K-1 Fiance(e) Visa Process & ProceduresI-129f approved, but decided for me (USC) to move to Austria

My I-129f was approved for my French fiancée. We've decided instead to move to Austria together this winter. She will be visiting America in November for her birthday at which point we will get married in Boston at the courthouse. It is only so we can be legally married and then on December 20th, I will fly to Austria to live with her and start my life in the EU. Can I cancel the I-129f visa since it was approved but we never went to the Consulate (Actually never received any paperwork) to get the actual visa and then she can come here to marry on the VWP with the intent for ourselves to move to Austria together and then I do whatever I have to do there to register as a French resident. We would like her to be able to get citizenship in America via marriage, so how would I go about that considering we will be living overseas for 3+ years?

In order for your then wife to get US citizenship, she needs to be a permanent resident of the US and living in the US for at least 3 years. Marriage does not automatically confer citizenship on the spouse.

Instructions from I-129F calls for passport style.

6 B. Give USCIS a passport-style color photograph of yourself and a passport-style color photograph of your fiancé(e), with both photos taken within 30 days of the date of filing this petition. The photos must have a white background, be glossy, un-retouched and not mounted. The dimension of the full frontal facial image of you and your fiancé(e) in separate photos should be about one inch from your chin to the top of your hair. Using a pencil or felt pen, lightly print the name (and Alien Registration Number, if known) on the back of each photograph.

US passport style 2x2 inches or about 5x5 cm.

It needs to be a straight on view, against a white or off-white background. it should show your head and shoulders.

If you know what your doing with photos and photo printing, you could make your own.

I filled the petition for my fiancee about a year ago, and she got her visa in January 2007, she came here to USA in march and we didnt get married. She came back to her country (no overstay) but I want her to come back to me. Is it possible? I dont want to wait next 2 years. What should I do?

You need to include a wavier, or get married and file for a spousal visa. Take a look at the IMBRA forum. Spousal visas are exempt from the IMBRA limitations.

I'm a naturalized US citizen. The item 10 on I-129F form requires the number of certificate, date and place it was issued. I can't seem to locate the certificate, unfortunately. Where can I find the information?

I do have a copy of my green card with the Alien Number.


You will likely need to get a new certificate. I'm not entirely sure if you can just show a copy of your passport, like you can if you were suppose to have a certificate of citizenship.

Interview and medical fees are handled by the Dept of State. Those did not change in the USCIS fee change. Everyone still pays the $100 visa fee, and the medical cost varies by country.

I have been wondering about this myself. Sasha had a SSN issued to her in 2005 while she was here working. When she returned in 2006 I believe she had the same number for working again. And this year when I filled in that question I wrote "see attachment". Then I added a typed page with the explanation, including her SSN. Should be sufficient, i hope. Anyway, my question is....When she finally arrives back in the States and is issued a number, will it be that same number she was issued in 2005? I cant see any reason why they would give her a new one or give me trouble for answering that question that way. :blink:


If she has her card from before, you wont even need to file for a replacement card.

first time user to the site and already a fan.

my boyfriend and i are getting married (yay) and are looking at doing the application ourselves.. On the I-129F it asks me, the alien fiancee, for my US SSN and A#.

Now I used to work in the US for about a year and a half and have a SSN, I have left since then so do I still fill out this one? And what about this A#? What is that?

You had a Social Security number, so enter the number where it is being requested.
The "A" number is the Alien Registration number given by USCIS. It may or may not be on some other document you received from Immigration when you were coming to the US to work. It starts with the letter "A" and is followed by 9 numbers. If you do not have that, leave it blank.


Social security numbers are with you for life. So use your number if you have it. You may or may not have an A number.

Just a question. I understand the need for the financial support, but the level is set at $16,000? I am in the process of bringing my fiancee here and decided to get a different job because I didn't think the $30,000 I am making now would be good enough to support her and myself. For those of you that just made the cutoff, how realistically can you support a wife/husband and yourself on that? I'm just curious...I know eventually my fiancee wants to work once she has settled in here, but for the time being, I will be financially responsible for her.


