I am planning to go be with my Fiance the 24th of aug. My 1-129f was received back in the middle of april, if my calculations are correct, I might get my NO2 about the time I leave for 18 days.


If it does arrive then is there any time sensitive things in there I need to worry about?

Since I am going over to see her is there anything I should do / bring that might be to my advantage?


Well just take care of the I-134 before you leave and take it with you. Thats all you really need to worry about at that point. If you have additional proof of your relationship that you want to provide you should make copies of that as well.

Unless the consulate or embassy asks for it specifically, you may not need to provide it at all. They usually only require the BC of the beneficiary.

No she can't come back before the 90 days are up, she is taking care of her father and the 90 days is up this week.

My immediate goal is to make certain that her K-1 visa status is ended in a way that doesn't cause problems in the future.


Provided you haven't been married yet, and the visa is not outside its original 6 months expiration, you may be able to revalidated the original visa at the embassy or consulate where the visa was granted.

Yes, but when it comes around that time, you may get proccessed and approved first or the other person will. While applications are generally processed in order, they do get a little out of order at the processing end. And some petitions may need background checks. So they may get approved later than someone who sent in their application after them.

Its really hard to know for sure, but you may start to see some movement toward the end of august.

Hi everyone, I´m from Spain and my girlfriend from Puerto Rico. I´ve discovered this awesome forum few days ago, and you´ve solved us a lot of doubts we had....but we still have million more :whistle:

We´ve recieve the NOA1 in June 1st., and since then nothing yet :angry: . But even without the NOA2 in my hands, I´m very very worried about the affidavit of support.... the reason are these:

1.She is not working now because she is on holidays with me here in Spain (she´ll return the next moth).

2.Before she came here she was studing....so there weren´t any incomes (she worked before, the last year, but not in this).

3.Our intentions are (when getting the K1 approved), to go to Florida to live, not to PR.

So...what do you think? :) ... really difficult right??. As you see we can only have one co-sponsor, she can´t be the first one because she hasn´t incomes....we´ve thought that maybe if she gets a job the next month there, maybe it could work??, I mean, would it be enough to be my first sponsor and also attach another co-sponsor in addition to her??. But is still one problem....i won´t go to PR, both of us will move to Florida, so there, none of us will have a work at the moment of moving.... :blink:

Any idea of what can we do??? :help: :help:

Save whatever money you can in the mean time. But getting a co-sponsor should take care of your problems. Unless your fiancee has a lot of savings, she wont be able to sponsor you on her own without a job.

:help: Hello everyone. I am a US resident (have been for 25 years - since I was 8 years old - Army brat) but I German passport holder. I would like to take my Thai girlfriend/fiance to the US with me. I have found lots of info how to go about this as a US citizen but nothing for Permanent Residents. Am I better off marrying her in Thailand and then trying to bring her to the US or should I wait and marry her in the US? Any advice anyone can give me would be greatly appreciated. :help:


If you have been here 25 years, you definetly do quality for US citizenship. US citizens get first priority when it comes to petitioning for someone in immigration, and you will have access to visas that you would not as an LPR. The shortest route will start with you going through naturalization. You may or may not be able to keep your German citizenship. While the US allows for dual citizenship, other countries may not.

Hello everyone I sent my I-129F to the Texas Service Center last week, and as I was looking through the forums I found out that it will be forwarded to California. My question is, since the fees change after the 31st, and since it will probably be a good 2-3 weeks before I receieve my first NOA1, will I still be charged the old fees for the rest of the process? I've read numerous messages but haven't wuite found the answer because my petition is the "lucky" few that has to be forwarded to another Center to begin the process. Alsoe I sent a money order instead of a check is there a way to "track" when they cash it? I appreciate the help you guys and Good luck to everyone!

As long as its postmarked before the 30th, you will be charged the old fees.

Depends on who provided the money order. You will have to ask them.

If you send it now, it probably wont make it to your file. All you can do is have it prepared, and wait for an RFE.

I've never had any trouble using webcams on any computer. Choppiness is likely to do with the connection on one or both ends. If you don't have at least basic DSL or Cable on both ends, don't expect good speed or quality. But distance does add some latency, usually its not noticeable, but sometimes it can be.

As far as your computer locking up, it could be a dozen different things. Definetly need more information.

The speed and memory available in the video card often has more to do with webcam chat problems than anything else. I have three computers. One of my laptops just doesn't have the video capacity to handle a webcam. Yahoo Messenger works fine for us.


