If at any point you are suspected of fraud, you could be charged, be stripped of any visitation rights to that country and put on a ban from that country.



But even then when is a high risk, I've read so many people who successfully obtain their green card (adjusting from tourist visa) that's its almost a joke. the other day I'd an argue with a vj member about that...he said that aos interviews from tourist visas are as quick and easy as AoS interviews from k1 visas. i was like really???? how can that be? k1 visa holder need to go through a lot of stuff and are you gonna tell that a person who came to "visit" got married and stay without paying fees or sending a single paper can have his/her interview easy as mine? For God sake! is the stupid thing ever.


If is ilegal to get married and stay with a tourist visa but either way, people stay and get their green cards, the USCIS should eliminate the k1, k2, cr1, ir1 and all the immigrants visa use for marriage purpose, and let us avoid all the freaking waiting, high fees and the interview....Just saying :bonk: :bonk: :bonk:

So once I apply for AOS, I can also apply for AP, and that should take about 3 months to get to us. So you're saying she can travel out of the country, and then back again with the AP, all while waiting for the greencard? BTW, how long would the greencard take? standard 5 months?



What kind of visa is she using to enter to the US? A K1 VISA?

if is that the case, she cannot leave the country unless she has her ap or greencard. The k1 visa is valid for only 1 entry. But if you she is entering with a TOURIST VISA let me tell you that is pretty much ILEGAL to enter to the States with the clear intention of getting married FYI

If your fiance has a laptop and you have a Skype account, you can buy Skype credit and have him call you via Skype. Skype is not just for Skype to Skype calling. You can also call landlines if you purchase credit or subscriptions. I have a North America subscription. Skype credit can also pay for you to be able to use the airport Wi-Fi if you are in an airport that charges for Wi-Fi use. This is what my fiance did and I was at least able to know that he made it safely.

Have him log in as you and call your cellphone or landline home phone.

And don't worry, you did things right...Unless she commit some crime in the plane, or if she lost her k1 package on her way to the US, there're no reasons to be worried about getting deny at the POE. I's never read something like that before.

So be patient and don't worry...yeah he's gonna be tired from the flight and spending a couple of hours at the immigration sections is not fun but is not a huge deal either. They're gonna take his package, open it, check it and stamp his passport..That's pretty much it.

But you need to make him feel that everything is good and before you notice his gonna be running into your arms at the airport. :dance: :dance: :dance: That was the best day of my life!

My husband went with me to my interview, so when he came to Venezuela he brought me one of his old cellphones. We already knew that I was traveling alone to the US cause my now husband, couldn't wait for me to get my visa after my interview (His boss only gave him 3 days off from work so he could attended the interview with me and my visa took 10 days to be issued)

So once I landed I turned on the phone and call him while I was till in the airplane...While I was in line to go through immigration we were texting (be careful cause if an Immigration office watch u talking or texting, they will ask you to stop) once I was about to be in front of the immigrant officer I said bye see you!

He knew that be in the white room can take 30 min- to 4 hours in some cases so he was calm. We knew also that traveling before saturday was the best idea, so the airport (Miami intl' airport) wasn't that crowed. We choose the 4pm Caracas-Miami flight (last flight) and I arrived around 8.30 pm. I entered the immigration room by 9.20 pm and I was out by 10.30 pm

My then fiance was really excited and worried for me, cause while you are in the immigration room you CANNOT talk or text, so he needed to be patient.

Im not quite sure to count on telephone booth because that ones that I saw at the Miami airport, they were at the baggage/luggage section (to reach that point she already went through all the immigration stuff)

So having a cellphone with her I think is the smartest choice

When my husband and I sent both of my packages (K1 & AoS) we used a white 3 rings binder and plastic sheets. We created some sort of "book" with index include it so you can search any document and found it easily. We avoid any kind of paper clips and staples. We put basic some basic info. Some people told that I was wasting time and money but we dont have any kind of regrets, for me, having a well organized and neat package was pretty important instead of sending a stack of papers

The k1 to AOS guide says in step 11, referring to the i-683 form, which in turn refers to the i-485 form. Look at 7. and 8. It says, and I'll quote: "If you are a K-1 fiancé(e) or K-2 dependent who had a medical examination within the past year as required for the nonimmigrant fiancé(e) visa, you only need to submit a vaccination supplement, not the entire medical report".

