When I read my approval notice, I touched base with an ISO, as it was the same as yours.

That's quite interesting, about question 22. I had my husband write that I'd be going to the London consulate in there, even though I wasn't in the states at the time. The earlier question asking for the I-94 # was N/A'd too. I wonder if our adjudicator will also think I'm over there :P

NLR is right. In theory, if someone makes the minimum for the household size, they should be good to go, and NVC will most definitely complete the case. However, a consular officer doing the interview may think it is not enough for whatever reason and deny the visa pending a joint sponsor. Some consulates are more fussy than others.

K-1s sped up because they stopped using the K-1 processing people to process DACAs and started using the IR1/CR1 people. K1s were the first group affected by these other applications. 

 

Before that the K1s were extremely slow (just like we are now). We switched places, is all. 

 

Hopefully one day they'll hire a huge bunch of DACA-only people to avoid this kind of fiasco in the future!

There's currently a backlog of IR/CR-1s. This is because of the influx of DACA paperwork that totally threw USCIS off and made them stop processing I-130s entirely for around 6 months or so, so they could focus entirely on DACA. They continued processing I-129Fs for K-1 visas as normal. In my experience of working in an office under incompetent management, it doesn't surprise me at all. Thankfully, they are at least beginning to work on I-130s now and people who filed at the beginning of 2013 are getting their approvals.

So you sent in that birth certificate, then you were sent a checklist asking for the birth certificate. You're now wondering whether you sent in the right one.

 

Did you sent it in via email or via snail mail? I'm thinking if you scanned and emailed it, they thought it was too folded/battered? Because other than that, I can't see any problem with it. Perhaps you should call NVC to clarify what it is exactly they want from you.

Yes, they will. To ensure they do, take a copy of your marriage cert and proactively ask the border officer to stamp your passport as an IR-1, as well as enter it into the system as such.

 

Even if you end up getting a Green Card with an expiry of 2 years, you can get it corrected for free since it was a USCIS error.

Unless you miss out a few vital documents (and they will give you time to remedy that), you will sail through this. Your main goal now is to find someone legally resident in the US to be your co-sponsor. They will need to earn 125% of the poverty level for their house size (so whoever lives with them plus you).

I totally agree, what a long time to wait before doing anything. Did the cousin fool you into thinking 6 years is normal, or did some kind of emergency side-track you? Either way, my opinion would be that you need to re-file since all the old petitions were abandoned. Don't do this through the cousin again!!!

There are a lot of couples on the IR-1/CR-1 forum who have been married a long time. They aren't too hard to find :) are you looking for immigration advice or just a general sort of hang-out/support area?

 

For the former, the guides at the top of the page are extremely helpful. Some stuff is out of date, but the I-130 part at the beginning definitely still applies.

 

If you keep up to date on this or any other active immigration forum, you'll find yourself become increasingly knowledgeable about US immigration and can anticipate what the US government will require from you during each stage of the process.

 

For the latter, there are also some off-topic and country/region-specific areas where you can make friends and get emotional support through it all.

Not all vaccinations will be applicable to you. The ones that are, you must have or you will be inadmissible on medical grounds. I'm not sure if there is a waiver, someone else needs to chime in on that front. 

 

For the diabetes, I think you will need a letter from your GP stating that you have it and it's under control. In any case, if the panel physician needs something additional from you like hospital reports or additional examinations, they give you time to complete those before sending the medical packet off to the embassy.

Oh this is different story then.  P_dioso...you need to provide all the information to get any answers.  I saw some of your problems you are facing on your other posts including paternity test...you may need more help than you can get here. 

 

IMHO: If I were you I would want this guy to come and marry me in the Philippines.  He is going to have to come visit you BEFORE he files any papers anyways. (You have to meet in person within 2 years prior to the filing of any petition) Will he commit to marrying you this time?

That's actually not true for the IR-1/CR-1, the two year meeting requirement. I mean, obviously it helps greatly, but unlike the K-1 where you HAVE to have met within the past 2 years, it's not a fixed requirement for each and every IR-1/CR-1 case without a waiver.

No offence to you because I also really want to be with my love asap, but you'll be lucky to even have your NVC case number by May. It can take up to 8 weeks. Then you need to wait for them to invoice you for two payments which also take some time... then the AOS and Immigrant Visa packets you send take up to 30 business days to review. Finally, everything is okay'd and you get an interview date scheduled perhaps a month or two after everything is reviewed and approved, and that's assuming your embassy isn't backlogged with appointments for the next few months.

 

You need to realise and accept how long this process will take now, before you delve into it and set your expectations a tad too high.