Webcams have been around for a long time, you don't need much of a video card to use a web cam. However, if the drivers are faulty or old, that can cause an issue.

My fiancee (US citizen) who filed the petition on my behalf is currently unemployed and was when she filed the petition (and so put unemployed on the forms).
She is gettin a job within a few days, got her interview n stuff

Is that gonna affect the petition the fact she is unemployed and I am too? (I was a student when this was filed)

Also, if her parents added a statement saying that they would support us n stuff (financially and stuff) is that good or bad we added that?

This matters at the interview stage, and if your fiancee doesn't meet the requirements, her parents or another co-sponsor can also fill out the I-134. You don't need to show anything in the initial petition as far as support goes.

I sent my docs usps "express" overnight, to the Texas center, at a zip of 75185, i went to the usps page, to track it, and it said that an attempt was made at the zip 75149 - what gives with that? it seems, if it keeps being delayed, that i will have to write another check, for the increase that goes into affect Jul. 30.... :(

well, on the instructions it says a copy of that NOA2. I mean it's stupid because it's USCIS, they should know themselves whether the petition was approved or not. We could send a copy of the letter of NVC, but I don't think that's sufficient. We're not going to have another choice but bug them and hope they actually send something, I guess :(


I would think a copy of the visa from your passport would be sufficient, as you cannot get the visa without being approved by the USCIS. But then it all depends on who ends up processing your AOS. Some adjudicators are more picky than others.

We had our online NOA2 on May 29, 2007. Since then my fiancee has called three times and they told her three times that they would send it again. It still hasn't received? She received the NOA1 and also the NVC letter, just NOA2 is missing. I already had my interview last week and will be flying in 4 weeks, and in 6 weeks we're going to get married and we want to file for AOS ASAP. USCIS is just a bunch of morons... Should we contact her senator to get some help? What do you suggest?


Well during May and June there were a bunch of notices that were never generated. If it comes time to file AOS and you still haven't gotten your NOA2, I would suggest calling to see what you can use instead.

As long as your considered legal to marry age doesn't matter at all. But if your under 18 you may need permission from your parents. A significant age gap may be an issue in some places.

Old news. But no not really, they are trying to make it so the petition processing doesn't take longer than it already does. The fees are about on par as it would be immigrating to Australia or the UK. For me anyway, other expenses, such as plane tickets and wedding stuff is going to cost more than the filing fees.

You can still use your old passport. A copy of your marriage certificate should be sufficient to show a name change. From what I understand is that your plane ticket must match your passport name, even if its not the name you are currently using.

Yes you can stay for the entire 90 days, even if the petition is sent in as soon as you get there. You can be in the US when the petition is processing.

It can be difficult to come to the US, when a K1 visa is being processed. The officers at the border will know that you have a K-1 petition processing. They will ask you more questions and ask to see proof that you intent to return back to Japan when your time is up.

Proof can be return ticket, rental lease, mortgage papers, or deed to where you live, or letter from your employer as to when they expect you back. The more you can show the better. Even though your petition will not yet be processing when you enter, if you say the purpose of your visit is to visit your fiancee, be prepared for questions.

You should be able to come to the US to fill out the paperwork, just as long as you return before 90 days is up. Just in case, I would suggest bringing proof that you intend to go back. You can still be denied at the PoE if the immigration officers believe that you intent to immigrate on a VWP/Tourist visa.

I will go to a regular visa. This time my purpose is not getting marry with him.

It doesn't matter when he sends the packet to the service center, you can remain in the country while its processing even, though after its sent in it could become more difficult to enter.

i was in u.s on tn visa, quit and worked for another company for 2 weeks, came back to canada. When i tried to return i was topped and was allowed to withdrawl application. we then files our k1. my visa was not expired. from the time i quit my job and left U.S it was 4 months.

just wondering if anyone was issued a visa under similar circumstances


As long as something like that doesn't incur a ban or anything like that, it should cause a problem with getting a K-1. It will likely come up in the interview though, just be prepared to answer honestly.

All you have to pay for is AOS + biometrics. Then you can apply for AP or EAD as much as you want while AOS is pending.

But I have to wonder, where are you finding this information?

Do you have to be at a certain state of the process? I got my NOA1 a few days ago...and my guess is you haven't gotten an NOA2 yet or anything, because otherwise your petition would have been approved right?

So...where can I find this for my case? I don't see it on my CRIS portfolio, nor on the action NOA1!

Like many people on here I am STILL awating my NOA2 from the Vermont Service Center... when we first applied the processing date was at 44 days and now its 77 and theres been no word on our case since May! I cant believe this, its taking FOREVER!

