K-1 Fiance(e) Visa Process & ProceduresExpedite case

thanks for the responses? i what are the steps for trying to expedite a k1?

You cant pay a fee and have it expedited. Only some work visas allow that.

These are the online reasons a case will be expedited. http://www.uscis.gov...0000ecd190aRCRD

K-1 Fiance(e) Visa Process & ProceduresQuestion regarding proof of relationship...in relation to NOA2

Wow I had no idea I'd create controversy! My apologies!

But that is naive & elitist, no? The US Embassy in any country is run by the US govt, not a 'Third World / Fascist / Dictatorial / Communist / Middle East / Anywhere Else' country.

We are not 'connected' to the UK anymore. We have no special priviledges with them.

What I meant by this is that because my fiance is not from said country, (I ASSUME) they are less likely to be suspicious about her being tied to a government or organization that is not friendly with our country, NOR would it be instantly assumed that our marriage is some sort of sham (IE: She's a 'mail-order bride', she's trying to get into the country via a false marriage, etc).

My comment had nothing to do with how fast the US Embassy processes it's work, but rather how I believe they will look at who I'm petitioning for...

Based on the geopolitical climate in the world, among other factors, it is my assumption (there's that assume word again) that me wanting to bring a British citizen into the country will raise far fewer red flags than if my fiance were, say, Iranian, or Iraqi, or Afghani. Hell, I read a thing on someone's timeline about entry from China taking 1-2 years. I can only guesstimate why, but yeah.

Again, please forgive me...I do not mean to sound elitist or naive or anything stupid! I'm basing my opinions on the Bush Administration's definition of 'national security'. -_-

You're right, of course, but not everyone on VJ always wants to admit to political realities in the real world.

And most London Embassy applicants won't face nearly the level of questioning that some other applicants at other embassies will face. They COULD be subjected to the same questions -which is why everyone regardless of Embassy naturally frets about collecting the right sort of evidence for the interview, and they are wise to do so - but in most cases, they aren't.

Like I said, my fiance was a bit miffed they didn't want to see our shiny photo albums and phone bills. You'll see a lot of UK filers say the same thing.

Yeah it does vary a lot. I had included some evidence of our relationship in our original petition, a couple phone records and emails. Apparently it was enough, as the CO, didn't ask to see any of the other evidence that my fiancee brought to the interview. I would still recommend that you come prepared. Even if your fiancee is of a nationality that wont raise as many red flags. Because if you do get asked for it, its much better to have it.

K-1 Fiance(e) Visa Process & ProceduresQuestion regarding proof of relationship...in relation to NOA2

I know I am jumping the gun a bit here...I haven't even filed the I-129F yet (will do in a couple days though!)

But I was reading through things, and noticed that they ask for more proof of the ongoing relationship between the time of NOA1 and NOA2, if I'm not mistaken.

...I really have to wonder, just how necessary is it to be able to produce travel documents in this set of proof? It is going to be virtually impossible with my current job, and with school starting up again in a few weeks over a month, for me to travel to England to see my fiance...and she is saving up all of her money for when she gets in the US so she can get her own car, pay her insurance, etc etc etc. So spending $1,000USD or more on a trip between, whenever I get NOA1 and then NOA2 is going to be nigh impossible to accomplish given our situations (financially and otherwise).

We've pretty much figured that we won't see each other again until she arrives on that K1 Visa.

But having read that, I have to wonder if that's going to be acceptable...

We've been together 2 years, I have evidence of me going to see her, and she has some of having come to meet me, both in travel documents, pictures, etc. If all I can show for the next couple months is perhaps emails, letters, or what have you, I hope that would be okay.

Please advise here...I read through the guides and didn't see anything about this requirement and how it needs to be fulfilled. Fulfilling it for the initial filing is going to be easy, we have that covered as far as I can tell...

Thank you.

Travel or meeting proof is mostly important for the inital filing. Other relationship proof, emails, call records, chat logs, or postmarks from mail are needed for the interview stage.

The only thing that may be faster is DCF, but that all depends if you qualify. K-3 and CR-1/IR-1 are usually slower than K-1.

