hi bro, are you positively sure that K-3 and CR-1 accept co-sponsor in hcmc? im a student and dont meet the income requirement either. im going with a CR-1 and im worried sick about this. you just made my day if this is true.


It is my understanding that the marriage in Viet Nam route is the way to go with a Co Sponsor. I don't have any concrete evidence unfortunately. You may want to start a new thread and see if anyone has used one.

I finally got a response from USCIS Saigon:

Dear Sir or Madam,

If a person is married to a Vietnamese citizen, and the USC/petitioner lives in Vietnam, does the USC have to live in Vietnam at least a year before filing directly at your field office?


Their reply:

Thank you for your inquiry. Please be advised that in order for the petitioner to be qualified to file an I-130 application with USCIS-HCM, he needs to prove that he’s been in the country for at least 6 months and has a residency visa to reside in Vietnam for another year. Proof of residency and working contract are also required.

The fiancé(e) petition cannot be filed with oversea offices. The only petition that you may be able to file while you are in the country is spousal petition for her (Petition for Alien Relative, Form I-130). This petition can be filed with local CIS offices (Citizenship & Immigration Services). To be eligible to file an I-130 application with our DHS office in Ho Chi Minh City, you must establish that Vietnam is your place of residence, and that you have continuously resided in the country for a period of not less than one year with no more than thirty days accumulated absence during any calendar year.


Like I said before, you can file with the USCIS Field office after living there a year. That is not a Direct Consular Filing.


I've done a little more research on this and it appears that some are now using DCF as the process of filing at the USCIS field offices. It used to be that you could go to an Embassy or Consulate and file directly there. USCIS was not in the mix, if I am reading these posts right.

Regardless, you have filed with USCIS already. If it was me I would just wait.

As far as I know DCF's are not accepted there. The only option is to live there a year and file at the USCIS field office in Saigon. This would make no sense in your case since you have filed already.

The law eases citizenship restrictions on foreigners and overseas Vietnamese.

Under the Nationality Law that came into force in 1998, dual citizenship was banned, so people taking out Vietnamese citizenship had to relinquish their original nationality.

Under the amended law, foreigners eligible to take out Vietnamese citizenship and retain their origin nationalities would include those who:

- marry Vietnamese citizens or have Vietnamese parents or children;

- receive certificates or medals of merit from the State or the Government for their contribution to the country; and

- those whose citizenship would benefit Vietnam’s socio-economic development, science, national security or defense.

These categories of foreigners would be exempted from some Vietnamese citizenship criteria, such as being able to speak Vietnamese and residing in the country for at least five years.

The amended law, set to take effect on July 1 next year, also permits foreigners of unclear nationality to apply for Vietnamese citizenship three years after the new law takes effect.

The timeframe for processing Vietnamese nationality applications would also be reduced to nine months from the current 12 months, according to the amended law.

The government will issue further decrees with instructions on implementing the law.

I'm ready for a change. I think no matter where you go there is corruption. Right now in the. U.S. - there are so many theories and and conspiracies that I don't know what to believe. The night that it happened he said "Use your footbrake more." I said "Footbrake?" I didn't know I had one! I haven't ridden in 23 years, in my own defense.

We ate at a restaurant in District 7 three times in 2 days. The food was great and they didn't screw up the order. That's the positive. The negative is that the TV was on with the volume jacked up. My Wife had to remind the guy about our order on one occasion. I told her "Honey don't bother him, he's watching TV." She says "But it's his job." Bottom line is they ripped me off for $1.10 and have lost my business permanently because of it. I hate petty thieves, which is what the proprietor is IMHO. There is a cafe on every corner here. I will learn who the thieves are and who the honest businesspeople are and frequent the latter.

The services you provide is a case of apples and oranges. I doubt you have a competitor on every corner.

Yeah I agree with you that another thing that bothers me, They take advantage of Viet kieu's and foreigners on the prices and scam us all the time. No customer service what so ever. They seem like they don't care if you don't come back or not. Their all like soup nazi's!

I knew what irked the sh!t out of me coming, so it gave me a chance to brace myself.

I sat at a cafe yesterday posting that. I paid and then came back later. My order was 3 cups of coffee and 2 pots of tea. I was charged 30K VND all together and I tipped them 10K. When I got back to the hotel Thuy brought up the price. She had paid 5K per coffee the previous day. I sent her over to ask why and they said "Well he sat here a long time.". I was there 1.5 hours total and would have actually drank more coffee if the service wasn't so lousy. On top of that the freaking place was empty. She gave them a tongue lashing and told them not to expect us back. They got me for 20K VND and lost business in the process. Unbelievable.

I take the opposite stance on that one. I took a load from Idaho Falls, Idaho to Glen Burnie, Maryland a few months ago that was slightly bigger. It was an incredible waste of fuel IMHO ($1500). The company said to do it though, so I did. These folks are just making due with what they have.

Well my $12 a night hotel doesn't have in room WiFi so i haven't had a chance to respond. Here goes.

I feel 100% more comfortable on this trip. I knew what irked the sh!t out of me coming, so it gave me a chance to brace myself. I did most of the bracing during the 12 hour layover in Chicago! There have been 2 incidents since I've been here that shocked me though.

1.) We were at a nice restaurant in Saigon. I went to the bathroom and was taking care of business at the urinal when a kid that was at least 6 walked up to the guy beside me and grabbed him by the wanker. The guy shooed him away, but when he finally started pissing he called the kid back over (I'm assuming they knew each other). The kid lost interest in him and turned his attention to me. He stuck his head close to me and I said "Get the hell away from me kid!". Well that got everybody's attention and the kid backed off. He then went back to the other urinal and crammed his hand in it. To his Father's? credit he did wash the little pricks hands! When we were leaving I saw the same kid pounding on the elevator button. I told Thuy we would take the stairs and explained why.

2.) I was in Quan 1 yesterday having lunch with a friend. We were outside talking and heard a crash. A car (nice Mercedes) hit a motorbike rider beside the cafe. The driver slowed down a little and actually had a smirk on his face. The rider got up and appeared to be OK.

Things are definitely different here, but I am doing everything in my power to stay. I spent a year in a semi with very little time off, so i feel like I've been sprung! I'll deal with what i have to so I can stay with my Wife. If I land a job our plans are for us to stay here a few years then return.

Please be advised that in order for the petitioner to be qualified to file an I-130 application with USCIS-HCM, he needs to prove that he?s been in the country for at least 6 months and has a residency visa to reside in Vietnam for another year. Proof of residency and working contract are also required.

Maybe we should contact 60 minutes or somebody in the news and have them investigate this. I think its corrupt to the core and it needs to change.
