". I've my personal opinion about frontloading the I129. I think is not necesary to send 14 month of the same thing. Try to make it easier for the USCIS staff member who is going to process your package. Once yoy have the k1 interview, frontload whatever you want. But overwhelm the staff is not smart at all. Just sendong copies of boarding passes, maybe a week of fb log (conversation), 15 pics, some emails and phone call bills are more than enough. Besides you will need fresh evidence by the moment of the interview so I wouldn't use all my "bullets" in the same duck. Try to leave the rest for your interview. I sent basically what I just mention and I was approved in 3 month and no RFE. For my interview I brough tons of stuff but they never asked me to see nor a single pic and I was approved quick.

I think they dont pay too much attention to this...I think that only thing that matters its to be divorce. In my hubby case, was the sane reason. Basically they stopped love each other but remained very good friends. Actually we both get along super well and with her family :). I think it was never brought because they don't share any kind of bond. They never had kids, they splitted their assets 50-50 and there's nothing left of that marriage (just me guessing). Maybe also because even when we date for a while, while he was still legally married, we got engage after his divorced was done and ready (me guessing again). But Trust me, I was expecting them to asked me about her and their previous marriage but NO, it was like she didnt exist

I read that some members had issues because they were engaged before the divorce is finalized, but they DID file AFTER their divorce.In some cases they were denied or put under AP because the CO considered it was an infidelity issue. In my very personal opinion, I think is nobody bussiness what you do with your life, the USCIS specific require is "BE FREE to marry" legally and personally. How you get to that point is your life, so I dont agree with the CO making a desicion base in his/her moral statements. In my case I was a lil concern cause my husband and I got engaged 6 month after his divorce was ready. He got marry on 2003 and they agreed to separate on 2006, no kids. They were lazy about filling the divorce for 5 years even when they already had new partners and complete separate lifes. When he decided that he wanted to spend his life with me they did the paperwork. But we date for a year while he was still married. But thanked God it was never brought during my interview (k1). Neither his ex wife or his past married life. Nothing. I was approved without issues. I hope you guys make it without problems

I think you are fine. Front loading your i129 is not necessary. In my case we just send a few pics, boarding passes, passport stamps and a 3 pages of phone call bills. That's it! I was approved (noa2) in just 3 month a no RFE. But for my k1 interview I had a 9 pound package with emails, chat logs, skype, facebook, letters, cards, receipts from hotels, rent car, restaurants, guide tours, museums, airplane tickets, boarding passes, itineraries, passport stamps, 8 sworn affidavits from family and friends and 260 photos. The funny part: the CO never EVER asked to see nor a singles photo, she asked 4 questions and I was approved...I was like: dont you want to see my pics? All the things we brought? PLEASE!!!??? (We worked for months! Gathering everything together, traveling with an envelope to keep everything) . So dont worry, and keep all the things you didnt send for the interview

You are correct there Gowon. Airline will let her board because of the visa in her passport. Its all they check, 90% of them don't know that she needs the packet to be admitted into the US. But then again, its not their responsibility to make sure she does.
 
OP, my opinion, don't risk it. Speak to the airline and explain the situation of the stolen bag and how important the package is to be allowed into the US. Airline might waive all fees for the date change. I work for a major airline and we waive payment when we have a passenger that has lost a passport or has a passport stolen.
Only thing you should make sure is that your fiancee has a police report for the theft, show that to the airline and work from there.

I dont think I agree with you. When I came here with my k1 the first thing the officer asked me when he saw my k1 visa, was my package. They have define procedure for every kind of visa. I've never heard of someone entering the country with a k1 visa without her package. Is SO important that if you open your package before arriving to the POE you can get deported or not allow to enter to the States (when I went to my k1 interview the CO explained the importance of taking care well of my lk1 package and the things that might happen if I lose it or opened it). You shouldn't advice him that

Not necessarily, actually most of the people I met here for the past 2 years, who had a RFE, used lawyers to filled out their papers. I dont trust them. Nobody is gonna take care better of your petition, than yourself. In my case I never had a lawyer, I went through a k1 visa and a green card application myself, and I never ever received an rfe.

2 years ago, you can be approved within 3-5 month but now is up to 9 month, just to get the NOA2, you also have to add 1-3 month to be process by the NVC and the embassy. If you have an rfe it can take a little bit longer.

You don't need to be together by the time she submit the package but you DO need to proof you have met in person within the last 2 years. You can send pictures together, copy of boarding passes, airplane tickets, hotel receipts, everything that shows you had been together in the same place.

 

We didn't take photos when we met (duh!), would air tickets act as sufficient proof when requested for? That doesn't necessarily proof you met each other in person. You need to add more proof than just airplane tickets. India is one of the toughest embassy so you need to take that in consideration. 