K-1 Fiance(e) Visa Process & Procedureshaving a Congressman call/email the service center

I'm sending in my papers at the end of next week. Recently in my office I spoke with a person who works directly under and certain US Congressman, and I built some good rapport wit him...he offered me I could fax a copy of the package I send to USCIC. He then said he could see if the Congressman could reach the USCIS and ask them to "expedite" things.

Do you think this could help things go faster?

or could this possibly backfire in my face?

They wont be able to help until your petition passes 6 months of processing time.

K-1 Fiance(e) Visa Process & ProceduresFlooded with applications in July

Do you think service centers are going to be flooded with new applications in July, because of the fee increase at the end of July? Do you think it will take a lot longer to approve applications? 3 months?6 months? a year?

For K-1's its likely those sent to the CSC will get approved faster as the load is now balanced between CSC and VSC. For those sending to VSC, it will probably get a bit slower.

K-1 Fiance(e) Visa Process & ProceduresEmployment info on G325A

As described, my fiance listed her employment info, her only job, as being from December 06 to April 07. She actually started there in November 06, and then ended in April 07.

If we mail this in on the I-129F, are they going to care if she listed the wrong month? I mean, it's not for an affidavit of support, it's not for financial anything, it's just biographical.

She's already signed her copies and stuff, so I mean, for her to have to reprint them all and sign them and send them back to me would be a real headache...

Alternatively, if this *would* cause an issue (RFE or God-forbid a denial) is it possible just to white it out and attach, say, a post-it note with an explanation?

Or is it fine just to leave it as is?

Please advise ASAP as I wanna mail this off Monday!! Thank you!

You should be OK. I know my G-325A, wasn't completely accurate and I didn't have any problem.

K-1 Fiance(e) Visa Process & ProceduresEntering USA with K-1 Visa

I know I'm probably far from getting my K-1 as our I-129f is still processing (hopefully not TOO far though this is taking long enough), but I was thinking the other day about when I do get it... since I live in Ontario and my fiance is in NJ, he comes up and visits me often and it would be no problem for him to come up to Canada and drive across the border with me... would it be better though if I just came across by myself though, maybe with my parents? Does it matter? Probably doesnt matter but any thoughts?

Doesn't matter. Whatever you want to do.

K-1 Fiance(e) Visa Process & ProceduresQuestion 18 of I-129F

Hi..

I'm wondering how this question should be answered? Is it just a short statement of how I met my fiance, or can I add additional stuff of how our ongoing relationship is. Does it have to have details or just simple and cut to the chase?

Thanks!

How you met in person, one paragraph is enough, though if you need more room you can attach a separate sheet. I attached an extra sheet with the evidence of the meeting.

K-1 Fiance(e) Visa Process & Proceduresincorrect birthdate for my father on application

ok...ive posted a thousand times saying "this is my last question before I send in the package"....i'm just going to stop saying that now

anyway....on the papers that have already been signed and filled out...i realized that i put my father's birthdate as AUGUST 8th instead of AUGUST 6th.

will this be a big deal? will the USCIS even notice?

can I just one-line the "08" and write in a "06" or will this cause for a rejection?

Thanks everyone!

You should be fine, they may not even notice and if they do, they may see that its really close anyway. That is if they actually have your fathers birthday anywhere on file.

K-1 Fiance(e) Visa Process & ProceduresPrior Visa Denial ( not refusal)

My fiance has the following question...

last august 06 AMD pettioned me for a B1 visa. The visa was not issued as my company was a single member company. The US Embassy said I was not denied / refused the visa. Will this effect the K1. ?

Does anyone know anything about this?

No effect whatsoever, but you do have to disclose it.

K-1 Fiance(e) Visa Process & Proceduresparents of my fiance are deceased....

Both the mom and dad of my fiance are both deceased. On the form G-325A where it asks for the city and coutry of residence of the parents, should i just put "Deceased"? Also will that require any supporting documents like death certificates. I dont see why they would need to see that, but so many supporting documents are needed, i just wanna make sure i do this right the first time.

thanks!

Just put deceased, you don't need to include any supporting documents for them. Only supporting documents needed would relate directly to you, your fiance or your fiancees children if your fiancee has any.

K-1 Fiance(e) Visa Process & ProceduresWhat is age limit for US citizen to File K1 or K2 for his or her Fiance in India

Doesn't the age requirement vary state to state? If she is under 18 and wants to marry, I believe some states require parental permission to be submitted along with the I-129f. Just wondering.

