You better clarify, are you talking about packet 3? or the initial filing of form I-129F?

Letter of intent is a statement from you and your fiancee that you intent to get married in 90 days after the benificiary enters the US. It can be one letter with signatures from each of you, or 2 seperate letters, with one from each of you. Follow the guides to find an example that you can adapt for your use.

I am in the process of gathering all the information before I file my application for K1. I got the packet from USCIS with the forms for filing the fiance petition and 2 Biographic forms. The instruction states that all foreign language must be translated in english by a certified translator. Will that include the emails and letters that I'm going to be submitting with the application form? Please help!


Not nessarily. Birth cerificates, divorice decrees, and police certificates need to be translated if not in english. Chats and letters between you and your fiancee do not. Chats and letters also do not need to be included until the interview stage. Just the proof that you met in the past 2 years.

However, if by letters you mean a statement by someone you know atesting to the fact that you two have met each other in the past two years, then you probably want to translate that.

Your situation is probably going to be a bit complicated. Do you mean that you commute from Canada to go to school?

It is possible to file for AOS directly with on other visas provided that you already are in the country and you didnt have the intention to marry when you last entered. If you are entering every day, you may have trouble with that requirement. Even if you were able to file AOS directly, you would have to be in the US, until you were granted AP or recevied your greencard.

K-1 allows only one entry, and you cannot leave and reenter until you have AP or your greencard.
k-3 requires that you are married first, but allows multiple entries up to 2 years.
CR-1/IR-1 will get you a green card right away, though with a bit longer processing.

With any of the visas processing, you may find it difficult to cross the border.

Hello,

My fiancee is here in the USA on a K1 visa. The visa expires August 3rd. Her mother is in the hospital and she may have to go back immeadiately to tend to things. We were planning on getting married July 15th. Should we consider getting married ASAP before she has to go take care of her mother?

I am really not sure how to proceed. We can start the process of status adjustment (I believe), but will she be allowed back into the country after August 3rd if she has to stay past that date (in Russia).

We are quite nervous of the situation, can anyone offer us some thoughts as to what our options are please?

I think your best bet is make an infopass appointment right away and then get married before that appointment. At the Infopass appointment, apply for emergency advanced parole. They have the authority to grant it on the spot.


She would first have to petition for AOS and get the NOA back in order to be granted Emergency AP. Even then, there is no guarantee it would be granted. But, having married before going to the infopass appointment, they have closed the door for a very possible revalidation of the original K1.


There is no guarntee that the K-1 would be revalidated. Plus it generally can only be revalidated if your still in your six month window and only to the end of the orginal expiration date. AP if granted, would allow more flexibility. I think AP is the better choice, but yes, you need to talk to a lawyer as soon as possible.

There are other reasons to have a ceremony outside the US. Its pretty unlikely that my fiancees parents will even be granted a visa to the US, much less any of her other relatives. Not to mention, it would be rather expensive for her family and relatives to travel here, even if they were granted a visa.

We preferred to take K-1 for a few reasons. 1. We could get started right away rather than waiting another 6-9 months to make another trip to actually get married. 2. Its shorter than k-3 or CR-1. 3. We preferred to be together once we are married and not apart anymore.

We will be doing a simple ceremony and reception in Indonesia before we leave together to the US. For us, its the best option for all the parties involved. We get to take the faster route at getting together by getting a K-1 visa. My fiancees family gets to celebrate our wedding while we are there.

Your fiancee can get stuff like a police report taken care of, but they do have a limited validitiy (3 to 6 months), so dont do it too soon. Other than, she can make sure she gets her birth certificate and get it translated if nessary.

also, to clarify, i did not come here with the intention of getting married when i entered on may 5th, 2007. This was discussed a a recent possibility and was encouraged by our lawyer as a way to sort of bypass the wait times of the fiance visa. I really just dont want to have to go to canada and aimlessly sit around for months and months waiting for this visa.

why is it that you need a fiance visa to enter the country and get married, but if you were already here, and you just decided to get married you can do so without issues and get a marriage lisence easily? that doesnt make sense. Why wouldnt everyone just do that and claim they "didnt enter with the intetion to marry the person" even if they did.

Couple reasons, its hard for citizens of certian countries to get tourist visas, unless they are very wealthy.

You can claim that, but you may be asked to prove it. And that may be hard to do. If you fail to prove no intention upon entry, you can be deported or even banned.

Technically, K visas and Tourist visas are both non-immigrant visas, but the K visas allow you to file for AOS. The tourist visas only allow you to file AOS in certain conditions.

If your attorny says its ok, then get married soon and file AOS before July 30th when the rate hike goes into effect. Keep all evidence of your intention to return so you can provide it if asked for it.

