This is an AOS issue, you should post in the appropriate section and read AOS guide.


It means that both of your S/O will have to get thru a 2nd medical exam for AOS, that's where you go with the waiver and what was required (the record of a 2nd shot that was needed for example) by the first doctor. For you Silverfox, they won't be anything to do except showing the waiver as she'll still have her allergy in 6 months. ^^

It just means the doctor stated one of the vaccines wasn't appropriate for you fiancée because of a medical condition (the allergy).
That's why they send you to a doctor and not to a nurse who could just check your medical records and give you the missing vaccines.

Ok, I had a usefull link about that, but of course I can't find it anymore.

It won't delay your application but make sure she keeps all paperworks and test results and brings them to the US with her, she'll have to show them at AOS medical exam.

Have a big breath, it's overwhelming at first. But if you take everything step by step, it's really not that hard.
You don't need a lawyer for that process, unless your case is "complicated". If both of you have no criminal records, and deal with USCIS for the first time, you should be just fine.

No, you absolutly can get married in the USA on a VWP visa. The only thing is he'll have to return once his visa is over, this is it.
That's what I'd do if I was you. And just juggle with tourist Visa until you move to France.
I really see no point on going thru the K1 visa and AOS process just to live in the US for 6 months...
You know K1 is just the first part, AOS (with Work Permit and Advance Parole) fee is 1.010$, right?

Once you're married you go visit the french Ambassy and ask for a residency visa for you.
You need to go with the residency visa in France, because a student visa won't entitle you to go thru a DCF process later.
Anyway I'm pretty sure it would be less hassle than getting a student visa.

Once you have the "Carte de Séjour", you can apply to the University you want et voilà !

I'm not sure I understand the second question very well.

You're worried that if you got married in the US that will impact your visa here in France because you actually didn't get married in France?
You know, you could just get married in the USA, without K1, and that would entitle you to a residency card in France. Then later you could fill a DCF if you wish to go back to live in the US.

So if I understand it all, you're filling for a K1 to be together like 6 months next year and then go to live in France? I don't know but this looks like a waste of energy and money to me.
This is no judgement from me, but I'm not sure you're taking the easiest way there.

It'll take at least 3 months before your fiancé will be able to work, then he'll have to find a job for 3 months then go back to France...?

He could also just apply for a 6 months visitor visa, you're getting married in the US, you move together to France later, and the day you want to go to live in France you just apply for a DCF. Way cheaper and way easier.

The average age for the first pregnancy is actually 30 in France and I think it's like 35 in South Corea!

And the actual definition of women of childbearing age is 15 to 49.

It's much better to have a baby in good conditions, rather than a baby in a hurry with no family stability.
It would just be selfish then.

No matter what the OP isn't even 30 yet! She has a several years to plan this and do things right.

Detailed invoice weeding venue is confusing me, you already booked a place for the wedding? You are not "supposed" to make plans until you have the visa in hands.
This is not something you want to show to USCIS. Everybody is free to take that risk, but I wouldn't advise to do such a thing, especially at an early stage like yours.

You have some reading to do...

If you want to be able to move during this next summer, you've got to start the process NOW.
Average delay for K1 is about 6-8 months. It can be shorter, it can be longer.

"Does not require you to renounce to the other citizenship" doesn't mean "recognize dual citizenship". Gary is right.
American government allows dual citizenship, but they'll only consider you as an american citizen, the rest they basically don't care.

I'm not sure but I think that Punjabi marriage require the spouses to not have seen each other before the wedding.

In my opinion, your only option is to get married in India and then file for CR-1 at this point.
I think the main problem here is the conflict between the fact that american consulates don't like relationships which involve introduction from the family and the fact that this is the base of a traditionnal arranged indian marriage...
Which means even though you get married in India, and then file for CR-1, you'll still have a very hard case there. :(

On the bright side, I wouldn't call this a real denial.
It was denied because the petition was not complete, money and time aside, it is not a big deal.
Some people get denied, face deportation, get banned and have no chance to live together in the USA anymore.
Well you are not there.

