I'm really confused. I got the checklist letter asking for the IV packet but it also said this about my AOS packet:

F - FINANCIAL EVIDENCE:______________________________________
The NVC has received the information you have submitted in reference to
the Affidavit of Support. Please be advised that the Affidavit of Support
information you have provided does not appear to meet the minimum
income requirement according to the current poverty guidelines to sponsor
the intending immigrant(s) for this petition. The consular officer will make
a decision regarding this requirement at the time of your interview. In
order to avoid delays, you may wish to submit an additional Affidavit of
Support (Form I-864) for a/another Joint Sponsor to the National Visa
Center to assist in sponsoring the intending immigrants. To view the

If you decide to use a Joint Sponsor to assist in sponsoring the intending

I'm confused because I did have a joint sponsor and he makes over 50K a year. I'm not really sure what to do. I guess I'll just bring a copy of the AOS packet to the interview since it said the CO will make the final decision. This process is killing me :bonk:

Agreed on all points. It ought to be nearly infinitely easier for you, and likely will be. However, that said nothing is assured until after the POE. After all, the terrible thing none of us want to think about is that even the Visa is NOT permission to enter the US. It is merely permission to come here and ask permission to enter. Even though refusal at POE is practically unheard of for a visa holder, it isn't impossible.

I know I won't totally relax until we're sitting in our house here in the States. At any point between then and now something could go wrong, even for those for which it ought to be and probably will be a cake walk.

Hey! Silly but quick question - I tried to call last night from home to see if my case has been received yet, but the NVC system doesn't like my Blackberry when trying to enter my USCIS number. None of the numbers pick up correctly by their system. I'm so impatient I just hung up after 3 tries. :whistle: Question is - is there a way to just speak to an operator? :bonk: :help:


Press 1, then 5 to get to an operator. You should be doing this anyway because the AVR is usually a couple of days behind.

Take your time and review your IV package, don't get excited. I was about to forget my marriage certificate when I sent it Tuesday night :wacko: . Congrats.


Yikes that would have been bad! I actually sent the IV package at the same time as the AOS package, they just haven't entered it into the system yet. I reviewed it many times before I mailed it as mail takes about a month to get from here to the US; I really don't want to have to resend anything.

Call today! My mom has been calling the AVR every other day for me because I live overseas and it's expensive to call the US. The message said that the checklist was issued yesterday (03/07) so that's when I called an operator to see what was up. It wouldn't hurt to call today.

I was looking back at my previous emails and such and it looks like it took NVC a week to go from "emailed in I-864EZ" to "Reviewed and found issues".... I'm hoping it doesn't take another week for them to review my corrected one. Any idea how long it normally takes to recover from such a situation?


A week to review your file?? Maybe I won't get a CC this week :angry:

I was looking at Saylin's spreadsheet earlier and at the beginning of February they were closing cases in just a couple of days. So maybe they'll speed up again soon!

Nope. Instruction packet is the package you receive from NVC about the IV package (DS-230 and such).

The interview letter is Packet 4 on the timeline.


I was confused by that too. There's also no place on the timeline for "return instruction packet". Or I'm just not seeing it.

The form does not expire, what expired was the comment period to OMB. If anyone were to submit the form that is currently on the website, they would have no issues doing so.


Oh yeah, I do remember having read that before. It was the Previous Editions Obsolete part at the bottom of the form that had me a little worried that maybe this one would be obsolete too. Thanks for the clarification :thumbs:

You realize they must have a huge number of cases pending, and they probably receive thousands of emails a day, right? It hasn't even been 2 business days yet, you should better take a deep breath and relax cause it might take a few more days!


And they've been open for less than 2 hours today, it is still early on the east coast. I am really anxious too but we gotta give NVC a break at some point.

When the AOS and I864 bill is generated and sent for payment - does it matter if I pay it, or can my other half? Just wondering if it is like USCIS stage where is has to be paid by the petitioner.


You can pay it. USCIS fee has to be paid by the petitioner?? My dad paid for mine because I (petitioner) do not have a US bank account. I don't think they care as long as they get the money.

Now some info I wanted to share with everyone: in our March interviews thread, someone who had their interview yesterday in Manila was asked for their 2011 tax return + W2. It's actually the only thing the CO asked for! They had everything and got approved. Be prepared to bring your 2011 tax forms (you might not have the transcript yet) EVEN if your interview is BEFORE April 17th!!


That's really good to know. Are copies of the tax return + W2 acceptable?

I just checked and DOS still hasn't updated the DS-230 that expired 2/29/2012 :bonk:. Which is good for me since I mailed my package after that but WOW.