However, looking at instructions from i-683 it says "Even if a new medical examination is not required, you must still show proof that you complied with the vaccination requirements". The only way to do that is: "you will have to have the vaccination report completed by a designated civil surgeon. In this case, you are required to submit the vaccination record and page 1 of Form I-693". Assuming there is no class A flags you file your DS-3025 and a page1 from i-693. The i-693 page needed requires a sig from civil surgeon. And the transcribing (if needed) from a foreign country is done by the same guy who does full medical: civil surgeon. Here is another thread about this mess as it concerns the UK. After calling 12 doctors (civil surgeons) asking them for a sig for page 1 of the i-693 (not even a vaccination supplement DS-3025) they all told me NO. Their reason? They are on the hook if later something comes up about vaccines. They don't want to transcribe for the DS-3025 at all. They also don't want to sign anything unless they administer the vaccines themselves. In our case, they did a combo of screening for vaccines already administered and redoing vaccines they can't test for. Did the SK gov/doctors have their act together and include everything needed in the K1 medical? Yes. She clearly had everything needed. But I couldn't find a doctor willing to sign page 1 of the i-693 without the full medical happening.


Obviously things have change since 2011, but now 2013 if you are AoSing from a k1 visa you only need to submit a copy of your vaccination record (the one the civil surgeon gave me back in my home country) I did NOT submitted anything else!

Depends on your age rank! If you see my second post, put the op a link in spanish so you see the ones require by the k1 visa. But in my case, the civil surgeon had all the vaccines the k1 holder needed it so he put me the ones I was missing. Must of the civil surgeon has all the vaccines require the USCIS

If you already have records of the immunizations, just use that. No need to get them done again because...

Once you are married and have to get another medical for the AOS (for green card) the doctors in the US will insist on some of the vaccines being redone. Maybe it is different coming from the UK where all the records are in English - but my wife's records from South Korea were basically ignored. I called about 12 doctors in the SF bay area looking for someone who would accept prior vaccine records and none would sign/submit a medical without a fresh round of vaccines (my wife had to get 1 or 2 shots in SK for the K1, and then had another set in the US). Even doctors that could read Korean didn't want to sign. For the life of me I don't understand why they can't just accept the medical already done for the K1.

Not done ranting... When we went for the interview for the green card I saw both medicals in our file. He looked at the K1 medical and didn't even open up the US medical. I wanted to flip out right then and there... but I just bit my tongue and smiled.

Basically, don't get any vaccines you don't need for the K1. Just get your K1. Your AOS medical will make you get vaccines again, so getting them in the UK is just wasting money.

You have a lot of BS ahead of you. Do the minimal until you get the green card.


That's partially untrue...Im about to get my green card and Im also adjust from k1 visa and I didnt need to get my medical exam again and I dont need no more vaccines. I also know a lot of people who actually get their GC recently and no one of us needed to step in a civil surgeon office. We mailed only our vaccines record and that was it. Actually when I went to my medical examination for my k1, in order to get it, I need to be done with my vaccines and the civil surgeon put me the ones I was missing

I understand your reasoning, but let me give you our situation and you can then decide if I "wasted" my money. My wife received her K-1 visa in September. She wanted to finish out the semester at work plus get the permission to leave completed so she could retain ownership of her property. We decied that she would be leaving in December. One-way tickets in December were running $3200. Round-trip tickets in December were running $2300. So I bought a RT ticket and canceled the return leg which I picked to be 88 days after arrival. So I did not use half of the trip package, but I only spent $2300 verses $3200 for the using the entire trip package. So from your perspective did I waste money?

OP: Go on-line search for a cheap ticket and buy the cheaper of a one-way or round-trip that meets your needs of travel time, layover times, connection times, number of stops, transit visa requirements (if needed but you should check) and price. Notice that I put price last as IMHO for this part of the visa process all the othr factors should come before buying just the cheapest priced ticket. My wife's ticekt was more expensive because I refused to have her go thru O'Hare where the cheaper flights are. This was based on her last two trips where she had problems in O'Hare and that was with a tourist visa.

Do the math, you paid $2300 for RT ticket if you split it in half and half that would be $1150...well you just threw $1150 (the returning ticket u didn't use)...and even when the one way ticket was $3300, what u "wasted" was $150 more expensive than the difference between both prices (prize difference between OWT and RT: $1000 - price aprox of the return ticket u didn't use: $1150)

The funny part is that even when you already paid for that return ticket, the airline sold to someone else I bet for at least 2500 or more, so your little investment on them, help them to get almost $4000 for a seat that you already paid. So yes, from my perspective, even when you save almost 1000 box, it's a waste of money.

