Until January 1, 2008, US Citizens can enter and return from Canada without a passport by land or sea. If he travels by air, he has to have a passport. It should be easier for his fiacee to get a visa to visit Canada.

Though he really should do something about the back child support. Passport isnt the only thing thats restricted.

Could take months to years after to get your GC. It varies from case to case.

Ussually you are eligible for citzenship 3 years after you get GC approval, if immigrating through marriage, Otherwise for other immigrant types its 5 years.

You can get a passport once you are naturalized. The US does allow for dual citzenship, but not all other countries do. You will have to look into the laws of Nicaragua.

Based on what you wrote, you got engaged after you entered into the US. So filing to adjust status will be fine. But do keep all the documentation you have that you were planning to go back. This is the only opportunity you have to do it this way, leaving the country and then returning to get married and adjust would be fraud unless you entered on a K-1.

For him to be able to immigrate, it will take 10 years or more by immigrating through a sibling. And its been proposed to remove that as an immigration option.

There are other possiblities, If you are you or your fiancee is willing to sponser him and he is able to get accepted to a US college, he could try to come here on a student visa. He wont be able to stay after he is done with school though, unless he finds someone and gets married.

Even though its not easy to get, having a 4 yr college education does make him eligible for an H1B visa if he can find an employer in the US willing to sponsor him. Those visas are capped, but the selection process is random, so he does have somewhat of a chance.

To clarify, then - since she's not married and is childless, she's basically needing to meet 125% of the level for a 2-person household, me and her?

The only other things I can think of as evidence are cinema tickets and hotel receipts - I have mine, but Sarah has the hotel receipts and I don't know that she kept them. Thanks for your help - I'm sure we're all in or have been in the same boat, so you'll know that we're very nervous about the process and keen to do as much as possible to minimise our chances of being delayed or rejected.


Possibly yes, if her partner is not a dependent (or married filing jointly) on her then her partner doesnt need to be included. I'm not really sure if your fiancee would be considered a dependent in that calculation or not. But if her income meets the level for a household of 3 you should be more than fine.

No, you can have a co-sponsor. Although at the interview stage the guidlines are at 100% of the poverty level (It does depend on the consulate though), AOS stage requires a sponsor able to meet 125% of the poverty level.

Your aunt would be supporting 4 people, which at 100% is $20,650. 125% is $25,813. Alaska and Hawaii are abit higher.

You can visit the US even with a K-1 processing. But you do have to show ties to your home country or you could be sent home.

Your step daughter could petition for the child to come to the US once she becomes an LPR. Although thats likely to take 5 years. Take 5 years to petition the child, not to become an LPR.

1. No, not getting a tourist visa will not affect a K1 as long as the reason for denying the tourist visa isnt a reason why a K-1 can be denied.

2. Go home and apply for K-3 or CR-1. Filing for AOS after entering on a tourist visa with the intent to get marrried and stay is fraud. You can get married here on a tourist visa, you just cant immigrate without a K-1 visa.

As long as your divorice is final (Have the divorice decree), you can apply for a K-1. You may not be able to actually get married in your state until the waiting period is past, but the waiting period is not something that all states have. By the time you actually get the K-1 visa, your wiating period will likely be over.

No, none of its a new law yet. The changes are still going through the congressional process. But it mainly deals with a new working type visa, and removal of certain types of family based immigration options. As far as I know, it doesnt affect any of the K visas.

Your wife and children are in preference category 2A. Which currently has a priority date of 22-APR-02. So you can expect at least a 5 year wait. It may be easier and faster just to wait until you have citizenship. You will be able to file for your wife and children under K-3 and K-4.

Yes as the others said you have to be free to marry before filing the (K1 Visa) or else you will get rejected.
No he cant come and stay with you and just marry and stay for good,you guys might want to file K1 Visa.

If you marry in your state, yes. But you can get married elsewhere and not be subject to the waiting period. Marriage laws do vary and not all states have a waiting period.