I'm not sure if this is true or not, or even applies to this situation, but I remember reading a long time ago, that consulates/embassies put aside certain weeks/months for certain visas. So, for example, K1s get the first two weeks of each month while IR-1/CR-1s get the last two weeks, or K1s get every even month for interviews while IR-1/CR-1s get every odd month for interviews. JUST AN EXAMPLE THOUGH. Just something to think about.


In Paraguay, they only schedule IR-1/CR-1 interviews for the first week of each month, I guess since there are so few. So I'm really hoping for a case closed soon; I don't want to wait til May for an interview!

No, it's the person filling out the form (joint sponsor) that puts their own name.


Actually #13 is referring to the sponsor (petitioner) and #15 to the household member contributing more income (her father, I believe). Both the sponsor and the household member have to sign the I-864A, it's different from having a joint sponsor, who would sign their own I-864.

Total cost of the forms, as mentioned above is $420 (I-130), $88 (I-864) and $404 (DS-230) = $912. Everything else totally depends on the country of the beneficiary. My husband's civil documents and translations only cost around $30 total. I'm not sure how much medical will cost as we haven't gotten to that point yet.

Okay, yesterday was my NOA2.

Today I couldn't call NVC because they're having a power outage.

My next step is to get DS-3032 email format sent from my wife's (The alien relative) email address.

Problem is, my wife doesn't have internet and isn't in a town that has internet.

Can I just send the DS-3032 for an e-mail account made on her behalf, as if she created it?


My husband (the beneficiary) didn't have an e-mail address either so I created one for him and sent the DS-3032 from there. (I figure that maybe he can use it when he gets to the US.) When you get your case number make sure you tell the operator your e-mail address and your wife's e-mail address.

If you make no income then your father will have to fill out a separate I-864. An I-864a is for combining income with someone in your household but in this case there is no income to combine.

But back to your original question: yes, you will be the sponsor and your father can be a joint sponsor.

If you began your current job in 10/2007 you should write 10-2007 -- Present. Do not leave any parts of the form blank.

This was just my own experience: my joint sponsor was my dad, who files taxes jointly with my mom. He sent in W2 and 1044s from 2010 and our AOS package was accepted without problems. My mom did not fill out a I-864a. As long as the tax transcripts show the joint sponsor's income separately you should be fine.

Okay, after reading pushbrk's response and the instructions for the I-864, I'm a little confused. I have the same permanent address as my parents. I have had income and filed taxes in 2010, 2009 and 2008 but they were all below the poverty line so I was going to combine my income with that of my parents. I thought that they needed to file the I-864a. Is that correct or should my dad file his own I-864 and my mom an I-864a since she lives with him?

Hi I am almost ready to file, but I have an important question regarding the cover sheet

My address is supposed to be entered right under my name, but what address do I write? The address I currently reside at abroad or my address in the US (which is my official address for tax purposes, as well as a big part of the proof I have that I will be returning to the states (we do plan to live there when we arrive) However my current address in Vietnam is (obviously) the one on the lease I am going to include for evidence of a bona fide marriage, but that is NOT listed as my address for any purposes in the US.

So which one do I use and will either cause any trouble?


Use your current address abroad. You don't have to worry about re-establishing domicile in the US until later on in the process. Recently petitions filed while the petitioner is abroad have been getting expedited so that's why I suggest putting your overseas address. How is that? US country code is 001, not 0021. No matter which country you call from, so long as you're dialing a number in the US, the country code remains 001.


That is what I thought too but the first time I tried to call them from here I dialed 001 and it didn't work. I asked the woman working at the phone company how to call the US and she said dial 0021 and it's worked every time. It's weird.

I am asking this question just in preparation for the upcoming events.

Supposedly, my wife's income is below the poverty guidelines and we need a co-sponsor. In that case my mother in law is willing to be the co-sponsor.
However, she files her taxes as "married filing jointly" with her husband.
I understand my mother in law will have to complete and sign an I-864, provide her tax returns / transcripts, birth certificate and other income related documents but since she she files as "married filing jointly", will we also need approval or I-864 filled and signed by her husband as well?
Note: She receives her own benefits and is not dependent on her husband's income. There are only two people living in that household (my mother in law and her husband). My wife lives separately. So the co-sponsor will be from a different household.

As always, your advice will be much appreciated.


If your MIL makes enough for a household of 3 (her, her husband, and the immigrant) then her husband does not need to fill out a separate form. She just needs to send in proof of her individual income (W2, tax transcripts if they show her income separately, etc).

This is from the I-864, Affidavit of Support instructions: "If you were not required to file a Federal income tax return under U.S. tax law because your income was too low, attach a written explanation." Your husband will still have to fill out an I-864 and so will the joint sponsor. But it seems like explaining his situation will be enough for them. Good luck!

That is fine. I got our marriage certificate translated in Paraguay with a certification from the translator here and we had no problems.