Question, this might not be possible but I thought I'd ask just in case. I live in Ontario and one of my friends has recently moved to BC and it got me thinking... could I go and visit her and have my interview in Vancouver instead of Montreal which seems to be really back logged for interviews? I hear Vancouver interview dates are much quicked to get, correct me if I'm wrong though. So ya, can I apply for an interview in Vancouver when I live in Ontario?

You generally get assigned to the consulate or embassy that processes K-1s to where you live. Most countries only have one place that processes K-1s. You can request your case be transfered, but unless you have a good reason, its unlikely to happen.

Wouldn't it make more sense to go back and give it some time? Don't you have obligations, jobs, family, or other things that would still tie you to your current country you may want to wrap up and get sorted?

I guess if they are both sure about it and get married and apply from here it would also work, but it just seems like a very large decision to make. If I were looking at the adjustment it would be hard to believe the intent was not there if they come in under a different visa type and then get married.

If that is the case, then any country who has access to tourist visas would be wise to take that route. All you would have to say is you were dating for X amount of time and came here to visit and then they proposed and you got married. Then just stay here and file the forms and be together without having to be apart. How can you prove it isn't fraud or it is fraud in these cases?


Sometimes you can't, but other times you can. If someone basically moves (ties up all loose ends, obligations, or terminates lease) here on a tourist visa, then its pretty clear they have intention to stay.

If the USCIS determines the fraud was committed, the consequences can be pretty severe. Including deportation, and possibly a ban.

I came over to the on a tourist visa to see old friends and I have completely fallen head over heals for one them (whom ive known for quite some time and found out he feels the same way), we'd like to marry as soon as possible....

As long as you are truthful about having no marriage intentions upon entry, you can skip K-1 and file AOS directly. You need to start with getting married first. Its best to do that before your current visa status expires. Then you will need to get a medical at a USCIS civil surgeon. You can then file for AOS, you will need to include form I-130 along with the AOS package.

Just be aware, leaving without AP or your green card will be considered abandonment. If you want to come back, you would have to start over.

In the whole scheme of things, fees are only part of the cost. In preparing the visa documents, I probably spend a couple hundred at Kinko's and sending stuff to Indonesia. But for me, the most expensive part will be flying and likely cost of living while my fiancee is here and not able to work. But really, you cant put a price on being able to be together with your love.

If you intend to get married there thats not all you need..
Philippine law requires that you also need to get a document from the Embassy saying that you are legally able to marry. Then it takes 10 days for the marriage license.
If you intend to get married in a church then you also have a waiting period because thye put up this banner thing for like 3 weeks.

Sorry I'm not being more specific, real early in the morning and I'm tired and cant think of the document name or the exact time for the church.

As for an age requirement for a fiancee visa.. I can not find any specific documentation that there is a minimum age. Most counties in the US thou do have a requirement for how old you have to be to get a marriage license without parental consent.. Check the law where you live.
However you said she is turning 18 in sept.. so its kind of a moot point.. by the time any serious work starts getting done on your visa app she will be 18..

Your best off waiting until she is at least 18. Which will probably be the case anyway, since you need to meet in person first. But in general, once your 18, you can get married to whomever you want without parents permission in the US. But I still suggest checking your states laws just to be safe. You will need to meet in person before you will be able to file for a fiancee visa. Are you able to meet the other requirements for the fiancee visa?

I'm not really sure exactly how the CFO part plays into this, you may want to ask in the Philippines forum. She may end up needing parents permission not to get married, but to leave the country to get married.

If your talking about getting married in the Philippines, you need a spousal visa (K-3 or CR-1/IR-1) to bring her here. For that you can only apply once you have married. K-1 is to bring a fiancee to the US.

To get married in the Philippines, you need to follow this:

Well for future reference, when it comes to immigration, Resident (Legal Permanent Resident or LPR) and Citizen mean two different things.

But you might have another issue, since you said that yesterday was the first time you went out of the US, have you met your fiancee in person? Has she come here? Thats also another requirement to file for K-1.

There are some things that Philippines does differently than most countries which could cause issues with age. (Required to attend CFO seminar) You might want to ask the age question is the Philippines forum as well.

Are you a resident or a citizen? They mean two different things and you can only do a K-1 or K-3 as a citizen.