Yes it does, she could file in some states at 16 with parents permission, but generally once you are 18 you are pretty much free to marry without anyones permission.

K-1 Fiance(e) Visa Process & ProceduresWhat is age limit for US citizen to File K1 or K2 for his or her Fiance in India
K-1 is fiancee visa, K-2 is a visa for children of the fiancee.

Age is going to be an issue. But more due to being able to provide support rather than able to get married. I would suggest that she waits until she is at least 18 to file.

Generally you have to be free and legal to marry to file for a K-1. You can can get married in some places here in the US at 17, but generally most states require parental permission. At 18 most states allow for marriage without any conditions.

She is going to have to prove that she can support her fiancee. She can use a co-soponsor if needed.

Personally I dont think its a great idea to get married at 18, but each person makes thier own choices. If she waits until she is 18 to file, she will probably have an easier time getting through the process.

K-1 Fiance(e) Visa Process & ProceduresMArriage location and honeymoon

Hi Everyone

I'm just starting the K1 visa process and have a few questions that I'm hoping someone on this sit can help me with:

1) should i be getting an immigration lawyer?

2) after i am approved for the K1 visa can I still enter the USA to visit my fiancee (prior to our wedding) or will he have to come visit me always? we still have 9 months to our wedding!

3) i want to have the wedding ceremony in Canada - i was planning to have the ceremony in Canada and the legal marriage in the US. We are planning a spring wedding next year in Canada followed by a honeymoon somewhere outside of the USA and then we were going to enter the USA and have a legal marriage there. Is this risky? Has anyone faced the same issue?

ANy help would be great! Thanks :)

1. You can do it on your own, but if your case has complications, a lawyer might help you sort out any issues.

2. You can only enter once with a K-1 visa, and if you enter with a K-1 visa, it will be used over any visa wavier program or any other visa free programs.

3. You can do that if you want, but be aware. You are not married yet, and saying anything else could confuse border agents and cause problems with entry into the US. Many people have done it, especially with countries where its hard if not impossible to get a visa to the US. But if you are concerned about issues related to that, you could get legally married now and take one of the spousal visa paths. And still have your wedding ceremony in the spring.

K-1 Fiance(e) Visa Process & ProceduresApplication receipt number

I sent in my I-129F petition and just had the check cashed. I'm trying to find the case number on the back, but parts of the check are poorly stamped and unreadable. There are some numbers that I can read, but none are 13 digits long, which I believe is the length of a case number. Can I just call USCIS to get my case number? I wanted to ask first before navigating their phone maze.

You can, but they may tell you to wait for NOA1 first. If for some reason its not delivered, then they will be able to get you your case number.

K-1 Fiance(e) Visa Process & ProceduresFile K1 Now or Later? Opinions Please!

Hi Everybody,

I swear I am going to get more active on these boards so if this has already been posted and I missed it sorry! I have a question...

Christophe and I are trying to decide if we should do the K1 visa now or should we wait til I get a perm job? I am currently interviewing for perm jobs and in between that, I am temping. Does anybody have any suggestions? Obviously, we just want to get this application form moving but want to make sure it is not bounced back to us a million times.

Thanks for any advice!

Maggie

Do you make enough as a temp to satisfy the support requirements? You wont have to fill out the support forms until later, and if needed you can have a co-sponsor for the I-134 and you will hopefully be able to self sponsor with the 1-864.

K-1 Fiance(e) Visa Process & Proceduresi mail out tomorrow...

I included 8 pictures of me and my fiance. I did NOT write anything on the back of the pictures because I was told I only have to write my name on the back of my passport style photo.

One thing I'm worried about...my girl works on her family's farm in BuriRam. However, she doesn't exactly look like the typical "farm girl". She still has plenty of style and makes herself up VERY well. I've got pictures of her and I just lounging and dressed down, and I've also got pictures of her dressed up. Will they see these pictures where she is dressed up looking nice and say something isnt right?

IM PARANOID!!!!!!!!!! :help:

It doesn't really matter what the pictures are, just as long as your together. And its also just considered secondary evidence.

Yes. TSC and NSC dont process I-129F's anymore. But you are still required to send to the service center covering your area. Though that is changing and soon you will be able to send directly to CSC or VSC.

