I dont know exactly how it works the american consulate on france but after the noa 2, procedures are mostly the same.after getting the noa 2, your package is foward to the NVC and they recheck the package and they give you a new case number. You should call them o get this number and they will tell you how proceed. Then the NVCsends your package to Paris. The package 3 contemns all the forms and a list of items your fiance needs to gather like birth certificate and police records and send it back to embassy. They also give you the date of the interview. In my case, Venezuela doesnt have ny of this packages. Once your package reach to the embassy you email them nd ask for the interview and then they mail you back with the date and the items you need to bring with you. Check France portal and Oaris embassyreview for further information cause procedures change accoring to the country

Your welcome! And yes is only 3 month!! Naturally, the police record (antecedentes penales) is only usefull for 3 month only (with or without the apostille) but the birth certificate doesn't have an exp date, but with the apostille id only 3 month. A year ago was 6 month but the minister change it! Thank God el gestor I hired knew it (so do I) and we wait. I was approved on january 19, but we didn't have a date until late february...so when I finally have we started gathering all the documents. Remember that you can have them all in spanish for your interview, but once you are you will need to have a version in spanish and another oficially translate to english, cause you will them both for your AoS package. I did the translation here in the US. Back to topic, bring your fiance's divorce decree if you want to, for peace of mind, but once you get the interview app, they also send you a list so you will see is not need it

Actually, you may need your petitioner's divorce decree and you should have the original divorce decree with you at the interview. The petitioner submitted a copy of the divorce decree with the I-129f, but USCIS/DOS has the right to request to see the original of any copy submitted to USCIS/DOS. When I had my K-1 interview, I was asked for the originals of my husband's two divorce decrees and the adjudicator actually had to call in a consult on one of them (the first!) because i was in a different format than he had seen before. I know my then fiancee was very reluctant to let the originals out of his sight, but he did and I'm glad or I may have received an RFE at the interview instead of the Visa. So, you do need to bring the original document from which the copy was made. You may or may not need it, but if you do, you will have it.

She should have in case she need it but you cant apostille a non venezuelan document. When the embassy send us our email with list it wasn't listed and they don't ask anything that is not in the list. But for peace of mind she can take her with her. Obviously without the apostille

If the beneficiary is divorced of course you need the apostille stamp on the divorce decree. If the US citizen is the divorce one, you dont need his divorce decree for anything cause he already submitted in the k1 visa. My husband was divorce and in the moment of my interview they never asked me his divorced decree, actually is NOT listed in the items require for the interview. If the beneficiary is divorced, must take his/hers divorced decree with the apostille. FYI the apostille in venezuela only has a useful life of 3 month, after that time, the document is totally usless. Try to get the apostille of all your documents, ONCE, you have an interview appointment

FYI, if she got her SSN before marriage she should have it change before you guys get married. Reasons? If she wants to change her lastname for yours, is recommended to have all her documents under the same name, so she needs to back and have a new one. Second, if she got her SSN without her Work permit or a greencard (something that shows legal bonds with US), usually this kind of SSN says NOT ALLOW TO WORK. She can keep this one, but after getting her EAD she should go a change it

I just got mine yesterday and I filed for my AoS on july 19... As soon as you get marry, apply for her AoS. You need to prepare and send a package (AOS) just like you did with her k1. You need to wait for noa1, biometric appointment, pay a fee. The work permit is not something you go and get, you need to file within her greencard package.

Nobody is saying to send a messy, unorganized package. But sending in an entire binder with plastic sheets is a waste of time, and will be thrown away. If the OP wants to waste their time, they are obviously free to do so. But it's actually just more work for the adjudicator who then has to take apart your fancy, pretty presentation and put it into their own order.

Nothing wrong with just sending in a stack of paper, neatly divided with paperclips, and a cover letter. It can be just as organized as it would be in a binder.

The way you presented your package has nothing to do with how fast it got adjudicated.

This has nothing to do with psychology.