Assuming that you are a citizen, your son can get citizenship . Though normally, you would file for a certificate of a birth abroad at a US Embassy or Consulate in the country he was born, being here, I'm not exactly sure what you need to do. Talk to a lawyer or see if you can get more information by making an appointment with the USCIS.

thanks again for your help...just a couple more questions...

first off, what constitutes her being a fiance? i thought all you had to do was show some written and signed intent to marry and some proof of having met in the last two years...

As for the proof of us having met in the last two years i dont have emails but i have msgs written on myspace and facebook which are dated. I also have pictures of the two of us together but those dont have any dates or anything on them..

also some clarification here. she can visit on her student visa? i thought she had to come back and go to school with that but could not visit? am i wrong in thinking this?? and y would her british passport make things difficult?

One last question...her and i have spoken of getting married and we spoke of it b4 she left to go back to jordan so she obviously knows that i intend to ask her to marry me...but if she came over here for a visit and then i asked her and we got married that would be legal?

Proof of having met in the last two years are things like passport stamps, receipts, photos, boarding passes. Emails constitute proof of an ongoing relationship, which is necessary for the interview stage.

It is possible to file for AOS on other visa types, but only in certain conditions. Your fiance has to be in the country without the intent to marry you and stay. If she does have that intent upon entry on a visa other than K-1, (H1B would be fine) filing to adjust status would then be fraud.

I'm not really sure about the student visa point being that she has graduated already.

First step is to read the guides.

Having a UK passport doesnt really matter in this situation. If she is in Jordan, she will go through the embassy/consulate in Jordan. The first thing you need to decide is what type of visa you want to get. Fiancee visa (K-1) is ussualy fastest, but there are good reasons to get a K-3 or CR-1/IR-1 depending on your situation.

this is a wonderful site for us with lots of great info. we followed every step metioned here to apply our k1 visa and now its approved. so i m waiting for my package to arrive.

just one question. Is it ok to get married while waiting for the k1 process. we both went back to our country and got married in a traditional way. its mainly for our parents and to enjoy the company there. My fiance who lives in US is not a citizen by birth. He is not registering our traditional marriage in US so that we could get married again there.

Will there be any problem during the interview or the visa process as we are married now.

i really really had no idea that we couldnt get married during the process...we were thinking that its no problem at all...just call me stupid or whatever...there is a cert that i m using to apply a residence staus for my fiancee who is a US citizen...so i guess i have no choice then to consult with the consular what to do next...

i dont know if there is a shortcut now to get going with the i 130? any ideas? if u were in my situation what would u do...

So it was a legal marriage. Then yes, you have no choice but to start over with a marriage visa.

You could have done a a traditional wedding (in most countries, that by itself is not legally binding), and still remained legally un-married and able to use the fiance visa. A bit to late for that now.

You probably should inform the consulate/embassy that you had your interview at that you wont be using the K-1 and instead filing for K-3 or CR-1. You will have to go through another few months of waiting before you can finally come to the US. It will likely take longer to process than the K-1 did.

The only thing thats really diffrent is that you need to include a copy of the divorce decree with your filing. There will be some qestions on the I-129F that you will answer diffrently.

You may also need to send a copy of the divorce decree to your fiancee to be taken to the interview.

If you have residency in Scotland, you can have your interview through the embassy in London. But you will need to get a police certificate from Pakistan.

On the I129F, did you specify Canadian citizenship?

You might be able to request that the case be transfered to Vancouver, but I'm not really sure exactly why it was sent to Taiwan.

Yup, provided that you got engaged after your fiancee's last entry into the US, you can get married and file for AOS. If you got engaged beforehand however, getting married now and filing for AOS would be fraud, you would have to use a K-1/K-3 visa. I'm assuing that you fall into the first case.

Get married before the visa expiration, and then file for Adjustment of Status. You dont have to worry about the joint stuff until the AOS interview, but I assume you would take care of that once you're married.