K-1 Fiance(e) Visa Process & ProceduresAfter the NOA2 question.

What to send to your fiance(e) once the I-129F is approved (Receive NOA2):

1. A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one).

This was taken from the K-1 guides.

Do I really need to send her this? Isn't the petition I sent transfered to the consulate for the interview?

I never received an RFE so I know that doesn't apply.

Thanks so much for your help in advance.

Wioombeen

Don't need to, but helpful for reference for your fiancee. The embassy will have the original petition forwarded to them.

K-1 Fiance(e) Visa Process & ProceduresShould I hire an attorney?

I need some advice on what to do now. I am in the black hole of waiting for security checks to clear. We filed March 2006. I have done everything I can. I have called USCIS several times for outide normal processing times. I have called a congressman and 2 Senators. Today I got a letter stating this can sometimes take years. Background checks are still pending. We cannot speculate about when the background cheks will be completed. USCIS has determined that no documentation related to the case will be issued at this time. They realize I may be frustrated by the progress of my case, but they must balance individual inconvenience against broader issues of public safety and national security. WE hope that hte recognition that your case has not been forgotten lessens any anxiety from the delay in the adjudication. So what can an immigration attorney do for me that I have not already done??? Any thoughts?

Unfortunately, with the heightened requirements for security screening due to threats of terrorism, extra processing time is not uncommon for those going through countries in the middle east or North Africa.

So far they haven't told you that you have been denied, but yes, you are way outside of regular processing times. When you called the USCIS, did you follow the RFE prompts, or did you just talk to someone at the national call center? The RFE prompts will get you to someone in the service center with your case, and they usually have better information than the national call center does.

K-1 Fiance(e) Visa Process & ProceduresPROBLEM!!!!!!!

My concern here is that the Colombian embassy finds out about it..or for that matter that the US finds out later on and does something crazy like deport her for no stating it

Thats not a reason to deport someone. And since its not asked for, she wouldn't be misrepresenting herself by not disclosing it. (Its not the Columbian embassy. Its the US embassy in Columbia)

K-1 Fiance(e) Visa Process & ProceduresPROBLEM!!!!!!!
I don't think they are asking about visas filed for other countries, just US ones. And you could cause some confusion if you say yes to that question and disclose the visa pending to Canada. I think giving information about the pending visa to Canada would likely cause more problems than avoid. Really the visa petition to Canada that was filed on behalf of your fiancee will kinda become void at least for her if she immigrates to the US. Its good to be honest, but I think in this case, unless specifically asked for it, your probably better off just not worrying about it. I don't think they will know about it. But if you do tell them about it, and they want to verify it, it could send your case into AP.

From what i have read as long as we are honest about it and put it in a letter we should be ok...And further more, the forms were filed 2 yrs ago, my fiance and i met 5 months ago...And her mom filed for her, she didnt do the filing herself....If anyone has any comments or advice , please help me out here!!!!!! :crying:

Not really sure how that might be a problem. Your applying for her to immigrate to the US and not Canada.

Just the point that her name is involved in another process at the same time, and Canada and the US share information if im not mistaken

They don't necessarily share all information. US immigration may not even know about it or care if they do. I think you might be asking for more trouble by volunteering the information, but instead if they do know about it, and they ask questions about it, be honest. There is nothing I know of requiring you to disclose pending visas with other countries.

I have read a TON of forums when it comes to the I129f in Colombia...and one of the things that i have seen the most being said is to be honest and not to withhold information...as a matter fact, on the actual visa application form for her , there is a part that asks wether anyone has ever filed a petition for her or uf she ever applied for a visa herself

Don't withhold information that is required. But you don't need to volunteer information thats not required. There is no where on the I-129F or G-325A that asks about visa applications to other countries.

Your right that it isnt on any form, but there is one part that asks if anyone has filed on her behalf.

The only question sorta related to what your talking about pertains to you, and whether or not you have filed for a fiancee or spouse visa before. Question number 11 on the 1-129F. The question is asked due to limitations imposed by IMBRA.

So the I-129F package was sent out Friday from my mom's place in Ohio. How do I start to monitor my case online like everyone else keeps talking about? Do I have to wait until the NOA1? Is there a number on that form that I would use to register?

