It is totally within their discretion to deny a visa if they detect a faint hint of fraud, even if there is none. Your lawyer is WRONG! It's certainly required for the initial submittal, just like the I-129F and every other attachment. He's incompetent and you need to report him to the Minnesota bar association. Additionally, he botched your case by not ensuring the form was signed and did not include the letter of intent in the original package. He should pay for all overnight mailing.

Really? I've read many cases of fiancés and spouses signing the G-325A at the interview. Though I think they usually sent a statement to USCIS to that effect, just so USCIS wouldn't think they forgot.

I thought I could use the same one over and over, but found that I was naïve :( I'm sure Snappy Snaps are getting sick of the sight of me! But I don't want to use a photo booth. I have to take my glasses off and then I can't see what I'm doing!

 

Anyway, the ACPO form states:

 

ONE recent colour passport style photograph (Approximately 45mm x 35mm).

This should be appropriately endorsed on the back

 

So the 2 x 2 inch one won't work in this instance.

Although you satisfied the meeting-within-2-years requirement, the embassies and USCIS have a wide berth as to the reasons they can deny. Technically, they can deny people if they don't like their shoes (though hopefully that has never happened!). Even though you have met, they are suspicious as to how it can be a real relationship if you only met once, in the US, and then decided to marry. To them, it looks like your fiancé went to America, loved it, and decided he wanted to come back via marriage to the first American woman he could find. That is essentially the "easiest" way into America as a permanent resident.

 

I would recommend you visit each other more, and build up a portfolio of ongoing evidence of your relationship. Photos, chat logs, gift receipts on Amazon, texts, phone calls etc over a long period of time. You will probably find he will have difficulty getting a B-2 tourist visa to the US now since he has displayed prior immigrant intent, so you should make plans for multiple visits to his country.

Itineraries are not proof of anything other than buying a ticket, it is not evidence. They want physical proof that you boarded the plane with corresponding passport stamps. A printed itinerary means nothing

If you've thrown out or lost your boarding passes, you can print out the e-tickets/itineraries and attach them with the corresponding passport stamp. That kind of proves you used the ticket in the same way a boarding pass would.

Technically, the Form I-797c, Notice of Action, Petition Receipt (NOA1), is the official receipt that you will receive from USCIS acknowledging receipt of the petition and the correct payment. Most folks receive one from after successful submission of the I-129F petition and the correct payment.

Not exactly - we received our NOA1 as normal stating that $420 was received, but about 9 days later our cheque bounced. They don't seem to wait for payment to clear before issuing the NOA1.

Just some quick clarification :) your boyfriend submitted the petition to USCIS, not to your embassy. Your embassy gets involved in the very last stage when you have your interview.

 

When you say "last March", do you mean March 2013? If so, has your boyfriend checked up on what's happening? That is a very long time to wait for an I-129F approval.

 

The only way being a student can affect anything is if he doesn't make 125% of the federal poverty guideline for his household size. If he doesn't, he will still be primary sponsor, but will need to either find a job pronto, or ask a family member or friend to be a co-sponsor for you. This financial aspect of the visa doesn't come into play until your I-129F is approved and your petition is forwarded from USCIS to NVC and then finally on to your embassy.

 

Edit: When I say "your embassy", I mean the American embassy in your country. It's probably also worth mentioning now that the American embassy in the Philippines is very picky when it comes to co-sponsors. They may say that your fiancé can be the only one to sponsor you, but YMMV.

He got both Hep A and Hep B from his GP. His medical exam is April 25th. He's getting all his shots right now for free through NHS so we don't have to pay for them at Knightsbridge. Yes Hep A and B are on the required list. So far he has gotten: Hep A, Hep B, diptheria poli pertussis, tetnus, measles, mumps, and rubella. He gets the second stage of Hep A and B next week, and then the third stage in 6 months.

 

That's good. For a moment, I thought Knightsbridge were forcing people to take the shots that weren't age-appropriate to get more cash :P You'll find you don't need to worry about the Hep A and B boosters at all for the AOS stage, but it's still good to be immune from things like that.

I have seen people get RFEs BECAUSE of their attorneys. There are some really shocking errors made and absolutely awful advice given by attorneys that VJ members report almost weekly, if not daily. A lot of attorneys forget to include the statement of intent to marry with the I-129F petition, something the petitioner and beneficiary probably would have made sure to include had they decided to do it all themselves.