BTW do you want to know why SOMETIMES ONE WAY TICKETS are more expensive that ROUND TRIP??? for something very simple...When you buy a RT ticket (regardless the season) your are paying for 2 VACANT SEATS. In seasons like xmas, new years eve, holidays in general MOST of the travel businesses like travel agencies, travel websites etc know how high is the demand. People are willing to pay what it takes to catch flights to be with their loveones during the holidays. And they all know this

So what they do? Simple, even when your immigration status is nobody business, most of them ask if your are planning to move from your homecountry. Normally people who want to leave their country to live somewhere else buy one way tickets, also people who wants a long trip and doesn't know when to comeback. So they try to sell ROUND TRIP TICKETS FOR LESS CAUSE THEY KNOW YOUR ARE NOT GONNA USE THE RETURN TICKET, SO THEY CAN SELL YOUR "VACANT SEAT" TO SOMEONE ELSE. Even when they sold you your RT for much less they gained money for a return ticket you already paid for.

So my advice would be, check for both types but try to keep the OWT as first option unless you are as lucky as this vj member

That was your EXPERIENCE not mine, obviously if I would found RT cheaper than a one way ticket, I would purchased it. But my case was different. A round trip ticket cost (back then) $1050 and buying my ONE WAY TICKET it only cost me $350. I dont needed to cancel any returned ticket and I saved $700.

I worked on travel agency for 2 years and in SOME cases RT tickets are cheaper. Not only that, but you traveled on a very high and expensive season, PROBABLY near Christmas day or New Years eve so that might explain why you didnt find anything cheaper

I want to share something very special, with you

Your welcome! definitely april 20 was one of the happiest day of my life. Even when I was pretty nervous and anxious (I remember that I barely slept the night before), I checked my luggage and documents like thousand times HAHAHA what a psyco. I also picked my the clothes I wear that day very carefully #WhatAPsyco hahaha but I was to make sure everything was ready to the big day but I also promise to myself that I will enjoy the day instead of losing my mind.

I woke up at 7 am, take a bath, made breakfast and I checked everything for the last time. By 1 pm I was ready waiting for my dad in law to picked me up and take to the airport. Once I got there it took me literally 5 min to get my boarding pass and get rid of my 3456 luggage ahahahahahahah. Usually the AA line are always super full but maybe it was still early. The airport was empty. I said goodbye to my dad in law and went to immigration. Once I got there, part of my anxiety was already gone. I was afraid of being late but I was totally ready by 2 pm and my flight was scheduled for 4.20 pm.

I'd the chance to eat, to do some shopping on the duty free, I even got a massage :rofl: :dance: (there is a mini spa at the airport), then I skyped a lil bit with my parents before a boarding the plane. By 3.30 pm they were calling my flight. Thank God everything went SO well that we takeoff 30 min earlier so I texted my then fiance to be aware.

From Venezuela to Miami is a short flight only 4 hours. I remember that I read some magazines, slept, play with my phone...I handle the way to kept myself distracted from the anxiety and the boredom. I can explain how beautiful was the sunset that I saw through the airplane ticket. I saw the venezuelan shore, with the sea and this beautiful sunset like if my country was wishing me a good trip. I would never forget that.

In one moment, when I was falling sleep, the airplane started descending, and I heard when I lady told her daughter "Look we are about to land" My godddd I was thrillinggggg! I looked through the window and I saw all the roads and the houses, I literally started crying. I just couldn't help it. I just could think "WE MADEEE IT WE MADE IT". After all the struggle, the waiting, the long days and night apart, those memories were completely vanished from mind in that exact moment. I just knew in my heart that everything was totally worth it.

We landed at 8 pm. was already dark. As soon as we stop, I turned on my husband's old cellphone and text him. we always knew that I was traveling alone, so he brought me an old cellphone when he went with me to the interview. He was happy and texting my family to let them know I was already in the US. I text with him during 15 min until I arrived to the immigration line. He already knew that it will took me few hours before they released me so he was ok so do I. When it was my turn, the immigration officer ask me for my passport, took me a phto, took my finger prints and lead me to the immigration room. I got there by 9 pm.

I read a book while I was waiting cause you are not allow to use any kind of electronic device. There were a few people there from different countries. even when a super social creature hahahahaha somebody adviced me not to talk to anybody, so that's why I did. Like 40 min later a lady from American Airline staff, came to me and she ask me for my luggage tickets, I handle them and she took notes of the numbers. She told me not to worried that my suitcases are outside, waiting for me. That was a huge relief for me. Like 40 min later an officer calm and ask when I was planning to get married and told him that we don't have a date yet but within 90 days. He smiled at me, stamped my passport and said "Welcome to the United States, good luck lady" That was music to my ears.