I think Im free of giving my opinion. I neither said that any of you sent a messy package either. I think you need to read things again. Im NOT saying either that the way we presented my package is the official, or the best way, Im just SHARING my experience. i think the OP is FREE to do with my advice what ever he/she thinks is best . If you sent a stack of paper, good for you! Is your way to do things and Im not criticizing you,either. And if the way I sent my package made it faster or not, as I said, I DONT know and I guess you CANT either, so far I know you are not an USCIS staff. Im not saying EITHER that an immigration process has something to do with psychology, im saying that people responds better and positive to the organization of the items the need to work with, doesn't matter if an USCIS staff, a lawyer, a school teacher. If Im saying it its because I KNOW. I've been in the psychology field for 8 years now. In our case, we didn't care a thing if USCIS destroyed our package but we still sent it in very fancy presentation. We choose a 3 ring white binder and bought also 3 whole plastic sheet bags. It was really cool cause we made like a sort of "book" with our paperwork. The plastic sheet bags allowed us to avoid staples and paper clips, keep our papers safe and it was easy for the USCIS staff to find any docunent inside our package. In the cover letter we created an INDEX so they can go to a certain page and found what they need. We also bought 3 wholes plastic sheet bags made specially to keep photos and you only need to attached at the end of the paperwork inside the same binder, so USCIS staff can check our photos like an album, all in the same binder. We put a huge sticker outside with our names, our petition and address. We were so proud of our package that we did the same thing with my AoS package. I dont know if the way we present my k1 package had something to do with the fact that only took me 120 days to get my noa 2 (4 month only which is nothing). But I truly believe, that a very well organized a well present package, speaks volumes of the person who is sending it. Im a psychologist and is very well known, that people rather to work with organize items cause make their work easier. Is more easy work with a package where you can find anything quick, than working with a messy package where you need to go back and forth to find a piece of paper. But that just my opinion:) wishing you tons of blessings in your new journey!

I got the same issue but "al reves" I was the beneficiary and my now husband is the US. In a year of relationship i never had the chance to visit him to the US cause i did nit have a tourist visa, he was the only of us who can visit. It was never an issue ad never asked in our interview. I dont think is an issue, i think is really good for you cause having a b2 visa is a great plus for you, i think is harder getting a b2 visa than k1 :). Besides, if you went there and NEVER EVER overstay, speaks volumes about you, as a responsible and respectful person to the US law. You could go, stayed and married, but you rather to take the right route, and followed the law. I think you have so good things on your side so if I were you I wouldnt be worry :)

In my case, I went with my now husband to my interview. There were only 2 cases of k1 visa that day, a girl and mine. This woman went alone and her interview last almost 30 min, mine only 10? 3 questions to me, 2 for my now husband and that was it. we both were approved but the experiences was totally different. Also, having my then fiance with me was the best. In Venezuela, you can be all day long waiting for your turn. In my case, we arrived at 7.00 am and walked out at 1.00pm. I was very very anxious and my fiance hold my hand the whole time, made jokes to me, I even felt sleep in his shoulder. I m not saying that having your fiance at the moment of the interview, grants you the visa, but Im sure it DOES make a difference. And if is not, at least you have the one you love right there :)

Hi Sandy! In our case, my now husband ( the US citizen) was also divorced. He went to the court and asked for his divorce decree and they give him 3 certified copies. We sent one with our k1 packGe, he gave me one, and the other one we kept it cause we needed it for our marriage license process. All of 3 were certified (stamp plus signed). We never had an RFE. And when I had my interview in Caracas, they never asked me his divorce decree.

I think you are doing the right thing about canceling the visa if you feel your relationship is not working. Most important than the visa, is your relationship. Im tired of reading cases where the couple had been having issues way before the foreign fiance got her/his visa. The result: most of them didn't make it the 1st 6 month of marriage. You don't need your US citizen fiance to end or cancel the k1 petition. You can choose to go or not to your interview. If you don't go, the consulate cancel the whole petition and they send back your package to the USCIS. after 6 month of your noa 2 recieving, if is the package is not process, is automatically cancel, cause you quitted the process. If this happens and you relationship is back in track you can always start all over again with a new package and you need to pays the fees again. But your biggest concern right now is working things out with your fiance, i know that this process can be very stressing and painful and sometimes it seems to jeopardize your relationship but you need to find out if is because of the k1 process or another cause. Doesn't affect your AOS. Whether or not his first marriage was legally valid, he ended it legally through divorce. He was free to marry you and proved that in the I-129F petition stage of the process. He did nothing wrong. She is the one that married 2 people and committed bigamy.

For AOS you won't need anything else besides what you needed for the I-129F petition. They already have a copy of his divorce decree in your file. That is all he needed to prove he was free to marry you.

ACTUALLY HE DID DO SOMETHING HE WENT TO A COURT TO EXPOSE HIS CASE AND THE JUDGE ASKED HIM FOR EVIDENCE OF HER PREVIOUS MARRIAGE. HE HIRED AN IMMIGRATION LAWYER WHO TRIED TO FIND THOSE DOCUMENTS BUT THEY WERE NEVER FOUND. SO THE JUDGE TOLD HIM TO PROCEED WITH THE DIVORCE AND THAT WAS IT. REMEMBER SHE GOT MARRIED IN CUBA NOT IN THE US, SO THE JUDGE TOLD HIM WITHOUT ANY KIND OF EVIDENCE, CERTIFICATE ETC HE CANT ANUL HIS MARRIAGE.

