K-1 Fiance(e) Visa Process & ProceduresK-1 TOTAL COST

[font="Arial Black"]Just curious for those who have completed their journey here. What was your total cost breakdown for this petition all the way to your fiancee becoming a US citizen? We are now only at the interview stage of the game. Thanks in advance!!!!!

The answer to this question is complicated, because the citizenship is several years away yet for many people, even those that have gotten their 10 year Permanent Resident card. As you know there are proposed fee increases for all immigration benefits, so total cost may change in October of this year.....Perhaps in the new fiscal year for USCIS (begins Oct 1, 2007) the new fees will be announced for all petitions, and then you'll have a better idea of total cost.

-P

Fees will increase quite significatly, if the fee increases for the next fiscal year are approved. Fiscal year for the USCIS starts in October. Also total cost will vary a bit in each circumstance.

You will pay the inital filing fee for K-1 which is current $170 (proposed $455), plus probably a few trips to kinkos to get everything printed and copied (it ads up pretty quickly). In the interview/medical stage, you will have to pay around $100 for the medical (varies depending on what vaccinations are needed), and then another $100 for the visa. At this stage you may have some costs to have translations done.

After your fiancee arrives in the US and you are married, you can file for AOS. Currently, there are 4 fees depending if you choose to file for EAD and AP. If the new fees are put into place, the AP and EAD documents will be free of you have an AOS processing. The total fees with fingerprinting will be around $1000.

2 Years after AOS, you can apply for removal of conditions. The current fee for this is $205 the proposed fee is $465. Naturalization which is optional, is currently $330 with a proposed fee of $595.

Its likely if you start now, you will probably be paying the proposed fees for AOS and beyond. The proposed fees may vary from what will actually be implemented in the upcomming fee change.

K-1 Fiance(e) Visa Process & ProceduresHow Long
I takes 2-4 weeks for the case to be transfered to the consulate. If it takes longer than that, call the NVC.

After the case is received, an interview date will be scheduled. For the Philippines, it looks like the interview date will be 4-5 months after the case is received.

K-1 Fiance(e) Visa Process & Proceduresplease help..still married but filed K1
If it is considered a legal marriage and she is not considered legally able to marry, you will need to resolve this as soon as possible. Depending how long it takes, you may have to restart the K-1 process once its resolved. You need to find legal counsel in the Philippines that can resolve this matter for you. The help here, is mostly going to be limited to emotional support.

If your age gap was in the range of 15+ years, you might be put under closer scrutiny (Possible sign of fraud). But an age gap is no reason to deny an application. You have nothing to worry about.

K-1 Fiance(e) Visa Process & ProceduresPolyamory and K-1 visas

Im kind of surprised at all the support this woman is recieving. Im just wondering.... if this was a man instead of a woman proposing this bs, would the replies remain consistent? Many a time, guys have been flamed out because of breaking up with the fiancee, then making plans to meet 2 more. I fail to see how this is any different. But i guess if you slap a fancy word on it, like polyamory, then there is nothing wrong with it.

Honestly I dont know why i feel so strongly about this......

Probably due to your upbring and the construct of what a "normal" relationship should be. If you understand normal as just being a social construct part of our society, you will realize that all kinds of relationships are possible. You don't have to follow someones lifestyle choice, just accept that they are different. Agree to disagree.

The practice of polyandry is an interesting concept. I would find it unusual for most western males accepting that role but I would guess there is always an exception to the rule. This will be interesting to watch.

Its definitely not for everybody. You have to be willing to let go of jealousy and possessiveness. Not everyone can do that.

Just as a side note, adultery is illegal in some states, but the laws vary from state to state. Usually laws such as this are considered "blue laws" meaning that they are not enforced. However, in this situation I wouldn't be surprised if the gov't did want to enforce it. That being said, applying for the K-1 while you have a boyfriend other than your proposed husband is not committing adultery. Adultery is only commited when one is married and sleeping with another.

I would recommend just not mentioning your boyfriend at all to USCIS. They do not really need to know about that and I don't think it would lying for you to name your boyfriend your 'friend' or 'roommate' on any forms. He is your friend and your roommate. I'm sure others will say that that is lying, but in cases like this I think you'll be okay. Sure, maybe there are ways for them to determine whether he is your boyfriend of not, but why would they look something like that up if you don't give them reason to suspect it?

It is a tricky situation and I'm not sure a lawyer could really help you. I'm not recommending not to get a lawyer. But somehow I just think that telling the US gov't the truth about the situation is a sure way to get the visa denied.

Just my opinion though. Good luck on your journey!