Rethink and redo a petition, see what is best for you according to the guides and help you will be able to find here.
And everything will be fine at the end!

My family does not speak my fiancé's language (and he doesn't speak English), nor have they met him since I met him while studying abroad. They are not necessarily "unsupportive," but not very enthusiastic either. And HIS family likes me, but do not want me taking their son to a big, scary country, so are quite skeptical about this whole thing. Needless to say, I don't think we are going to get any written affidavits of support from either side to show at the interview. sad.png  I know these are not "required," and Costa Rica is not one of the high fraud embassies, but I am still worried about getting questioned about what our families think about it and that becoming a red flag even though the rest of our information and "proof" is good. We have been in a relationship for over a year now and I have been to see him once (for 6 weeks) since we first met. We talk mainly using google voice since internet really is not an option for us. I am just worrying about every little thing that could possibly go wrong right now. We really truly love each other and have gone through a lot together and it would really stink if we got denied because our families were not too pleased about us getting married. Is anyone going through something similar, or can speak to this subject at all from experience? Thanks!

I wouldn't worry about that, affidavits are not mandatory. And If during the process they asked for affidavit, just say the truth "our parents are not supportive", this won't be news for the CO, I'm pretty sure.

On the personal part, I think our parents are rarely supportive about this process.
Buuuut... It will get better! 
My mother gave me hell about this. I mean real hell, I had to stop to talk to her for a couple of weeks because I was not able to manage the stress of the process and my mother altogether.

Since my husband didn't speak french, he made a drawing with a couple of simple words in English, this has actually won her heart.
Now, three years after, she says we were meant to be together, blabla! smile.png

Firstly that agent was very lazy and didn't ask me the usual annoying questions!

(I did a big silence here, waiting for the ''When do you plan to marry him?" question or something similar but absolutly nothing came...)

- Noooooe, we're not there yet, but in the future, once we submitted it, will I still be able to come visit?

Haven't sent ours yet! Might be a few weeks. Trying to be as meticulous as possible in what we're sending because we really have no idea what they want, and trying to think of something else that we might be able to include. Ever since you mentioned they only asked you for those 2 categories of things (and we got asked for 3), we're really stumped as to what the problem is, or what they didn't think was enough proof, so we're trying to cover every base. I figure if anything, that's what we sent the most of in the first place, so I just can't understand why they're asking for more.

I've started with a letter explaining what all is being sent-- going item by item on their list, and responding line by line with "we already sent this, but they are included again in case they were lost" or "we already sent 3 years, here's 1 more" and so forth. I hope they don't think I'm being a smartass about it, but I mean, they asked us for nearly everything we already sent, so...

As of now, the only new stuff we've got is:
-The new apartment rental agreement
-Renters Insurance evidence of insurance that is addressed to us both (paperless, though, so it's just a printout of a fax)
-Print-out of our account info for internet/cable that shows me as an account "partner" and shows Adman logged in. We always just used the same login before... *shrug*
-print-out of account info for cell phone showing account managers (this includes me (bill in my name), Adman, and also my mother (family plan), so I'm hoping it doesn't confuse them)
-2012 tax transcript - Not sure if I need to include w2s-- they had it listed on the RFE but I thought transcripts meant you didn't have to send w2s?
-Utility Bills in his name + cell phone bill in my name-- both show same address, but neither have both of us on the mailing address
-Itinerary of a flight we have booked together in May to visit his family back in the UK. Gonna highlight the price of the tickets coming out of our joint bank account in hopes that means something to them...

