Your done with the USCIS at this point, so you can't change the address with them. You can try to change the address with the NVC, but you may not be able to get through to them in time. Your best bet is getting ahold of the embassy and giving them the new address information.

here are the fees:
I-129F filing - $170
Medical - Varies by country $100-$300
Visa - $100
AOS - $325 + $70 biometric fee
If you need AP or EAD they are $170 and $180 respectivly
Removal of conditions $275
Citizenship of you decide to do it $330


The fee you quoted above is WRONG! The I-129f filing fee is $455 as of 7/30/07. Also, AOS is bundled with AP & EAD, you can no longer file for them separately.

If you're going to use the ID "VISAHLP", you should, at minimum, be delivering accurate information.



I didn't know the AOS was now bundled up in the AP and the EAD. Julezablelle, how does that affect the speed in which our fiances will be able to work? I've seen basically it takes about 6 months to get an EAD. Will that take longer (as long as it takes to get the AOS?)? Also, with the AP- that is the document he'll need to travel back to his home country, right?- will that also take longer to get? Thanks!


It likely wont change the time much. AP and EAD will both take 90 days or so. With the fee changes, they are committed to speeding up processing times, but it might take awhile before we actually see that.

Technically, AP is used to reenter the country while status is pending. Your fiance could leave at any time, but your fiance needs AP to reenter.

I know that they want $455 for the I129F.
But many posts on this site mention two other forms that require fees.
They often mention the "fee for the visa itself."

Correct, K-1 is $455, and its paid to the USCIS.

The other two significant costs up until the visa is issued is the medical fee which varies by country, anywhere from about $100-400. Then the visa fee paid the the embassy of $100.

With the initial filing, you only need to include the USCIS fee.

Thats just for the visa, there are other fees to get a green card (AOS fee is about $1080) and to remove conditions. There is also a fee for naturalization if you choose to take that path.

Ok! Here goes!

First of all, thank you in advance to anyone who will read this and offer their input and support. It is GREATLY appreciated.

I met my Fiance (Micho) 7 months ago thru mutual friends/family who thought we'd get along - we ended up realizing we were meant to be together and couldn't wait to meet each other. We spent months on the phone and internet learning, laughing, loving. We both decided we needed some time together and couldn't wait to meet each other any longer, so I planned a trip with my family to Syria. We met, our families met, and instantly formed a bond. Not long after I reached Syria did we know we were meant to be. Having known about the K-1 process, although very little, we decided to get engaged and pursue the K-1 once I got back into the states. Let me clarify a bit - he and I had spoken of the possibilities and I started looking into the ways he could come into the US and the K-1 seemed to be it. I started researching and downloading files and filling out paperwork, making copies, highlighting phone records etc etc etc. I only wish I had found this site in the weeks I spent doing all of that.

I now realize that as organized as I thought I was, I am not. I don't seem to really be anywhere close. I should add that the day after we came back to the US we found out that my mom was no longer in remission from the cancer that broke her down years ago and is now undergoing extremely intensive chemotherapy. I need him here and by my side, not to mention want him here :D and this now seems waaay to overwhelming for me. I'm pretty sure I have all the paperwork I need put together just need the patience to sit and sort through it all. I am waiting on 2 papers I needed from him: 1. the paper from the church we were engaged in - stating we were engaged in the church 2. his criminal background check.

I have a ton of questions, although not sure where to start.
1. I was discouraged when I saw that syria was not listed in the statistics page under the countries.
2. Assuming all is submitted properly, whats the avg time from a middle east country.
3. Does every form/paper have to be translated in both languages
4. when providing phone records should they be from both sides (I ask bc as of today's date he has only received our first months bill - the billing cycles are strange over there)
5. Is it true I should have 3 original packages prepared?
6. What are NOA's i think you call them?
7. HELP!!!

1. Not as many people immigrate from Syria. But it does look like the US embassy in Damascus does process K-1. But you probably wont be able to get a lot of Embassy specific information for that country.
2. Depending which service center you file at, 1-3 months for the petition to be approved, about a month for the petition to be sent to the country (it goes through the NVC) and processing times do vary by consulate, anywhere from a few weeks to over a year. Most are within 1-3 months. Coming from the middle east, extra background checks and extra processing is common, which can add months and sometimes years to the processing time.
3. Nope, only official forms, like police record and birth certificate and you will likely only need to use it for the interview. The embassy may accept documents just in the original language, but for the ones you will need later with AOS, they will need an English translation.
4. Its up to you, and you wont need that until the interview.
5. No, you don't need to do that. But having extra copies on file is helpful in case you run into trouble.
6. Notice of Action, its a form sent out by the USCIS when they receive your file, and again when they approve it. You need to save the second one for AOS.
7. Read the guides and research. If you are still not confident in your ability to go through this process, you can hire an attorney.