I doubt that will be a problem, the federal government doesn't enforce state laws and states has no jurisdiction in immigration.

K-1 Fiance(e) Visa Process & ProceduresPolyamory and K-1 visas

Sorry for the long rambling post but it can be hard to explain my situation. Everyones replies have been very helpful so far. I was thinking about leaving my bf out of it and then I wondered how much they would want to know about my household situation i.e. who I live with, how I pay for my housing if I dont work, etc. And no, I have no intention of marrying my bf here in the states. I did not originally want to post this subject here as I knew some people would be offended by it but I have had no luck in more...alternative lifestyle communites. Someone had mentioned in a post from late 2006 about a poly couple that was on this site several years ago but the archives dont seem to go back that far. Once again thenk you for the help. Also, one last question, does anyone think that an attorney for this matter would be helpful due to my unique situation. I obviously want to be as honest as I can to the US Governement about myself but I do worry about proving a bona fide relationship.

An attorney might help, but if you choose to go that route, do your research. Some attorneys will take the case, but have little experience in family immigration issues, you may end up with bad advice or have problems/delays.

I don't think your US boyfriend has to be mentioned at all. In my opinion, if the USCIS or Consulate officials ask, he is just a roommate. Its none of their business as to what kind of relationship you have with him.
Dan JMaleIndonesia2007-03-26 03:59:00
K-1 Fiance(e) Visa Process & ProceduresPolyamory and K-1 visas
For the most part I think you should be fine. As long as you don't also plan to marry your boyfriend here as well. The US has laws against polygamy but not this.

I think you should leave your boyfriend out of this as much as possible, and have your parents co-sponsor. The USCIS doesn't need to know about your boyfriend, and to save yourself from questions of a bona fide relationship its best not to complicate it by mentioning him. Its not illegal, but there is a cultural bias against it. Don't make it anymore complicated than you need to.

K-1 Fiance(e) Visa Process & ProceduresGetting Married In Malaysia?
Yes, you have to get married in the US with the K-1 visa. If you are married when you enter the country on a K-1 visa, you will be turned back at the PoE. You still can have a ceremony for family in Malaysia if you do it after your legally married in the US, or make sure its non-legally binding.

K-1 Fiance(e) Visa Process & ProceduresQuestion 18
1. Just last meeting, and it has to have occured within two years prior to filling the petition.

2. Well most people write everything on a seperate page and include evidence of the meeting. It isnt enough to say that you have met, you also need to show it.

What i did was write a cover letter to a packet of evidence of our last meeting. The cover letter included the details and what was included as evidence. I paper cliped it to the copies of evidence that I had.

USCIS processing is pretty much the same no matter which country your fiancee is from. Vermont takes about a month, California takes about 3 months.

2-4 weeks for the case to get sent to the consulate.

http://www.visajourn...eline/stats.php According to that page, about 75 days to get an interview for the UK.

She doesn't need an SSN or TIN as part of the initial petition. When she is in the country she can apply for an SSN a week or two after she enters the US. SSN may be needed for marriage license in some states.

You can definetly use another address if your current home address may be changing. Work address if the workplace is ok with receiving mail for its employees, or you could also go to the post office and rent a PO box.

K-1 Fiance(e) Visa Process & ProceduresPOE SEATTLE

Hello. My fiancee and I will be landing at Seattle Airport as our POE, on April 22, 2007, from the Philippines on a K-1 Visa. I would like to hear from anyone who has used Seattle as POE on a K-1 Visa lately. Will we be able to go through immigration and customs together? Will she be able to get her EAD then and there? How long will the process take, (we only have 1 hour from landing to catching our next flight to denver)? Can you provide any other helpful information about Seattle POE?
Thanks

Only place that is currently issuing EAD stamp is JFK as far as I know anyway.

As far as getting through in an hour, it depends. If your flight is the only arriving international flight, 1 hour is probably enough time. If there are several flights arriving about the same time, it could take more than an hour to get processed. Depending how your got your tickets, you may simply be bumped to the next available flight. If you purchased the international/domestic tickets seperately, you probably won't. Talk to your travel agent/airline about that.

As far as going together, it depends on the PoE, there is ussualy an immigration officer directing people to the correct lines, ask them.

K-1 Fiance(e) Visa Process & ProceduresAnother question

That is a good question, you will definetly have to wait at least 2 months until your divorce is final to file. As far as the 6 month waiting period? I dont know. If you could marry outside of the state and that would be valid, then I dont see what the problem would be with filing during that period. But you might want to run that by an immigration lawyer first.

Where did you see this? Am I just issing something? I have never seen USCIS place this kind of requirement on filing?