Hello, I recently spent a month in Minsk, Belarus with my fiancee...and I wanted to know if anyone recommends getting a attorney who specializes with K-1 visas or is it better to just do all the paperwork myself. Any suggestions and/or recomendations would be greatly appreciated. Thank you for your time and support in this matter.


We did it ourselves and he just and our interview and were approved. There was nothing really complicated in our case. No waviers needed or that kind of thing.

Actually thats the cover thier a$$ date. Most people get through in about 3 months. I think April filers are currently being processed, not december.

But should your petition go outside of normal processing time, they won't expidite it until 6 months have passed.

My wife and I were married well before the end of the ninety day period for initial entry ended. However, the ninety days expired last Friday and we have not submitted the status change application yet because my fiancee needs additional vaccinations with a civil surgeon. Has anyone ran into problems as a result of a late filing? It doesn't appear we'll be able to get it in for another week, in which case we'll be two weeks over the ninety day limit.


As long as your married in 90 days your fine. AOS can be filed at any time afterwards. You could run into problems if you wait too long though.

I'm confused about this too - if USCIS doesn't call, then what's the point of the G325A being filled out by the foreigner? I understand that the USC has to provide an affidavit from his/her employer, show the past 5 yrs of tax returns, etc. to show that the foreign fiancee won't be a burden to society...

If USCIS doesn't call, then how do they verify where the fiancee has worked for the past 5 yrs?


To provide information for a background check. Just having someones name is not ussualy enough to figure out who someone is. There could be many people with the same name. The more information provided makes it easier to correctly identify a person.

Its less about specifically verifying that the infomration is exactly correct, but instead to match the infromation provided on the G325A to a specific person. With that, they can see if there are things not disclosed like a crimial record, or to make sure a person does not appear on any terrorist watch lists.

1. Used to be withing 2 weeks, but they have been lagged down a bit recently, I'm not quite sure if they caught up yet. And yes it will get transfered to California first.

2. They will receive it on June 11th, but it may not get processed by the mail room right away. Once its processed and entered into the system, that will be your recipt date.

3. As soon as they process it. If your using the site timeline its based on when the petition was sent to the service center.

4. About 3 months, could be a bit faster or could take longer. Longer if you get an RFE.

Printing all of them out, would be way overkill. Not to mention you would go through a couple trees. For me, going through indonesia, 4 to 5 emails and 4 to 5 chats along with some calling card recipts and phone records was enough. Indonesia as far as i know doesnt deal with as much fraud.

But I think going way overboard can make you look like your overcompensating and covering for something else. Your best bet is to find a dozen or so emails/chats over the entire time period.

I beleive the fees are around $380. if you paid the fees to the NVC, I don't think there is an additional visa fee to be paid at the Embassy. someone correct me if I'm wrong

beckypua, that may be more evidence than I had. I provided a photocopy of a bus ticket and a plane boarding pass. I explained on there how my fiancee picked me up in a different town because no bus went to her town. That was pretty much all that I provided.

I/she was denied the first time around {at interview} for not having enuf pictures. I only had four. They wanted pics with me and her family.


The CO didnt even ask to see any of the other pictures my fiancee brought to the inteview. In fact they didnt ask to see any addtional evidence. What I included in the I-129F was enough. I did include some printout of chats and emails with the original petition and calling card recipts along with the evidence of meeting.

I think the affidavit of support may actually be optional for Mexico, but it wont be when you reach the AOS stage. Even if you were living outside of the US, but you were still a USC, you have to file yearly tax returns. You can use the tax returns to show that you are able to make enough money.

That is one option i suppose, but we are already in the process of planning the wedding out there. Also, it's not really possible for some of his family to travel all the way over here due to health reasons. We really want all family members to attend as this is going to be the most important day of our lives.


If you have lived in Ireland long enough (6 months is usually the requirement), you may to get married and file for a Visa via DCF. It generally works the best when you have no US residency, and in some cases, faster than other options.

A Wedding is not a marriage, and a marriage is not a wedding. You can have a legal marriage in ireland to be able to consider yourselves legally married and be able to file for a marriage visa. Then have a the wedding you want when you want after you enter the US.

2. In one of the forms i have to fill up G-325A (biographical information) it asks where i've lived for the past 5 years.. well WITHIN those 5 years I've lived in the Philippines for more than 3 years, do i also have to get an NBI? police clearance? CENOMAR (certificate of no marriage)?

3. Does my co-sponsor for the affidavit of support have to be a relative? or a friend will do??

4. Can my co-sponsor have dual citizenship? i think shes also an Australian citizen (and U.S)... She is an immigration lawyer in Australia, have properties and a call center here in the U.S. as well as the Philippines? would it be ok if i use her for my co-sponsor despite her dual citizenship? She's not in the army or anything.