Hi vjers I would appreciate your thought about my topic. Im just curious about it. I'm my husband second wife. He got married with a cuban girl (His first wife) on december 2003 til dec 2006. She came from Cuba late 2002 early 2003 she was maybe 19 or 18 years old, met my husband and got married. My husband told me today while we were talking about ramdon stuff, that he was her ex wife.s second husband...I was like what?? the point is that she got married on 2002 with a guy while she was still living in Cuba, 9 month later she moved in the US and started dating and MARRIED my now husband, while she was still married with her Cuban husband. My husband found out 2 years later that she was married with 2 man at the same time. The point is that he tried to find an anulment but in Cuba is really hard to find any kind of paperwork and he got divorced to end up their "marriage".

My question is:
1.- were their marriage legal here in the US?

2.- Where I come from (Venezuela) you need to prove you are single or never be married before. How the US goverment prove if someone is not getting married with a previous marriage still pending?

3.-They have been separate for 7 years now, NO kids involve, but does he need to prove that her 1st wife got married with while she had another marriage pending?

Im a little concern cause I have an AoS pending and I dont want something like this to jeopardize our process...

Well in the case of my home country (Venezuela) we dont have package 3 or 4. The embassy sends you an email with the requirements and your appointment date. Then you have to bring your paperwork with you at the moment of the interview.

Either way, the consulate keeps all the things you bring. The proof of bonafide relationship stays with you. If you visa is approve, they keep your passport and documents. The consulate gather all your documentation together a put them inside a brown envelope, and then they mail it to you along with your passport (in some countries they issue the package and the visa the same day, but most of the cases, they mail you days later) . Under any circunstance, this package cant be open. Once you get to the States, an immigration officer will request you this package and he/she is the only person allow to open it.

Yes of course! after you guys get married, file for AoS ASAP, you can file for your AP along with your EAD (work permit) and usually arrive within 65-70 days. Is a great option if you need to travel outside the states while your Green card is still pending. That's what I did!

As far as I know she should have it done in Venezuela, by one of the physician listed in the US embassy website of Caracas-Venezuela. She needs to have a copy of her NoA 2 to proceed with medical exam, is a requirement. But the best think you can is write an email or callthe US embassy in Caracas and ask them if is allow to do that. Is is that the case, that she is allow to have her medical exam done in costa rica, she MUST pick one of the official physician listed on the US embassy website from San Jose.

FYI if she is gonna spend more than 6 month living in Costa Rica, she must request a letter of Good behavior or police certificate from Costa rica's authorities. She need it for her interview appointment, eventually

Hi, everyone! Here I am again with a question.

Is it true that if the CO ask you if you have relatives in the USA and you would answer 'Yes' could be a possibly result your visa to be denied? I know this sounds insane but I have heard few of my friends who said it's true. This gave me a scar again since I have 2 cousins in the USA. :-S

I also remember that when I arrived I had to go through VISITORS, but the line was too long and and officers took me through CITIZENS. I had a mexican couple ahead of me and no one of them were english speaker. The officer was very rude at them. When it was my turn to go through the 1st stage of the POE, he started to be rude at me until I started talking in english. His entire face expresion and voice tone change and suddenly he was extremely nice and sweet with me. That action made think that they do appreciate any effort from u if u try to comunicate with them in english. My second advice would be try to schedule your flight late at night and avoid weekends and mondays.

I entered alone through Miami POE on April 20. Im the beneficiary. After going through the regular immigration, the officer took me with my package to the "white room". I wait there probably 2 1/2 hours. Is a long wait cause they keep other immigrant petitioners, is a long wait, too many people and the officers rather to chat a tell jokes than doing their work. I was "lucky" cause I arrived on thursday with the last flight at 8.00 pm from Venezuela. Went out from the airport at 11.15 pm.

I was lucky cause the room wasn't too crowed, but the officers took too long attending people. One thing I notice is that most of them are spanish speakers officers but for some reason they rather to torture people who didn't know english, by talking in english only until they can't do it anymore. It was frustrating watching people struggleing trying to explain to the officers that they don't speak english, and in the end the officers started talking perfect spanish :bonk: :bonk:

In my case I was released quickly cause I did know english. They asked me 2 or 3 questions about my then upcoming wedding and they made me very clear that I only had 90 to get married. After that the officer stamp my passport and he welcomed me.

I think is not an interview is just a couple of questions and that's it. After all, both of the officers who attended me they were very very nice with me and I think I had a positive experience. good luck

you can obtain a SSN as soon as 2 weeks after your arrival, but if you wait until your I94 expires THEN you will need to wait for your EAD to get a SSN. In my case I apply for my SSN with AFTER getting my EAD cause I wanted my SSN to have my married name.