 

Given your country of origin, and assuming you have no criminal records or overstays, this is an easy legal process once you read everything carefully and follow all instructions given. It just takes a long time and there are a fair few forms to fill in, which intimidates people. A lot of the info you have to give is repeatative. I had to prove my marriage was real to USCIS, a bit more of a task than merely proving we'd been in person together within 2 years, and did this with no legal help and no co-mingling finances (a big deal sometimes for USCIS). I got approved after 6 months with no RFEs and no lawyer.

 

I've already seen you're not going for the lawyer, but I get really worked up by shoddy attorneys taking advantage of people who just want to be with their partners, thus my rant. My father-in-law is a family lawyer and tried getting my husband to hire an attorney. I put my foot down there and then and told them both "no way!"

I think you'll be fine. Take the photos to the interview with you. With the I-129F, you don't have to prove a relationship, you just have to prove you've met within the past 2 years. Norway is not high fraud, so I would be surprised if you got an RFE from USCIS.

Your interviewing officer might believe that you have temporarily divorced your ex to marry a foreign mutual friend and bring him to the country, especially since your ex is the joint sponsor. Be cautious. I know it is a farfetched idea, but consulate officers in high fraud countries only have to have their fraud senses tingling a little bit to deny a visa.

As for syphilis i guess im just over worried as a self check over after medical i found something but wont say the details. I guess ill wait to see if i get a call be Tuesday as the doc said.

They do sometimes do a urine test if someone admits to taking illegal drugs. This is then used to deny the visa if it comes back positive. It doesn't happen that often.

The medical is one of the easiest parts of the process if you have nothing wrong with you, and I seriously doubt you would have syphilis and not know it. They give you a quick look-over, blood test, x-rays and vaccines, then you're on your way.

 

Only other problem that may crop us is if you've ever used illegal drugs, but hopefully you haven't!

Only weird thing that ever happened to me was my second time going to the States, I was pulled aside and had my suitcase "searched". And by "searched", I mean he pulled a book and a shirt out, asked what my visit was for, then let me go. Ironically, I did actually have syringes and needles in my suitcase, but they were full of heparin, not heroin :D Otherwise, I never had much trouble gaining entry. The guitar was the most likely thing that set them off, they might have thought he was going to do some busking.

They can't deny a K-1 for lack of ties to the UK since the purpose of the K-1 is to leave the UK forever :P

Unfortunately, the US does make it rather cumbersome to bring a fiancé/spouse into the US. They do this because of fraudsters who will marry an American just to get the Green Card before they disappear into the ether, leaving the US citizen worse for wear. I'm not at all saying your fiancé is a fraudster, but it is an assumption you have to overcome when you file for the visa.

 

This is why you need the affidavit of support requirements to be met (to prove to the US government you can afford to keep your partner without him claiming welfare), and at the interview stage (or I-129F stage if you wish), you should take/submit proof of an ongoing relationship.

 

If you read the guide at the top for the K-1 visa, you should get the gist of what you need to do. There are also wikis here that explain steps you can take to prove your intent to re-establish US domicile, if you don't move back there before the interview.

There actually was a case on this board not too long ago.  The person in question was forced to let the airline staff open the envelope when boarding the plane or they wouldn't let him on.  There was a lot of frantic calling ahead to POE and so on and I believe that POE allowed the airline staff to reseal the envelope and things went okay, but it was VERY extenuating circumstances and there was a lot of franticness involved.

 

That is so weird. Did they think there was a bomb inside it or something? I didn't see that thread.

This was advice given to me here and on another forum as my husband works security with differing hours each week.

if she gets as far as customs then she's already in, now immigration, that's a different story.

 

That's not necessarily the case 100% of the time. I've read of people breezing through immigration, then being nabbed by a customs officer over an immigration-related issue and subsequently denied entry... despite being admitted >.>

 

When I'm in customs wheeling my suitcase out, I avoid eye contact with all of the officers except for the one who takes the form off you. Last time I looked at one who was just chilling at the side of the room with his colleague, he flipped out and dragged me over to the side to search my case. It was weird because he didn't actually search it. He just destroyed it instead. Had he searched it, he would have found my needles and syringes full of drugs. Legal, of course - I have to take heparin before I board flights - but he would have gone to town with a suspected drug mule case, I'm sure.

 

Lesson learned, never look at a customs officer! :D
