They don't say it's ridiculous Victoria. It's just a big risk to take. At each step, USCIS, NVC or at the ambassy, you can be put into Additionnal Processing, each AP can last up to 6 months.
It seems to be very common to be put into AP at NVC.

The risk is that you could get very disappointed by the additionnal process time and on the top of that, you'd have to deal with the whole wedding cancellation and the money loss.
That would be hell, and some VJ members are actually dealing with that. They took that risk, their choice, but they shouldn't whine about it because that warning is stated a few times along the process.

My monkey and I have no real family. The wedding ceremony isn't important for us. So no date here.
I wish we could get at least a little romantic wedding though, but the travels and the visa fees have sucked us completly dry.
I'll feel lucky if we can pay the AOS fee without worrying. So it will be a court wedding. Anyway here in France, you have no other choice but to marry at the city hall so...
It will look "normal" to me. smile.gif

It seems that USCIS had to clean all their backlog for H1B visa around June which would explain the lack of activity at that time.
The same must have happened this year.

My bet is the first of us to get their NO2 should get it at the end of October.


Hmm. What are you plans? Once you get the visa, will you have to wait to organize the trip (leave job, appartment, and so on), or will you take the first plane ticket available? smile.gif

It's more than possible.
There have been reports that say there's way less petitions this year (probably due to recession) and it's quite obvious when you look at Igor's list.

But it also means that some USCIS agents will get laid off.

If I remember correctly July 07 filers got their approval in October.

We haven't got NOA1 and application receipt number after more than 1 month that the I-129F was filed. Anyone of you faced this situation ? What we should do now ?



Your fiancé had to provide a check (455$) for the I-129F fee.
Do you know if this check was cashed?

Most of us didn't use an attorney...
So...
1. Find out if the check was cashed.
2. Ask the attorney to provide the proof of delivery. If he can't provide the proof, fire him and ask for a refund.

This situation isn't normal. You should get the NOA1 about one week after USCIS received your application.

Yep, the visa is valid 6 months, then we have 90 days to get married.

I've been thinking a lot about that lately.

Considering that I have to give a 2 month notice in order to quit my job, and a 3 month one to leave my appartment...
I'd hate it if I'd have to wait for 3 months once I have my visa...
And it's still a big risk to give your notice before you get the visa in hand.
Thinking about those things gives me headache :x

I have to admit something, of course I'm very impatient to start my life with my monkey (I don't call him monkey, that's how he calls himself!), but I also feel very excited about starting a new life in a new country.
A new job, new friends, new home, new everything! I can't wait to make new discoveries!
My monkey feels more concerned about it, he worries I get homesick, Delaware is not Paris, you'll get bored here, blablabla...

I don't think how we met really matters. Translation : no real romantic meeting here.
I met my fiancé about 3 years ago and our first two years were something like rollercoster.
"Oh noe, our story is impossible!"

Once we decided to get engaged and file for the K1 visa, we both felt secured and our relationship changed a lot.
I cherish this time a lot more than what happened before.

I tried to get prepared for the "questioning people", but oddly nobody in our friend circle ever did...

I haven't told my mother yet. :x
That will be a big time, I plan on telling her after she got a chance to meet him not before.
I don't want her imagination to torture her (and me) for months, it's useless.

Victoria, I'm afraid we'll spend much more than 5 or 6 months together.
We'll probably be "connected" for the next 2 years. smile.gif

Ah Christmas... There's a good chance that Thanksgiving and Christmas holidays slow down our process.
I was aiming for that date too, but then I realized that it would probably be better if I spend this "last french Christmas" here with my family before leaving.

"Hey Mom, merry christmas, ho but by the way, I'm moving three days before it happens!" I don't know, it doesn't sound right to me.
Plus I spent Xmas in the US last year already.

Hello October filers,

What I plan on doing about Skype (because I have the same issue, it's pretty much our only communication way) is to take screenshots of the calls logs, if you go in the display tab then history, you have all the logs of all your calls, date, hours, how long...
Copy pasting into Word is no proof as it can be modified very easily. I strongly believe screenshots are the only way to go.
Same for emails, the screenshots should show the interface which somewhat proves where the file comes from.

During the summer of 2009, many couples were approved in less than a month in VSC.
As someone mentionned it, it works like waves.

I bet you ten bucks that starting next month it will go much much faster.
It happens each year... Starting July they usually focus on K1 visa, they catch up CSC and it will get slow again starting october.

We sent our petition in July and at that time, we were expecting a 5-6 months delay...And we got approved in 3 months.
2009 August filers were the champions, most of them were approved in less than a month.

Don't panic. Often package/mail get lost and then found back.
Could you give a timeline? ie when did you send it, when was the tracking available the last time...


For now, I would wait until monday to see if the tracking changes by then, it's often just a scanning issue.

Good morning my peeps!!! I need help because I'm losing my mind.. After my fiancé got here from Haiti .. It's been three weeks now.. He got a call from Haiti that his dad became ill.. Since then he's been miserable... I didn't want to be the ungrateful fiancé knowing how much he loves his dad.. we decided he has to be there for his dad...he has his social security already but we didn't got married.. Over the weekend he decided he wants to go back to Haiti . So this morning he left... What is going to happen? What do I need to do? Help me please? Is he able to come back here at all ? Any suggestions will help


I remember clearly someone in the french section who succeeded to get his visa re-issued for very similar reasons.
He should just contact his embassy explaining the hardship. 
I would suggest him to gather a couple of proofs, like hospital bills if they request any.
I'm sure it will be fine.

Yes, Schengen visa is a pain. As is it's for all Europe, they send a request to all european countries, if any of them say no, or doesn't answer in the delay, poof, denial.
For someone from MENA, let's say it, the probability of denial is very high.