 

All the negativity aside, I truly wish you luck and a speedy journey through all this bureaucracy!

My package is shown to be delivered on the 19th February, and I'm still waiting to get the notification. Is it normal? How long would the whole process take?

 

It varies a lot, but the general consensus is that after 30 days without any sort of notice at all, call them and ask them to re-send it. We got ours 6 days after they picked it up from the Chicago Lockbox.

If a CO denies a K-1 purely for immigrant intent, that would be quite backwards. The whole purpose of the K-1 is to eventually adjust status within the US. I think your lawyer doesn't know what a K-1 is.

You need a joint sponsor. Cash is counted as an asset, but at a pretty low rate. And I doubt it they will count the asset only, without regular income. You'll run out of cash in 2-3 years and then what? You sponsor your spouse for 5 years minimum (if she gets her citizenship in 5 years).

 

Spouse of USC can apply for citizenship after 3 years of permanent residence married to the same petitioner.

Pregnancy, no. Things like natural disasters in the beneficiary's country, or if the petitioner/beneficiary is dying, yes. There may be some other criteria, but if you are not in immediate danger in some way, usually they won't grant the expedite.

I recently got married in Illinois to a Brazilian, and we are applying for a spouse visa. I currently live in the United States, and he currently lives in Brazil. I am almost done filling out the i-130, but I also found out last week that my company is moving me to a different state. I live in Iowa, and now I am moving to Miami.  I want to file as soon as possible, so I need to send my materials to the Chicago lockbox facility.  However, Florida falls under the Phoenix Lockbox facility. I am a US citizen, and he qualifies as an immediate family member.  Will there be issues if we file with one Lockbox, and I later change my permanent residence to a different Lockbox's jurisdiction? 

 

Any advice? I'm just worried they may make me start over again if I change jurisdiction.  

 

You'll be fine. Send it to Chicago, then when you are able to view the case online, you can use the same website to change your address. Make sure you set up a mail redirect before you go though, or you won't get your NOA1 receipt notice if it arrives after you leave :)

You should have used the name she's going to be using going forward, but there's nothing you need to do now.  Just use the correct name on the visa application and everything else at the NVC stage.

 

You committed another common error though on C17.  Your wife is not your relative's spouse.  You are.  Your name goes there as your alien relatives spouse.  If she has children, her children's information goes there too.  No worries.  It's such a common error, they just ignore it.

 

Sounds strange?  Think about how the I-130 would be used if you were filing for your mother.  Her husband's name would appear there and you and your siblings would as well.

 

I'm pretty sure we made that mistake (don't have a copy of our petition to check), so I was surprised we didn't get an RFE up until reading what you've posted :P

Once you get your approval, you can start calling NVC to check if they have your case yet, then when they do, you can keep checking in with them to see if your case number has been generated. Their number is 1-603-334-0700, I believe you need to press 1 to get an operator.

Yes, You could apply an expedite. Whether USCIS will grant it or not, is another matter.

That's what I meant, surely we would all qualify for an expedite if the only criteria are that we miss our spouses and visits cost a lot. Up until today, I have read that they are for life-and-death/emergency situations only. Not even imminent childbirth qualifies for an expedite usually. How can they deny it to a woman about to have a child, but in the next breath give it to someone who should just wait their turn? Clearly OP has something else going on that DOES qualify for an expedite and hasn't disclosed it (which is totally his right not to), or he is misunderstanding and has just had his case upgraded from an F2A to a CR-1 (he mentioned he has very recently become a citizen).

 

Sorry if my post sounds mean, but I'm genuinely confused. Perhaps expedite criteria has been loosened recently or something  :blink:

Unless there is something going on that would really qualify for a hardship waiver, I'm a bit lost. It would be nice if we could be expedited purely for the financial and emotional aspect of the separation, but then EVERYONE would be expedited... meaning no one is expedited.

The NVC doesn't make any kind of decision. They just process the paperwork.  The embassy is the one you need to prove something to.  Take all evidence to the interview. 

IMO you don't want to weigh down your NVC packages because it may get lost and take them more time to weed through and pick out what they really need.  

I only sent what they asked for.  You can read the first post on the NVC thread . All the info is there.

 

I think you're missing what the purpose of side-loading is. NVC certainly won't look through it and do any approval/denials based off of it, but the entire case is then shipped to the embassy for the CO to review before the beneficiary even walks through the door on their interview day. Since so many refuse to look at what the beneficiary has brought in with them, it's a handy tip for people in MENA countries to front-load with USCIS, then side-load with NVC.
