It could be, border can be as difficult as getting the visa. But if she comes prepared she should do fine.

Yours is a very unusual case, and I doubt your going to get much of a good answer on these forums. Your best bet is talking to a lawyer who specializes in immigration and probably more particularly asylum cases.

Some Canadian airports do pre-flight immigration, if you go through one of those airports, you wont be able to get an EAD at JFK.

You need to figure out what happened to your case. The petitioner can contact the embassy in London to find out what stage its at. You should be able to call them via phone. If you turned in packet 3 and were waiting for packet 4, there is a Dept of State number you can call, though I dont know what it is. Someone in the UK forum may have it.

It doesn't need to be detailed. You need to show how you met and when. It might help to describe any evidence that you are using to show that you have met your fiancee within the last two years.

Speeding tickets, like parking tickets are generally not considered criminal offenses. You don't really need to report that kind of thing.

Actually, Air only until january of 2008. But the air rule has kinda been suspended as long as you shown that you have applied for a passport.

Your confusing two separate processes. K-1 is the visa that allows you to enter the country, get married and file for Adjustment of Status (AOS). AOS is what will get you a green card once its been processed and approved. But the green card is a conditional one, and you will need to remove the conditions at the end of the two year period.

K-1 takes about 3-4 months on average for the petition to be approved. Maybe another couple weeks or month to reach the embassy or consulate. The wait for an interview varies from a couple weeks to over year in some countries. In Canada, interviews are held in Vancouver or Montreal, depending where you live. Vancouver takes a couple months, but Montreal may take 4-6 months or maybe more.

Assuming you don't get caught in a black hole, which is in this process is called AP or AR, your visa will be approved after the interview. Once you have your visa, you can enter the US.

After you get married you are able to file for AOS. Once approved you will get your green card, however, it can take 2 months to a couple years depending on your situation. But in the mean time, you will be able to apply for an EAD which will allow you to work, and AP, which will allow you to renter the country if you go back home to visit.

Depends on how quick the embassy or consulate that you would go to is at giving interviews. In Canada Interviews are done at Montreal (4-6 month wait) or Vancouver (3 month wait). But you should expect that the process will take about a year for a CR-1/IR-1 visa.

DCF route is the fastest, but its not available to all couples. Usually it requires your USC spouse to be a resident of Canada to apply that way.

Other than that, K-1 visa is generally faster than the two spouse visa options.

You can visit while the visa is processing, however the border agents will know about your visa, and will likely give you more scrutiny when crossing the border. You may be asked to show proof of ties to your home country, like lease of a place you rent, mortgage or deed for a house you own, or a letter from your employer that you intend to return to work by a specific date.

Assuming no divorce, it takes 3 years after getting a green card to be eligible for naturalization. If your fiancee spends a lot of time outside of the country, it can take much longer. So depending how long it takes to get your green card, your looking at 2011 at the earliest.

The more visits , the more time together the better, great proof of a relationship. You are in a lucky position as you can get tourist visas from the UK, impossible from China. Visit each other as often as you can.


VWP visits are limited to 90 days, but I do think there is a limit of how much time you can spend in the country over a year. Though I wasn't able to find exact information on that.

Photos are secondary evidence and are not necessary, but can help.

What you do need to send is evidence that the two of you have met, like receipts, board passes and passport stamps.

You may not be able to get it until your husband has his green card. States vary as far as drivers licenses. I dont think you can extend the I-94 since the visa is only valid for 90 days.

1. Yes, but some people have had trouble doing so.

2. You can file for AOS outside of the 90 day time frame, however, your wife will be kind of in limbo until you do. She wont be able to work, or leave and reenter.

Will someone please clarify the "rumors" about K-1's being forwarded to a location other than the location initially filed. I filed my 129F with the TCS on 05/22/07 and have not received any touches. I saw a few posts and heard rumors that all 129F's filed thru TSC are being directed to California. I also heard that all k-1 petitions will be processed and filed thru VSC.

What is true and what is false? Can someone clarify. If petitions are being moved, will it still be "processed in the order it was received"?

TSC and NSC haven't processed K-1s for awhile. But you were still required to send your petition there if you were in a state covered by it. That will change after July 30th, and you will be able to send your petition to VSC or CSC depending where you live.

Your petition was sent to California. After its received, you wont see any touches for about 2-3 months.

Yup that guide is all you need. But do be aware if you leave without AP or your green card, you will be abandoning your AOS. And you can only renter to stay with a K-3 or CR-1/IR-1 visa.

Otherwise you need to return to Canada before your current visa expires. Overstaying will only make things worse. (Although you need to overstay 180 days before you get a ban). You would need to return to Canada anyway for the medical and interview.

D&G: Canadians don't require a visa to visit the United States.


I know that, they still cant just stay here. While they may not go through the same procedures that citizens of other countries go through, they do still have a similar status.

Ooops. Just noticed that you came here in February so your six months is coming up. Sorry about that.

Actually, I was here in February for 2 weeks only (so her parents could see that I was reasonably normal). I returned here on May 5th, by which time K had her own apartment, in preparation for the possibility of marriage.

In theory, then, I could stay here until May 5th plus six months, but that would go against what I said (verbal statement) to the immigration officer at the airport. He may have written that down somewhere, and I wouldn't want them to consider me a scoff-law.


Well, you can get married now, and file for AOS and skip getting a K-1 or K-3 visa, if you had no intent to get married when you entered, which it looks like is the case, but only you know that. In addition to the regular AOS, you would file an I-130 and you would need to get a full medical.

Otherwise you need to return to Canada before your current visa expires. Overstaying will only make things worse. (Although you need to overstay 180 days before you get a ban). You would need to return to Canada anyway for the medical and interview.

it's pretty startling to find this out, isn't it... I wanted to be married in Australia; I've been living in London for the past three years and my family hasn't even MET my fiance, and as I'm the one agreeing to uproot and move we thought it was more than fair... but when we found that the only way to do that was a K-3 and an average wait of 9 months (during which I wouldn't be allowed to enter the States), we quickly changed our minds :s

it's daft... if we didn't want to do something special and family-centred, it would actually be EASIER; how can they not see this?

To get legally married in Japan, instead of the US, you will have to apply for a visa after you get married. And apply for a K-3 or CR-1/IR-1. Getting legally married outside of the US, and then immigrating to the US on a K-1, is fraud.

You can have a ceremony in Japan before immigrating to the US, if its not considered legally binding. What is considered legally binding for a marriage varies by country.

Does anyone know anything about the Diplomatic passport/visa? The diplomatic passport/visa was attached to the Philippine passport but was lost. However, all of the stamps was placed on the dimplomatic visa... Is that okay even though the Philppine PASSPORT was lost? Please help



I think your using passport and visa interchangeably which is making your question confusing, they are not the same thing.

I assume you have a Philippine diplomatic passport and a regular Philippine passport? If you are allowed to use your diplomatic passport for personal business then you don't really need a regular passport, unless you can only use the diplomatic passport when you have your regular passport.

If the beneficiary, only if you need it to show name changes.

For the petitioner, you cant use a foreign BC to establish US Citizenship, instead you need to show a copy of your US passport, Certificate of Naturalization, Certificate of Citizenship or BC of a birth abroad.

Just one is necessary, Certificate of Naturalization would probably take less paper. If you choose to use your passport, you need to copy every page of it and it needs to still be valid for 5 more years.

You cant pay a fee and have it expedited. Only some work visas allow that.