The visa itself may be free, but the invitation letter is actually a form that requires a little fee. Your familly would have to go get it at fill it at their city hall. They also would have to justify enough incomes to welcome you and enough space in the house... It's a very intrusive process.

I tried 3 times for a pakistani friend, and it always got denied...

So yes, that's the kind of visit you want to do once your SO has the american passport. :)
Unless you can get that 24h visa at the airport.

I'm really going to try to contribute to this community, I have found a lot of great information here. I'm a writer and a scientist; paperwork and follow-up is what I live for daily. This place is a gold mine!

Our plan as of now is to do what was suggested -- I'm going to move our stuff down first and get us set up. From there, she's going to come on in for a visit, then subsequent visits. I travel a lot for work all over the freaking globe, so when I have to do an extended China trip (a month or two weeks) or something, she'll go hang out at home. We're going to figure this out; but believe me, this was a shock. A real serious "holy #######, what are we going to do" kind of shock. I plan, I figure, I do these things. This one was in a list of things we needed to get to, and the task before us is way larger than either of us initially had gotten perspective on seeing. I was working 75+ hour weeks and managing two product lines, this got moved into the "we'll get to it" category, which obviously was a miscalculation.

Flamers, I know your individual cases are important. Ours is too, especially to my wife and I. I never said that your cases were unimportant, that was put in my mouth. Thanks for all of the help here though, it is invaluable.


Let's be honest, at some point we are all get through that phase, "Oh my!!! What are we going to do?! It's the end of the wooooorld! We will never be able to do this! We can't do this and that!"
You really really need to take a step back, because I'm afraid you can't see clearly right now. But I think you're on already on the good path.

Here's a couple of random suggestions:
- Do not hire a lawyer, you do not need one. Your case is very normal and typical. Hiring a lawyer will only slow you down and make your wallet to shrink. This is the most important thing of your life, you want to be able to control it yourself, OK? (You seem this type of guy.)
- Have a glimpse on the overall picture and process, but take one step at a time. The whole thing is too overwhelming at first. If you take it step by step, you will find solutions.
- Do not jeopardize your love and life doing stupid risky things. Do it the right way. There are many stories here about some couples who had a very straight forward case but totally screwed it up because they thought they couldn't be apart for a couple of months.

I think these 3 things are the key.
It's not going to be fun, for sure, but you, like us, can make it.

You came thinking your case was "unique", of course it's unique for you, but you came to the right place, as we are or were as the exact same situation as you are right now.
I don't think those flamers have bad intentions, they want you to have a little more perspective. Of course, being crossed star lovers with someone who's really on the other side of the planet is much harder. Some people endure years of separation...
Again, it means you can certainly manage this situation, without tears.

We can only help you with the legal aspect of the immigration process but I think you need to figure out of couple of personal things first.

Hello...

I've been reading this forum for like a year waiting for my man to finally propose.
And he did. I'm going back to the US as a visitor in 3 weeks, we'll start to fill the forms then.
So for now we're gathering all documents.

Let's be honest, my american fiancé is a monkey when it comes to paperwork or organisation.
So we need his birth certificate (the long form, yeah i've been reading the guides over and over again).
And tadaaaa, he doesn't know in which county he was born!
So at least, he knows he was born in St. Louis Missouri, but there are two countys, St. Louis and St Louis City.
He's got no clue which one it is... He lost his parents so he has no one to ask.
He's got a passport though, of course; but this is it. He doesn't know which hospital neither...

Anyone's got an idea where should we ask to get this information?

I thought that maybe we could make the resquest to Saint Louis, and if it's not there I guess they check Saint Louis City but well...
Or would it be written St. Louis City on his passport if that's were he was born?

About G-325 form, my last big move in my life was in june 2004, new job and new residency.
The months before that were just a mess of unemployment and temporary residencies.

Do you think it's ok I start my history of the last 5 years at that date ?

Since June 2004, I've been living in the same place and been employed by the same company.
Which makes it much easier of course.

Plenty of people use middle names that aren't officially their names. My father is one of them, he uses a confirmation name as his middle name. I would think that your fiance wouldn't be the first case of that that USCIS has ever seen.

That being said, you are required to give the full legal name of your fiance, so I would work on figuring out what that is.

We'll use the middle name that is stated on his BC, which is also stated on his Social Security Card. And I listed the other middle name he is using in the "Other used names" box.
I felt more confident about which name to use when I found his SS card.

Argl... I'm about to get hysterical.
I just checked his passport again, and actually it doesn't state any middle name at all...

Problem is most of his other documents such as taxes, salary bills... will show that other middle name.

Now I'm thinking about using the middle name that's stated on his BC and put the other middle name in the "Other names used" box on I-129 form...
I'm not sure what that box is for.

Help...

Pff...
The more I think about this problem the more I get confused...

My future husband's parents were chinese and born in China.
I'm really scared that if we just use the passport copy they'll make an RFE asking for the BC.

So we have two options, either we use the middle name that's stated on his BC but well any other documents will show his other middle name...
Or we use his other middle name wich is stated on his passport hoping they wont ask for RFE...

Of course, the best option would be to have a legal name change record...
We dont even know where to ask such a record...
It seems to be a court record though.

I guess the best to do is to use passport, hoping they wont ask for the BC, and during this time look for the name change record.


Anyone has some suggestions...?

So we got my fiance birth certificate. Which made him to remember that his mother changed his middle name...
We have no clue if she legally changed it or not...
No matter what his "last middle name" appears on his passport.

We have no legal document reguarding this change...

So my guess is we shouldn't send a copy of his BC but the full copy of his passport.
Correct?

I'm not sure how a middle name change really matters though...


Now I have a qestion about the letters of intend.
Should it be fully handwritten or just the signature?