Agreed, it would be hard to support 2 people on $16,000 a year in most places. I can bearly live on that by myself. I did for awhile and I even had a roommate at that time. Even then it was hard to keep up on bills and whatnot. But then I live in the Minneapolis, its possible it would be more doable outside of a big city.

For the OP, you need to either get a second job, or find work someone else. Getting a $10 an hour job should not be too hard provided you have at least a HS diploma/GED (If you dont have that, that should be the first thing you do). And that will put you well over the sponsorship requirement.

If she was already here and then you decided to get married, you could and file for AOS. But she cannot enter on a tourist visa, get married and file for AOS as that would be fraud. You can only do that on a K-1 or other immigrant visa. If you did go ahead with it, she would likely be deported and may be banned from the US.

I doubt your license will be suspended or will you they put out a warrant on you over a parking ticket. But if you do park in the same jurisdiction again, don't be surprised if your car gets impounded.

$1100 dollars is alot for a ticket, you can try to negotiate it down, but considering how long you put it off, i doubt the county is going to be very helpful. I've gotten tickets here in Minneapolis that I didn't quite pay on time. I did manage to negotiate them down a bit.

No, credit status has no effect on visas whatsoever.

Credit will not even trasfer to the US, you will start with someone who has no credit. But if you were to ever return, leaving bad credit may not be the best thing to do. If you can, sell the call and pay off the rest of the loan.

There are usually restrictions in residing there for a year before you can use DCF, but if you have, it may be a faster alternative. His status in the UK, should not be affected by a application for a visa to the US. If you take the K-1 route, you will have to have the mail sent to a US address, like your parents.

Its not really hard if you break it up and take it piece by piece. Trying to understand the entire process from start to finish will be overwelming, but you dont need to know all of it right away.

Your first set would be to prepare the petition and mail it to the service center covering your area. Preparing the petition is pretty easy as long as you dont have any criminal convictions, overstays, or have filed multiple petitions.

Depending where you send your petition to, it may take a month, or it may take three. But it it will eventually get approved and by then you will be able to know what to expect.

Yeah, thats what my fiancees photos were as well with a blue background. But I had the original digital file so I edited and removed the blue background as well as cropped it to 2x2. Then I took the image and set it up in a file designed for 4x6 photo printing. with is a 2x3 grid of 2x2 photos. Then I took the printed photos and cut it to 2x2.

There are limits due to IMBRA on how often you can file a K-1. But I think you should be fine as your 2nd petition is more than 2 years after your first one. Unless you have filed more than 2 petitions; in which case you may have some issues.

You can try to call and see if you can get anything. Follow the prompts to respond to an RFE, and get to an operator. But they wont do much to expedite it until you passed 6 months of processing time.

Not only should you probably not be calling because you're the beneficiary, you shouldn't be getting into ANY habit like lying! Just like you're not supposed to be filling out papers, or saying anything during your interview that is in anyway a lie, why would you think it's okay to phone the information line and lie?

You have no idea whether you've received an RFE, or any NOA. You were touched. Period.

It is not lying to call USCIS after repeated "touches" but no updated to the case status, at least not w/ what's been hapenning these last couple of weeks w/ the online status updates. Many February k-1 filers started seeing repeated touches but no updates. The worry is very real in thinking that an RFE was issued. This "slowdown" in case status updates online is coupled w/ many people just not receiving paper NOA's...there is some sort of backlog going on at CSC or their online notification system has a bug. Calling the 1-800 # and stating that you fear you got an RFE, you don't know what's going on, in not lying in this case. That is what some of us have done, only to find out that we were approved....but no notification send at all, e-mail or snail-mail. By the time some of us received snail mail NOA2, their petition had already cleared NVC and was on the way to the consulate. :)

Agree. It's not lying by asking, " I have 2 touches and then nothing, did I get an RFE ?"
Dan and I used Skype conference call to call the USCIS. It's free for numbers that starts with 800. The operator did ask if he could speak to the petitioner. So, if you want to call, it's better to call and have your petitioner SO with you on the phone. Best wishes for your journey.