The old/updated stuff we're resending/updating is:
-ALL our bank statements from back to 2007 when we got married (only sent quarterly before)-- We plan on putting sticky note flags on anything that was a bill paid on the shared account-- again, no idea if this is overkill, but...
-print-out of new car insurance with just Adman and I as "Drivers" at the new address (previously sent one in my mother's name as we were on her policy at her house, now in my name since we moved, I am listed as the primary insured, Adman listed as "Driver - spouse")
-2009-2011 tax transcripts-- sent 2008-2011 last time. For some reason when we called for transcripts it wouldn't let us access 2008 this time, so I'm hoping that isn't an issue. We didn't file in 2007 because neither of us worked, if memory serves...
-Re-print of health/dental/rx/vision insurance card showing both of us + a recent invoice showing him and I as patient/responsible party + a letter from his workplace confirming shared insurance + life insurance with each other as beneficiary (they had all this before minus the invoice...).
-And I'm considering sending copies of the USPS confirmations of change of address for us both, just in case they're still not sold on the "we still live together" thing.

It just feels like it's all "meh" proof. If they want more confirmation from when we first got married, I don't know what to tell them-- we sent all we had, so I guess they'll have to call us for an interview if that's the case (I presume they go to interview stage, and not just rejecting us?!). If they want more recent stuff, well, hopefully this is enough, because it's all we've got as far as I can tell. I wish they'd just come out and say what they want in the RFE. Argh.


You know what, my file was very meh too.
I sent a lot less than that, but we have never moved.
I thought my "key" proof was the copy of the renewal of our lease where our owner added a friendly written note with both of our first name.

I think it's all down to :
-The new apartment rental agreement

I'm pretty sure this is the key.
A joint lease will show you have moved together and this it.
Well in your case, it's the only thing that makes sense.

I'm 200% sure everything will be fine if you send what you have put on this list.

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsWhen (not if!) DOMA falls at the end of June...

Hi all.  I am a US citizen, legally married to my same-gender spouse, who is Australian.  In 25 days or less, we'll know whether DOMA will be ruled unconstitutional.  I know that I already have my I-130 petition filled out, as well as the G325As!  I know a lot of same-sex couples who are NOT already married will be going the K-1 process, but I thought there might be others like me and my partner who will be IR-1/CR-1 petitioners.

 

I would assume that our bonafides will be exactly the same as an opposite-gender couple, but if anyone has any hints as to "the best" bonafides, I'd appreciate a discussion here.

 

While my partner and I have a lot of experience with immigration forms and interviews (I am now a permanent resident of Australia), we have decided to use an immigration attorney - given that the examiners will be seeing same-gender couples for the first time.  I'm going to assume that we might be scrutinized more intensely than straight couples!

 

If there are other same-sex couples getting ready, I'd love to compare notes/stories/successes!

Maybe I'm too optimistic but... 
For how long have you been married...?
A straight couple with the same circumstances as you would get a very low level of scrutiny at a consulate like Australia, or even no scrutiny at all. 
I can't find any reason why you would get any if you have been married for a couple of years or more and have tons of proofs of a common life.

The only thing that I can think of is that the CO would be personally against same sex marriage and therefore would let his personal feelings affect his decision.
Like some mayors are refusing to marry same sex couples in France right now. But I'm afraid this a very french attitude only... :x
But American people are way more obedient, so if DOMA pass, I'm pretty sure it'll be painless for you. (Ahahaha, I am so going to get bashed for that)
So maybe having an attorney around at the consulate stage would be helpful, or more like comforting.

Other than that, if you know how to file a form and know how to read the guides (and it seems you know them by heard already), I don't think you will need one.
Before the consulate stage, what immigration lawyers do is just to fill form for you, nothing more. 

Plus, dammit, you're not guilty of anything, are you? So there! 

I can't wait to go back to France to celebrate a couple of weddings. Many of my friends have been together for so long...
Luckily they had a way in France to stay together with the civil union contract we have.

My 2 cents here... as I work in the computer industry.
The laptops you'll find in Philipines are the just the same as the ones in the US. They're all manufactured in the same place hmmm China. ^^
You'll find the exact same brand and models.

Plus the warranty is usually only valid in the country where you purchased it. So if there's any problem, your loss...
A very few manufacturers offer international warranty.