By the moment it was already 10 pm. I was exhausted, but extremely happy. I started walking to the exit door and find all my suitcases arranged one next to another like waiting for me :), the airport look like a graveyard, it was super super empty. Thank God the last airport staff member who was leaving, saw me struggling trying to climb my super heavy suitcases on the karts, so he helped me :) I walked to the exit and there was my fiance waiting for me. I ran into his arms, forgetting my luggage behind me. We cried, hug and kiss...finally I was home.

That was the first day of our new life together

I hope that sharing my story with you helps you with your anxiety, remember this is one more step.

I did bring my I 129 copy with me but it was in my regular luggage so it wasn't there with me at the POE. I just brought it to have all my documents with me not because I thought I need it at the port of entry. You don't need any of that only your passport and the yellow envelope.

All the things you need are already in that package. But the most important thing is try to relax a little bit. You still have a long trip ahead so u need all energy levels up :) try to sleep during the flight and relax...

Remember that you re coming home, that means happiness and joy. The POE is the same for everybody else only that for you it's gonna take just a lil bit longer, nothing less or more. Is just a simple procedure.

You can search for ONE WAY TICKETS through different website and you may find some good deal, for my perspective, buying a round trip ticket is wasting your money.

Try to book the flight on WEEK days, with preference on tuesday, wednesday and thursday. Flying on monday its like doing it on saturday. Those 3 days are the most cheaper also, so you may find so many good deals. like the other vj member just told you.

Another good advice somebody told was try to arrived early in the morning or late at night so the airport is less busy.

Besides your regular luggage, you should carry and carryon luggage so you can keep your most valuable belongings with you. I also brought my chest XRAY but it was never request at the POE.

Remember that it's gonna be a while for you to come back to visit your home country, so try to bring all the things you might need. Your personal documents (academic, work, religious, medical, ID, immigrant) should be inside your luggage. You need them here if you want to study or if you have a medical condition etc etc. I brought 5 suitcases not only with my clothes but also with all my personal documents, pictures, some devices, jewelry, even some medicines. BUT THAT'S ANOTHER STORY

:ot2: But while you are at the immigration section you only need your passport and the k1 visa package with you (the yellow envelope). I know how it feels, I also came alone but DON'T WORRY :thumbs: it might take you a few hours to be done, maybe less (depending on how crowded is the immigration room). The immigration officers are gonna ask you for your package, they're gonna open it, check some stuff and remain you to get married within 90 days. After they stamp your passpor you are free to go :)

I strongly suggest you to flight during week days so the airports are not so full of people. But it's a piece of cake....honestly nothing to be scare of! I remember I arrived through Miami on april 20 at 8 pm. By 10 pm I was already with my hubby. I was tired from the flight but handled to look calm and happy.

For me was one of the best days of my life....Imagine yourself running into the arms of your fiance. That was my happy thought that day and what it kept me going through the stress and tiredness. :dance: :dance: :dance:

that travel agent just tricked you.... they don't have to know your immigrant status, just sell the airplane ticket. But they know if they are selling the ticket to a person that is not going to come back to her/his country, it mostly likely, he or her are going to buy a ONE WAY ticket, so the agent's commission is lower compare if he sells you a round trip ticket. Dont let them fool you. I remember somebody warned me about this when I was about to move to the US with my k1 visa.

I went to an agency and the travel agent told me that in order to issued me a plane ticket to the US, it needed to be a ROUND trip, that is not allow to anyone to travel to the States with a one way ticket. I was like whhaaaaatttttt?? why? I told him I was legally immigrating to the States and I was not going to paid for a ticket that I was NOT going to use. Thanked God I was aware of this and said to him to sold me a one way ticket or I was leaving to another agency. He ended up selling me the ONE WAY TICKET and a I saved half of the price.

I took my flight with AA and I had ANY kind of issues.

You're going to be fine. If they ask you about it just be honest. You met someone a few years ago and it didn't workout, having denied case 7 years Ago it shouldn't affect your current case

Hi! I've a venezuelan friend who also live in Curaçao and she is about to obtain her interview date at Caracas embassy. She is very very friendly and the only venezuelan member I know that is actually living in Curaçao, her vj member is Sandris&Jim. But basically if you are going to have your interview at Caracas you must follow the same instructions as everybody else who's attending that embassy.

Yes it is very expensive. And you are right, lending shouldn't be an issue. Don't voluteer this information to the CO unless it is specifically asked IMO.

That's a very good questions...but besides that lending some money shouldn't be an issue.