So, you can apply for your EAD with or without a SSN, but you need BOTH if you want to get a driver license for example. And yes, take weeks to get the SSN by mail. It took me 1 month and week.

If you apply for you AoS, your EAD and AP (you can apply for work permit and travel pemit (advanced parole) at the same time with no additional fee) takes 60-75 days.

I strongly suggest you to apply for your SSN ASAP if you still have a chance and apply ASAP also for your AoS. I applied on July 2012 and Im still waiting for my green card interview.

What's the risk? Being denied at the entry point and wasting a plane ticket? On the flip side is spending many months of the K1 process alone. Of course I would take that risk. This is one of the very few human ways of going through the process, another one being moving to her or 3rd country for the duration of the process.


A denial at the point of entry can set a bad record for her, jeopardizing her own k1 process. That's the main risk from my point of view. And Yes, she may make it and have no problems but what if she don't? How can she explain during her interview, she got denied at the POE because she was planning to stay for 3 month with her fiance AFTER quitting her job and her daughter's school? They WON'T think: "aww she just wanted to spend 3 month and then go back home" NOO, they will think she was denied cause she wanted to ilegal immigrated to the US to avoid the regular procedures, get married and stay.

The american embassy in Caracas is everything BUT a piece of cake. Even when we have low rate of denials for k1 and cr1, people there can get very RUDE during the interview, very inquisitive. And a denial in US POE is not something they will NOT ignore as simple as that.

Remember, for the US GOV all the beneficiaries, we are all walking frauds for them. That's how I see it! and our JOB is to prove them, they are wrong. That's why we need all this paperwork, all the pics, letters, chats logs, interviews etc, so they can see our honest intentions. Even though, I met so many people here with true and honest intentions and never make it.

So the other part of our job, is not give them any reason to give us a denial :bonk:

but in the end she need to decide what's best for her and her k1 process.

I'm agree with them. Even if you dont mention the k1, or that you re quitting your job, I wouldn't take any risk. the 1st part of the k1 package (the one he need to send) it's not complicated. He must follow instructions and that's it.

hi! well, even when gay marriage is legal in America (in some states only) I'd never read or know of a case like this in visajourney. The best thing you can do is talk to a good lawyer and find out if its possible. The other important thing if your state, allows gay marriage.

I know is not the same case but, is very important to know the second one. For an example: here in the states is legal, cousins marriage (2nd, 3erd, 4th etc) and you can even apply for a k1 or cr1 if your fiance or spouse is your own cousin (I know all this cause I went through a k1 process successfully and my husband is my 3rd cousin). But this doesn't necessarily apply for 1st cousins. Is only legal in 16 states. If you belong to one of the states that doesn't allow 1st cousin marriage, your petition would be automatically denied.

So my point is, find out if your state allows it and then find out if it possible to file for a k1.

of course they are useful, but when I was preparing for my k1 visa interview, I also took a few screen shots, with friends and family comments on our pics. We choose Valentines day, our official engagement party (with tons of comments), christmas, our bdays.

Let me share a list of things we collected for our visa ( we sent a few things with package and the rest for our interview) We spent months searching for the most important items requested by most of the embassies:

1. whatsapp, bb mmsn, skype chat logs and screen shots.
2. pictures the two of us and with the family
3. receipts from: hotels, restaurants, hostals, museums, tours etc
4. Call logs
5. emails, cards, letters
6. airplane tickets, boarding passes, itineraries
8. copy of passport stamps
9. western union/money transfer receipts

After we sent our k1 package we started gathering all our stuff...and weeks put it them together....the funny part is that the consulate staff who interviewed me, NEVER asked me to see nor a single photo... It only lasted like 5 min? I was like Is that it? don't you want to see our pics? I have pretty pics :bonk: :bonk: :bonk: :rofl: I was kind of disappointed cause we spent a lot of time and money having all this together...

VERY high risk.

If at any point you are suspected of fraud, you could be charged, be stripped of any visitation rights to that country and put on a ban from that country.



But even then when is a high risk, I've read so many people who successfully obtain their green card (adjusting from tourist visa) that's its almost a joke. the other day I'd an argue with a vj member about that...he said that aos interviews from tourist visas are as quick and easy as AoS interviews from k1 visas. i was like really???? how can that be? k1 visa holder need to go through a lot of stuff and are you gonna tell that a person who came to "visit" got married and stay without paying fees or sending a single paper can have his/her interview easy as mine? For God sake! is the stupid thing ever.


If is ilegal to get married and stay with a tourist visa but either way, people stay and get their green cards, the USCIS should eliminate the k1, k2, cr1, ir1 and all the immigrants visa use for marriage purpose, and let us avoid all the freaking waiting, high fees and the interview....Just saying :bonk: :bonk: :bonk:
