As said before, you will be ok getting married in Hawaii.

Getting married in a US territory however could cause you problems getting into the country. You probably want to avoid this since its a little gray as to whether or not you are actually in the country in a territory.

Getting married in a non-us territory is fine as long as the marriage remains unofficial (With a civil wedding in the states). You can not enter the country married on a K-1 visa.

We are now in the proces of waiting for the interview date for our fiance visa. My question is my fiance is in UK and is from Pakistan. He was thinking if we recieve the visa, of going to Pakistan first to see his family before comeing to USA. Has anyone done this type of thing? I wanted to know if this would cause any problems for him once he enters the Port of Entry.


As far as I know it doesn't really matter from where you came, just that you don't leave after you enter. So he could go to Pakistan, and then come to the US from Pakistan. He should have no problems with that.

If the consulate decides that what you have is not enough, you may need someone to co-sponsor. What proof you need depends somewhat on each consulate, I would ask them.

My fiance and I started this process a few years ago, broke up, he married someone else, is now in process of getting that marriage annulled and we want to marry. I'm assuming his annullment has to be complete before we can even file for K-1? And, does he have to check that he is divorced and include proof of annullment? Also, where are the I-129f's going these days? It appears that for K-3 they're going to Missouri, but what about K-1?

You cant start it until the annulment is completed and you will have to include proof of the annulment as part of the application. K-1 goes to the service center covering your area, which is either Vermont, California, Nebraska or Texas. The form tell you which center to sent it to.

If you want to use the K1 process and get married in the UK, it has to be a non-legal marriage. Have a wedding, but don't take the steps to register it with the government. Instead either have another wedding in the US, or just a simple civil wedding.

If they are not citizens of a visa free country, they would have to apply for a visa to enter the US. If this doesn't work out, an alternative would be to have two weddings, one non-legally binding one in your fiances country and another in the US.

I've read posts about copying passport before. It's safer to copy all the pages, even the blank ones. It's for authenticity assurance

With this you are getting into a gray area, but in this case you would probably be considered self-employed and subject to the same rules as an employer, except you're the employer...

Also, how would you rectify receiving foreign source earned income in the UK after you have domiciled yourself in the US... According to the US/UK tax treaty, the UK is not eligible to tax you on the income, only the US is...


Thats a good question and I dont think there is a simple answer. I would talk to a tax accountant or lawyer that specialized in employment/taxes.

Generally when you work abroad as a USC, you dont pay taxes unless you make over $85,000 or so per year. But that generally means you are also living abroad. The income level before you get taxed his high because you may have to pay taxes in the country you are working in.

Its possible that you may need an EAD to do any work. Even freelance/contract work or telecommute to a company outside the US. Or that type of arrangement may be exempt for employers based outside of the US. I really dont know.

You will definetly be requried to prepare the affidavit of support. What you need to include with it, will depend on each embassay. It could be 1-3 years of tax returns, statements from bank or employer, or more than one of the required proof.

You will have some fees, medical exam fees are ussualy standardized with vaccinations being extra. There will also be a visa fee paid on the day of the interview.

Some voip providers offer discounts to call other customers because the call doesnt have to go over POTS and thus saves them money. Using certain Voip providers link lingo or SkypeIn, allows you to get a phone number in a forigen country (countries are limited however) making it a local call to receive a call from someone within the country.

Both will take about the same amount of time. So it ends up being a matter of preference. With K1 you cant get married until after you have received a visa and have come to the US. With K-3 you can get married and file after you are married, but you will likely be apart depending how much you can afford to travel/live in the others country while you wait. Its up to you and your fiancee and what you prefer. But be prepared for the long haul, it will likely take 6-12 months to get the visa.

Not quite, NOA1 is what you receive when the USCIS receives your petition. NOA2 is received once that petition is approved. But it can take 2 weeks to a month before the case arrives at the consulate (Sometimes more, case goes through the NVC). When it arrives at the consulate, they will send out whats known as Packet 3. The reason for preparing information when you receive NOA2 is that it can take time to get the documents together and then send them to your fiancee overseas. Waiting until packet 3 may not give you enough time. (Some consulates also issue a packet 4, but that varies by consulate). 1. Photocopies are fine. Thats what I included for boarding passes and everything else. But be prepared to send the orginals if they request it.

2. I wrote it as part of the packet of proof of how we met. Kind of as a cover letter to that proof.

3. Dont need to worry about that until the petition has been approved. Depending where you file, it could be a month or more before you need to do this. I think its pretty much up to the doctor to decide which shots you need.

Even with a lawyer, its important to understand the process for yourself (Its long and involves alot of paperwork and waiting). If you do choose a lawyer, make sure he or she is an immigration lawyer that has handled K-1 cases before. There is too much unknown to really give good advice in this situation. And likely some miscommunication as well as bias.

If this is a case where her partner is abusive, go to the police. Period.

If this is a case where she is regretting her descsion, either because she really doesnt like her partner or she is homesick, she should attempt to work it out. If that doesnt work, then its probably the legal obligation as the supporter of your cousin, of her fiancee to pay for a trip back. If he wont or cant, contacting the embassy of the given country or just getting deported would get her sent back, but at a cost to the tax payers who really shouldnt be responsible for this situation.

Due to the cost of travel there are many cases where people dont spend as much time together as they should or for whatever reason, rush things when they should take more time.

Thanks for the replies. I've never had any problem at the gate not even any extra questions and I've been to the US quite a few times. I've studied in the US back in '97, '98 which might help in letting them know I can follow the rules. As far as the ring goes, I just don't know if I should declare it or just have it on me (which i will anyway). I don't want to scare the POE officer by declaring this ring. On the other hand, I sure don't want to brake any law or jeopardize anything for a stupid mistake...Maybe I should form a club, something like the Worriers Anonymous, anyone is more than welcome to join up :)

Nah, you're not crazy, you're just being on-guard...well a bit over on-guard so that you worry about everything.
As long as you don't bring drugs or bombs I think they won't ask you weird things. And if they ask why do you bring the ring, I think you could just answer casually, " Yes, it's a ring.. would it cause me any problem ?". If they ask who do you want to visit, you could answer casually again, " My girlfriend, would it cause me any problem ?".
I think it's the best thing I could help you with my words. I'm never good in giving advice. Oh well. If you have a woory-too-much-club, count me in 'coz I'm like you too sometimes. It sux though.