It's also VERY risky to ship a laptop by mail, laptops have a high tendency to disappear during the shipment. If you do so make sure you purchase the extra warranty based on the value, so you get a refund if it gets "lost".

To put it into a nutshell, buy one there.

You don't have to end this relationship because the K1 visa got denied.
As you said, I think you have to set priorities differently.
If this is litterally killing you right now, then put this away for the moment.
Take care of yourself first, always.
Then you'll take care of this later.

I'm very sorry but from what you're saying, I'm not sure you're in a good shape to share a life with someone who obviously need a lot of support once she'll step in the US.

Again, it's not because K1 failed you have to end the relationship, I would just put it on hold for now. And you'll see what happen in the future.
If things get fixed, you'll be able to file for a CR1 or another K1.

If you're not sure right now, just postpone this. Give yourself a break, I sincerly think you need it.

I don't pretend I know what's right or wrong for you, I just wish you to have all the courage you need to make the right decision for you.

Portugal is considered right now as the "backdoor" of Europe and is getting blamed by the European Council for this matter.

Even if you manage to get through this, and if they leave you alone, it doesn't mean you'll have a life. You won't be able to work... and again it will take you years before you can have a real status in that country.

I don't think this is off topic. An example of what it's like in another country is always good.

Seriously, the difference between our two countries immigration process was one of the main reasons why I would move to the US, rather he'd move to France. So could I allow myself to complain about it? I don't think so... Anyway I'm not a USC.

But don't get me wrong, I understand the whole purpose of this thread.
I honestly think they're already aware of it and probably working on it too.
If you guys feel like taking actions, why not. Why not using that elegant letter I've readen in a previous post and send a copy to USCIS, your congressman and the president. If you are 500 to do so, for sure it will have some kind of an impact.

Now come ask me again in 6 months, and if my case is still pending, there are many chances I'll be way more aggressive on the topic. smile.gif

This is the process that is set in place. You have 2 choices here. Follow the process as is laid out by the USCIS/DOS or move to your fiance/spouse's country. I guess you will call me heartless because I have my husband here now. But the truth is that my spirit is broken because of this system. Post back here after you have fought the same battle that we have. Let's see if you have the same high hopes that you can make a difference.


That's the typical "journey" if you want to bring your foreign spouse to France.
Actually 2 years and only 2 applications would even be lucky. Your visa request is usually denied 2 or 3 times before it -may- be approved. It's very common that one single visa process lasts more than 2 years.
Whoever takes care of your file has the entire right to deny your case without any reason. They usually say "secret government reason". You can't appeal. You can only try again, and spend the fee again, and I think there's even a delay before you can!
And after you get approved, you'll have to deal with the immigration services more than 10 years before you get a permanent residency card... Residency card that you'll have to renew after one year at first, then 3 years then 5, and so on. It's a neverending story.
Emmigration process in France are nothing like in the US, no nice site with online updates. You have to go to their office for real and do hours and hours of queues...
There's no clear rules, any agent can ask you any document any time and ask you to come back.
It's so broken and so slow that many times, people can get a one year visa that will expire in two weeks. (I've seen it through my own eyes)
And for sure, no nice brochure "Welcome to France"...

Whoever said that immigration procedures are much easier in Europe is very wrong...
Most of Europe is totally closed to any kind of immigration. France is "fighting" against family immigration because it represents 80% of our immigration right now...!

Unfortunatly, I know what you've been through. And I really know how it can break your spirit as you said.
I did fight against my own system for 3 years, and I finally gave up. It broke our couple. During those 3 years, I never had any justification, no explanation, just denial of everything we could try.
I actually never thought I could do this again... but when I see USCIS rules and process, it conforts me. It's nothing like what I've seen in my own country.

Of course, it has little failures like any system, but for the most cases, everything just go fine.

The entire world is into a "closing walls" process, I highly doubt this is going to get better anytime soon.
For now, I just feel VERY lucky I can hope to be with my american monkey within a year.