This question gets asked at least a couple times a week. Yes your fiancee can get a tourist visa and visit, but without evidence of non-immigration intent, your fiancee can be turned away at the port of entry.

Going through Vermont and Portugal you could be done with the K-1 visa in about 3 months if you dont get any delays. So its possible you will have the K-1 visa before your planned wedding, but there is no guarentee.

2.) Does the Texas and Nebraska ceters do any work or is california getting over in some way??
3.) I am in the Army and I am preparing a K1 visa packet. Would my W2's be good enough or do I need my 1040's??
4.) In the Support Affidavit, do they look at the GROSS or NET salary?? I am in the army, so some monetary benefits are not counted on my W2's, but are on my earning statements. For example housing allowances.

2. They do processing, but not K-1s. If you live in thier districts, you still have to send to them.
3. You dont need to show support until the interview, and part of the Adjustment of Status petition. What you need to include will depend on the consulate. But you can include 1040s+W2 or ask for tax transcripts from the IRS.
4. Gross before taxes is what should be included. I think I would include some of the benefits, as long as your fiancee would benefit from it too.

You can apply, but you will get denied and waste the $170 for filing the petition.

Really I don't know how someone can get engaged to a person you never met. There are alot of things about a person you will never really know until you meet in person. I know being apart is hard, but if you try to rush things too quickly you may end up apart anyway. Which is not that bad for you, since your not immigrating, but if things don't work out after marriage, your fiancee will in a strange place without much support (Or she could just be using you to get a greencard which sometimes happens). Take a trip or two, let your relationship develop, and then see if you still want to get married to her.

Provided your address is correct you should get a Notice of Action in the mail within a month of sending it. They are a bit slow at the moment, so you may get your notice a bit later than most people have.

If you used a personal check, wait for the check to be cashed and get the cancelled check, it will have your case number on the back.

An RFE at the petition stage ussualy has nothing to do with the country your fiance is from. You will just have to wait until you get the RFE in the mail, and just satify and send it back right away. It shouldnt delay your petition processing more than a couple weeks.

I am confused here (nothing new :whistle: ). I am the beneficiary and I am in the process of selling my home and moving to a rental apartment while I wait for my Visa. I am going to be out by July 1st. Nothing has been approved yet.

Do I need to submit a change of address? What if anything gets mailed directly to me as the beneficiary?

You should have your address changed yes. Once approved, your petition will be sent to the embassy and they will send you packet 3. Even if you tell the USCIS of your new address, you may also want to contact the consulate with your new address as well.

Well, we all know he should pay off the child support first, but that wasn't the question was it? The the overdue child support was from many years ago, and due to a lot of financial problems over the years he just never was able to pay it off before. He's paying it down now but it's a large amount and it will probably take him like 2 or 3 years to finish paying it off. Do you think his GF will wait that long?

So, back to the original question. How can they meet?

Until Jan 1, 2008 US citizens can go to Mexico and Canada without a passport, right? Can a Philippine citizen get a tourist VISA to Mexico?

How about any other US territories? Puerto Rico?


A US territory will likely have the same requirement to get in as any US state.

Assuming his fiancee can get a visa, meeting in Canada, or Mexico is the best bet. I don't know what it takes for a citizen of the Philippines to get a visa to Mexico or Canada, but I would guess that its a bit easier than getting a visa for the US. Though your friend has to travel by car, as airlines already require a passport.

Until January 1, 2008, US Citizens can enter and return from Canada without a passport by land or sea. If he travels by air, he has to have a passport. It should be easier for his fiacee to get a visa to visit Canada.

Though he really should do something about the back child support. Passport isnt the only thing thats restricted.