5. How much money savings is sufficient to have in my bank account?

1. Nope. For a K-1 petition, you just have to be a USC, other citizenships dont matter.

2. No, if your the petitioner. The beneficiary does need to get the police certificate, later for the interview.

3. Anyone can co-sponsor, although the I-134 is not legally binding the form used at the AOS stage I-864 is. If you are still using a co-sponsor for AOS, you better make sure they are willing to make the commitment.

4. Dual citizenship doesn't matter.

5. If you are using just savings. I believe the number is $50,000 for a household of 2. Which is about $16,000 x 3 years. You can use savings to supplement your income if you fall short by annualizing it. If you have $10,000 in savings, divide it by 3 and it will account for $3,333 per year in income.

6. Depends on the country, just one may be enough. Contact the consulate/embassy on that one.

If you were a USC, even working abroad, you do need to file tax returns every year.

We would not sign any papers whatsoever at the time of the ceremony. It will be symbolic only. We will have another "real" wedding with papers signed and delivered to the powers that be once the K-1 visa is in hand. Would there be any legal repercussions for this or do you think it will be ok just as long as we dont file any paperwork for the symbolic wedding ceremony?

You would have to have a legal wedding in the US since your K1 visa permits you to enter the country as a fiancee/fiance. I am not sure if you can have a legal marriage in your country after you are issued the K1 and then use it to enter the US. Im sure others will correct me if I am wrong.


Im pretty sure he/she means having a legal marriage in the US after the K-1 visa is granted. Although the wording may suggest otherwise.

Your fine to do just a wedding as long as its not a legal marriage. What you have to watch out for is calling yourselves husband and wife and wearing wedding rings (if you use them) before you are legally married.

First I'd like to say that I'm new here and so excited to have found this forum. I was so sick of getting lawyers when I did a google search!

So, this is my situation.

I was recently living in Poland for nine months, where I met my boyfriend. When we first started looking at visas that would help him come and VISIT/WORK in the US, it seemed that it would be immpossible, so I thought, hey, why not a fiancee visa. It's not THAT big of a deal. So we talked about it and decided that maybe it would be the best route. We told some of our family and a few of our friends the sort of visa we were applying for, but that things were very much still up in the air, as there was no way to know if he would even LIKE the states.

Recently though, I read that it would take six months or more to get the fiancee visa and that it really was a HUGE deal. The day after realizing the length of time it would take for a fiancee visa, I (by serendipity) found a place that would sponsor him to come and work on an H-2B visa.

So this is the BIG question.

If he did come on the H-2B visa and discovered he liked my family and liked living in the states, and then we got married here, most likely at least over a year from now, would the INS accuse us of having planned it that way all along and then deport him?

I haven't filed any paperwork yet and I don't have a ring on my finger either. I'm just so confused and afraid!


The question is staying after you get married. Anyone can get married in the US.

It is possible to use other types of visas, that is other than immigrant, K and H1B visas to get married and adjust status. Only if you decide to get married after you enter the country. To enter on say a tourist visa with the intention of getting married and staying would be considered fraud and AOS may be denied.

H1B is considered dual intent. Meaning you can come here and work, and then go home, but you do have option of getting married and adjusting status. But H2B is not.

I believe its from approval. If you have had a K-1 approved in the in the past 2 years, you cannot file for another with a wavier. Also a wavier is required regardless if you have already filed 2 or more petitions in the past. Someone else probably knows this stuff better than I do, since it never applied to my petition.

I have a feeling by this point, the case may have been canceled. But do contact a the office of a Senator in your state and see if they can get you more information.

You could also try calling the USCIS, but follow the prompts for responding to an RFE. After you enter your case number you will be able to connect to someone at the service center your case is at. Other prompts on the call system will bring you to the national call center, which usually only has the same information as the website does.

It totally depends on what the crime was, but from what it looks like, its very unlikely to cause any issues for even if you disclose it. You can have minor issues on your criminal record and still get a visa or petition for a visa.

Well, you might be able to get through this, but you have alot of things working against you as mentioned in the other posts.

Its possible, but with no guarantee that you could overcome the issues preventing you from entering the US. It will likely take a lot of time, and probably money if you hire a lawyer (I don't think I would do this alone in your case, though it could be done if your prepared to do alot of research). But if you are unsuccessful, there are no refunds.

Having your fiancee immigrate to Canada is probably the quickest, easiest and cheapest way out. (Provided that your fiancee doesn't have anything preventing her from living in Canada) Then after your 10 year ban expires, you can try to immigrate to the US.