Up until just recently, all petitions sent to Nebraska or Texas were sent to California. But that has changed now. You either send directly to Vermont or California.

My name is Brian and I have a special case here. I was born in the US and grew up in Hong Kong. I met my girlfriend couple years ago in China and we started our relationship. The good news is, we are planning to get married next year. However, the bad thing is, we do not have enough evidence to prove our relationship.

Here's our story:
I am 24 and I met my girlfriend in November 2005 in a trip to China. Our relationship didn't start until September 2006. From the day the relationship started, I have spent couple weeks with her in China. Due to the fact that I am also a resident in Hong Kong, I do not need to apply any visa when I visit Hong Kong and China. So my passport is completely clean. Fortunately, I still have my plane tickets for my Hong Kong and China trip. I also have all my phone bills and emails proves dated all the way from November 2005.

Here's a huge problem. We decided to get married recently and we do not have any pictures taken together. From what I have heard, it is the most important evident to prove our relationship. I am going to visit her again this November and I will make sure I will take some pictures with her and my family as well.

Please let me know if this is a good time to submit my I-129 application or should I wait until I take some pictures in November. What are the chances of getting my application approve without a couple picture?

I am planning to get married during mid 2008 and is it too late to file the I-129 in December 2007?

With the K-1 you do need a US address. You can file from overseas, but you do need an address in the US for notices to be sent to.

It looks like filing a visa through China may take about 8-9 months. Maybe a bit shorter of your petition goes to VSC. Any AP/AR will cause your case to take more time. You may not have enough time if your plan is to get married in mid 2008. You can however file now, but you don't have to use the visa right away, it will be valid for 6 months.

Well the address change may or may not make it with your file. Since your case only makes a pit stop at the NVC, its may be much easier just to get the address change to the consulate or embassy where you will have your interview.

Its hard to say for sure. But by the time you actually get to the interview stage, you may already have the next two trips under your belt. So you could possibly send it now and be OK. Its up to you. But I personally wouldn't get married with such a short relationship.

Its pretty easy, just call the USCIS main number, listen to the menu prompts and follow the prompts regarding a request for evidence. I dont remember the exact path and it may have changed. You will be asked to input your case number, and you will hear something like please send in the requested evidence, and then you will have the option to speak to customer service.

If you don't have a case number, those wont work. But it looks like you do, just your NOA1 was suppose to be sent when they were having issues.

I hope they do, as you know, this will help the entire ongoing process.

Without it, and given the number of days elapsed, they need to contact USCIS for a status update, if any is available.

If not, 105 days is a serious issue, with respect to the lack of an NOA-1.

It may be high time to contact an immigration attorney.


They have the case number, look at the post above yours.

During May and June, USCIS had some computer issues were NOA mails were not being sent or being sent late. Those have been fixed since as far as I am aware.

RT tickets are fine, just make sure you have it set up to use the outgoing leg and not the other way around. Airlines cancel the return if the outgoing leg is not used.

RT tickets are actually more than OW tickets if the fare class matches, but usually RT tickets are discounted into a lower fare class more often then one way tickets. Fare class determines how many miles you get, or how much it will cost you to get a refund or change dates.

You should be fine switching visas if the option becomes available. L-1 is dual intent so you can apply for a green card on that visa. That is if you can get an L-1 before your K-1 is granted. I'm not quite sure how they would handle it after the K-1 visa has been granted. You may have to talk to the consulate to void your K-1 if your going to use L-1 instead.

Most likely the issue is paying originally the wrong amount, $340 instead of $170. Your fiancees daughter does not have a separate petition fee, but will have a separate medical and visa fee.

Generally your Fiance would file the petition here in USA, while your in your country...you wouldnt be able to travel to the USA during this process...you would have to wait until you recieve the K1 Visa, after that you can come to the USA and you have 90 days to marry your Fiance....once your married you have to adjust your status.

If you wish to marry in Canada you might look up K3 or Cr-1 Visa's...this would be a Spousal visa vs. Fiance visa.

You can travel to the US while K-1 is in process, it just might get a little more difficult getting in.

To the OP, if you plan to legally marry in Canada, you cant use a K-1. However you can get married here, and then go to Canada and have a ceremonial wedding. If you do enter on a K-1, you will need to marry and apply for AOS to get an EAD (Allows you to work) and AP (Allows you to reenter the country will your status is pending)

You may be confused about the petition approval form being with the papers kept by the CBP officer. It would not have been in the sealed envelope. You received in in the mail. It's what we refer to as NOA2. If you lost it, you will need to get it replaced as others have mentioned.