NOA1 will have your case number. If you used a personal check, it will be on the back of the canceled check as well, which you may be able to get before NOA1. But it will take a couple weeks.

Just use your new address after you are married and have filed for AOS. You don't need to change address unless you plan to get married and live in Kansas for awhile before moving to Guam.

I'm not entirely sure how this works for US territories, but I don't think it should be any different. After you activate your K-1 visa, you will have to be careful about taking any flights that may transit through another country. Well at least until you receive your green card or AP. I think you should be fine going to Guam directly if thats where you plan to live.

I understood about NOA is just notice. but when my boyfriend receive NOA2, he have to send NOA2 to me??? What is inside of NOA2? and What is inside of US embassy send to me before an interview?

and for my interview, he has to fill the I-134 and send me.

NOA2 is just a sheet of paper saying that the petition has been approved and has been forwarded. No he does not have to send you a copy, but he will need to hang on to it. Its used later when you apply for AOS after you have come to the US and gotten married.

What the embassy will send you and what you will need to do for your medical and interview varies by embassy.

K-1 Fiance(e) Visa Process & ProceduresK1 visa

Hi, I am preparing information about K1.

I can understand my fiance ( American ) ( I am Japanese) have to file to Sevice Center.

but I can't understand NOA ( 1st of Notice of Action) and NOA2( 2nd of Notice of Action).

My American fiance have to do is to sent papers to Service center? or Does he have to do some action after he receive NOA and NOA2 ? and after NOA2 , is he just wait for me to enter US? nothing to do?

and, I have a question about ' assembling the I-129F package : checklist ' in here, http://www.visajourn...mp;page=k1guide

I can't understand about this sentences.

4. Declaration of how you met in person in the last two years. This should be a single typed page attachment regarding question 18 of the I-129F. Make sure to sign and date it.

12. Copy of final Divorce Decree(s) or Certificate(s) for the US Citizen and/or foreign fiance(e) if either has been previously married. If the previous marriage of the US Citizen and/or foreign fiance(e) ended due to the death of their spouse then include a Copy of Death Certificate(s) documenting that fact.

13. Proof of Legal Name Change if either the US Citizen and/or foreign fiance(e) is using a name other than that shown on the relevant documents. You must give USCIS copies of the legal documents that made the change, such as a marriage certificate, adoption decree or court order.

14. In regards to Section C Question 2, if applicable provide certified copies of all court and police records showing the charges and dispositions for any specified conviction(s) (in accordance with the IMBRA). See section 9 of the I-129f instructions for more information.

What will we have to prepare for No. 4, 12, 13, 14?

I hope someone help my questions.

Thank u for reading (L)

Almost, NOA1 is just a notice from the USCIS that they have received your petition, NOA2 is a notice sent out once the petition has been approved and forwared on to the NVC and afterwards to the consulate or embassy where you will have your interview. After your fiancee sends in the petition, his part is mostly done. He will have to provide the I-134 to you for the interview.

Starting with number 4, one of the requirements of the K-1 visa is that you have met in person in the last 2 years. You also have to provide proof of that meeting. Attaching a statement is optional, but if you dont have enough room in the question 18 box, you can add an extra sheet briefly detailing your meeting. You will need to include copies of passport stamps, boarding passes, receipts and pictures showing that you were either in the US, your fiancee came to japan, or you met in a third country.

12 only matters if you or your fiancee was married before. If not, you don't have to do anything. If either of you were, you need to show documentation of the termination of the marriage. Either with a divorce degree or death certificate.

13 only matters if you have ever legally changed your name. If not, then do nothing.

14 only matters if your fiancee has been arrested and charged with a crime. If not, you dont have to do anything for that portion.

K-1 Fiance(e) Visa Process & ProceduresWhat to do if my No2 arrives and I am on vacation?

I am planning to go be with my Fiance the 24th of aug. My 1-129f was received back in the middle of april, if my calculations are correct, I might get my NO2 about the time I leave for 18 days.

If it does arrive then is there any time sensitive things in there I need to worry about?

Since I am going over to see her is there anything I should do / bring that might be to my advantage?

Well just take care of the I-134 before you leave and take it with you. Thats all you really need to worry about at that point. If you have additional proof of your relationship that you want to provide you should make copies of that as well.