But We cannot only see if the USC fiance can afford the whole visa process but also think that its very expensive bringing a person from another country. Thanked God I had my savings so I can help my husband with my expenses (even though when he has a great job). Not only think about the visa, is the AOS too, buying clothes, a car,...... is not meant for everyone

I don't see anything bad about it, if you are going to get married and start a new life here in the US, helping your US citizen fiance with some of the expenses, it's a great idea. When I moved here after getting my K1,I brought my savings so I can help my now husband with our expenses while I was unemployed (well I couldn't work even if I want to) so don't worry

In 7 month I was absolutely done with my k1 but that was last year. This year is taking tooo long to get a noa2 not less than 6 or 7 month. Even when my process was pretty fast we could plan a wedding so my husband and I got married in a court and LATER with plenty of time, we prepared a beautiful wedding! I think is not worth it, to book and pay fir something if you are not sure you re gonna be able to make it!

I'v often considered recently using the VWP to go back to the US get married then file for a CR-1 and cancel the K-1, at present it seems likely that K-1's through CSC will take 9 months to a year minimum not to mention all the stuffing around waiting for it to get through NVC and your consulate. Also being a spouse of an US citizen and being there illegally seems to be they way to get through the system quickly these days anyway.

Yeah is a quick way but not a legal way...

Not sure if it makes any difference, if anything I would guess Malaysia would be harder.

Yes, we are okay with that. Basically we have some time to work with. She is Chinese, and I am year of the snake, which is this year. She says marrying during this year is very bad luck, so she would like to if possible put the marriage off until after lunar new year, which is Feb 2014. So in our case maybe the wait times aren't so terrible, we would just like to see each other for some time before hand, and if she can get a few months in the US and have time for me to propose to her formally, then that is good. Wish she could stay while the fiance visa processes and such, but all is not perfect in the world. Backup plan is if she cannot get a tourism visa, we will just apply for the Fiance visa at the end of this month.

How do you guys deal with the time apart? Seems this is a very stressful process, but we are both confident that no matter the time we will be together. We are doing okay for now, while I was in Afghanistan, we spent about 6 months apart, and luckily with my income and circumstances we were able to live together for a bit over two months after I was done. We met when I was on a trip in South Korea before I went to Afghanistan, sometime in April 2012. I now work in California.

That's great that you have a plan A and plan B. We don't want to be a party po$&@" but getting a tourist visa its veryyy veryy hard. Is not imposible but the denial rates are pretty high, but I hope she can get it :) if she actually gets it, she can stay with you as long as her I 94 is not expire, and having a couple pf month togethers its a great way to deal with the waiting. In our case, I visit my now husband one time for a couple of weeks, but he came to visit me 4 times the year, we filed our petition. By dec 2011 we went to visit my family in Spain and spent a pre honey moon together in Portugal. I saw him again almost 3 month later when he went to my interview. We spent several months aparts, it was awful but we found the way to pulled it through. Skype was our best friend back then, we used to chat for HOURS, about everything. I remember also, that we used to left our laptops on while we were sleeping so we felt our company. Text mssg, whattsapp, phone calls are other ways. Its incrediable how fast you get use to, to your new cibernetic life and how you can do almost everything while your spending quality time with your loveone. Even when we love each other dearly sometimes, the distance, took the toll of us...so I couldnt help to feel sad and depress but our committment to wach other was so strong that is the only thing it kepts me going...and well, time went by and after 6 month I was already here. Next month Im going to be 1 year since I got here, and I feel it was like yesterday. Even when ut was a hard time been apart, I truly believe that this only made our relationship stronger. We truly appreciate the time we spend together and nothing about wasting it. Never take anything for granted it

Faster is not always better. It depends on the importance of having the green card and the right to work right away ot not. Fiance visa requires an adjustment of status which costs more and takes longer for the spouse to work and move forward. Being married they have the greencard, right to work and social security card all up front with no other immigration to worry about until the ROC 2 years down the road. OP, just check out all the options and chosse what works best for your situation. It seems the time difference is not that large right now anyway.

Yeah you are right but the truth is the even when the cr1 holder comes to the US with all their documents done, the k1 is still faster. Since my husband files for me until I moved in, it only took me 6 month, 2 month later I was adjusting and after a month and a half I had my work permit and my travel permit in hand. The same day I got my driver license and 3 weeks later Iwas working. While most of my cr1 friends (who filed the same year) they were still waiting to get the visa while I was already working and married. But yes its a lil expensive if you adjust from a k1, and you need to wait for your GC, but at least I was here with my boo and the work permit combo card is a great tool so not having my gc yet was never an issue

I strongly suggest you to follow the k1 route cause is the faster one, but you need to get married after getting the k1 visa and you only have 90 days after her arrival, but its ups to you
