A good explanation is just a statement to say he didn't earn enough/anything in order to need to file taxes for the relevant years. You don't need to go into the nitty gritty. You can probably find example statements via Google.

I know what you mean about people commenting about marrying someone in the US. I'm from the UK, a country people don't generally try to escape from, and even my mum and work colleagues think I married my husband just to get the opportunity to live in the US unsure.png I dated this guy since I was 15 and didn't even consider moving to his country. Originally we were going to live in the UK, but sky-high rent and the new £18,600 salary rule kind of prevent that from happening...

 

But yeah, my point is, you know deep down your reasons for marrying your man - because he sends your senses reeling! :D and now you want nothing more than to be with him, by his side. As long as you keep that knowledge in your mind, you can rise above others' cruel and jealous comments.

That's just how it is :( last year, from about Feb/March until Oct/Nov time, absolutely no I-130s were adjudicated. They receive over 1000 per day alone, and just let them stack up. Only recently were they like "s*** - look at all these petitions!" and distributed them out to different service centres - as they have with yours. Petitions have seemingly been coming in thick and fast, so hopefully yours is on the horizon. Some centres are faster than others, so hopefully yours was sent to a fast one. Hang in there!

Since you are overseas too, you might find you'll need to go back to the US ahead of your spouse so you can settle in, find a job and file a tax return showing an income that satisfies the requirements. This is all you can realistically do with no joint sponsor or assets.

Are you registered disabled, or just finding it tough to find work? You might consider moving to another State with more work opportunities. My husband moved from Nevada to Ohio for this reason.

If your marriage is over 2 years old when he crosses the American border with the visa, it will be stamped as an IR-1 and he will receive a 10 year Green Card.

 

If he gets a 2 year Green Card by mistake after he arrives, you can send it back to USCIS for correcting for free as it was their mistake.

Does the total income have to be more than 125 percent of the poverty rate for the last year, or for all of the past 3 years?

 

Technically only for the current year (2014), but the tax returns build a good case of a stable, ongoing income. If you didn't earn enough for your upcoming 2013 tax return, but will this year, they will most likely approve it provided you can prove it with paystubs and a letter from your employer.

 

Having said that, the last tax return you filed is a mandatory document to be included with the I-864.

In fairness, the guide does not say if the copies need to be certified or not for the I-130 package. I am in this thread after doing a forum search to find out the same information, so perhaps the guide should specify.

 

If you read the whole guide, you'll see where it says they can be photocopies. Whoever has editing rights on it needs to make that more clear, and update the page to reflect the new application forms.

Thanks for all of your replies! I guess I'm looking for any suggestions that *might* help speed up this process (calling the USCIS? using an immigration lawyer? or maybe there is nothing to do but wait...) or advice on a legal way to extend my husband's visitor status. My relatives keep suggesting that I call an immigration lawyer, but it seems like that would be a waste of money. I do understand that this is a long process, and we're all stuck in the same boat waiting to be together with our loved ones.

 

Right now, we're waiting to receive the NOA2, but the Nebraska service center is still processing applications from March 2013 (we applied in May 2013). So it appears that we're likely 2 months away from even the NOA2, and then the rest of the process still has to happen. If there is a way to legally extend my husband's visitor status (for example the I-539 visa) for a few more months, I would like to try pursuing that option. I have made an appointment at a local USCIS field office to try to get some advice.

 

 

My family also keep pressuring me to hire an attorney even though it's a waste of time, money and effort. As a result, they think I want to be apart from my husband. As if I'm not stressed enough :D They won't listen when I say that an attorney cannot obliterate the backlog, and even if he somehow did, that would be so unfair to everyone who filed way before we did.

 

As Darnell said, since your husband is with you now (and I assume did not intend to immigrate on that visit), you can legally apply for adjustment of status so he doesn't have to go home. Well, he won't be able to go home until he receives AP (if you choose to file for it).