Might it be possible, to just file an I-130 with AOS instead of paying to get the form replaced? As thats what a couple would need to do if they get married outside the 90 day limit or marry on another visa.

Copies are generally fine for any evidence that you send. The only things that need to be original, are the benificaries police certificate, and birth certificate. And any divorce decrees or death certificates that show termination of previous marriages if that applies to you.

Sometimes its sent to the petitioner via email. Depends on the country.

Not exactly, but it is the date they use before they will do anything about a case when it has gone outside of normal processing times. Normal processing times are about 3-4 months. You can look on the timelines page for more info.

All you have to do is multiply the number on the chart by 1.25.

The 125% requirement applies to the form you provide during the AOS stage. For the visa stage 100% is fine. Though the CO does have some leeway in deciding if what you make is enough.

Yes, but not for the reasons why they would say no to you for a tourist or another non-immigrant visa. Really the reasons that might delay or get your visa application denied is pretty clear (Medical reasons, security threat, lack of support, criminal record). The only one where the CO has any room for interpretation is the fraud question, do you have a bonefied relationship. If you can prove that, you have nothing to worry about.

Other non-immigrant visas can be denied if the CO feels that the applicant has immigration intent. With a K-1 visa, that intent is explicit.

With the K-1 visa, the only way your fiance could work right away is to go through JFK as the PoE. You will be able to get the work stamp. Although, its only good for 90 days. Otherwise, your fiance would have to apply for an EAD which takes about 90 days to receive, and its best to apply for that with AOS, otherwise it will only be good until the expiration of the visa (And you probably wont receive the EAD until after).

With K-3, he can work as soon as he applies for and receives his EAD. This takes about 90 days.

CR-1/IR-1, he will be able to work as soon as he arrives. Since this is considered an immigrant visa, the K visas are non-immigrant visas with immigrant intent.

Evidence to collect would be photos, boarding passes, passport stamps, receipts like hotel receipts or ATM receipts and anything else that can show that you were in Germany.

Fiance visa is generally the fastest option. But if money is an issue (which it sounds like it could be), you may want to consider CR-1/IR-1 which is a spousal visa option. Its the cheapest route to getting a green card. But it will also likely take the longest.

I assume by residency that your fiance is considered a US citizen?

You can marry on any visa, but you can only stay if you enter the country on certain visas. In order to stay after getting married on a tourist or student visa, you have to enter the country with no intent to get married. You have already made that intent clear, so you will have to use one of the K visas or CR-1/IR-1.

You can enter the country while any of those visas are processing, but you do have to go home for the interview, and your best not overstaying whatever visa you use to stay in the country.

K-1 is likely the fastest route, the time it takes depends on which service center your petition is processed, and how quick the embassy in Sweden is at granting interviews.

Its easy. The reasons for a K-1 to be denied are very clear. There is no CO going, "I don't like you, so I wont grant you a visa". They have to follow guidelines based on the law.

I don't know your situation, but you cannot enter on a student visa to marry and adjust status. If you finish the K-1 process, you will be able to go to school after you arrive.

A student visa may not be granted if you still have a fiancee in the US.

A wedding doesn't make you married unless the laws of the location make it so. Usually (As it varies by country or state), you have to apply for a marriage licence and get a marriage certificate for it to be considered a legal wedding. You need a legal marriage to use the K-3 route.

If you want to find out if your k-3 is canceled, you can call them with your case number and ask. They may not actually send out notification that they received your letter.

If i will bring with me my son, using the K2 VISA, and if we will not include him in the application of I-485 Adjustment of Status, because of the plan that he will continue his studies in the Phillipines, but we want him to visit the States every summer. So what do you think is the best VISA should we have for my son. Do you think its better that i will apply TOURIST VISA for him in his first entry, anyway we will not adjust his status after my marriage with my fiancee?? From what it sounds like, sponsoring your son for a tourist visa is the best option. Technically, you wouldn't include him on your fiancee's AOS, instead he would apply for AOS on his own. If you do take that route and he only stays in the US for 3 months out of the year, he can end up loosing PR status. There is also no guarantee that he would actually receive a tourist visa.

That form is used for other visas where that question is more applicable. But you will not need your diploma or anything like that at the interview.

Having it is good if you want your education to be accredited in the US. Along with transcripts for any post-secondary education you may have had. It will make it easier to continue education in the US.

Thats not a bad idea, get a prepaid SIM card and have it activated, and then send it to her. This is assuming she has a GSM cell phone, which is pretty likely as most of the rest of the world pretty much just uses GSM. US GSM providers are AT&T and T-Mobile.