His divorce will be final in 2 months, you have to be legally able to marry when you file. So he has to wait the 2 months until after his divorce is finalized.

K-1 Fiance(e) Visa Process & ProceduresI totally forgot my Name was changed when I was 6

I guess all you can do is wait and see. Can you get the supporting documentation to prove the legal name change while you wait just in case? Was all of your identification changed? Like your birth certificate etc?

Sorry... not much else to offer than a hearty good luck

A

Yes, the note of the changed name is jotted down on my birth certificate at the very same page. My dad made it legal, he went to court 4 times in 1986 for the name changing process. I know I-129F document doesn't require birth certificate of fiance/fiancee unless there is a name changing thing. But..oh well you're right, and Dan is right. To wait and see, and stay positive :crying: .
Thank you for replying, you're so kind :D Best wishes for you and your loved one

K-1 Fiance(e) Visa Process & ProceduresI totally forgot my Name was changed when I was 6
I know Dan told me to just wait and see, but I don't think I can. I hope it's not a major problem we have to go through. I totally forgot that my parents changed my name whenever I was 6, long long time ago. The reason why they changed it was because Back then I always had problem with my health, I always got sick. They believe that my name was to heavy to bear. Yeah, there's such a believe here, especially javanese tribe people. So anyway, I totally forgot to tell that to Dan before he sent the I-129F in mail. I wonder if anyone here ever had the same problem ? :) :crying:
Dan JMaleIndonesia2007-02-16 22:23:00
K-1 Fiance(e) Visa Process & ProceduresHow long do I have to wait ?
The wait is due to the number of petitions being processed (somewhere around 200,000-300,000) and extra checks to weed out fraud and those people with terrorism connections or significant criminal history.

While Vermont may process your petition quickly, it will take up to a month to reach the embassy, and looking at the Taiwan data, about two months after they receive the petition to schedule an interview. If you were to file today you could have your visa in about 4 months if don't run into any snags. But there is always a chance something could hold up your case.

Having a social security number is pretty much only going to allow you to file for AOS a bit sooner than you otherwise would. But it wont help speed up your visa petition.

Yes you can travel to the US on other visas. However, if you cannot prove significant ties to your home country, you may be denied entry. Overstaying other visas could while a K-1 is being processed could hold up your K-1.

If you have already made plans for a wedding in April and you cant back out of it now, you could go ahead with a non-legally binding ceremony. You do have to be careful with this though, don't wear wedding ring, and don't refer to each other as husband and wife to immigration officers. Its none of their business if you have a non-legal ceremony, don't give them any reason to suspect that you may have already had some kind of a wedding.

The other option is to just get married, and file for K-3 or CR-1/IR-1. Being your wedding plans are in April, it may not make much of a difference.
Dan JMaleIndonesia2007-03-22 17:26:00
K-1 Fiance(e) Visa Process & ProceduresCan she come visit me?
Yes, but as long as she can show that she has no intent to immigrate. She will need to show ties to her home country such as letters from her employer, property that she owns, or rental lease that is current. Even if she is granted a visa, she can still be denied at the PoE if she cannot prove ties to her home country.

K-1 Fiance(e) Visa Process & ProceduresPrison Record

I am wanting to marry a Brazilian girl who sadly has been working in the illicit trade there but has more than proven to me her devotion and committment to find a better life for herself. Let me just say that I havent' sent her a dime, nor will I except to fund this process and of course her travel to the US. The question I have regards my own indescretions from 20 years ago, I have 2 felony convictions for drug posession, will that hinder my chances of marrying someone from a foreign country? I served prison time in 1988 and completed all programs mandated by the judge. In fact, I went onto become a counselor for many years and today have 19 years clean. Suffice it to say that I went on to build a good life for myself and have been on the same job for 8 years earning in excess of 100K. Not your typical ex-con story by any means, I worked very hard to get where I am and don't want to mislead through this process just to be rejected at the end. Any thoughts or suggestions would be appreciated. How does the INS view the US citizen with a criminal record that is 20 years old? Thanks

This should not prevent you from getting a visa for your fiancee. However you may be faced with extra hurdles. In general with these cases, most people here would recommed that you consult an immigration attorney. You will have to disclose it and you may have to file a wavier. A good attorney will be able to give you a better advice than most people here.

As far as your fiancee, there are certain trades that can cause her to be banned from entering the US. Has she traveled to the US before?

K-1 Fiance(e) Visa Process & ProceduresCan I marry immediately in the US, or is the K1 correct way?
If working is an issue, you might want to consider getting married and then file for CR-1/IR-1. It may take a little bit longer to go through, but once it does you will be able to work when you enter the US as well as travel.