I visited my husband in July for 2 weeks, got married in the second week then flew home. When I got to the POE and was asked my purpose for entering, I said "to visit my boyfriend for 2 weeks". I was stamped in right away (after the officer stared at his screen looking suicidal for a few moments o.o)

 

VWP is handy when there is no grilling :)

Hi all, 

 

Ok so my wife spoke to an immigration lawyer today for some advise, we have already filed form I-130 and received the notice/receipt. 

 

She did ask weather I would be able to come into the USA on a VWP (Visa waiver program / standard tourist visa which allows a a tourist up to to 90 days to remain in the USA) and he replied and was adamant to say that I should not do that as it could delay / mess up the I-130 process! I have however asked on the forum before and others have stated that they did do so and had no problems. 

 

So my question is has anybody had any problems with this? Of course having a return flight ticket already booked and ties that show your 'need' to return back home is a given.

If you do the married filing seperately you have to do a paper return.  You cannot efile.  You put NRA in the SSN block and mail it in.  Any company that you use will also have to do this.  Do not, under any circumstances, file as single.  You can always amend these taxes after your spouse arrives in the USA and has an SSN.  

 

My husband is doing the e-filing and he was allowed to leave the SSN blank as long as he selected a reason why it was blank. He chose "Spouse is not a US citizen" and it accepted it. Is that incorrect?

 

Edit: Actually, I just went to H&R block and the option actually says "Spouse is not a citizen or resident alien". Seems good to go!

Kind of sucks for petitioners who get no annual leave, since there is no legal minimum in the USA. They'd essentially have to quit their job to fly over, and they might be the sole sponsor too. Don't some embassies refuse co-sponsors? Hopefully they aren't the same ones who need the petitioner there.

When you get to the airport, you go into the visitors' line. When it's your turn to be inspected, you say you've arrived with a visa. They'll process you (possibly in secondary) then let you in. Then you leave the airport or go to catch your connecting flight.

The forms you'll fill out for the CR-1 after your initial petition is approved are called the I-864 (Affidavit of Support) DS-261 (Choice of Agent) and DS-260 (Immigrant Visa Application). The latter two forms are done online and the Affidavit of Support is mailed to the NVC.

 

The DS-3032 and DS-230 Parts 1 and 2 were old paper-based forms that are no longer used.

 

Don't know what OF-169 and OF-230 are, but they are most likely very outdated! Who has editing rights to the guides? They need a do-over quite urgently.

Frankly, making only 24,000 a year it will be a challenge to provide support for you and your child.  Have you thought about how difficult it might be without that money?   I only ask, because even in our situation with no rent to pay, no car payments, etc.  We find it tight on more than that sometimes.  Just to be realistic, I'm not sure how you could afford to live on much less, know what I mean?

I second this, if your husband doesn't make enough and neither his friends nor family make enough to sponsor you and your child, how will you live in the States? You don't want to be in the situation where you can't provide for your child.

ya, sorry, you use 'there' twice in different meanings, so I dunno what you are trying to say.

'Being in the states' ain't the visa track on an approved i-130, I hope that is self-evident.

 

Q22 has a left side and a right side, both are meaningful.

Don't forget - the I-130 is a multi-purpose form. 
 

 

The first "there" was in reference to the I-130. The second "there" was in reference to the USA.

 

What I'm saying is we filled out the right hand side on Q22 even though I wasn't in the US at the time. We had read of people receiving RFEs for not stating their consulate (though surely they should know the nearest consulate to someone based on their home address) so decided to fill it in anyway.

The adjudicator prolly got confused with q22 of the I-130.
 
When I read my approval notice, I touched base with an ISO, as it was the same as yours.
I think it was the ILS human that got me the right traction, though.

That's quite interesting, about question 22. I had my husband write that I'd be going to the London consulate in there, even though I wasn't in the states at the time. The earlier question asking for the I-94 # was N/A'd too. I wonder if our adjudicator will also think I'm over there :P