You will need parents permission if she is not of legal age where you plan to get married. It might be better to wait a couple months to file until she is 18 and then you should have less issues.

hmmm.. another thing.. the immigration mentioned that before "9/11", passport as proof of citizenship is ok. Now its not anymore, you should really present the original Certificate of Naturalization. is this true?


Did he gain his citizenship through his USC parents after being born abroad or did he gain citizenship through naturalization?

I was born outside of the US, but my mom was a citizen. Before I moved here, she registered my birth and the US embassy and I got my passport. Although the form asks for a certificate of citizenship, a copy of my passport was fine. But if your fiancee was indeed naturalized instead of getting citizenship through parents as you implied, then you may need the certificate.

My fiance' is a US citizen after birth. He was born outside the United States and he is a U.S. citizen through his parents, but he lost his certificate of citizenship years ago. HE can't file the I-129F because according to USCIS he should wait for his New Naturalization Certificate (which he requested 7mos ago!)

Question is... is his passport not valid as proof of his citizenship? can he already file the I-129F even without the certificate, just a passport? Our I-129F is on hold because of this. We are still waiting for his certificate replacement. USCIS site states that N-400 takes 6-9mos of processing. but thats for those who are applying for naturalization. my fiance is just asking for a COPY bec he lost the original. does anyone know why the copy is taking this long?

Same case with me but I never got a certificate of citizenship. Passport is fine. Copy all the pages and include that with the filing.

It also asks for the number on the I-134 form used at the interview stage, I just contacted the embassy where my fiancee was to have her interview and they said that if I proved my citizenship with the petition, a copy of the biographical page of my passport was all I needed to show.

If your applying for a Certificate of Citizenship, the form is N-600 not N-400.

Not a problem as long as it is made out in USD $$$ and made out to "Department of Homeland Security" and has the petitioner's name on the note line.

Fee is now $455 to file I-129F.




today is 30th is there any way we can file with old fees like giving old date stamp from courier?not sure if its possible?

Nope POST Mark needed to be before July 30, effectively Postmarked July 28th.

Also they wont accept the older I-129F, you will need to download a new one and fill it out.

The fee hike was first announced February 1 2007. So if you were not aware if it, its your ignorance. I don't think the USCIS is going to give you a wavier for it as its been know for 6 months

Would anyone mind giving me a plain English (brief) description?

I've read the comparison guide and the various flow charts .. I'm pretty new to all this lingo and could use a hand.

Our situation is:

I'm a Canadian citizen, living and employed in Canada, my fiance is an American citizen, living and employed in the US.

I am an accountant and would plan on working in the US (legally of course).

We can easily arrange to get married if that will speed anything up.

I'm just not sure which route to follow.

Any advise would be greatly appreciated.

K-1 = Fiancee Visa. A visa to bring your fiancee to the US to get married and immigrate.
K-3 = Spousal Visa. Allows your spouse to come to the US to immigrate.
CR-1/IR-1 = Spousal Immigrant visa. You are automatically an LPR as soon as you enter, while you have to apply for LPR status with the other two visas.

Generally K-1 is the fastest. CR-1/IR-1 is usually the slowest. Each have advantages and disadvantages, it depends on your particular situation.

I didn't know that we had to be living in the US for at least three years. Well, I may come back to the US for graduate school. Is she granted permanent residency?

I have the I129f approval, it was said to be sent to the consulate, but we received nothing from the Paris embassy. That's as far as we went.

So, can she just come here and we get married (I assume people do this all the time then leave for their home country)?


You can come here to get married, as long as your wife returns home. I suppose you will be going with her as well.

When you come back later to live, you will have to apply for a spousal visa for your wife. But you may have the option of applying for CR-1/IR-1 with DCF. That will get your wife PR status as soon as she enters the US. The DCF option which is limited to citizens filing abroad, is usually the fastest way to get a visa.

My I-129f was approved for my French fiancée. We've decided instead to move to Austria together this winter. She will be visiting America in November for her birthday at which point we will get married in Boston at the courthouse. It is only so we can be legally married and then on December 20th, I will fly to Austria to live with her and start my life in the EU. Can I cancel the I-129f visa since it was approved but we never went to the Consulate (Actually never received any paperwork) to get the actual visa and then she can come here to marry on the VWP with the intent for ourselves to move to Austria together and then I do whatever I have to do there to register as a French resident. We would like her to be able to get citizenship in America via marriage, so how would I go about that considering we will be living overseas for 3+ years?

In order for your then wife to get US citizenship, she needs to be a permanent resident of the US and living in the US for at least 3 years. Marriage does not automatically confer citizenship on the spouse.