 

I am assuming this questions is more likely to be asked at the local US consulate when I attend the interview is my assumption correct? no, during the interview they will ask you everything about your relationship, by the moment of your interview you should have all the past questions, very very clear.

 

After I-129F is approved and I-797 mailed out, can I request for my interview to be expedited? No, unless your petitioner is part of the US military you will need to wait like everybody else.

sweetheart, even when I always support the idea of not hiring lawyers for immigration purposes, I think you should talk to one. I do believe that vaccines should be something mandatory cause it safe lifes, but I also respect your religious and moral backgrounds. For what I read ANYONE of us has a CLEAR idea on how the vaccines waivwer works. So you better save time and go and to a professional. Have you search in the USCIS website? Try to cintact them if you can. Personally I've heard is not easy but I bet is not impossible mostly because we live in a country where your belief are sacred, is a right. Just to clarify...If people in America are immunized then how can a unimmunized person infect anyone?!?! They can't...It has been well documented that Autism is directly linked to immunizations, and that immunized people infect the unimmunized. OP I would encourage you to pray and however God answers you remain faithful to Him. If you both choose to not immunize and get approved I would be very interesting in hearing the update. My fiance and I have been discussing this very thing because by faith we are also counciled not to inject our bodies with chemical whether it is a dead or weakened strain. God be with ye!

I've been working with autistic kids for 6 years and autism its something you are born with, not something you caught out there. My now hubby filed for my k1 visa 2 years ago, and back then the approval was way faster (3-5 month) and one of the things they explained me was that the first part of the k1 journey the background check was only perform over the petitioner and later (nvc and US embassy) they checked the beneficiary. It's been 2 years, so maybe things change.

No, at this point you need to proof you met each other in person within 2 years and by the time of the interview, you need to proof you are in a genuine relationship and you are willing to get marry within 90 days if your visa is approve. Having money transfers and western union receipts can be part of the secondary proof you take to your interview, but by itself it means nothing. If he helps financially or not is not decesive to the USEM. Actually in some embassy, yhis kind of proof might be tricky cause the CO can think the petitioner is getting pay for your visa, in case that the money comes from the beneficiary. But if you are independent, and your fiance is not sending you money there is no problems about it. The only part where financially support really matters is when you USC fills the i134 or affudavit of support. Your fiance needs to proof he/she is able to support you once you are in the US, but in terms of proof your fiance is sending you money, is not necesary. You should submit: photos of you together, mails, letters, boarding passes, passport stamps, receipt from hotels etc.

It's a really hard situation cause most of us would never marry with somebody who can be as old as our parents or grandparents. I'm 12 years younger than my husband (Im 26 and he is 38). And even when is not such a great difference, we can help notice the difference between how we are living life. Is not easy, and cant imagine getting married with someone 40 yrs older and not being able to have kids. That's why people may think it can be a fraud but not necesarily. To the OP, the truth is that is going to be very very hard, but you can still marry him and file for cr1. Maybe moving with him for a while sounds like a good idea too.

Admitting to any drug use will almost 100% of the time result in a denial of the visa.  You'll then be required to do some sort of rehab like program, proving that you are clean.  I've read that this program can add anywhere from 1 to 2 years onto the process.  After the program you could reapply.
 
This is just one of the many many things I've read doing my research.  Could be different in some degree depending on the country, like everything else.

i agree with you...everytime somebody come clean with drug use, usually receive some sort of "rehab classes" for at least 2 or 3 years. I read this kind of topic a lor of time. Usually from people who smoked pot during their teenages years. In my case the dr indeed asked me, but I was to "nerd" and never did drugs. The best thing you can do is always tell the truth and hope for the best

You can always check the guidelines (type step by step how to submit k1 visa here in visajourney) it's super simple... for the i129f you need just a certain amount of proof..try to keep the best ones for the interview. In my case I only sent 10 pictures, a few emails, few copies of boarding passes and phone calls receipts. For my interview, they didn't request to see any proof

For the K-1 visa control sustances is very critical factor to denial your petition.... However to walk around it you should seal the record in court before made your move with immigration

also will be fine that you are clean in the pass 5 years. A friend of mine was denial due to that and you should have a lawer to seal your record in the court system before your petition

Nevertheless I wish you luck on it however be ready to deal with that soon or later. This is my modest opinion base on my friend experience; perhaps you do not like it but that is what

happened to him that perhaps could happened to you.

Yes you forgot the Form I 129F Question 18 that must be in a separated sheet  explaining how you meet her

also every document in spanish have to be translated to the English lenguaje word for word..

Also will be nice to support you visit the Hotel invoices and anyh other purchase during you visit. 

Also if you sent her any money Western Union or any other mean will help you to notice you support .
